      Restraint/Seclusion Bill on Hold

      On Tuesday, November 2, NDSC Governmental Affairs Director Susan Goodman and representatives of several other national disability organizations met with Senate staff members about the Keeping All Schools Safe Act, S. 3895.    The momentum for this legislation began when a U.S. Government Accountability Office (GAO) revealed hundreds of cases in which children were abused, and some even died, as a result of seclusion and restraint in public and private schools. 

      In March, a bill passed the House strongly supported by NDSC which would have, among other things prohibited inclusion of restraint and seclusion in Individualized Education Programs (IEP).  However, controversy arose among disability groups when a provision was included in the Senate bill that would have allowed restraint and seclusion in IEP’s. 

      According to Senate staff, the Senate bill will not move forward in this session of Congress.  It is possible that another bill will be introduced in the House and Senate during the next session of Congress.  We will keep working to ensure the rights of children with Down syndrome will be protected, children will have positive educational experiences and will never be subjected to harmful practices.
