The battle over who should pay to protect endangered steelhead trout
in the Ventura River continued this week when the federal government
asked a judge to rehear an argument it previously lost.
The Casitas Municipal Water District won the last court decision when
a three-judge panel ruled the federal government had to reimburse the
district for essentially forcing it to send water down a fish ladder
to protect the steelhead. Many saw the small water district's victory
as potentially precedent-setting in the battle over water in the
But on Wednesday, the federal government asked for a rehearing on that
decision before the U.S. Court of Appeal for the Federal Circuit in
Washington, and for a full 12-judge panel to consider it.
The U.S. Attorney's Office claims the previous decision runs counter
to rulings by both the Court of Appeal and the U.S. Supreme Court.
