    FAILURE OF HIGH STAKES GAMBLE AT FRAUD

    The current issue of the free Zalma s Insurance Fraud Letter (ZIFL) reports
    on the failure of a high-stakes gamble to enforce a foreign Judgment of
    nearly a half billion dollars. Walter Lack, Thomas Girardi and two others
    were found by the Ninth Circuit Court of Appeals to have initiated and
    directed years of litigation against Dole and Shell that they knew were
    false. Their efforts went beyond the use of questionable tactics. Their
    actions crossed the line to include the persistent use of known falsehoods
    according to District Judge Tashima in his capacity as a special master. One
    lawyer was publicly reprimanded, two were suspended from practice in the
    Ninth Circuit for six months and one was privately reprimanded. Both law
    firms agreed to mitigate the charges -- to pay $390,000 in sanctions. The
    court concluded its opinion by stating that: " Respondents in this case have
    been respected members of the bar, and each has presented significant
    mitigating evidence. Their conduct in this case, however, cannot be excused
    on that basis, given their culpability and the substantial injury their
    conduct caused the opposing parties and this court."

    billing for services to the dead; the delivery by the California Department
    of Insurance to local District Attorneys of funds to fight fraud; that two
    fraud convictions with charges started by ex-New York Attorney General and
    ex-Governor, were thrown out by the court because the prosecutor withheld
    exculpatory information; an insurer punished for failing to comply with
    anti-fraud statutes; and convictions across the country of those who
    attempted to defraud insurers.
