    I write you with an urgent request to support Senator Feinstein's effort to eliminate a key obstacle to Clean Local Energy Accessible Now (CLEAN) Contracts, historically known as feed-in tariffs.  As you may know, there are utilities around the country that have threatened legal action if States implement CLEAN Programs, and these threats have prevented favorable CLEAN progress in numerous places.

    Under Senator Fienstein's leadership, a provision is included in the Senate Appropriations Bill (HR2354) requiring the Federal Energy Regulatory Commission (FERC) to issue regulations that clarify State-authority to implement technology-differentiated CLEAN Contracts.  Existing language is shown in the links below, but improved language has been offered by Senator Bingaman, Chair of the Senate Energy Committee, and vetted by FERC, the California Public Utilities Commission (CPUC), and the Office of California Governor Brown.

    Senator Feinstein needs support letters for her CLEAN leadership, because a predictable group of reluctant utilities is mobilizing opposition.  Support letters are requested to be emailed to Adam Christensen in Senator Feistein's office by Monday if possible (later if necessary, but Monday would be most helpful).  Adam's email address is as follows:  adam_christensen@... 

    Please find attached two support letters that will facilitate quick turnaround: a support letter from the Clean Coalition and a sample support letter combined with a factsheet resulting from a joint effort between the CPUC and the Office of California Governor Brown.  

    I hope you can help get letters of support emailed to Adam (adam_christensen@...) today; or at least within the coming days...

    “Sen Feinstein has introduced language in the Senate Appropriations Bill that clarifies the authority of States to adopt CLEAN Contracts (aka feed-in tariffs).  The existing provision language is at http://www.gpo.gov/fdsys/pkg/BILLS-112hr2354rs/pdf/BILLS-112hr2354rs.pdf, starting on page 120 line 19, and the Senate Committee report language is at

    The improved language offered by Senator Bingaman and vetted by the FERC, the CPUC, and the Office of California Governor Brown is as follows:

    “Not later than 180 days after the date of enactment of this Act, the Commission shall issue such regulations as are necessary to clarify that the avoided cost determined under section 210(b) of the Public Utility Regulatory Policies Act of 1978 may differ by technology to take into account a State’s requirement that a utility purchase electric energy generated by specified technologies.”
