      More than a year and a half has passed since the arrest of James
      Kieffer Malecek, the now 20-year-old Korean American adoptee charged
      with involuntary manslaughter, but prosecutors and defense are close
      to striking a plea bargain.

      Malecek’s trial, which was scheduled to take place in April, has been
      pushed back to June, Michigan City News reports. Prosecutors and the
      defense are hoping to buy some time and hopefully reach a deal before
      the case goes to court.

      The new trial date will also accommodate the schedules of possible
      witnesses who are currently away at college and cannot take time away
      from their studies.

      Forty-five minutes outside of Chicago, during a Fourth of July party
      in 2011, Malecek fatally struck Kevin Kennelly Jr. The blow occurred
      after Kennelly reportedly attempted to break up a fight between
      Malecek and one of Kennelly’s friends. The altercation began after
      Kennelly’s friends reportedly began to harass Malecek’s
      then-16-year-old sister, also of Korean descent, for wearing a red,
      white and blue bandana. The taunts were allegedly racially-fueled.

      Malecek pleaded not guilty to felony charges of aggravated battery and
      manslaughter. An autopsy shows blunt trauma to the head resulted in
      brain damage and Kennelly’s death.

      Kennelly’s father says he hopes to see Malecek serve a 10-year prison
      sentence for the death of his 17-year-old son.
