� �ELECTION COMMISSION'S HELPLESS PLEADING TO SUPREME COURT
It is good that the Election Commission has told the Supreme Court that a charge sheeted person should be barred from contesting election (press report dated 20thAugust,2013).� �However, the fact is that the Election Commission has been saying this since 1977.
Election Commission �is� pleading to Supreme Court and is looking for guidelines and instructions from Supreme Court which is as� much a constitutional body as the Election Commission is. In the process , the Election Commission has reduced itself to the level of an administrative body.
�Election Commission is not realising the fact that the �responsibility� �reposed �on �it�� by the constitution� to ensure �free and fair poll� automatically implies that it has to assume the powers to do whatever is necessary to ensure free and fair polls. . Particularly when Election Commission �is convinced that �it has to bar a charge sheeted person �from contesting election to� ensure free and fair poll , it �has �to assume the inherent and residual power , as a constitutional body �,to do so.
By looking to Supreme Court for instructions in this matter , Election Commission is guilty of abdicating its responsibility as a constitutional body.
