      URGENT MEMO TO ALL PRIVATE INVESTIGATORS

      FROM: NCISS LEGISLATIVE COMMITTEE

      For the next three days, the Financial Services Modernization Act of
      1999
      will be considered on the floor of the Senate. It is referred to as S
      900.
      The House version of this bill, HR 10, includes HR 30, the Financial
      Privacy
      Act of 1999, as an amendment. At the moment, the Senate version
      contains no
      such language.

      It is anticipated that privacy advocates will attempt to amend the
      Senate
      version to add privacy language similar to that contained in HR 30,
      which is
      now part of HR 10. This language makes it a crime to use a pretext to
      obtain
      financial information from a bank, or more importantly, from any bank
      customer, although we did get an exemption for child support in the
      House
      version. For this reason, it is imperative that we flood all members of
      the
      Senate with language similar to the following on your individual
      letterhead:

      "Privacy legislation should be considered on its own merits and by the
      regular order. Do not add privacy language to the Financial Services
      Modernization Act because it will prevent creditors including accident
      victims, elderly victims of fraud and children of divorced parents from
      collecting court approved payments. Appropriate language can be
      developed to
      provide privacy protection while permitting legitimate recoveries."
