      The Federal Register yesterday (Dec 15) published the
      Notice of Proposed Rule Making for the 2% rule.
      This proposed rule would allow up States to use
      modified/alternative assessments with up to 2% of
      children in the state whose disabilities
      allegedly would prevent them from achieving at
      grade level.  According to the NPRM, "States will
      be able to use different achievement standards
      for approximately thirty percent of students with
      disabilities, which is a significant change in
      how those students are assessed."
