I sent a lengthy email yesterday about obscenity. Let me break it down and
clarify. This is important.
Obscenity refers to words that appeal to a person's prurient (lewd)
interests. These are explicit descriptions of sexual acts, such as
pornography, that can be considered titillating and pandering. The Supreme
Court's standard on obscenity is a three-fold test:
1.Would the average person, applying contemporary community
standards, find that the material appeals to prurient interests?
2.Does the material depict or describe in a patently offensive way,
sexual conduct that is specifically defined under the state law and which
would form the basis for any obscenity prosecution?
3.Does the material, taken as a whole, lack serious literary,
artistic, political, or scientific value?
OBSCENE LANGUAGE CANNOT BE BROADCAST AT ANY TIME!!!
Indecent language "describes in terms patently offensive, as
measured by contemporary community standards for the broadcast medium,
sexual or excretory activities and organs, at times of the day when there
is a reasonable risk that children may be in the audience." Indecent
language, however, lacks "an appeal to prurient interest."
The most important aspect of this definition is the emphasis placed
on children being in the audience. Indecent material will be held to lack
serious artistic, literary, political, or scientific value when children
may be in the audience. Specific words that cannot be used are "fuck,"
"shit," "piss," "motherfucker," "cocksucker," "cunt," "tit," and "blowjob,"
and have been specifically placed in this category. Other specific words
will be decided on a case-by-case basis.
INDECENT LANGUAGE MAY BE AIRED AFTER 10 P.M. UNDER THE FOLLOWING CRITERIA-
1. Check with program director or station manager
2. Warn the audience that the material about to be broadcast may be
by reading a disclaimer: "The following program (or song)
contains language which may be
considered offensive. KMUN urges you to exercise your choice
of whether or not to listen."
Log the warning.
3. Announce the length of time the questionable piece will be on
ANY QUESTIONS PLEASE ASK ME!!
