      past implicate both Cheney and Rumsfeld in murder coverup

      June 2004: It's hard to know what to belief these
      days. This particular story, now resurfacing in
      view of recent history, has much past history behind
      it and is quitely likely to be accurate. Even more
      important at this point is the realization that
      those now in control of the American government have
      been indeed masters of deceit, cover-up, and death
      for a very long time now. They've occassionally
      been exposed by investigative journalists and
      they've survived many close-call scandals. But so
      far they've always managed to slinker on enabling
      them to be the primary perpetrators and cover-up
      specialists to what has been happening both in the
      Middle East as well as on the homefront since they
      retook power in Washington, this time at the very
      top, in 2001.

      US VICE PRESIDENT DICK CHENEY AND SECRETARY OF
      DEFENCE DONALD RUMSFELD LINKED TO "MURDER OF CIA
      SCIENTIST"

      Secret documents have revealed US Vice President
      Dick Cheney and Secretary of Defence Donald Rumsfeld
      are "linked to the murder" of a senior CIA
      scientist. Frank Olson, who was a key member of the
      CIA's secret brainwashing
      programme MK-ULTRA, was sent plunging from a New
      York hotel window after he had threatened to reveal
      the CIA involvement in "terminal experiments" in
      post-war Germany.

      The importance of the documents are not only their
      historic significance. They could play an important
      role in the race for the White House this November. Ironically it
      falls due on the 51st anniversary of Olson's murder.

      Frank Olson's son, Eric, a psychologist, believes
      that fact will not be overlooked by President Bush's opponents as they
      search for further evidence that Rumsfeld and Cheney have a long
      history of news management and hiding the truth that could be highly
      embarrassing to the White House.

      The documents reinforce how Rumsfeld and Cheney have
      honed their skills over the past thirty years to
      ensure that today they have so far managed to keep
      the current scandal of US torture in Iraq - and
      elsewhere - from ensnaring themselves and President
      Bush.

      For almost half a century Eric Olson has insisted
      his father was murdered "on orders from the highest
      level".

      Frank Olson's work for the CIA had included making
      biological weapons. He had devised an aerosol
      disguised as insect spray that contained the lethal
      pathogen, botulism. It was successfully used to kill
      a Russian GRU military intelligence officer on a
      visit to Gdansk, Poland, in 1951.

      Another creation had been toothpaste containing
      salmonella, an incapacitating bacterium. The CIA
      arranged for it to be distributed in 1952 to
      Bulgarian troops in Sofia.

      Yet another weapon was inserted into Polish produced
      jam, the shigella bacterium, which produced
      incapacitating diarrhoea. For a time it produced a
      major outbreak among Polish and other Warsaw Pact
      frontline troops in 1952.
      All these, and more, Frank Olson had produced in
      his laboratory at Fort Detrick, near Washington DC.
      It was America's chemical-biological warfare
      complex. Since 1943, Olson had worked there.

      To ensure his weapons worked, they were tried out on
      what the CIA classified as "expendables": suspected
      double agents, captured spies and others held in
      detention camps in the American Zone in southern
      Germany.

      This was the 1950s when the Cold War was at its
      height. But Olson had never witnessed the result of
      his work. Then in the summer of 1953, he visited a
      CIA "safe house" near Stuttgart. He saw men dying,
      often in agony, from the weapons he had made. He was
      shocked, and protested. By the time he had returned
      to Fort Detrick in November of that year, his fate
      had been sealed. CIA director Allan Welsh Dulles
      decided that Olson was a dangerous whistleblower.

      Eric Olson had always maintained "my father was
      murdered on the highest authority". He has fought a
      long battle to prove his point. But at every step he
      was blocked by two of the most powerful men in
      Washington - Cheney and Rumsfeld.

      But the documents which have surfaced in Washington
      all too clearly pinpoint the role the two men played
      in covering-up the murder of Frank Olson. In a
      "Flash Secret" memo from Cheney to Rumsfeld, the
      future Vice President warns if the truth emerged "it
      might be necessary to disclose highly classified
      national security information".

      Another memorandum to the President (Gerald Ford)
      reveals that Eric Olson and his family "have
      indicated their shock and outrage at the
      circumstances surrounding Dr Olson's death". The
      memo suggests "the President expresses his own
      outrage" over the death.

      Cheney warns in a further memo that Olson's job "is
      so sensitive that it is highly unlikely we would
      submit relevant evidence on the issue of his
      duties".

      The 23 pages of documents paint a clear picture of
      the determination of Cheney and Rumsfeld to keep
      secret Olson's work and to ensure, as a matter of
      public policy, it must remain secret that "a drug
      criminally given him (Olson) cannot as a matter of
      law be determined he died in the course of his
      official duties".

      "The documents remind us why blind trust in any
      government official or agency is a bad idea. The
      cover-up of torture in Iraq today has its roots in a different time -
      but it's the same culture of cover-up. That cover-up ultimately led to
      the murder of my father", said Eric Olson.

      "After witnessing experiments on prisoners held in
      secret CIA "safe houses" in Germany, my father was
      so shocked he was seen as a whistleblower by his
      superiors. They arranged for him to receive a
      mind-blowing cocktail of LSD and other drugs. Then a
      CIA field operative pushed my father out of a hotel
      window in New York. The CIA said my father had
      committed suicide due to 'personal reasons'. Both
      Cheney and Rumsfeld continued to conceal the truth -
      even after 2003, when President Bush renounced the
      use of torture and abuse by the CIA", continued
      Eric.

      A California history professor, Kathryn Olmstead
      discovered the documents in the Gerald Ford library.


      Cheney and Rumsfeld were given the task of covering
      up the details of Frank Olson's death. At the time,
      Rumsfeld was White House Chief of Staff to President
      Gerald Ford. Dick Cheney was a senior White House
      assistant to the President.

      Frank Olson's family received US $750,000 to settle
      their claims against the US government in 1976. But
      the cover-up continued.

      Both the offices of Rumsfeld and Cheney have
      declined comment on their role in covering-up the
      murder of Frank Olson.

      But from his home outside Washington, Eric Olson
      said the documents involving Rumsfeld and Cheney
      show they "have questions to answer".

      President-elect places his hand on the Bible, raises

      Section 7. Security of person and property searches
      seizures warrants. The people shall be secure in their
      persons, papers, homes and effects, from unreasonable
      searches and seizures; and no warrant to search any
      place or seize any person or things shall issue
      without describing the place to be searched, or the
      person or thing to be seized, as near as may be, nor
      without probable cause, supported by oath or
      affirmation reduced to writing.

      Section 10. Freedom of speech and press. No law shall
      be passed impairing the freedom of speech; every
      person shall be free to speak, write or publish
      whatever he will on any subject, being responsible for
      all abuse of that liberty; and in all suits and
      prosecutions for libel the truth thereof may be given
      in evidence, and the jury, under the direction of the
      court, shall determine the law and the fact.

      Section 11. Ex post facto laws. No ex post facto law,
      nor law impairing the obligation of contracts, or
      retrospective in its operation, or making any
      irrevocable grant of special privileges, franchises or immunities, shall be passed by the general assembly.

      Section 14. Taking private property for private use.
      Private property shall not be taken for private use
      unless by consent of the owner, except for private
      ways of necessity, and except for reservoirs, drains,
      flumes or ditches on or across the lands of others,
      for agricultural, mining, milling, domestic or
      sanitary purposes.

      Section 16. Criminal prosecutions rights of defendant.
      In criminal prosecutions the accused shall have the
      right to appear and defend in person and by counsel;
      to demand the nature and cause of the accusation; to
      meet the witnesses against him face to face; to have
      process to compel the attendance of witnesses in his
      behalf, and a speedy public trial by an impartial jury
      of the county or district in which the offense is
      alleged to have been committed.


      Section 17. Imprisonment of witnesses depositions
      form. No person shall be imprisoned for the purpose of
      securing his testimony in any case longer than may be
      necessary in order to take his deposition. If he can
      give security he shall be discharged; if he cannot
      give security his deposition shall be taken by some
      judge of the supreme, district or county court, at the
      earliest time he can attend, at some convenient place
      by him appointed for that purpose, of which time and
      place the accused and the attorney prosecuting for the
      people shall have reasonable notice. The accused shall
      have the right to appear in person and by counsel. If
      he has no counsel, the judge shall assign him one in
      his behalf only. On the completion of such examination
      the witness shall be discharged on his own
      recognizance, entered into before said judge, but such deposition shall not be used if in the opinion of the court the personal attendance of the witness might be procured by the prosecution, or is procured by the accused. No exception shall be taken to such deposition as to matters of form.

      Section 18. Crimes evidence against one's self
      jeopardy. No person shall be compelled to testify
      against himself in a criminal case nor shall any
      person be twice put in jeopardy for the same offense.
      If the jury disagree, or if the judgment be arrested
      after the verdict, or if the judgment be reversed for
      error in law, the accused shall not be deemed to have
      been in jeopardy.

      People appear to be waking up extremely fast now----to the
      FRAUD OF THE INCOME TAX----and it is a FRAUD------always was---
      the lawyers and Judges are going to have a lot to answer for ----
      shortly----the handwriting is on the wall----and anywhere else you
      can write. The lawyers secret oath to uphold the bankruptcy
      ( international--1930 ) has been publicly exposed. This JEWISH
      FEDERAL RESERVE paper money system is "a comin" down-----and when

      Trading with the Enemy Act of 1917 & 1933 (People Declared the Enemy)

      Oct. 6, 1917, under the Trading with the Enemy Act, Section 2, subdivision (c), Chapter 106 - Enemy defined "other than citizens of the United States..."

      March 9, 1933, Chapter 106, Section 5, subdivision (b) of the Trading with the Enemy Act of Oct.6, 1917 (40 Stat. L. 411) amended as follows "...any person within the United States.." See H.R. 1491 Public No.1

      Found the definition for "American citizen": AKA "foreign prisoner". By
      terror-torial association and prevailing "public policy":

      Now if Guantanamo is "Cuba" where in all the world could "elsewhere" be? And why didn't the "court" qualify that statement with "outside the U.S."?

      The "American citizen" is the "foreign prisoners" the United States already
      holds "elsewhere"......As has been created of the "citizen of the United
      States" in 1934, The New Deal amending the, 1917, Trading With the Enemy
      Act in omitting the exception of what is an "enemy alien".

      Is the "citizen of the Unites States" deemed an alien enemy? Does the "american citizen" have to give his name? Does he have to accept official SUSPICION against him? And is he not free from performing under some exaction? See Title 42 Section 1981 "Civil Rights." Do you "enjoy" the designation "occupant" on your "domestic"[ated] mail. Are you a "human resource"? Are "citizens" Domesticated, as sheep?

      Need more proof that "american citizen" means "foreign prisoner"? 'Liberty' is a "license" of Parol, the "freedom" given a prisoner by a
      superior Occupier.
      Check "your" contract's preamble, do you "enjoy" the "Blessings of
      Liberty"? Did This come after a "Treaty of Peace"?

      the servants we elect/hire to manage our affairs). If we refuse to
      surrender this right and exchange it for a license (permission from those
      in authority), we will be treated as a criminal, prosecuted, and even
      labeled a Felon.

      I am a victim of a number of abusive laws being used in America to
      legally plunder its people to feed an out-of -control bureaucracy. It is
      my intention to launch a Federal Civil Rights action and sue a number of
      Josephine County, Oregon judges for their denial of my rights under color
      of law. I am pressed for time via Statute of Limitations to bring a U.S.C.
      Title 42 law suit against them. No attorney will touch this as attorneys
      are Officers of the Court, and for them to take part in suing a judge would
      be the end of an attorney's career.

      I have located a freelance litigation team who research law and will
      assist me to write the process in asking the Federal Court to hold those
      responsible for violating the my rights in the Circuit Court serving

      and the shootdown of Flight 93 during his interview on The Alex Jones Show
      back in February.

      Alex Jones called the Colonel this morning and he confirmed that Rick
      Gibney was the pilot who shot down Flight 93.

      Caller : And was United Airlines Flight 93 shot down in Pennsylvania by a
      U.S. or NATO pilot and was that what was supposed to hit the Pentagon?

      DGP: No, that was hit at 10:00 hours. It was taken out by the North Dakota
      Air Guard. I know the pilot who fired those two missiles to take down 93.

      Caller : Was it shot down because the airline pilots actually regained
      control of the hijacked auto-pilot or was that to replace the unmanned
      drone that was shot down?

      DGP: No, it was the aircraft, you see, had totally unconscious people on
      board. There were no hijackers. At 9:35, the Happy Hooligans, the Air Guard
      flying the F-16s were ordered to take that plane out. And they took it out
      from 9:35 to 10:00.

      Caller : Were there any refueling jets involved in that operation?

      AJ: Hold on a second, John. The question is why would they deviate from the
      plan of flying it into the Capitol? Why did the globalists decide to go
      ahead and shoot the plane down?

      DGP: There had been an adjustment to the controls, probably by an AWACs
      aircraft flying overhead, again, remote control. And it was on a course for
      either the Capitol or the White House. And at this stage, you don't know.
      The Happy Hooligans came in and took care of it.

      AJ: Do you think they were not following orders?

      DGP: Who, the Happy Hooligans?

      AJ: Well, yeah, you've got Cheney running around, we've got the stand down
      taking place.

      DGP: Well, this is correct, but you see the Adj. General of the State of
      North Dakota gave the command to take it out. And, by God, they took it
      out. And I've got the full story in the book.

      AJ: That's a good thing they did that. You said you talked to the pilot.
      Think about this folks. Imagine what Bush would have gotten if he would
      have had that plane fly into the Capitol? Imagine the police state we would
      be in right now.

      John: Was there any refueling tankers used by the North Dakota Air Guard
      and what tanker wing was used?

      DGP: I don't know about the aircraft itself. I don't know about refueling.
      They came off base in Langley and it was just a few minutes out from
      Langley to the intercept over Pennsylvania. It was just a matter of minutes.

      AJ: Colonel, how did you get in touch with the pilot who shot the plane down?

      DGP: It turned out to be an old friend of mine from the Air National Guard
      and this is my home state of North Dakota. And I attended the ceremony in
      North Dakota and watched the Adj. General [garbled] the pilot being
      decorated a year later for this activity that happened on 911 with Flight 93.

      Colonel, before we take these four final calls, go over that a little bit
      slower for folks. That's a big deal. You talked to the pilot, a friend of
      yours, who shot down Flight 93 that was going for the Capitol or the White
      House. And go over that for folks.

      DGP: Okay, quick rundown. They were out of Hector Field, Fargo, North
      Dakota. A bunch, this 119 Fighter Group and they are called the Happy
      Hooligans. They are probably the best interceptors that we have in the
      country. They were moved to Langley Air Force Base from Hector Field down
      to Southern Virginia. And when the klaxon horn went off at 9:35, those two
      pilots put down their coffee and shot into their aircraft and took off.
      They didn't know where they were going initially but by 10:00 hours, they
      had rendezvoused over Southern Pennsylvania. That's about 250 miles in just
      a matter of minutes and engaged 93 with two side-winder missiles. And they
      accomplished their objective. Now Hector Field, I use to fly out of Hector
      Field some time ago. I know most of those pilots. I could name names. I
      know the National Guard Adj. General. And they were decorated about a year
      later and I have the full write up of that story in my book.

      He was awarded a medal from the Governor one year later for his heroic
      actions. As well as Decorated by Congress on 9/13/2001. The Happy Hooligans
      were previously stationed in North Dakota, and moved to Langley Air Force
      base some months before 911 occured on a "Temporary assignment."

      Major Rick Gibney did as he was ordered and did nothing criminal. He was
      merely following orders, of which he had no choice. Please do not harrass
      this man or bother him for doing what his CO & ultimately George Bush,
      ordered him to do. Major Rick Gibney has no reason to feel guilty nor
      regret following orders. The fault lies with his superiors, and a one,
      certain President George Bush who planned and engineered 911. Please do not
      heap any kind of abuse onto this man, a crack fighter pilot, one of the
      best in our nation, for doing what he was trained and ordered to do. He is
      a good man, honest and full of Integrity as well as unlimited discipline.
      He is a patriot, and was lied to and deceived.

      He had no way to know that this plane wasn't a 'hostile.' Nor could he
      have. The fault lies with his superiors, and President George 'Dubya' Bush.

      Didn't a little Teuton with a mustache do the same thing? Entire families were killed or taken away in the night never to be seen again. Now they are using Ashcrap's USAPA to deal with ALL crime, not just for the terrorists as intended, and without due process or the presumption of innocence. It was written to totally abrogate our Constitution, and take away the rights and freedoms of Americans. The alleged terrorists wouldn't obey the our laws anyway.

      If they were dealing or using drugs, they should have gotten a search warrant and prosecuted them, but were probably on shaky ground? I don't like drugs or drug dealer in my community either, but then we must be mindful of those who import them (our own government confirmed by the CIA's own documents, and why the borders will not be closed) and that's where the prosecution should begin.

      The Taliban burnt the poppy fields in Afghanistan, but our troops now occupy that country, and they had a bumper crop this year imported to the US and all over the world. So, it's business as usual folks, and Americans pay twice. First to have the military import them as during Nam, then over a $Trillion in tax dollars to fight the non-existent "War on Drugs" since it's inception. All the Central banks would crumble if illegal drugs were stopped. They are called the elite (International Banksters), but Bush says, "I call them, my BASE." Custom officers http://www.customscorruption.com , and border patrol doing their job, were reprimanded, terminated, and killed for reporting drug trafficking to their supervisors. US Rep. Tom Tancredo investigated these claims and found them to be true. There are still some good guys left in the Congress, Customs, Border Patrol, and FBI. But, who are the real criminals while the media sticks their heads in the sand?

      Since the police have employed these tyrannical Nazi tactics, on the little guys, many innocent people have been shot and killed just while watching TV in their own homes, including a female government worker who had a heart attack due to their Rambo style entry into her home. It happens all over the country, but localized, so people don't hear about it nationally. Is the death of one innocent person to catch a little fish worth it when all the big fish are swimming around enjoying billions in profit and destroying America? These drugs are very easily attainable from NW district of OH, with dispersal all the way to the OH state capitol, and to the White House. But the FBI are in on it, and have covered up the trail to many of the pillars of society who were using and trafficking. Of course there are bust to justify their job, and make people think the law is being enforced, but never the elite who are protected at all cost.

      An attorney had verifiable evidence of these criminal activities, but labeled crazy and arrested to silence her in a distant Kangaroo Court with the star witness a police officer and brother to the judge, hand pick by the opposition involved in the trafficking. The FBI even refused to investigate a related murder, or provide protection to the litigant. Do your job (as an officer of the court), and go to jail. A young man who had evidence the sheriff and city council were operating a drug ring in their small town of ID, went to the FBI with evidence, shortly afterward he was found murdered in a creek bed. Unfortunately those who make and enforce the laws don't always obey them.

      China White was off loaded from Chinese vessels while luxury cars were simultaneously being on loaded, under the watchful eye of our Coast Guard, near Seattle, WA. The importation of illegal drugs is big business, but lets nail those little guys and increase the lucrative inmate population, especially near those that have manufacturing plants i.e. Hanes and an inexhaustible human worker resource of inmates working for .25 cents an hour, so that corporations can compete with their foreign counter parts, and increase their bottom line while the and private prison providers become even wealthier. They are already bragging the inmate population will soar from 6.5 million to 10 million. It's a win-win situation for the elite, "Bush's base" and who is also heavily invested in the private prisoner providers i.e. Wackenhut, CCA, etc. It's estimated by 2020, 50% the population of which half will be working in the prisons and the other half will be the inmates. Who gains? Follow the money.

      Now really Pam, could we expect less from Oregon, the USSA=United Soviet State of America earned by their reputation for passing tyrannical laws, even though this happened in Washington State. I tried to send this to your state legislature, but my program wouldn't let me send it to so many recipients, but I attached it. I am impressed by the number Reps. who have alternative email addresses so they apparently wish to hear from their constituents.

      An even better plan would to legalize drugs, addicts could get them from clinics. It would take all the profit out of drugs, and all of those involved would quickly go out of business, and the robust prison business due to drug convictions would stop, reducing the number of police officers and bureaucratic offices need to deal with the problem, including all the resulting murders, prostitution, and broken homes. They are putting a band-aide on a hemorrhage and reacting to crime rather than solving it. This is an illness just like any other addictive behavior, and should be treated like a medical condition. The legalization of drugs was very successfully in Switzerland, actually reducing the number of addicts who later wanted treatment for themselves, and stopping drug related crimes.

      Amazingly, when you legalize something, it takes all the fun out of it. There were a greater number of drinkers per capita during prohibition than any other time in American history. :))

      VANCOUVER, Wash. -- Sheriff's deputies shot a woman and a dog in Vancouver, Wash.today after confronting a man with a gun in the doorway of
      a house being watched for drug activity.

      Commander Keith Kilian of the Clark County Sheriff's Office said the woman was taken to a hospital with a gunshot wound in the lower right leg. He would NOT release any names or the condition of the dog.

      Two men were detained at the scene, but NOT immediately arrested. Deputies began watching the house a few days ago, when a real estate agent showing a rental house in the East Minnehaha neighborhood noticed drug paraphernalia and weapons.

      The shooting happened after officers knocked on the door of the home, and a man holding a gun responded. A chase through the house ensued. At one
      point officers returned to the front door, and a boxer dog lunged at them.

      Officers shot at the dog, hitting it and the woman inside the house. The
      officers involved in the shooting will be put on routine administrative leave while the incident is investigated.

      A man who was screaming in a field near Jacobsburg State Park and
      threatened to kill police officers Thursday night died after Bushkill
      Township police tried to subdue him and shot him with a stun gun, police
      said Friday.

      Kris J. Lieberman, 32, of 1557 Pen Argyl Road, Plainfield Township, was
      pronounced dead late Thursday at Easton Hospital, where he was taken after
      the struggle in a field south of the park and attempts to revive him failed.

      State police at Belfast, Northampton County District Attorney John
      Morganelli and Coroner Zachary Lysek are investigating.

      Though an autopsy was done Friday, Lysek said the death remains under
      investigation, pending results of additional laboratory tests.

      State police said Bushkill police got a call at 8:47 p.m. Thursday about a
      disturbance off Schoeneck Road, near Henry Road.

      Cindy Shriner, who lives at 581 Schoeneck Road, said Friday she was
      watering her flowers when she heard noises across the street.

      ''I heard strange screamings and carryings-on from the fence row over
      there,'' she said.

      Mike Orlando of 658 Schoeneck Road said Lieberman was yelling for nearly an
      hour before police arrived.

      ''He was cursing and swearing and moaning,'' said Orlando, whose wife
      called the police. ''He was really in total hysterics.''

      When township police arrived, they saw a man ''in a disruptive, unusual
      manner,'' state police said.

      State police Lt. William A. Teper Jr., who heads the criminal investigation
      division, said Lieberman was ''just not acting normal.''

      When police arrived, Teper said, Lieberman began threatening to kill the
      officers. He grew increasingly agitated and combative, Teper said, and
      refused orders to stay on the ground.

      Lieberman lunged at one of the officers and the police fired a Taser stun
      gun at him, Teper said. Lieberman continued to resist as the officers tried
      to control him.

      During the struggle, Teper said, Lieberman lost consciousness. Township
      police tried but failed to revive him before ambulance personnel arrived.

      Mark Johnson, government affairs manager at Taser International in
      Scottsdale, Ariz., said 4,900 police departments across the country use
      Taser products.

      In early April, CBS Evening News reported that 40 people died after being
      stunned with a Taser.

      Johnson said Friday that none of those deaths was attributed to Tasers.
      Most were due to drug overdoses.

      The company has posted on its Web site the names of 41 people, between the
      ages of 18 and 51, who have died since 2001 after being shot with Tasers,
      and the results of their autopsies.

      ''Ever since law enforcement has pinned on a badge, in-custody deaths have
      occurred,'' Johnson said. ''If you look at 12 years ago, people were being
      killed with pepper spray.

      ''In custody, deaths continue to happen, and it's unfortunate,'' he said.

      On Friday afternoon, no one answered at Lieberman's small gray house. His
      father, Richard, lives next door. A relative said the family had no comment.

      Neighbors LeRoy and Randy Lieberman, father and son contractors, declined
      to talk about Kris, who was LeRoy's nephew and Randy's cousin.

      But Randy Lieberman, a former township supervisor, did say that Kris worked
      on Richard Lieberman's farm ''as far as I know,'' and that Kris had a
      daughter who is about 10.

      Kris Lieberman was a member of the Plainfield Farmers Association and the
      American Professional Rodeo Association, and drove race cars. Besides
      working on the family farm, he had also run his own landscaping business.

      In 1995, Lieberman was sentenced in county court to 23 months of probation
      after pleading guilty to receiving stolen property.

Isn't every one in SUSPICION a "criminal suspect" "facing formal charges" when under the intial "investigation". And doesn't HIIBEL say a name must be given? That the instance of incrimination by giving a name does not prevail against the needs of the state...Namely, the undermining of Miranda and of remaining silent for purposes of fabricated evidence, the "investigation", to support any SUSPICION.

      Justices Warn Police on Coercion Tactic
      Court Warns Police to Stop Coercing Confessions Before Advising of Right to Remain Silent

      WASHINGTON June 28, 2004 - The Supreme Court on Monday warned police away from using a strategy intended to extract confessions from criminal suspects before telling them of their right to remain silent.
      The court, on a 5-4 vote, said that intentionally questioning a suspect twice the first time without reading the Miranda warning is usually improper.

      But the court left open the possibility that some confessions obtained after double interviews would be acceptable, providing police could prove the interrogation wasn't intended to undermine the Miranda warning.

      Criminal defense attorneys and civil libertarians had complained that the strategy was being used to get around the Supreme Court's landmark 1966 Miranda v. Arizona ruling, which requires that suspects in custody be told they have the right to remain silent.

      The court had considered the treatment of murder suspect Patrice Seibert. The Missouri Supreme Court ruled that the two-step interrogation process used in her case was improper a decision upheld by the nation's highest court.

      Such questioning can be successful because suspects may be more willing to talk before they're told they have a right to remain silent. And when told of their rights later, they may not realize their first confession cannot be used against them.

      "The message for officers is you have to read rights first before questioning," said Amy Bartholow, Seibert's public defender. "Criminal defendants will have more rights in the interrogation room."

      Also Monday, the court sided with police in a separate Miranda case, throwing out a decision in the case of a Colorado man who had told an officer not to bother reading him the Miranda warnings.

      The two cases are the final ones in the Supreme Court's sweeping look this year at Miranda and how it is followed by U.S. law enforcement.

      In January, the court ruled that police may not try to wrest confessions from criminal suspects facing formal charges without telling them they have a right to see a lawyer. Then in early June, law enforcement won a second case when the court refused to require special treatment for young people under questioning by police.

      It took the Supreme Court more than six months to rule in the last two cases, an extraordinarily long time. They were argued back-to-back at the court in December.

      Seibert was convicted of plotting to set a 1997 fire that killed a teenager who had been staying at the family trailer in Rolla, Mo., a rural town in the Ozarks. Police said she arranged to have her home burned to cover up the death of her 12-year-old son, who had had cerebral palsy, in order to avoid neglect allegations.

      Justice David H. Souter, writing for himself and three other liberal justices, said that the practice is worrisome because questioning tactics are taught at national training sessions.

      Justice Anthony M. Kennedy agreed with those four that the interrogation technique "undermines the Miranda warning and obscures its meaning."

      But the court left the door open for police to be able to use some confessions obtained after double interviews. Kennedy said that police must be able to prove that the interrogation was not done "in a calculated way to undermine the Miranda warning."

      In a dissent, Justice Sandra Day O'Connor said it would be tough for lower courts to determine if officers had gone too far. She was joined by Chief Justice William H. Rehnquist and Justices Antonin Scalia and Clarence Thomas.

      "In virtually every two-state interrogation case ... courts will be forced to conduct the kind of difficult, state-of-mind inquiry that we normally take pains to avoid," she wrote.

      In the second case, officers had come to Samuel Patane's house to question him about a domestic case, and they told him he had a right to remain silent, but he said he already knew his warnings. He then directed them to a gun in his bedroom and was charged with illegal possession of a firearm.

      The Denver-based 10th U.S. Circuit Court of Appeals ruled that the gun could not be used as evidence against Patane because its discovery was the result of a statement made without a Miranda warning.

      Thomas and two other justices said a failure to give a suspect Miranda warnings did not make such evidence inadmissible in court. O'Connor and Kennedy, while not going that far, said that the government presented a strong case for allowing evidence in the Patane case.

      The cases are United States v. Patane, 02-1183, and Missouri v. Seibert, 02-1371.
