Revised 6/6/05---major changes----proposed amendments for regional houses of
representatives and senates(or unicameral legislatures) in addition to existing
state legislatures, creation of regional defense departments as well as regional
treasuries
and the dismantling of those two departments in the District of Columbia. Also,
making
federal reserve district banks regional central banks.



    The following draft is in the process of being sent to state(not federal)
representatives and
senators throughout the nation. If you find yourself in general agreement,
kindly forward to
yours(faxes, office visits, and letters most effective)---constituents always
receive top priority!! :)  Any feedback you may have would also be appreciated.

    Greetings. Article V of the Constitution allows for a Constitutional
Convention if 2/3
of the state legislatures vote to have one. All a Constitutional Convention does
is
propose amendments which are then sent back to the state legislatures(or state
conventions)
where 3/4 must sign off on them to become law.
    An increasing number of individuals feel that the time has come for the
calling of such a Convention due to the federal government's:

1) failure to uphold the Constitution and secure our borders from massive
illegal immigration;
2) failure to forumulate a national energy policy aimed at decreasing our
dependence on foreign
     oil;
3) failure to address the issue of job outsourcing which has led to the
deterioration of our
     manurfacturing base in the U.S.;
4) failure to adequately administer the social security trust fund.

    Be that as it may, if such a Convention were to be called, the theme should
be Returning Power to the States. The following amendments should be proposed,
with the Bill of Rights being "off the table" as a prerequisite for a
Convention. The aim here is to restructure government to better serve the people
and the states, not eliminate freedoms:

----Abolishing the House of Representatives and the Senate in the District of
Columbia and
     creating REGIONAL Houses of Representatives and Senates(or unicameral
legislatures)
     for 10 regional zones (FEMA model) in the United States.
----Dismantling the U.S. Treasury in the District of Columbia and creating
REGIONAL
     Treasuries(10)(This would include elimination of the federal income tax).
----Abolishing the Board of Governors of the Federal Reserve as well as the
Federal Open
     Market Committee(FOMC) and in their place, creating REGIONAL Boards of
Governors(10)
     as well as Regional Open Market Committees(10) with federal reserve district
banks be-
     coming REGIONAL central banks with regional autonomy.
----Transferring Social Security tax payments to state trust funds as opposed to
the federal
     "trust fund."
----Returning all federal lands(including military bases) to the states and
creating REGIONAL
     defense departments.
----Making the state supreme courts the final word in all state cases, with
REGIONAL
     supreme courts deciding cases between states, and the federal supreme court
deciding
     cases between regions.

The purpose of these amendments is to literally defund and restructure the
federal government and transfer as much power as possible back to the states.
The time has come for REGION-
AL GOVERNMENT to take shape in the United States as this nation is simply too
big
and diverse to continue to be ruled from a hamlet called Washington D.C. FEMA by
the
way already has a plan on the books for regional government in the event the
federal
government should become non-functional in the event of some disaster (see
http://www.pbsjdfirm.com , Click on "Regional Contacts" at left, view map).
Needless to
say, many feel that the federal government has been non-functional for quite
some
time in many important areas affecting our nation's well-being and security.
   In any event, my purpose in emailing you is to encourage you to support a bill
calling
for a national constitutional convention. To add a sense of urgency to the
matter, consider the following executive orders that might be implemented in the
event of an economic collapse,
perhaps precipitated by escalating oil prices:

E.O. 10990 Seizure of all modes of transportation and control of highways and
seaports.
E.O. 10995 Seizure of all communications media in the United States.
E.O. 10997 Seizure of all electric power fuels and minerals, public and private.
E.O. 10999 Seizure of all means of transportation, including personal cars,
trucks or vehicles
                   of any kind and total control of highways, seaports and
waterways.
E.O  11000 Seizure of all American people for work forces under FEDERAL
supervision in-
                   cluding the splitting of families if the government finds it
necessary.
E.O. 11001 Seizure of all health, education and welfare facilities, public and
private.
E.O  11002 Empowered the postmaster general to register all men, women and
children in
                   the U.S.
E.O. 11003 Seizure of all airports and aircraft.
E.O. 11004 Seizure of all housing and finance authorities to establish Forced
Relo-
                   cation areas if deemed necessary.
E.O. 11005 Seizure of all railroads, inland waterways and storage facilities,
public
                   and private.
E.O. 11051 Empowers the Office of Emergency Planning and gives authorization to
put
                   all Executive Orders into effect IN TIMES OF INCREASED
INTERNATIONAL
                   TENSIONS AND ECONOMIC OR FINANCIAL CRISIS.
E.O. 11310 Empowers the Department of Justice to enforce the plans set out in
Executive
                   Orders, to institute industrial support, to establish judicial
and legislative liaison,
                   to control all aliens, TO OPERATE PENAL AND CORRECTIONAL
                   INSTITUTIONS, and to advise and assist the President.
E.O. 11921 Empowers the Federal Emergency Preparedness Agency to develop plans
to
                   establish control over the mechanisms of production and
distribution, of energy
                   sources, wages, salaries, credit and the flow of money in U.S.
financial in-
                   stitutions in any undefined national emergency. It also
provides that when a
                   state of emergency is declared by the President, Congress
cannot review the
                   action for six months.
E.O. 12919 Signed June 3, 1994 by President Bill Clinton. Encompasses all the
above
                   executive orders.

Thats pretty sad, specialy concidering colledge students can sneak
plastic knives onto plans threw major security holes as pranks.

Another good news item is about a man getting a ticket for not paying
a big enough tip.

putin doesn't blame us any more than we can blame them for the east
german terrorist gangs.

he is, rightfully so, upset about the STATE DEPARTMENT giving him
warnings about going after chechens...

but the world knows the sate department and the US are not on the
same page. usually aren't.

he's upset that the state department had been trying to turn chechens
against, or at least give some information on, the larger al-queda
network.

this is the same as getting a local gang to point out who's further
up the chain, and "we'll leave you alone (this week)"

meanwhile you're collecting info on everyone and you'll round up the
lot as soon as you know you can get them all at once.

vilification.  They show that PUTIN is definately pointing at the US
and Britain.

Washington DC, September 14 -- In the wake of the terrorist atrocity
at a school in Beslan, North Ossetia, in the Russian Federation,
Russian President Vladimir Putin has made remarks to the western
press which expose the key role of the US and British governments in
backing Chechen terrorism

(AND AGAIN)..........

On Monday September 6, Putin spoke for three and one half hours with
a group of some 30 western correspondents and Russia experts at his
dacha near Novo Ogarevo outside Moscow. There is no official
transcript so far, but accounts have been published in The Guardian,
The Independent, and Le Monde. The Washington Post waited until
Friday, September 10 to publish an article, but left out the most
significant remarks. There are now signs that the Anglo-American
press is beginning a new campaign against Putin as a dictator,
stressing the obvious in order to silence his attacks on the US-UK
sponsorship of Chechen terror.

(AND AGAIN).........

The key point is that the Russian press is now openly denouncing
London and Washington as centers for terrorist control. This can blow
the lid off the 9-11 hoax.

"SCHOOL SEIZURE WAS PLANNED IN WASHINGTON AND LONDON"

This was the headline of an even more explicit unsigned commentary by
the Russian news agency KMNews.ru. This analysis blames the Beslan
school massacre squarely on the U.S. and British intelligence
agencies.

Editorial 09/15/2004   Are they self-destructive?
This week Democrats will hit the airwaves to continue questioning President
Bush's National Guard duty. Their claim: Bush has a pattern of lying about his
military service.
       Is it any wonder John Kerry's poll numbers have plummeted.
       Ignoring former President Clinton's advice to avoid miring in Vietnam, the
Kerry camp apparently believes attacking Bush on what is a non-starter with
voters is the best way to counter continued questions about the veracity of
Kerry's war time claims and post-war activities.
       But this tact only reminds voters of the accusations made by Swift Boat
Veterans for Truth and, and makes us wonder how apparently (obviously, we
believe) forged documents bashing Bush's record got into Dan Rather's hands.
       Sounds like panic. Soon after the "new" documents were found, the Kerry
went on defense, arguing the "bogus" letters were a Republican dirty trick
intended to paint Democrats as underhanded. Still, they are using the new
interest in Bush's National Guard record to bash Bush.
       Making this all the more foolish is that voters don't care about Bush's
National Guard service, but they do care about Kerry's service since he made it
the main reason he would be effective in fighting terrorists.
       It's one of the reason's the book "Unfit for Duty," which challenges
Kerry's war record, remains atop the bestseller's list.
       If you doubt the accusations in that book are suspect, we suggest you turn
to Lt. Col. Robert "Buzz" Patterson's book "Reckless Disregard" (Regnery), a
blistering examination of how "liberal" politics has undermined the military.
And while Kerry is only part of the story, Patterson raises serious questions
about Kerry's post-war activities, which raises troubling questions about his
judgment and philosophy.
       * On October 15, 1969, Kerry attended the Moratorium March on Washington,
an anti-war protest organized by North Vietnamese in Communist Cuba. Kerry later
piloted Ted Kennedy advisor Adam Walinsky as he made his anti-war speeches.
       At the time Kerry was an active member of the Navy and receiving a Navy
paycheck, a clear violation of the Hatch Act and the Uniform Code of Military
Justice. Kerry could have been subject to court-martial, Patterson writes. Why
wasn't he?
       Even Kerry seemed to understand his dilemma and, wanting to kick off his
political career in January 1970, he asked for an early discharge.
       * That May, Kerry went to Paris to meet and discuss peace with delegates
from Communist North Vietnam and Communist forces in South Vietnam. While
federal law prohibits private citizens from negotiating with foreign
governments, it didn't stop him. Again, he was not prosecuted.
       * In 1971, in an interview with the "Harvard Crimson" Kerry said "I'd like
to see our troops dispersed through the world only at the direction of the
United Nations." He must tell us why he felt that way, and how he's adjusted is
view since.
       * From November 12-15, 1971, Kerry attended a Vietnam Veterans Against the
War meeting in which another member proposed assassinating seven pro-war
senators. Kerry voted against the plan and claims to have resigned from the
group three days later. But, Patterson finds, he represented the group two
months later and at a January 26, 1972 protest meeting.
       Worse, Kerry never reported the assassination plot to any law enforcement
officials.
       Kerry owes us an explanation for this. Then he should follow Clinton's
advice and get off the Vietnam issue. For Kerry it's a quagmire as treacherous
for his campaign as the Vietnam War itself.

will get the point. Do read between the lines.

It has been almost one generation since the last COLD WAR. looks
like it starts again.

Maybe some of you remember Gorby when he left saying What you see in
the Soviet Union is for foreign consumption only. Let me
repeat "There is no change in the Soviet Union."

I knew that I only had to wait and it would started again. Ah! It is
good to have my old enemy back. She could always be trusted to do
what was precisely to her benefit (or that, disguised of course, to
the aims of the New World Order.) And think, Gorby has been living
it up in California. Probably feel quite at home there amonge the
locals. Actually they have about the same level of contempt as teh
Chinese to our materialistic stupidity and short mindedness.

Do not mistake this for "Russian paranoia." What we are hearing and
reading is calculated propaganda. Characteristically, the mass
murderer accuses his intended victim of harboring identical
intentions to his own. It effectively appeals to the willing dupes,
useful idiots and fellow travelers of the anti-American left. At the
same time it covers President Putin with a halo of innocence.

Russian policy has entered a new phase. President Putin's declaration
of war against an unnamed country, his mobilization of Russia, his
call for unity, his nostalgia for the Soviet Union already
characterizes this new phase. Russia's policy is clearly anti-
American and anti-capitalist.

Aren't we having a lot of military threats and slignment happening in
a short period of time. Does it hav anything to do with the
potential pre-emptive strike against Iran, Syria etc? Is anyone
worried that we are going to become too large a presence in Iraq with
the 5+ permanent military bases we are building there so we can pull
out (Are we going to pull out?)

And what about the alliances China has with other mid-East countries
either directly or through surrogates? Are our people at risk? Is
it time to bring the alternative energy devices ouyt of the closet?

China is building a respectavble ICBM fleet. We are using tax payer
dollars to pay for destroying the Russian obslete missiles as prt of
the SALT treaty while the newer production were not counted in the
treaty because they were not deployed.

Taiwan in March 1996.

I am concerned about your position on trade agreements.  These agreements,
especially the FTAA will not increase Latin American trade.  The combined 2003
Gross Domestic Product for the 34 Western Hemisphere nations was approximately
$15.7 trillion, $11 trillion of which (70%) was generated by the United States. 
Therefore, there is no overwhelming market in Latin America for U. S. exports. 
These countries have no money for trade with the United States, nor do they have
the capacity to manufacture products for trade.

What would truly help exports in Latin America is to stop helping their
dictators and corrupt governments, and quit killing America's capacity to
produce here at home with overwhelming regulations and taxation.

Additionally, such agreements as the FTAA are huge, deceptive power-grabs -- an
attack on our independence and sovereignty.  NAFTA, CAFTA, and the FTAA are
designed to lure us into regional governments in violation of the United States
Constitution.

I implore you to study the real facts, and change your position.

Making sure that your electronic vote will be counted

Next month, nearly one-third of voters will be able to
cast their ballots on a computer touch screen-a highly
controversial development. Some surveys show that
people trust electronic voting, but the prospect
alarms some computer scientists and voters' rights
groups.

People in precincts that already offer e-voting have
reported the use of unauthorized software, nonworking
machines, and delays in tallying votes cast onscreen.

The critics point to a number of potential problems:

Voter-access cards, needed to activate the machine,
being mass-produced and used to allow individuals to
vote multiple times.
Insiders rigging machines to favor one candidate.
Machines, lacking voter-verified audit systems, hiding
problems and making recounts impossible.
E-voting machines do have advantages over older
systems, and they are favored by some organizations
representing Hispanic and disabled voters. The systems
can be programmed for multiple languages, can provide
audible ballots for the blind, and can prevent people
from voting for more than one candidate for an office.

David Bear, a spokesman for Diebold Election Systems,
a large manufacturer of electronic voting machines
that has been battered by criticism this year, says
that e-voting systems come with layers of security,
plus human monitoring at polling places. If recounts
are needed, Bear says, they can re-run the machines to
confirm the tally or print a hard copy of every ballot
that was cast.

VerifiedVoting.org, a nonpartisan lobbying group that
advocates voter-verified paper ballots, says
malfunctions have not been addressed, and a proper
recount means comparing the new tally with
voter-verified ballots.

Some jurisdictions have decided that an alternative,
such as an optical scan of ballots, may be the only
way-to allay concerns. This spring, an investigation
by the California Secretary of State's office found
security problems with some Diebold systems. The state
ordered most e-voting counties to ditch the machines
or take additional security measures, including active
poll monitoring. Counties must also give voters the
option of using a paper ballot.

Nevada is the first state with e-voting machines with
a voter verified paper trail. Made by Sequoia Voting
Systems, the machines allow voters to review their
ballot before they leave the booth. Dean Heller,
Nevada's secretary of state, says he pushed for the
printed records. "Otherwise it's a trust-me scenario,"
he says, "and I don't think that works today."

What you can do

There are steps you can take now and on Election Day
to help ensure that your e-vote gets counted.

Try the machines ahead of time. Many localities are
offering demonstrations. For more information, contact
your local board of elections.
Ask the board of elections or voter groups whether
anybody is running pre-election tests to see how well
machines perform. If not, lobby for one in your area.
Check your ballot before casting it, says Lloyd
Leonard, director for advocacy at the League of Women
Voters. If something's amiss, contact a poll worker at
once.
Report problems to the local board of elec­tions as
well as to advocacy Web sites, such as
http://www.VerifiedVoting.org. Or, call Election
Protection, a coalition of civil liberties
organizations, at 866-687-8683; a team of attorneys is
on call to help you.
Consider lobbying for the kind of machines used in
Nevada, which produce a paper record you can review.

Dear Governor Owens,

      First of all I would like to thank you for signing SB-25 into
law and thus rolling back the illegal and unconstitutional ordinance
that forbade the citizens of Colorado from carrying side arms within
the city limits of certain "home rule" cities, such as Denver.  Thank
you for your stand for the Constitution as being the supreme law of
the land of Colorado as well as for the United States of America.  I
am sure that millions of patriots including those who have been
concerned about their constitutionally guaranteed, 2nd amendment
right to keep and bear arms will hold you to be a hero and you will
go down in history and be remembered as a defender of the 2nd
Amendment and the rights of the free citizens of the state of
Colorado.  I am certain that you are quite familiar with the
following legal quotes but I will include them in this letter so they
will once again be fresh in your mind.  I am sure you must have
reflected upon those quotes before you signed SB-25 into law and I do
hope that you will continue to think upon them whenever there is any
question or doubt of there being any violation of the Constitution or
the Constitutionally guaranteed rights of the citizens of your great
state of Colrado whom have elected you to serve them to the best of
your ability.

"The general rule is that an unconstitutional statute, though having
the form and name of law, is in reality no law, but is wholly void,
and ineffective for any purpose; since unconstitutionality dates from
the time of it's enactment, and not merely from the date of the
decision so branding it... No one is bound to obey an
unconstitutional law, and no courts are bound to enforce it."-
Sixteenth American Jurisprudence, Second Edition, Section 256

  "Since an unconstitutional law is void, the general principles
follow that it imposes no duties, confers no rights, creates no
office, bestows no power or authority on anyone, affords no
protection and justifies no acts performed under it. No one is bound
to obey an unconstitutional law and no courts are bound to enforce
it. 16 Am Jur 2nd Section 177

"The claim and exercise of a constitutional right cannot be converted
into a crime. Miller v. U.S. 230 F 486 at 489"

     Governor Owen's, it has long been brought to my attention that a
certain citizen of the state of Colorado has become somewhat of
a "thorn in the side" to certain judicial and law enforcement
personnel in the Denver area as well as to many in government who
seek to usurp the Constitution of the United States of America and it
is rumored that they intend to rid this percieved menace once and for
all by sentencing him on the 10th of September, 2004 for up to 32
years in prison for the mere crime of exercising his constitutionally
guaranteed rights.  I am quite certain you are familiar with the case
since I have read many letters written to you by other concerned
citizens regarding the matter so no need for me to go into all the
details of the case again.  I really do question whether or not you
have actually recieved those letters or if they have been filtered by
someone who doesn't have your best interests in mind.  It is
posssible that someone is keeping this from you so any repercussions
will be blamed on you, thus damaging your career and credibility.  I
will post this letter publicly as a media release also to help insure
that you recieve it.  It may be that someone you know will read it
and pass it on to you and you will then act upon it before it is too
late.
      There is a great storm brewing within the patriot community
because this injustice is not only affecting the accused and his
family, it is affecting all of us who love liberty and the country
that is founded upon our Constitution and the Bill of Rights which we
all cherish.
      We are forced to obey many unconstitutional laws and we are very
tolerant of abuses compared to our forefathers and although we are
taxed far beyond what is right yet we have not revolted.  There have
been hundreds of thousands or millions of people who have been
imprisoned or fined for doing things that were once legal to do by
our forefathers and I am sure if they were alive today, many of them
also would be arrested and imprisoned.  I am quite sure they all
would have called for Revolution long before now and tar and
feathering would once again be common practice until those tyrranical
usurpers of government once again learned to fear the people.  "When

fears the people, that is liberty. - Thomas Jefferson
We, the people of the United States of America, are tired of cowering
down and being afraid of those tyrannical usurpers in government who
have trampled our Constitution under foot.  We are supposed to be a
free people yet we are forced to get licenses, permits, tags, etc.
for nearly every activity that we do or we become outlaws and are
judged and sentenced as criminals.  We suffer those abuses because
they have long been common to all of us and most people have become
accustomed to the yoke BUT what we will not tolerate is a blatant and
flagrant violation of of our rights that have
been explicitly spelled out in the Constitution and the Bill of
Rights, namely, in this case, the right to keep and bear arms.
Certainly you must agree or you wouldn't have signed SB-25 into law.
Just briefly let me go over the case so you can apply the above
quotes and judge it righteously.
We have a man, who dearly loves our country, our rights and the
constitution and has stood up in defense of them for us all.
He's a charismatic and outspoken man who was truly "born ahead of his
time".  Had he been born 150  years earlier he would surely have been
a force to be reckoned with.  I am sure you are aware of the facts
surrounding his arrest involving the wearing of firarms within the
city limits to purposefully contest the unlawful ordinance that you
helped to reverse by signing SB-25 into law.  Not only was Denver in
violation of the Constitution for the United States but also for the
Constitution for the state of Colorado.  This man was arrested and
sentenced before SB-25 was signed into law.  As the above quotes
proclaim, those laws were null and void from their inception and no
one was bound to obey them nor enforce them.  The man proceeded to go
about and live his life as those ordinances never existed and they
did, in fact, not exist.  He should never have been arrested and he
should never have been sentenced.  After you signed SB-25 into law
confirming that it is still lawful to carry a firearm in Denver, the
man was given the option to wear an ankle bracelet under house arrest
or serve the jail time that he was sentenced to.  He refused to be
humiliated by wearing what amounted to a dog collar by it's master
and demanded that the police come and get him since he would not
voluntarily submit to being caged like an animal unjustly by
appearing at the jail at the appointed time.  Many pleas we're sent
to your office, including two from me via email, but I doubt that
they even reached your desk.  I am sure that you have much more to do
as Governor than filter through thousands of emails every day and had
this case come before you I am sure that you would have acted swiftly
to grant this man his due pardon. He served his 102 days in jail and
was deprived of further rights, especially his right to liberty and
the pursuit of happiness.  His wife and children also suffered
needlessly as well as his business and his finances. I am quite sure
also  there is a multimillion dollar lawsuit that would most likely
be awarded to him if he should ever decide to press charges.  It
isn't the money that he is concerned with though, it is our rights.
He has sacrificed his own liberty for ours and we are indebted to him
for it. His sacrifice will not have been in vain, especially if he is
forced to sacrifice needlessly and without just cause any further.
This man wrote a Notice and Order to the judge via the court advising
him that if he didn't return his gun to him and drop the sentences
that he would be arrested by the Mutual Defense Pact Militia to be
tried for treason.
Below is an excerpt of the exact wording of the Order and NO WHERE in
it does it say nor imply that the man, Rick Stanley was going to have
the MDPM try and hang the judge for treason.

"Rick Stanley demands that Judge Donald W. Marshall, Jr., overturn
this conviction of Stanley on constitutional grounds.  Failure to do
so will result ina treason charge  against Donald W. Marshall, Jr.
for failure touphold the oath of office to defend the  Constitutions,
which thiscourt has on record, and Donald W. Marshall, Jr.,  swore
to, as a"condition" of his office.  This treason charge, will result
in aMutual Defense  Pact Militia warrant for Donald W. Marshall,
Jr.'sarrest if the following conditions  are not met: 1. Overturn
the unconstitutional conviction of Rick Stanley for  violation of
TRMC 38-237 because TRMC 38-237 violates the constitutional
	 rights of Rick Stanley, under the guise of "color of law."
	 2. Return the $1,500.00 bond to Rick Stanley. 3. Return
Rick Stanley's property which consists of 1 each Smith  and Wesson 6
shot .357 pistol and 6 each .357 bullets."

(1.) A treason charge was to be made by Rick Stanley   (2) This
treason charge, will result in a Mutual Defense Pact Militia warrant
for Donald W. Marshall, Jr.'s arrest if the following conditions are
not met:

That's it.  Everyone in the MDPM knows when you make a citizens
arrest you hand the criminal over to the police as soon as possible.
Of course the police would just arrest the arresting citizens and let
the judges go.  The judges jumped to the erroneous conclusion that
they were going to be hanged and took it as a threat to influence
their unconstitutional decisions.

True, the MDPM, or any citizens for that matter, can and should have
arrested those judges for treason since they have betrayed our
constitution and knowingly sentenced an innocent man to jail.  They
are guilty, Governor Owens, and I believe that they will one day be
arrested either by citizens or the police (legally) and they will
stand trial for treason and it will be in a real court of law not a
kangaroo court as in this last case where most of the jurors were
teenage girls.  There's a lot of judicial reform movements making
fast headway and things will be different in the very near future.
The usurpers of our government are not going to just sweep Rick
Stanley under the rug and think no one will notice and hope that the
activist problem will go away.  Maybe they think they will just make
an example out of him so no one will ever try to stand up in the face
of tyranny again. Wrong. It's in our blood, Governor Owens.  I am a
7th generation son of a soldier who fought in the Revolutionary War,
and I for one will do all I can to insure that what he and all our
forefathers fought, suffered and died for was not in vain.  We will
not go away.  We will not be silent and we will fight for our rights.
I have children and grandchildren and they wont go away either.
There are millions of us who are waking up from the lullaby lies of
the usurpers of our Constitution and we are beginning to unite and
come together for the aid of our country and our patriot brothers and
sisters who are being sentenced unjusdtly. There are organizations
and groups starting all over the country including one that I have
recently started thanks to those who have wrongly persecuted Rick
Stanley.  It is they who have caused to be brought into existence the
Constitutional Rights Enforcement & Support Team (C.R.E.S.T.)
Chapters will soon be springing up in every county all across the
country in defense of one another against those who would deprive us
of liberty for the sole "crime" exercising our Constitutionally

brothers and sisters are sentenced to the perils of prison life for
exercising their constitutionally guaranteed, Rights.  No Sir.  We
will not be guilty of the sin of omission.

I entreat you, Governor Owens, to please drop all charges and
sentences against Rick Stanley, for the sake of Liberty and of our
Constitution and also restore to him the things that have been taken
from him and make restitution.

Once again, it's time for the Darwin Award Nominees.
The Darwins are awarded
every year to the persons who died in the most stupid
and unusual manner,
thereby removing themselves from the gene pool.

This year's eight nominees are:

Nominee No. 1

[San Jose Mercury News] An unidentified man, using a
shotgun like a club to
break a former girlfriend's windshield, accidentally
shot himself to death
when the gun discharged, blowing a hole in his gut.

Nominee No. 2

[Kalamazoo Gazette] James Burns, 34, (a mechanic) of
Alamo, MI, was killed
in March as he was trying to repair what police
describe as a "farm-type
truck." Burns got a friend to drive the truck on a
highway while Burns hung
underneath so that he could ascertain the source of a
troubling noise.
Burns' clothes caught on something, however, and the
other man found Burns
"wrapped in the drive shaft!"

Nominee No. 3

[Hickory Daily Record] "It was supposed to be a
"jack-ass" type prank" said
Ken Charles Barger's (17), underage friends, whose
names police have
withheld because of their age. Barger accidentally
shot himself to death in
December in Newton, NC. Awakening to the sound of a
ringing telephone beside
his bed, he reached for the phone but grabbed instead
a Smith & Wesson 38
Special that was placed there by friends. The unnamed
friends of Barger
videotaped the entire ordeal. Their statement to
police read that the
intention was for their friend to "pistol whip"
himself but the loaded gun
discharged when he drew it to his ear.

Nominee No. 4

[UPI, Toronto] Police said a lawyer demonstrating the
safety of windows in a
downtown Toronto skyscraper crashed through a pane
with his shoulder and
plunged 24 floors to his death. A police spokesman
said Garry Hoy, 39, fell
into the courtyard of the Toronto Dominion Bank Tower
early Friday evening
as he was explaining the strength of the building's
windows to visiting law
students. Hoy previously had conducted demonstrations
of window strength,
according to police reports. Peter Lawson, managing
partner of the firm
Holden Day Wilson, told the Toronto Sun newspaper that
Hoy was "one of the
best and brightest" members of the 200-man
association.

Nominee No. 5

[Bloomberg News Service] Michael Van Houton (36) was
killed by his own gas
emissions in his sleep. There was no mark on his body,
and an autopsy showed
lethal amounts of methane gas in his system. His diet
had consisted
primarily of beans and cabbage, prescribed by his
doctor in an attempt to
help Van Howton lose weight. The man was shut up in
his nearly airtight 7 x
7 ft bedroom of his apartment. The apartment had no
heat, and Van Houton had
used blankets to insulate the window and door from the
inside. According to
the article, "He was a big man, nearly 650 lbs at the
time of the autopsy,
with a huge capacity for creating "this deadly gas."
Three of his rescuers
got sick, and one was hospitalized with methane
poisoning.

Nominee No. 6

[The News of the Weird] Michael Anderson Godwin had
spent several years
awaiting South Carolina's electric chair on a murder
conviction before
having his sentence reduced to life in prison. While
sitting on a metal
toilet in his cell attempting to fix his small TV set,
he bit into a wire
and was electrocuted.

Nominee No. 7

[The Indianapolis Star] A cigarette lighter may have
triggered a fatal
explosion in Dunkirk, IN. A Jay County man, using a
cigarette lighter to
check the barrel of a muzzle loader, was killed Monday
night when the weapon
discharged in his face, sheriff's investigators said.
Gregory David Pryor,
19, died in his parents' rural Dunkirk home at about
11:30 PM. Investigators
said Pryor was cleaning a 54-caliber muzzle-loader
that had not been firing
properly. He was using the lighter to look into the
barrel when the
gunpowder ignited.


Finally, THE WINNER!!!

[Arkansas] Two local men were injured when their
pickup truck left the road
and struck a tree near State Highway 38. Thurston
Poole, 33, and Billy Ray
Wallis, 38, were returning after a frog gigging trip.
Poole's pickup truck
headlights malfunctioned. The two men concluded that
the headlight fuse on
the older-model truck had burned out. As a replacement
fuse was not
available, Wallis noticed that the .22 caliber bullet
from his pistol fit
perfectly into the fuse box next to the steering-wheel
column. Upon
inserting the bullet, the headlights again began to
operate properly.  After
traveling approximately 20 miles, the bullet
apparently overheated,
discharged, and struck Poole in the testicles. The
vehicle swerved sharply
to the right, striking a tree. Poole suffered only
minor cuts and abrasions
from the accident, but will require extensive surgery
to repair the damage
to his testicles, which will never operate as
intended. Wallis sustained a
broken clavicle and was treated and released.

(Though Poole and Wallis did not die as a result of
their misadventure, as
normally required by Darwin Award Official Rules, it
can be argued that
Poole DID, in fact, effectively remove himself from
the gene pool.)

"Since I last stood in this spot, a whole new
generation of the Miller Family has been born: Four
great grandchildren. Along with all the other members
of our close-knit family, they are my and Shirley's
most precious possessions.

And I know that's how you feel about your family
also. Like you, I think of their future, the promises
and the perils they will face. Like you, I believe
that the next four years will determine what kind of
world they will grow up in. And like you, I ask which
leader is it today that has the vision, the willpower
and, yes, the backbone to best protect my family?

The clear answer to that question has placed me in
this hall with you tonight. For my family is more
important than my party. There is but one man to whom
I am willing to entrust their future and that man's
name is George Bush.

In the summer of 1940, I was an 8-year-old boy living
in a remote little Appalachian valley. Our country was
not yet at war, but even we children knew that there
were some crazy men across the ocean who would kill us
if they could. President Roosevelt, in his speech that
summer, told America "all private plans, all private
lives, have been in a sense repealed by an overriding
public danger."

In 1940, Wendell Wilkie was the Republican nominee.
And there is no better example of someone repealing
their "private plans" than this good man. He gave
Roosevelt the critical support he needed for a
peacetime draft, an unpopular idea at the time. And he
made it clear that he would rather lose the election
than make national security a partisan campaign issue.

Shortly before Wilkie died, he told a friend, that if
he could write his own epitaph and had to choose
between "here lies a president" or "here lies one who
contributed to saving freedom," he would prefer the
latter. Where are such statesmen today? Where is the
bipartisanship in this country when we need it most?

Now, while young Americans are dying in the sands of
Iraq and the mountains of Afghanistan, our nation is
being torn apart and made weaker because of the
Democrat's manic obsession to bring down our Commander
in Chief. What has happened to the party I've spent my
life working in?

I can remember when Democrats believed that it was the
duty of America to fight for freedom over tyranny. It
was Democrat President Harry Truman who pushed the Red
Army out of Iran, who came to the aid of Greece when
Communists threatened to overthrow it, who stared down
the Soviet blockade of West Berlin by flying in
supplies and saving the city.

Time after time in our history, in the face of great
danger, Democrats and Republicans worked together to
ensure that freedom would not falter. But not today.
Motivated more by partisan politics than by national
security, today's Democrat leaders see America as an
occupier, not a liberator. And nothing makes this
Marine madder than someone calling American troops
occupiers rather than liberators.

Tell that to the one-half of Europe that was freed
because Franklin Roosevelt led an army of liberators,
not occupiers. Tell that to the lower half of the
Korean Peninsula that is free because Dwight
Eisenhower
commanded an army of liberators, not occupiers. Tell
that to the half a billion men, women and children who
are free today from the Baltics to the Crimea, from
Poland to Siberia, because Ronald Reagan rebuilt a
military of liberators, not occupiers.

Never in the history of the world has any soldier
sacrificed more for the freedom and liberty of total
strangers than the American soldier. And, our soldiers
don't just give freedom abroad, they preserve it for
us here at home. For it has been said so truthfully
that it is the soldier, not the reporter, who has
given us the freedom of the press. It is the soldier,
not the poet, who has given us freedom of speech.

It is the soldier, not the agitator, who has given
us the freedom to protest. It is the soldier who
salutes the flag, serves beneath the flag, whose
coffin is draped by the flag, who gives that protester
the freedom to abuse and burn that flag.

No one should dare to even think about being the
Commander in Chief of this country if he doesn't
believe with all his heart that our soldiers are
liberators abroad and defenders of freedom at home.
But don't waste your breath telling that to the
leaders of my party today. In their warped way of
thinking America is the problem, not the solution.

They don't believe there is any real danger in the
world except that which America brings upon itself
through our clumsy and misguided foreign policy. It is
not their patriotism -- it is their judgment that has
been so sorely lacking. They claimed Carter's pacifism
would lead to peace. They were wrong.

They claimed Reagan's defense buildup would lead to
war. They were wrong. And, no pair has been more
wrong, more loudly, more often than the two
Senators from Massachusetts, Ted Kennedy and John
Kerry.

Together, Kennedy/Kerry have opposed the very weapons
system that won the Cold War and that is now winning
the War on Terror. Listing all the weapon systems that
Senator Kerry tried his best to shut down sounds like
an auctioneer selling off our national security but
Americans need to know the facts.

The B-1 bomber, that Senator Kerry opposed, dropped
40 percent of the bombs in the first six months of
Operation Enduring Freedom. The B-2 bomber, that
Senator Kerry opposed, delivered air strikes against
the Taliban in Afghanistan and Hussein's command post
in Iraq. The F-14A Tomcats, that Senator Kerry
opposed, shot down Khadifi's Libyan MIGs over the Gulf
of Sidra. The modernized F-14D, that Senator Kerry
opposed, delivered missile strikes against Tora Bora.
The Apache helicopter, that Senator Kerry opposed,
took out those Republican Guard tanks in Kuwait in the
Gulf War. The F-15 Eagles, that Senator Kerry opposed,
flew cover over our Nation's Capital and this very
city after 9/11.

I could go on and on and on: against the Patriot
Missile that shot down Saddam Hussein's scud missiles
over Israel; against the Aegis air-defense cruiser;
against the Strategic Defense Initiative; against the
Trident missile; against, against, against. This is
the man who wants to be the  Commander in Chief of our
US Armed Forces? US forces armed with what? Spitballs?

Twenty years of votes can tell you much more about a
man than twenty weeks of campaign rhetoric. Campaign
talk tells people who you want them to think you are.
How you vote tells people who you really are deep
inside.

Senator Kerry has made it clear that he would use
military force only if approved by the United Nations.
Kerry would let Paris decide when America needs
defending. I want Bush to decide.

John Kerry, who says he doesn't like outsourcing,
wants to outsource our national security. That's the
most dangerous outsourcing of all. This politician
wants to be leader of the free world.
Free for how long?

For more than 20 years, on every one of the great
issues of freedom and security, John Kerry has been
more wrong, more weak and more wobbly than any other
national figure. As a war protester, Kerry blamed our
military. As a Senator, he voted to weaken our
military. And nothing shows that more sadly and more
clearly than his vote this year to deny protective
armor for our troops in harms way, far away.

George Bush understands that we need new strategies to
meet new threats. John Kerry wants to re-fight
yesterday's war. George Bush believes we have to fight
today's war and be ready for tomorrow's challenges.
George Bush is committed to providing the kind of
forces it takes to root out terrorists. No matter what
spider hole they may hide in or what rock they crawl
under. George Bush wants to grab terrorists by the
throat and not let them go to get a better grip.

From John Kerry, they get a "yes-no-maybe" bowl of
mush that can only encourage our enemies and confuse
our friends. I first got to know George Bush when we
served as governors together. I admire this man. I am
moved by the respect he shows the first lady, his
unabashed love for his parents and his daughters, and
the fact that he is unashamed of his belief that God
is not indifferent to America.

I can identify with someone who has lived that line in
"Amazing Grace," "Was blind, but now I see," and I
like the fact that he's the same man on Saturday night
that he is on Sunday morning. He is not a slick talker
but he is a straight shooter and, where I come from,
deeds mean a lot more than words.

I have knocked on the door of this man's soul and
found someone home, a God-fearing man with a good
heart and a spine of tempered steel. The man I trust
to protect my most precious possession: my family.
This election will change forever the course of
history, and that's not any history. It's our family's
history. The only question is how. The answer lies
with
each of us. And, like many generations before us,
we've got some hard choosing to do.

Right now the world just cannot afford an indecisive
America. Fainthearted self-indulgence will put at risk
all we care about in this world. In this hour of
danger our President has had the courage to stand up.
And this Democrat is proud to stand up with him.

Thank you. God Bless this great Country, and God
Bless George W. Bush.

Although I do not live in Florida now, I was raised down there.
Given the rapid population growth of the state, many of the people
there are newcomers. They may not be familiar with some of the
history of the areas in which they live.

Back in the 1920's the population of south Florida was almost
nonexistent. Nevertheless, when a major hurricane came through, it
made news throughout the nation at that time. Over 2,000 people were
killed. The mechanism responsible for the majority of the deaths was
that the storm was powerful enough to create storm tides that
literally moved Lake Okeechobee. Several of the small communities
surrounding Lake Okeechobee were wiped off the map as a result. For
some time after that Congress considered passing legislation banning
people from living in that area.

That legislation never passed. What they did instead in the
1930's was that they built a system of dykes to contain Lake
Okeechobee.

Well, it is now 2004. I honestly do not know how well that dyke
system has been maintained. Obviously there are thousands if not
tens of thousands more people living close to Lake Okeechobee than
there were in the 1920's. My concern is that if Frances comes close
enough to Lake Okeechobee it is possible that the dyke system could
fail in sections. In which case the potential for loss of life would
be high. So, my advice is that if you live close to Lake Okeechobee
you should seriously consider evacuating.

All summer long, federal courts across the country
have been issuing a series of unusual rulings, little
noticed outside of the marbled courthouses but
ominously reverberating within them.


A federal judge in San Antonio handed down not one but
three alternative sentences to a defendant in a drug
case. Another federal judge in West Virginia sentenced
a convicted drug conspirator to just 1 year in prison
instead of the 20 years he might ordinarily have
received. Many other judges have simply stopped
sentencing convicts at all, postponing their cases for
months on end.


The disruptions in what would otherwise have been
routine sentencing decisions are ripple effects from a
U.S. Supreme Court (news - web sites) decision in June
that has so confounded the federal judiciary that the
high court, making an unusually rapid course
correction, has agreed to clarify itself when it
reconvenes in October.


In the case, Blakely vs. Washington, the Supreme Court
ruled 5-4 that it was a violation of the 6th Amendment
right to a jury trial for state judges to base their
sentencing decisions on any facts that had not been
weighed by a jury or established by a guilty plea.


That judicial practice had been routine under the
state's sentencing guidelines, which provided a
standardized formula by which a judge would add to or
subtract from a defendant's sentence according to a
series of aggravating or mitigating factors that the
jury that convicted him had never heard.


Dilemma for federal courts


The problem for the federal courts is that the
Washington state sentencing system closely resembles
the sentencing guidelines that have been used to
determine penalties in federal courts since the 1980s.
The Supreme Court did not directly rule whether the
Blakely decision should apply to the federal system as
well--an omission that has led to a series of
conflicting rulings in federal district and appellate
courts regarding the constitutionality of the federal
guidelines.


Even more alarming to some legal experts who fear the
judicial disruptions that could result, the Blakely
decision could open new avenues of appeal to thousands
of convicts currently serving federal sentences across
the country.


"We've seen a stunning amount of disruptions to both
federal and state sentencing practices," said Douglas
Berman, a professor at Ohio State University's law
school and an expert on federal sentencing. "Having
the rules so unclear creates an inability to sort of
move on with life. We're in a period of suspended
animation."


The uncertainty roiling the federal courts was
predicted by Supreme Court Justice Sandra Day O'Connor
(news - web sites) in her dissenting opinion in the
Blakely case.


"What I have feared most has now come to pass,"
O'Connor wrote. "Over 20 years of sentencing reform
are all but lost and tens of thousands of criminal
judgments are in jeopardy."


Earlier this month, the Supreme Court responded to the
confusion by agreeing to hear two cases on an
expedited basis in October that test whether the
Blakely decision ought to apply to the federal
sentencing guidelines.


The federal system, established in 1984, sought to
impose some uniformity in sentences meted out by
judges across the country, although it quickly proved
unpopular with some constituencies. Judges, accustomed
to exercising their own discretion in setting
sentences between the minimums and maximums specified
in the law, maintained that the sentencing formulas
were too rigid and deprived them of flexibility.
Defense attorneys argued that the system resulted in
overly harsh punishments and gave prosecutors unfair
leverage to pressure defendants into plea bargains.


The problem cited by the Supreme Court is that the
sentencing guidelines kick in only after a jury has
delivered its guilty verdict. Under the system, a
judge completes a lengthy worksheet that assigns
"points" to such factors as a defendant's criminal
history, whether a gun was used and, in drug cases,
the quantities of drugs involved--facts that may not
have been part of the original charges considered by
the jury. The judge then consults a sentencing table
and increases or decreases the sentence according to
how many points are tallied.


The Supreme Court ruled that it is unconstitutional
for a judge to increase a sentence on the basis of any
fact not previously considered by the convicting jury.



Rules left in limbo


With the federal sentencing guidelines now in limbo,
courts have been scrambling to find their way.





To the chagrin of federal prosecutors, some judges
have been handing out only the statutory minimum
sentence for each offense, fearing that anything
greater could be subject to reversal once the Supreme
Court clarifies the rules. That's what happened, for
example, in the case of a North Carolina farmer who
drove his tractor onto the National Mall in
Washington, D.C., and threatened to set off a bomb in
2003. Citing the Blakely ruling, a judge sentenced him
to time served and ordered him freed.

"A lot of prosecutors are wringing their hands because
they can't abide the fact that they now have to
bargain sentences down to levels that make some
sense," said Tom Hillier, a federal public defender in
Seattle. "Blakely speaks to an important principle,
which is that you shouldn't send people to prison
unless the facts are proven beyond a reasonable
doubt."

Some federal prosecutors have been trying to pre-empt
Blakely-related appeals by adjusting existing
indictments to include the additional aggravating
factors they want judges to consider when imposing
sentences. That approach adds to prosecutors' burdens,
because they must prove the aggravating factors beyond
a reasonable doubt, but it also avoids Blakely-type
problems because a jury will have considered all the
relevant facts upon which a sentence will be based.

Relying on loopholes

In other cases, prosecutors are relying on what
appears to be a loophole in the Blakely decision. In a
July memorandum, Deputy Atty. Gen. James Comey urged
all federal prosecutors to recommend to judges that
they use their discretion, rather than the guidelines
formula, to impose sentences similar to what the
guidelines would have called for.

"The sentencing courts then can, as a matter of
discretion, consider the same factors that the
guidelines make relevant to sentencing," Comey wrote.

"Blakely says that even though judges can't do this
under the guidelines, they can use the functional
equivalent using their discretion," said Ohio State's
Berman. "I'm seeing a number of judges doing that,
saying, `Here's what I'd do under the guidelines,
here's what I'd do using my discretion,' and it's
basically the same thing.

"If you connect all the legal dots, that seems to be
technically right," Berman added. "But how can it be
that Blakely stands for the proposition that if you
can't do it one way, you can wave your magic wand and
do it another way?"

The answer to that question, and many others, awaits
the Supreme Court's clarification.

"Once this all shakes out, there could be an enormous
amount of do-over work that has to be handled," said
Steven Chanenson, a Villanova University law professor
and former federal prosecutor. "The courts have
settled into how they are going to muddle through for
the time being. But no matter how the Supreme Court
rules, it's guaranteed that some of the muddling
through will be wrong."

The federal plans have been long-awaited by flu
specialists, who say it's only a matter of time before
the next pandemic strikes and the nation is woefully
unprepared.


There have been three flu pandemics in the last
century, the worst in 1918, when more than half a
million Americans and 20 million people worldwide
died.
