Action Alert

Senate Environment & Public Works Committee Chair

Barbara Boxer Schedules Markup of S. 787 Without Hearing

***This bill will profoundly impact every citizen & community in the country--You need to keep up the pressure:  It's been working***

1.  Bombard the EPW office with phone calls and tell them to postpone committee action

and demand a hearing on the bill:

                                   Democratic Office: (202) 224-8832

                                   Republican Office: (202) 224-6176

2.  Contact both of your Senators and ask them to request a hearing on the bill.

You can call any Senator at (202) 224-3121.

3.  Contact your member of Congress and ask him or her not to cosponsor this

legislation.  You can call any Congressman at  (202) 225-3121.

4.  Contact your governor, state legislators and local elected officials and ask

them to weigh in on this issue.

5.   Forward this message to people and organizations in your network.

Note:  If you are a Minnesota citizen, you need to contact Sen. Amy Klobuchar at (202)

224-3244.  She is one of four senators on the Committe that has been appointed to cut a deal, and the word in Washington is that she is doing Rep. Oberstar's bidding for him.

______________________

Washington, D.C. __ The Oberstar-Feingold Clean Water Restoration Act, regarded as perhaps the biggest federal power grab in the nation's history, has been scheduled for committee markup and possible passage this Thursday, June 18th.  The bill has been held up in the Environment and Public Works Committee for over a month because of large-scale, grassroots opposition from around the country.

Committee Chair Barbara Boxer has been frustrated for the past month, and is strong-arming Democrats on the Committee to support a bill without a hearing.  She has also established a 'gang of four' to come up with language that would assure Committee approval.

The four are Max Baucus (D-MT), Amy Klobuchar (D-MN), George Voinovich (R-OH), and Lamar Alexander (R-TN).  Baucus is the leading critic on the Democratic side, and is trying to 'cut a deal' by appeasing interests in his state.

The chief author in the House is Minnesota Congressman James Oberstar.  Rep. Oberstar chairs the Transportation and Infrastructure Committee, which has sole jurisdiction of the legislation in the House.  This is purported to be a 'legacy' bill for Rep. Oberstar, and although there is virtually no support for the bill in his own district, he has made it a top priority for his Committee, and is expected to introduce a bill in the House soon.

Rep. Oberstar recently received a green light from high level officials in the Obama Administration, inlcuding the Secretary of Agriculture, Secretary of Interior, Administrator of the Environmental Protection Agency, and the Chairman of the President's Council on Environmental Quality.

As Reed Hopper, lead attorney in a 2006 landmark Supreme Court decision stated in testimony, ".....this bill pushes the limits of federal power to an extreme not matched by any other law, probably in the history of this country."

Hopper wasn't exaggerating.  This bill expands federal power in two ways:

     1) By removing the limiting term 'navigable' from the 1972 Federal Water Pollution Control Act and replacing it with the all inclusive 'waters of the U.S.' (including wetlands, intermittent streams, playa lakes, prairie potholes, sandflats, mudflats, ponds, meadows and sloughs).

     2) By adding the new language 'activities affecting these waters,' which refers to land use activity as well as atmospheric deposition.  As Rep.
Oberstar has often stated, "water flows downhill."  That is to say that the bill is about federal control of entire watersheds.  And everything is in a watershed--all water, all land, all people, all communities.

In short, this bill is not about clean waterIt's about governance.  It's aim is top-down, command and control of land, water, people and communities.  It should be viewed as perhaps the greatest threat ever to liberty, property, jobs, energy independence, and access to and use and enjoyment of public lands and waters.  In the words of Jim Burling, senior attorney with the Pacific Legal Foundation, "If our constitutional system of limited federal powers means anything, we have to win on this issue."

The bill would overturn two U.S. Supreme Court decisions (SWANCC--2001 and Rapanos--2006) which ruled that the U.S. Environmental Protection Agency and U.S. Army Corps of Engineers had exceeded their authority under the 1972 Federal Water Pollution Control Act.  Cleverly and deceptively titled the Clean Water Restoration Act, the only thing the Oberstar-Feingold bill restores, and legalizes, is the abuse of the individual rights of American citizens, and the continued expansion of federal control over every aspect of American life.

In case you think we're overstating the case, a 2006 report prepared by Oberstar's Transportation and Infrastructure Committee staff leaves no doubt as to what this legislation is about.  The report emphasizes that control of non-point sources is the unfinished agenda of the Clean Water Act.

The simple definition of a non-point source is 'anything that doesn't come out of a pipe.'  This would include agriculture, forestry, mining, energy development, home-building and other property improvement, as well as recreational uses of public lands and waters.  It would include activities such as mowing your lawn, planting a garden, or building, maintaining, or using a recreational trail--virtually any human activity you can imagine.  As Ali Cambel, professor of Environmental Studies at  George Washington University warned over 30 years ago, "Wait until they get around to controlling non-point sources of water pollution."

The bill is not about pollution, it's about power.  It is being supported by every national environmental organization in the country as a means of maintaining and expanding their power base in Washington .  Many of these groups don't just have office space in Washington --they own buildings!  There are no checks and balances, and little oversight.  This is purely and simply a redistribution of power and authority, removing it from American citizens and communities and their state and local elected officials, and transferring it to a massive federal bureaucracy.  That is why organizations such as the National Association of Counties are so strongly opposed to the legislation.

Of course, there are some who will benefit.  If passed, it will be a full-employment act for environmental activists and attorneys, already a major growth-industry in America .  There will be endless litigation, as every acre of land and water in the country is up for dispute as to whether a human activity should be allowed.

This legislation is expansive and precedent-setting, so please act immediately.

Here's the full makeup of the Senate Environment and Public Works Committee:

Democrats:                                        Republicans

Boxer (CA)       Chair                        Inhofe (OK)        Ranking Member
Baucus (MT)                                      Alexander (TN)
Cardin (MD)                                       Bond (MO)
Carper (DE)                                       Barrasso (WY)
Gillebrand (NY)                                  Crapo (ID)
Klobuchar (MN)                                 Vitter (LA)
Lautenberg (NJ)                                Voinovich (OH)
Merkley (OR)
Sanders (VT)
Specter (PA)
Udall (NM)
Whitehouse (RI)

Call your Senators even if they are not on the EPW Committee.  You can call any Senator at (202) 224-3121.

This bill must be defeated, so please act now!  There's a better way to achieve water quality objectives--a way that allows for every citizen to participate in solutions to environmental problems--solutions that are better, faster and cheaper!  This approach has been tried successfully in many parts of the country.  It works.  And it can not only lead to common sense solutions to problems, it can help restore  trust in government.  The choice is very simple:  Do you want more top-down, one-size-fits-all, command and control government from Washington , or responsible, bottoms-up, common sense government from average citizens and local communities?

Please take the time to get organizations to support the petition below by resolution and have them return it to us as soon as possible

Warriors,

I hope you have had a chance to get out and ride our own trail system this
year.  It has been the best in some time (ok I know that is not saying a whole
lot) but I don't know of a club ride locally yet but I've seen a lot of
tracks!  In the interest of time I’m doing a letter of news instead of a
newsletter.

Change! Change! Change!  It is the new thing so we are jumping on the band
wagon, the March meeting will NOT be held on March 5th, this month’s meeting
is moved it to March 12 due to the Animal Run coinciding.  But one change would
not be enough so we have also moved meeting from 8:00 to 7:30 as the normal time
was conflicting with most members’ beauty sleep.  April’s meeting will be
back to the normal Thursday.  We are going to keep the new starting time of the
meetings at 7:30 for a while and see how it goes.  For our final change we are
going to see if we can get any stimulus money, seeing our gambling operation has
been lower the it has ever been…

Election of officers at the April meeting, if you know of someone who is
interested in running for an office (CEO, President, Vice President, Secretary &
Treasure) contact the election committee member (Eric Schrader, Larry Conrad,
Jim Kessler and Brian Peterson).

The club trip is always on our minds whether it is Silver City years ago, or
Hibbing’s finest posing for pictures with Waterford Warrior's finest.  It is
time to start thinking of next year’s club trip; locations looked at for next
year are Detroit Lakes, International Falls, Ely and Elephant Lake.  If you
prefer one of these locations over another attend the next meeting and lobby for
it as our destination.  And this time do you think we can do with out the cops?

With the economy right now our Legislators in St Paul are looking desperately at
all sources of revenue in order to balance the States growing budget deficit.
Our dedicated fund for snowmobile trails and maintenance may be in jeopardy.
Even though we have paid for this fund through our gas tax, registrations, and
trail passes, this fund is a lucrative source of money for some of those in St
Paul.  Doug Franzen, who is employed by us through MNUSA, is concerned that if
we do not step up and let our Legislatures know that our funding should not be
touched, we could lose it.  It is very important that we let them know that
taking our funds is not an option.  We need to protect our trails.

Minnesota United Snowmobile association has put together a Legislatures
Reception in Saint Paul on March 10th.  It will be at the Best Western Kelly
Inn at 161 St Anthony Blvd.  It is very easy to get to with plenty of free
parking available. It will be held from 4:00 until 7:00.  This time was chosen
to make it a minimum time investment for all those attending.  Hor de oeuvres
will be served.

We need to do two things, contact your representative from your area and ask him
to meet you at the Kelly Inn on March 10th.  Secondly, be there to meet them.
Ask them to not to touch our dedicated fund.  This is a great venue to meet our
representatives in a one on one environment.  I am sure that other issues may
be discussed as well, but we need to let them know that our funding source is
off limits.  They do work for us!

Steve; Here is a list of riders and cabin preferences. Lets try to keep these together. This list have all paid a deposit except me. Anyone that shows up without a deposit will have to stay in anyoverflow available as I have promised a bed to the paid ones first. I would prefer that there wouldnt be much jumping around on assignments.makes it easier on me. My phone is 507 649 1105. As usual this is both fun for me and a real pain getting guys to commit. I was pretty tough on the deposit and there may be a couple showing up without a deposit and I will try to keep a handle on them so there isnt anyone trying to get a bed without paying or a deposit.

Eric,

Hope the summer and fall treated you well! Plenty of
goofy stuff going on in the markets and economy and then
you get to add weather to your list like I do but
fortunately only during the winter for me!

Thank you for all your help over the years and I hope that
we can look forward to hosting the Animal Run again in 2009.

We quoted you the same price in 2008 as in 2007 at $180 for
Thurs/Fri/Sat stay (taxes and hat included) and Wednesday
night is no additional charge for those that can arrive early.

We'll hold the price the same for this coming March in the hopes
that you can convince the guys to return again and I'll block
plenty of cabins if you can tell me which weekend (first or

Once identified, I will also make sure we line up for extra

Thank you again for all your help and I'll look forward to

ICED... Two Trophy Eyes!
Save Your Mind... Through Fishing
I tend to be a little bias.  Having been named one of the Top 25 Fishing Destinations in all of North America, I am pretty confident in the quality of our fishing, be it open water or ice fishing.  Time and time again, I see the smiling faces of those who reap the benefits of some very special fishing.  Despite my basis, I still make it a point to ask what is going on in the mind of an angler that ventures our way.

Inevitably I am told that you just can't match the variety and remoteness of the area.   When it comes to fishing, you can pursue any one of 6 game fish at any given time.  Not only do you have exceptional odds of landing a trophy, you also get great action in the sheer numbers of fish this area produces.  And the concept of variety doesn't stop at game fish.  People always mention that coming here affords them the unique opportunity to fish literally hundreds lakes.  From big lakes to small lakes, deep lakes to shallow lakes, easy access lakes to remote access adventure lakes, there is something that appeals to every angler out there.

That said, I am currently doing my annual phone calls to touch base with our guests.  A common theme in our conversations is the condition of the economy.  There is a lot of doom and gloom out there right now.  You hear it every time you turn on the radio or watch the evening news.  It is easy for us to become frustrated with the borage of negativism.

If you're like me and most fishing and hunting enthusiasts, you constantly think about the enjoyment that comes with a fishing or hunting getaway.  I guess I am lucky in that sense.  During our New Year's celebration a couple of days ago, I was surrounded by family and friends allowing me the opportunity to get out and enjoy some good old fashion ice fishing.  What I enjoyed the most was not necessarily the fish that were caught, but more importantly the opportunity to escape to a place of pure rest, relaxation and rejuvenation.  When I think about it, I guess that is why I am so passionate about our fishing, and hunting, here.  I know the benefits that result in a fishing or hunting trip, and I am adamant hunters and anglers needs to experience it, not only once, but multiple times a year.

Some people are on the fence about a fishing or hunting trip in 2009. They cite the uncertainty of the economy as being their biggest challenge.   To them I say, there is no better time to plan your trip than now.  People fail to realize that recreation and leisure are a necessary part of life.  When you're constantly bombarded with gloom and doom, people become callus and numb.  In order to face the challenges the come in the type of economic state we are currently in, people ABSOLUTELY need to get away.  Call it a vacation, an escape or whatever, but when you are able to get away from it all, doing so allows you to recuperate and come back clear headed, stronger and ready to tackle the big challenges.  For me, there is no better way to do that then to head out afield and enjoy all that nature has to offer.~

ICED! Two Trophy Eyes!

Winter's play ground has proven to be a productive one so far this season.  Within the last 3 weeks, we have seen very good success fishing for walleye on our area hot spots.  Caught and then released were two trophy walleyes, one that measured over 30", weighing 10 plus pounds and another in the 8 pound range.  Both trophy's were released to be caught another day.  Also, as usual, our splake adventure has been red hot.  Add to that some fantastically good fishing on Onaman Lake and you find all the makings of an Ontario ice fisherman's paradise.

Speaking of Onaman Lake, I was fortunate enough to spend some time out there over the New Year.  Although fishing conditions were a bit chilly, there was plenty to be caught, including two pike in the 30 inch range as well as several walleye, the biggest being close to 5lbs.  One of the things I really enjoy is having a lake the size of Onaman all to myself.  When it comes to the remoteness and the pure escape of getting away, our area is second to none!

Leon,

Our dealership is the host site for avalanche training on Dec 10th from 6pm-10pm.  I was wondering if you could get the word out to your club to see if anyone would be interested in attending.  The cost is $45 and goes toward the cost of the trainer.  He is based in Colorado and travels throughout the US doing training.  If you are looking for additional information, please contact either myself or Shannon Christiansen @ 507-251-1045.  He is the organizer of the course.  Also, when is your next meeting? Subject: Western UP Snowmobile Lodging Offer

Hello,
I would like to invite your group to visit the western Upper Peninsula of
Michigan for a great snowmobiling experience.  The Ford Center can offer your
group an economical way to explore the UP¢s scenic vistas and rugged
wilderness.  Lodging options include dorm rooms or houses.  The rate is $22 per
person per night, which includes a continental breakfast.  All rooms come with
two twin beds, shared bathrooms and limited housekeeping.  Other amenities
include a recreation hall, two TV lounges, night time snacks and wireless
Internet.  The houses sleep between 6-14 people (minimum required).  Each house
has a kitchen, living room, and dining room.  Washers/dryers are available on
site.  The Ford Center also has plenty of parking for trailers and an enclosed
space for repairs.

The Ford Center¢s culinary staff can offer your group options for lunch and
dinner.  These meals must be scheduled in advance.  Please see group menu on
website.

The Ford Center is located in the historic community of Alberta.  Alberta lies
in the heart of a winter wonderland with its average annual snowfall of 200
inches.  In the area there are snowmobile, cross country and snowshoeing trails,
as well as many lakes, including nearby Lake Superior, for ice fishing.  The
Ford Center is located on US 41 just 60 miles north of Marquette and 40 miles
south of Houghton.

Make your reservations today; this offer is only available through March 31,
2009.  Please see attached brochure (.pdf) for more details and reservation
form.  If you have any questions, please don't hesitate to contact me.

Happy Snowmobiling,
Kari
