I do appreciate that this guy is going to need funds to support himself for the future. He would most likely not have been insured against injury from such an activity and the disability pension wouldn't go close to covering his expenses.
However I think his chances of accessing funds would have been better through avenues such as crowd funding rather that trying this litigious approach (which is not necessarily likely to succeed). If he had tried crowd funding, even some members of our close knit flying community may have considered putting in to help him. As it is now, with the threat that this case poses to our sport, I can't see any pilot supporting him now.

As I see it, this (supervised/restricted rated) pilot was operating in contravention of the HGFA operations manual as he did not appear to be under the direct supervision of an intermediate or higher rated pilot immediately prior to his launch. The HGFA has disciplined pilots for doing just that - so HGFA can be said to be implementing its own procedures with due diligence.
While I feel very much for the pilot and the life changing injuries he has suffered, I hope that the outcome of this case is such that it shows that our sport doesn't expose third parties (such as the HGFA and landowners) to legal liabilities as a result of non-compliant activities.
I also hope that our waiver system for HGFA members is shown to be sufficiently robust as this system protects volunteers such as supervising pilots, launch marshals and safety officers.
