    Culver City CA - June 1, 2010:

    The June 1, 2010 issue of Zalma's Insurance Fraud Letter (ZIFL) explains why
    the Florida Court of Appeal affirmed a motion for summary judgment against
    attorney Sanford Bosem and in favor of his insurer, because the claim he
    submitted was fraudulent. The court explained that Fraud provisions are
    enacted to provide a disincentive to individuals considering the commission
    of fraud. Allowing for payment of one portion of a claim would nonsensically
    allow an insured to engage in a "cost-benefit analysis" with respect to the
    contemplation of such fraud. One can no more be involved only partially in
    insurance fraud any more than one can be partially dead.

    In addition the June 1, 2010 issue of ZIFL reports on the conviction of a
    police officer who committed insurance fraud to protect a fellow officer
    engaged in an illicit affair; on a trial court decision that shows how
    expensive accusing an insured of fraud when a jury disagrees can be to the
    insurer; and an update on the Banana cases with a link to the oral argument
    in the discipline hearing of some of the lawyers for the alleged victims in
    Nicaragua. Finally ZIFL reports on convictions for insurance fraud across
    the country.
