"terrorism" related prosecutions yield few long sentences
- The following article, attributed only to wire services, appeared on page A6
of the Monday, December 8, 2003 edition of the Arizona Republic. Apparently
the "Justice" Department's efforts to smear large numbers of innocent people
as "terrorists" are bearing little fruit. From the length of the median
sentences, it seems most of those convicted were intimidated into plea
bargains. Sleazy tactics like these obviously have nothing to do with real
FEW GETTING LONG TERMS IN TERROR PROSECUTIONS
Washington--The Justice Department has sharply increased prosecution of
terrorism-related cases since the September 11 attacks but many fizzled
and few produced significant prison time, a study released Sunday finds.
About 6,400 people were referred by investigators for criminal charges
involving terror in the two years after the attacks, but fewer than one-
third actually were charged and only 879 were convicted, according to
government records reviewed by Syracuse University's Transactional Records
The median prison sentence was just 14 DAYS, [emphasis mine, -K.W.],
according to a study. Only five people were sentenced to 20 years or

against the state of Arizona in the Open Primary case.

Although the 9th circuit ruled the selection of party officers by
non-libertarians (15,000 libertarians vs. 350,000-400,000
independents) in an open primary that also selects Precinct
Committeemen, the 9th Circuits logic is twisted and strained and
lacking any consistency or understanding of the US or State
constitutions. The 9th Circuit wishes to limit the ruling to _only_
the Libertarian Party in an attempt to support a totally flawed
election system that ignores the 1st Amendments right of association.
Even though this ruling may increase the freedoms of those associated
with the Libertarian Party, it leaves the rest of the electorate in
shackles. It is not surprising that libertarian activists are not
satisfied and the battle will continue. However, as may have been the
intent, the standing of the Libertarian Party to challenge in the name
of the rest of the electorate is severely limited when our interests
may have been addressed. I say may since portions of the case has
been sent back to the District Court level for further consideration.
The 9th circuit has absolutely no clue how to handle this case
knowing that it will eventually wind up in the Supreme Court. An Open
Primary System that forces association with non-party members in the
internal selection of representative candidates and officers of the
partys internal structure is totally flawed fundamentally.
