re: glenelg wastewater permit modification
dear mr. gorski & ms. wazenski,
pursuant to mr. gorski's suggestion, i contacted "For The Record, Inc." and
one of the owners promptly advised me (thru their secretary) that their transcripts
are NOT COPYRIGHTED. (see my telephone notes appended to this message.)
i would also point out that the concept of originality is CENTRAL to copyright
(see clause 8 of the U.S. Constitution). creation, not just "sweat," is a
constitutional requirement for copyright. ergo, any transcript that could
be copyrighted by the transcriber would not be an accurate transcript.
i must file my closing argument tomorrow, therefore, i request that
machine readable transcripts of the hearing in this matter which are
in the possession of the board of ed, the department of the environment,
their attorneys or agents be emailed to me immediately.
if you fail to provide me with the transcripts i will consider such failure an
intentional effort by you to undermine the fairness of the proceeding and
a violation of my clients' due process rights.
notes from 1 dec 2005 phone call to "For The Record, Inc." (800)921-5555:
i asked karen at "For The Record, Inc." if their transcripts are copyrighted
and she placed me on hold while she contacted one of the owners (sara
vance) via phone and karen then told me that ms. vance stated that their
transcripts are NOT copyrighted.
