      An Arizona jury found Frank Roque guilty of the murder of Balbir Singh Sodhi,
      an Indian Sikh whom he mistook for an Arab or Muslim four days after the
      11 September 2001 attacks, and related charges. Roque's "guilty but mentally
      ill" plea was rejected. Under new rules imposed by the Supreme Court, the
      jury will decide whether to sentence Roque to death, and although they
      rejected the insanity defense, they may still consider Roque's mental state
      as a potential mitigating factor when determining whether to have him
      executed. If the jury rejects capital punishment, the judge may decide to
      sentence Roque to life imprisonment or to a term of imprisonment of not less
      than 25 years.
