HC directs SDM to hand over church to Orthodox faction

The Kerala High Court today directed the Sub-Divisional Magistrate,
Muvattupuzha, to allow the Orthodox faction to take possession of the
disputed St. Peter's and St.
Paul's Church, Kolenchery, in Ernakulam district.
Justice A K Basheer set aside the SDM's order dated July 11, 2005, taking
possession of the church following the law and order problems arising from
the factional feud between Orthodox and Jacobite factions of Malankara Church.
The judge directed the SDM to remove the lock put by him on the doors of
the disputed Church and allow Fr. M V Abraham, vicar of the Orthodox
faction, to take possession of the church forthwith.
While allowing the writ petition filed by Thomas M Aliad and another
parishioner, the Court held that the composite order passed by the
Magistrate was vitiated by procedural irregularities.
The Court added that the authorities were at liberty to pass appropriate
orders if the situation warranted, strictly in accordance with law and the
decree of the civil court.
