Need Help Finding Authority of Fed Court to Issue Grand Jury Summons
- I am working on a case in Florida where the grand jury is
investigating a friend who has never had a charge filed against him.
As I read US v Williams, the grand jury can investigate most anything
it wants, but it does not have subpoena power and must go to the courts.
I need help with this point: Assuming the grand jury can investigate
anything it chooses but is without subpoena power, how can the court
get subject matter jurisdiction to authorize a subpoena absent a
criminal allegation being filed and a determination of probable cause
So far, it looks as if the US Attorney is simply petitioning the court
clerk and he is issuing without subject matter jurisdiction. I have
looked for the special authority of the court to act without a cause,
but what is not there is always the hardest thing to find or to
establish that it is not there.
Any help anyone can offer would be greatly appreciated.
