      The U.S. Department of Education has issued new No Child Left Behind regulations. The regulations were published in the Federal Register for October 29, 2008. They are here:

      COPAA commented on the proposed NCLB regulations in conjunction with the Consortium of Citizens with Disabilities (CCD) a national coalition of  disability advocacy organizations. The final regulations did address a number of issues that members of CCD raised. In terms of graduation rate calculations, rate data must be disaggregated by subgroup and the disaggregated scores must count toward AYP proficiency beginning in the year 2011-2012. The Department of Education also made improvements with regard to students who require additional time after 4 years to graduate with a regular diploma. Moreover, states will be required to provide a more detailed and scientific explanation of minimum subgroup size. In addition, states must include NAEP results on report cards, including disaggregated data which will also support continued accountability for students with disabilities. Finally, better information will be provided to parents about providers of Supplemental Educational Services.
       
      Still under review are proposed regulations about IDEA Part B, IDEA Part C, and the FERPA. The Office of Management and Budget is currently reviewing these regulations, as it does all regulations.
