        The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.


         


        Section 3.


        All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership


         


        or


         


        to military posts, pursuant to an order from the United States government, Department of Defense.


         


             1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.


         


             2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 


         


             3.  Military posts receiving the types of weapons herein defined shall be required to


                   have a designated security officer who shall be responsible for the secure


                   storage and handling of said assault style, automatic and semi-automatic                 weapons.


         


        Section 4. 


        No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.


         


        Section 5.


        Congress shall have the power to enforce this article by appropriate legislation.

          Guns do not make a nation safer, say US doctors who have compared the rate of firearms-related deaths in countries where many people own guns with the death rate in countries where gun ownership is rare.

          Their findings, published in the prestigious American Journal of Medicine, debunk the historic belief among many people in the United States that guns make a country safer, they say. On the contrary, the US, with the most guns per head in the world, has the highest rate of deaths from firearms, while Japan, which has the lowest rate of gun ownership, has the least.

When analyzing law, one needs the legal context - this law or decision, prior annd higher authorities, the legislative history and the meaning of words as they were used at the time.



                For example, some Federalists, in opposing the clamor for a Bill of Rights, objected on the grounds that any such list would not add to the rights of the people as they dealt with matters authority over which had not been delegated to the national government in the Constitution. On the other side, some Anti-Federalists objected on the basis that no such listing of rights was likely to be exhaustive and that the omission of any rights from among those enumerated in a Bill of Rights would be taken at some later date as license for the national government to infringe such rights.



                With that background, we see that the Cruikshank Court merely state a truism that could have been applied to any other portion of the Bill of Rights.That is, that the rights enuerated in the Bill of Rights arose before, and are superior to, the Constitution.



                Turning now to the Miller decision, it is important to recognize that Court was dealing with a very narrow question which was this - was the shortened shotgun possessed by Miller in violation of the recently passed National Firearms Act? Clearly, it was shorter than the act required, but had Congress exceeded its authority be interfering with Miller's right to possess a firearm suitable for militia/military use? The Court inquired whether there was a military use for such weapon; if there was, Miller's possession of it would be protected under the Second Amendment. Here is where the Miller decison gets murky, because the Justice Department perpetrated a fraud on the Court by averring that there was no legitimate military purpose for such a shortened shotgun. On this basis, the conviction of Miller was affirmed. But, in fact, such shotguns had been used by US forces in the trench warfare of WW1 where they were colloquially called trench guns, and the US Marines still had thousands of them in their inventory.


                By the Miller Court's reasoning, you might well make a case against "Saturday Night Spe ials" (if there is such a thing), but an "assault weapon" ban, even a restriction on full-auto wweapons, would not pass constitutional scrutiny.

                    The second article of amendment to the Constitution of the United States is hereby repealed.

                    The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.
                     
                    Section 3.
                    All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership
                     
                    or
                     
                    to military posts, pursuant to an order from the United States government, Department of Defense.
                     
                         1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.
                     
                         2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 
                     
                         3.  Military posts receiving the types of weapons herein defined shall be required to
                               have a designated security officer who shall be responsible for the secure
                               storage and handling of said assault style, automatic and semi-automatic                 weapons.
                     
                    Section 4. 
                    No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.
                     
                    Section 5.
                    Congress shall have the power to enforce this article by appropriate legislation.

                      Guns do not make a nation safer, say US doctors who have compared the rate of firearms-related deaths in countries where many people own guns with the death rate in countries where gun ownership is rare.

                      Their findings, published in the prestigious American Journal of Medicine, debunk the historic belief among many people in the United States that guns make a country safer, they say.                             The second article of amendment to the Constitution of the United States is hereby repealed.

                            The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.
                             
                            Section 3.
                            All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership
                             
                            or
                             
                            to military posts, pursuant to an order from the United States government, Department of Defense.
                             
                                 1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.
                             
                                 2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 
                             
                                 3.  Military posts receiving the types of weapons herein defined shall be required to
                                       have a designated security officer who shall be responsible for the secure
                                       storage and handling of said assault style, automatic and semi-automatic                 weapons.
                             
                            Section 4. 
                            No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.
                             
                            Section 5.
                            Congress shall have the power to enforce this article by appropriate legislation.

                              XXVIII
                              TO THE US CONSTITUTION
                               
                              Section 1.
                              The second article of amendment to the Constitution of the United States is hereby repealed.
                               
                              Section 2.
                              The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.
                               
                              Section 3.
                              All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership
                               
                              or
                               
                              to military posts, pursuant to an order from the United States government, Department of Defense.
                               
                                   1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.
                               
                                   2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 
                               
                                   3.  Military posts receiving the types of weapons herein defined shall be required to
                                         have a designated security officer who shall be responsible for the secure
                                         storage and handling of said assault style, automatic and semi-automatic                 weapons.
                               
                              Section 4. 
                              No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.
                               
                              Section 5.
                              Congress shall have the power to enforce this article by appropriate legislation.

But as others have observed, talking about how to stop mass shootings in the aftermath of a string of mass shootings isn't "too soon." It's much too late.What follows here isn't a policy agenda. It's simply a set of facts -- many of which complicate a search for easy answers -- that should inform the discussion that we desperately need to have.

                                          The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.
                                           
                                          Section 3.
                                          All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership
                                           
                                          or
                                           
                                          to military posts, pursuant to an order from the United States government, Department of Defense.
                                           
                                               1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.
                                           
                                               2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 
                                           
                                               3.  Military posts receiving the types of weapons herein defined shall be required to
                                                     have a designated security officer who shall be responsible for the secure
                                                     storage and handling of said assault style, automatic and semi-automatic                 weapons.
                                           
                                          Section 4. 
                                          No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.
                                           
                                          Section 5.

                                            TO THE US CONSTITUTION
                                             
                                            Section 1.
                                            The second article of amendment to the Constitution of the United States is hereby repealed.
                                             
                                            Section 2.
                                            The manufacture, importation, sale, distribution, possession or gift of any assault style or automatic or semi-automatic weapon intended to launch missiles, bullets, grenades or rockets is hereby restricted as defined in section 3.
                                             
                                            Section 3.
                                            All weapons of the types defined in section 2 shall be manufactured for and only for shipment to licensed gun ranges pursuant to an order from a licensed gun dealer on behalf of a duly licensed and background tested candidate for ownership
                                             
                                            or
                                             
                                            to military posts, pursuant to an order from the United States government, Department of Defense.
                                             
                                                 1.  Civilian ownership and use of the weapons herein described is restricted to secure            lockers at gun ranges licensed by and supervised by both state and federal                 agencies.  Weapon shall be available to the owner for use with inanimate                 targets on the range property.
                                             
                                                 2.  Transport of the weapons of the type herein defined shall require disassembly and        packaging by the range operator and shipment to and only to another licensed                gun range. 
                                             
                                                 3.  Military posts receiving the types of weapons herein defined shall be required to
                                                       have a designated security officer who shall be responsible for the secure
                                                       storage and handling of said assault style, automatic and semi-automatic                 weapons.
                                             
                                            Section 4. 
                                            No individual rights or privileges regarding the ownership, storage and use of the types of weapons herein described shall ever be considered superior to the welfare, safety and well-being of the society as a whole.
                                             
                                            Section 5.
                                            Congress shall have the power to enforce this article by appropriate legislation.

                                                        Bloomberg abandoned his lifelong commitmentt to the Democrat Party (but not its principles) in order to run ifor mayor in 2001 as a Republican and did so for a very good reason - he could not be nominated in a Demosrat primary. He bandoned the GOP as part of his effort to change the rules and run for a third term, running for that third term as Independence Party nominee cross-filed as Republican. Now that he's bowing out as mayor, it willbe interesting to see if he continues to be touted s a third-party presidential candidate or simply returns to the Democrat fold.

                                                        If roads were collapsing all across the United States, killing dozens of drivers, we would surely see that as a moment to talk about what we could do to keep roads from collapsing. If terrorists were detonating bombs in port after port, you can be sure Congress would be working to upgrade the nation's security measures. If a plague was ripping through communities, public-health officials would be working feverishly to contain it.

                                                        Only with gun violence do we respond to repeated tragedies by saying that mourning is acceptable but discussing how to prevent more tragedies is not. "Too soon," howl supporters of loose gun laws. But as others have observed, talking about how to stop mass shootings in the aftermath of a string of mass shootings isn't "too soon." And several of those are not marginally higher than the US rate, but two to four times higher. The top spot goes to Honduras at more than six times thhe US rate.

                                                        The US Constitution does not apply beyond US borders and never has.  Nor has the 2nd Amendment ever guaranteed individual gun ownership. 
                                                         
                                                        Guns do not make a nation safer, say US doctors who have compared the rate of firearms-related deaths in countries where many people own guns with the death rate in countries where gun ownership is rare.

                                                        Their findings, published in the prestigious American Journal of Medicine, debunk the historic belief among many people in the United States that guns make a country safer, they say.
