      Friends:

I published to my site, http://www.zalma.com the December 1, 2008 issue of Zalma’s Insurance Fraud Letter that marks the thirteenth year of publication.

You will read how asbestos cases based on weak expert are thrown out, How a Fraud Failed, the need for you to have fraud training, why an IRC Study Shows Insurers Pay Fraud Perpetrators With Knowledge of the Fraud, Reports of Convictions From the Coalition Against Insurance Fraud, Convictions, Just for Fun, John Cooke is Back, Zalma On Insurance, Insurance Case Book by Barry Zalma,  and AD Banker Training.

For example you will read about how a Michigan judge recently threw out the evidence and medical testimony of a doctor who has diagnosed more than 7,000 asbestos litigants. The decision put thousands of other asbestos cases in Michigan in limbo, while triggering much debate about the reliability of medical experts in asbestos cases.

The ruling came one month after more than 30,000 asbestos lawsuits in Ohio were dismissed following a ruling by the Ohio Supreme Court , which allowed a 2004 state law imposing strict requirements on plaintiffs to be applied retroactively.

You will also read about how the parties plaintiff tried to avoid the charge of fraud by claiming that their fraud in the first claim was not relevant to the the second fire and they should, therefore, be allowed to profit from both arsons-for-profit. The argument, although imaginative, failed because the fraud was blatant and the court refused to allow the plaintiffs from profiting from their own wrong. It is, perhaps, informative that the answer was so obvious that the court felt it necessary to mark the decision as one not to be officially reported.
