    Insurance Fraud Can Be Expensive to the Perpetrator



    Culver City CA -March 1, 2010:



    Insurance Fraud and Insurance Claims Expert, Barry Zalma, explains why no
    insured should be allowed to profit from insurance fraud. When the fraud
    committed is so stupid that insurers and prosecutors cannot ignore it, the
    insured attempting insurance fraud should be punished both civilly and
    criminally. In the March 1, 2010 issue of Zalma's Insurance Fraud Letter,
    Mr. Zalma reports on a New Jersey decision where a legitimate windstorm loss
    was turned into a fraud when the persons insured added to their damages by
    beating on their building with broken pieces of a fallen tree and added to
    their crime by allowing their conduct to be videotaped. Their insurer,
    Liberty Mutual, found the tape and proved that their insured inflated the
    claim and recovered all of its investigative costs and attorneys fees. New
    Jersey law then caused the damages incurred by the insurer to be trebled.
    The insureds not only were not able to recover for the legitimate part of
    their claim nor the fraudulent part of their claim but were required to pay
    three times the expenses incurred by the insurer - over $150,000.



    The case proves that not only does crime not pay, if caught committing fraud
    in New Jersey, you will find that you must pay three times the damages your
    insurer incurred. After ten years of fighting the insurer - who had the
    courage of its conviction and a willingness to refuse to pay off an
    insurance fraud perpetrator - Liberty Mutual was honored with a judgment
    recovering all of its costs and a bonus. "What is difficult to understand,"
    Mr. Zalma said, "is why it took ten years for the courts to resolve the
    issue."
