      Last week the US Supreme Court denied the final "cert" petition
      of MD death row inmate Eugene Colvin-El. This action means that
      Baltimore County prosecutors will immediately seek a death
      warrant, setting an execution date some time between the
      early June and early July.

      This must not be allowed to happen! If Eugene is executed, he will
      be the 4th person to be executed in MD since reinstatement of the death
      penalty. Also, he will first person to be executed merely on the basis
      of circumstantial evidence: no witnesses, no co-defendants, no confessions,
      or any direct evidence tie Eugene to the crime.

      Instead, Eugene's case falls into an all too familiar and disturbing
      pattern in Maryland's
      death penalty: he is a poor, Black man, convicted by an all-white jury of
      killing
      a white woman in affluent Baltimore County. Also, Eugene was represented by
      an underpaid, inexperienced attorney who was openly hostile to Eugene
      throughout the trial.

      Eugene Colvin-El sits on Marylands death row accused of the 1980 murder of
      Lena Buchman in Baltimore County. Eugene is Black. The victim was white.

      Of the 17 people currently on death row in Maryland, 13 are Black. Ten of
      the Blacks on death row are convicted of killing whites. All of them were poor.

      The only physical evidence found at the scene that linked Eugene to the
      crime was a fingerprint outside the house, on broken glass from a door in
      the rear basement. No other physical evidence was found no other
      fingerprints, footprints, blood, hair, clothing, or anything else. The
      prosecutors claimed that Eugene had entered the house alone through this
      rear door. However, police reports show that a large metal storage cabinet
      blocked this door from being opened more than 4 inchesmaking entry impossible.

      The prosecutors also claimed that Eugene had pawned a relatively worthless
      pocket watch and Timex wristwatch from the house. But none of the truly
      valuable stolen jewelry was connected to Eugene. And two days after the
      murder, police investigators found pieces of jewelry attributed to the
      robbers lying in the driveway outside the home, where anyone could pick
      them up.

      Eugenes attorney had no experience defending someone accused of murder. His
      attorney had previous experience in only two felony criminal trials before
      Eugenes trial.

      The attorney did not present the jury with important factual material that
      might have proven Eugene innocent, including: 1) witnesses accounts of two
      young men seen riding bikes in the neighborhood where and on the day the
      murder occurred; 2) a police investigation that revealed witnesses who saw
      two young men "casing" homes in the same neighborhood one day after the
      murder; and 3) the fact that police later questioned a pair of young men
      (similar in description) about the murders and a string of robberies in the
      same neighborhood.

      During his trial, Eugene was denied his Constitutional right to represent
      himself.

      The prosecution illegally withheld evidence, including a fingerprint from a
      paper inside the victims purse that was not Eugenes.

      A Maryland court overturned Eugenes death sentence on the basis that he
      received inadequate representation at trial but left his conviction in
      place. His death sentence was later reinstated.

      Eugene Colvin-El is the next person scheduled for execution on Marylands
      death row. He is the only person in Maryland to be sent to death row merely
      on the basis of circumstantial evidence. No witnesses, no confessions, and
      no direct evidence tie Eugene to the crime. Instead, Eugene fell victim to
      an incompetent attorney and a judge who refused to hear his repeated
      requests for new representation.

      Despite these facts, the State of Maryland is preparing to execute Eugene.
      Only your actions stand between Eugene and the States death chamber. Here
      are some facts about his case:
