[Even for big organisations the cost and energy involved in big legal cases take their toll. Little else can explain Apple's failure to defend the agency system in Europe. What is not noted, realised or discussed is that the wholesale model is not what Amazon operates. That model, in print, is based on pre-orders; online it is esssentially post-order purchase. Also, the whole argument appears to ignore the business needs of publishing. This is not helped by the errors in the Reuters report. Only the ars-technica comment is worth reading.]
