      I would think that having filed a return that year and in the years following, along with having paid at least some taxes for those years, might go a long way toward establishing that you agree you have a legal duty to pay taxes.

      You don't have to accept an audit.  Get the IRS to prove that you have a legal duty to pay taxes before you accept an audit.  Ask them for the law.  You are not then person liable under IRC 6331(a).
