19629All Litigants Should Be Regarded With Equal Favor By The Law

      The law must be administered with the same equality and justice which it bestows upon every suitor, and without which the machinery of the law becomes the engine of tyranny. Gulf, C. & SFR Co. v. Ellis, 165 US 150, 162 (1897).

      One of the privileges and immunities of citizens of the several States is protection by the government. Slaughter-House Cases, 83 US 36, 76 (1873).

       

      Organized government is instituted for the establishment and protection of every civil right including the class of rights which the State governments were created to establish and secure. Slaughter-House Cases, 83 US 36, 76 (1873).

                 

      In Marbury v. Madison, 5 US 137 (1803) the Court said:

       

      “The very essence of civil liberty certainly consists in the right of every individual to claim the protection of the laws, whenever he receives an injury. One of the first duties of government is to afford that protection.” [emphasis mine] Id. @ 163.
