      NATIONAL ACTION: Call the Border Patrol Station in Imperial Beach, CA

      be respected and upheld (stop abuse/pressure, allow legal

      Subject: Border Patrol Detains Human Rights Observer in San Diego

      On October 3, 2003 at 8 PM the vehicle in which Macario Moreno, a Human
      Rights observer with the Sherman Heights Human Rights Committee,
      traveled in was ordered to pull over by a California Highway Patrol
      (CHP) unit in Barrio Logan, San Diego. The CHP called the Border Patrol
      which subsequently detained Mr. Moreno and a companion. Mr. Moreno and
      the driver of the vehicle were transported to the Imperial Beach Border
      Patrol Processing Center, were he remained until early Monday morning.

      Mr. Moreno who has been a Human Rights observer since February of 2002
      and has been participating with the American Friends Service Committee
      and the Raza Rights Coalition, contacted Human Rights colleagues via
      telephone to confirm his status, at which time he denounced that two
      Border Patrol agents physically restrained him and forced him to sign
      voluntary deportation.

      The American Friends Service Committee informed the Mexican General
      Consulate in San Diego of the troubling reports of abuse of authority
      and intimidation by Border Patrol agents.

      As of this moment, the exact whereabouts of Mr. Moreno are unknown, the
      U.S.Border Patrol station in Imperial Beach has informed the San Diego
      Office of the American Friends Service Committee that Mr. Moreno has
      been placed in Alien Detention and Removal (ADR) but that information
      has not been verified. As of October 6, 2003, Mr. Moreno reported that
      he had not had the opportunity to take a shower or change his clothing.

      We are asking the U.S. Border Patrol to meet the following points:

      1. That Macario Moreno be treated with respect and dignity while in
      custody of the U.S. Border Patrol.
      2. That Mr. Moreno's right to legal representation, and the right to a
      hearing before an immigration judge be respected.
      3. That an investigation into the intimidation used by agents of the
      U.S. Border Patrol to force Mr. Moreno to waive his rights be conducted.

      We ask that everyone contact the Border Patrol Station in Imperial Beach
      (619) 662-7057 where Macario is being held and demand that his Human and
      Civil rights be respected and upheld.
