      If you use count 2 as an argument then all the early presidents are disqualified as presidents as they were all born outside of the united States and actually in British territory.  That in turn would outlaw much of the early on enacted law, signed by presidents.

      Count 2 - The presiding officer over the vote was the defacto President Taft, who did not meet the Constitution requirements to sit as president of the United States of America. The disqualifying condition was that he was not born in the United States ,of America , but was born in Ohio , a possession/territory of the corporate United States . Ohio was not admitted as a state until after Taft's birth. At one time there was a movement to suspend every act that Taft signed into law, but it didn't fly very far.
