It is understood that a similar action is underway in the UK also.

It is distressing for both children and 'father' when a mother acts in this
way to satisfy herself and to deceive.  Such action in women is no less
wrong than that by men and should be treated as such.  Women should not be
permitted to hide behind the children.

Ex-wife sued in fatherhood row

A precedent-setting damages case, by a man suing his former wife over the
alleged illegitimacy of her children, will go ahead in Melbourne.

The man claims DNA tests have proven two of the woman's children, for whom
he had paid years of child support, were fathered by another man.

He has filed documents with the County Court alleging fraud and is suing
his former spouse for a figure believed to be about $400,000.

He claims loss of money through child support and anxiety and depression
after allegedly discovering the children were not his.

The pre-teen children are aware of the dispute and have received counselling.

The man faced a childcare bill of $178,063 from 1992 until this year and
had paid $30,388 before discontinuing his support.

The court documents call for the woman to outline any sexual relationships
she had with men outside the marriage in the period when both children were
conceived.

The woman has also been asked to disclose when and how she realised the
children were not her husband's.

The couple were married in 1988 and in 1990 a boy was born, followed by a
girl in 1991.

The man claims that at all times his then wife was aware the children were
not his.

In the documents, the man has asked his former wife about statements she
allegedly made after the births, which led him to believe the children were
his.

The documents also seek her comment on the development of the children's
facial features which were said to be inconsistent with his own.

The name of a second man is included in the documents, with allegations he
is the real father of the children.

Access is also sought to a diary the woman may have kept, in which an
admission about the real father might have been made.

Melbourne DNA specialists have said up to 30 per cent of men seeking DNA
tests for paternity, because of suspected infidelity, are found not to be
the biological fathers of the children they support.

A three-day civil trial in the County Court at Melbourne has been set down
for April next year.

his ex for deception. The story also ran on Current Affairs (TV) and the
women's (aka feminist) groups were of the opinion that the action taken
should be "in the children's interest", ie. if the "father" paid
maintenance and participated as a "father figure" then he should still be

Husband in $400,000 lawsuit over DNA tests

A Melbourne man is suing his former wife after DNA tests indicated he was
not the father of two children he has supported for almost eight years.

In the landmark case, believed to be the first in Australia, the man is
seeking $400,000 for the mental anguish he suffered believing the
10-year-old boy and nine-year-old girl were his children. The case comes as
the The Advertiser can reveal up to 30 per cent of men seeking paternity
tests are proven to be not the biological fathers of children they are
supporting.

Liam, who had been paying child support since about 1992, is suing his
former wife Meredith for fraud. To protect the children, The Advertiser is
not revealing their surnames. The law suit is outlining loss of earnings,
loss of use of the money spent, anxiety and depression.

In a separate claim for "disregard to the plaintiff's rights" Liam also
seeks exemplary damages. "At all material times, the defendant (mother) was
aware, and the fact was that the plaintiff (father) was not the father,"
says a writ lodged at the Melbourne County Court.

The writ claims Liam believed he was the father of the two children since
their conception and has suffered "severe anxiety and depression" since
discovering he was not their father.

It claims Meredith told him he was the children's father when she became
pregnant in 1990 and 1991.

He's not your father

The children caught in a landmark paternity suit have been told the awful
truth - dad is not their real father.

Their mother is being sued for allegedly lying when she told her then
husband that he fathered the children.

And now the real father allegedly refuses to undergo a paternity test to
confirm what the mother, Meredith, says is the truth.

Meredith faces a $400,000 fraud action initiated. by angry ex-husband Liam
who paid child support for about eight years..

The case, revealed in yesterday's Herald Sun, is believed to be the first
of its type in Australia.

The Herald Sun is not revealing surnames to protect the children.

Meredith said her children's real father could be only one other man, Mr X,
but he had now distanced himself from what remained of the family.

Liam, Meredith and the children had DNA tests that in March last year ruled
out the nine-year-old girl and the 10-year old boy as the biological
offspring of Liam

"I wanted to know as well, it has been a horrible thing to have hanging
over your head," Meredith said yesterday.

In breaking her silence on the case, Meredith said she previously suspected
one of the children was not Liam's.

"In 1995 I him I didn't believe one of the children was his," she said At
birth, their blond hair and blue eyes gave no reason to doubt Liam was the
father of the two babies, but as they grew into toddlers facial features
not consistent with Liam became apparent, Meredith said.

Despite her infidelity, Meredith said she had "not intentionally" deceived
Liam. "I did apologise," she said

Meredith said the children were told the purpose of the DNA tests when they
were carried out.

They have since undergone counselling.

DNA has families under analysis

For years, children have been the meat in the Family Court sandwich as
parents fight each other over custody and child support.

This week we've seen that theme turned on its head as a man launched County
Court civil action against his former wife over children who are not his.

In the landmark case, the Melbourne man is suing for alleged fraud,
claiming his ex-wife led him to believe - for almost eight years - that two
of her children were his.

Legal experts say the foray into the civil courts could lead to infidelity
suits, where one partner sues another for being unfaithful - bringing the
biblical crime of adultery into the courts as a "breach of contract".

Family law expert Annemaree Lanteri said it was a reversal of the
traditional Family Court conflicts.

"These are cases of people saying they no longer want anything to do with
the children because they are not mine," she said.

Victorian Bar Council family division chair Noel Ackman, QC, saw no reason
why unfaithfulness could not lead to further law suits.

"If a cause of action could be found under civil law provisions, a breach
of contract, the court of civil jurisdiction might arguably entertain such
a matter," he said.

DNA tests, the new miracle tool used to uncover truth in courts, has in the
present case found the man is not the father of the pre-teen children he
thought were his.

After paying child support for the best part of a decade, he wants his
former wife to pay $400,000 for the mental anguish and depression he claims
to have suffered since learning of her unfaithfulness and the children's
illegitimacy.

The mother admits the children are not his and says they could have been
fathered by only one other man. But that man, Mr X, refuses to take a
paternity test to confirm the woman's belief.

Her children have had counselling and are left without the father they once
had or the father they should have known.

DNA experts say 10 per cent of men in the wider community are unknowingly
acting as fathers to illegitimate children. And up to 30 per cent of those
who have DNA tests have their suspicions of illegitimacy validated.

The issue looms as a huge minefield for litigation.

The Melbourne test case, believed to be the first in Australian legal
history, looks set to open the floodgates for spouse suing spouse over
fraud-related relationship allegations.

Although damage claims for adultery have been ruled out by the 1976 Family
Law Act, the potential for such suits in other civil jurisdictions has not
been fully tested, Ms Lanteri says.

The power of DNA testing is already having a huge effect on settling child
support liabilities and Australian Family Association secretary Bill
Muehlenberg says it could become a big factor in regulating sexual
promiscuity.

Casual sex outside marriage or de facto partnerships threatens to become a
bio-legal danger.

Do-it-yourself DNA test kits are available on the Internet and with the
huge growth in divorce, more and more men, and women, are seeking the truth
about lineage.

About 3000 paternity tests, mainly to establish child support liability,
are carried out in Australia each year.

Those tests confirm up to 900 men are fathers to children who are not
biologically theirs.

There are 470,000 children on child support; potentially 47,000 children
who do not know their real father.

"There are pros and cons," Mr Muehlenberg said. "On the one hand, you could
say DNA is good to ensure honesty.

"The sexual revolution, launched about 30 years ago, has tended to be
something for the benefit of men.

"DNA testing may at least make men and women more accountable and responsible.

"In the past, men could basically love women and leave them - DNA testing
can tie them down. Whether it will slow things in terms of promiscuity or
infidelity is hard to tell.

"But it raises some bigger, more fundamental questions.

"At the moment, marriage is probably one of the most easily broken
contracts we have; it is harder to get fired from a job."

M R Muehlenberg said the advent of "no-fault" divorce was being readdressed
in the UK and the US.

It was only a matter of time until Australian law turned again, with the
DNA weapon, to assign some responsibility to marriage breakdown.

"There is a swing back on to more obligations, legally, in marriage," Mr
Muehlenberg said.

But, Ms Lanteri warned, before we got caught in punitive rewards and legal
remedies in court, it was important not to forget the children and the
impact judicial action had on them.

"The child has only ever known one person as the father, who treated them
as their father," she said.

"To wake up one morning and find themselves rejected through no fault of
their own is very hard.

"It's too easy to lose sight of the impact this has on the children.

"It is a very devastating thing, if the person they think is their father
just stops loving them."

Sadly, the true father is often either never known or does not want a
relationship with a child born some years before and raised by another man.

Ms Lanteri said some men, after discovering a child is not theirs, want to
continue a relationship with the child but are prevented from doing so by
the mother.

After reporting the case on Tuesday, the Herald Sun has received calls from
at least three other men willing to pursue similar actions.

Ms Lanteri also expects the Melbourne case to invite a rash of others.

"They might think it's worth a try," she said. "And I think the possibility
of getting back not just the money they paid (to support a child) but
something on top of that might be of interest to a lot of people."

  I noticed the Maury Povich Show was having men and mothers on and showing
  the results of DNA testing to prove or disprove paternity.

  One woman I saw, who claimed this man was the father, was proved wrong.
  Maury kept asking her if she wanted to apologize to the man and she said
"No."  She went into an all-too-typical female rambling maze of circular
  logic that he should take care of this child.

I am a victim of paternity fraud.  The local AFDC office has even been
notified of this.  My wife(now) had this to say to them.  "You mean to tell
me you people have the power to drag a man into court  without even knowing
if he is the real father or not.  Take every penny the man works out for
childsupport.  Then when you find out he's the real father you will do
nothing about it?!"  The woman said, "Yes."  That is what I'm dealing with.  
I am paying childsupport for two children.  The oldest child is not mine. 

 
Yet I'm paying.  Because I refused to pay childsupport because my ex-wife
would not have the children there at home to pick them up..the court decided
I could have visitation with my children (child) at McDonalds every other
weekend for 2 hours and my ex-wife can have 183.00 of my check a WEEK!

 

I don't have the money to get a lawyer and fight, pay for DNA testing.  The
judge put me where he wanted me.  In the poor house so I couldn't fight him.

      OKLAHOMA CITY -- A state lawmaker announced this week the
    Legislature will address concerns about the statute of
   limitations on DNA related cases.
         Rep. Jari Askins, D-Duncan, has proposed changes to the
   current statute of limitations regarding cases involving
   genetic evidence.  "DNA testing has evolved in criminal
   investigation, allowing evidence to be presented long after the
   statute of limitations has run out."
         Jeffrey Todd Pierce was released from state prison in May
   after serving 15 years for a 1986 rape conviction. A DNA test
   of semen recovered from the victim exonerated Pierce.

    Recently, evidence from his case matched a DNA profile in the
   state's convicted offender database with a different unnamed
   inmate.
         "The Pierce case is a perfect example of why the laws
   need to be adjusted," Askins said.  "Under existing law, the
   statute of limitations for prosecution of a new suspect may
   have passed many years earlier."
       The current statute of limitations in rape cases is seven
   years.
         Askins, a former special district judge from Stephens
   County, recommends the Legislature lengthen the current time
   frame on limitations or specify criteria in which exceptions
   can be made.
         "With recent developments in the state concerning DNA
   testing, it is important we create laws that without a doubt
   protect the innocent," she said. "However, we must alter any
   law that shields criminals from being prosecuted for their
   actions."

   "Fighting For Fatherhood"

   Andrew Bowey and Carnell Smith have never met in
   person.  They're two men who have perhaps heard of
   each other's fight for fatherhood through the media or
   supporters.  They're two men who love their children
   like I have never seen fatherly love expressed before,
   save the love my own father has for me. And they're
   two men whose courage and compassion for justice is
   unmatched.

   But here's the rub: what will Georgia do for these
   fathers and their children?  Anything?  Nothing?
   Something? Andrew Bowey and Carnell Smith may be
   immersed in what are now high profile cases, but the
   circumstances they started from are as routine as a
   good majority of us watching the Braves on the tube.

   Let's take a look.

   Andrew Bowey comes home one day to find wife and
   children gone.  A note is not left, no message on the
   answering machine.  Days later, the truth comes out.
   Frederique Bowey abducted the children to her native
   France.  The Bowey's had contemplated divorce, but no
   final court orders were in place. The mother stole the
   children.  The father is invited to France months
   later and brings the children back to Georgia where
   they live.  The father is arrested like a drug kingpin
   for a charge of kidnapping his own children.  The
   father is still under house arrest provisions despite
   the fact a Cobb Superior Court judge gave him custody
   of the children weeks ago.  Meanwhile, the mother came
   back to this country since leaving on that one day
   once to have a judge give her custody while the father
   remained in jail.  The judge told her to not leave
   with the children to France.  She did. Amazingly, it
   is he who now awaits a federal extradition hearing on
   April 16th in Atlanta to face kidnapping charges filed
   by the French government.  What are we going to do to
   help Andrew Bowey and the children he has custody of,
   but are still living in France with a mother who is in
   contempt of our court's laws?

   Carnell Smith is a loving father who is the victim of
   an incredible crime: paternity fraud.  He raised a
   child for years paying financial and emotional support
   without question because he of course believed the
   mother who told him he was a father.  A wonderful bond
   was in place, happy family.  Then, doubts arise and a
   DNA test is taken.  Carnell Smith is not the father,
   and the mother knew it.  Devastation.  Heartache.
   What to do about a felony?  What to do for Carnell and
   his present family who between paying child support
   and attorney fees are looking at six figure financial
   ruin? His paternity fraud case goes to trial on April
   16th in Dekalb county.

   Believe it or not, Carnell Smith stepped up and formed
   Citizens Against Patenity Fraud and went on a
   political warpath this last legislative session.  What
   happened?  The house of representatives approved a
   paternity fraud bill (HB369) by a vote of 163-0, but
   Sen. Tanksley stalled this bill, instead passing House
   Bill 130 which allows DNA testing on the deceased. So,
   in Georgia there is no relief financially if you're
   not daddy, and there is no relief if you are wrongly
   charged with kidnapping your own children.  Are we
   living in America or not?

   How much longer are we going to stand by and watch
   these fathers lose everything?

"Let's Talk About Paternity Fraud"

   It was the late novelist-philosopher Ayn Rand who said
   in so many words, that in a truly free society, there
   can be no unchosen obligations. This acute
   observation is indeed timeless. Taking responsibility
   for one's own chosen actions is one thing, and the
   right thing to do. Taking responsibility for actions
   that are not chosen or your own is quite another. I
   believe the words I'm looking for are the following:
   involuntary servitude.

   America, it's time to talk about paternity fraud.

   We seem to waste a lot of valuable opportunities to
   learn from one another by talking about things that
   are pointless. I'm not just talking about silly small
   talk and senseless gossip. We seem to have a love for
   the obvious, comfortable, and non-controversial.

   But what in the world do you tell a man who has paid
   financial and emotional child support for years upon
   learning he's---not the daddy? Not by a DNA long
   shot. The word "sorry" won't cut it, neither will
   "look at the support you gave as a gift." Try again.
   We need to do much more for all of America's paternity
   fraud victims.

   So what's being done?

   Ohio, Texas, Colorado and several other states have
   paternity fraud legislation in the books/works. These
   states recognize the simple truth that if a woman
   knowingly tells the wrong man he's the father, fraud
   has been committed and a family will eventually fall
   to ruin. How does a child benefit when he learns the
   dad he knows is not "biologically" his own? Doesn't
   the child deserve the truth? Why isn't paternity fraud
   taken more seriously?

   The numbers are almost surreal. Go to any DNA lab and
   you will learn that 30 percent of the fathers tested,
   thought to answer the question: "whose your daddy?",
   are in fact, not daddy. We get back to a common
   excuse for the mothers who have lied to both men and
   children. Well, won't the children suffer more when
   they learn the truth? I, and thousands of paternity
   fraud victims state the truth is always what matters,
   and it is not truthfulness in action when men accross
   this country pay weekly child support for some other
   man's children he's not paying child support for.
   Perhaps the mothers who chose to engage in paternity
   fraud knew the real daddy made less money. What a
   country. What are we going to do?

   In Georgia, the issue of paternity fraud has taken
   center stage thanks to the tireless work of a
   paternity fraud victim by the name of Carnell Smith.
   Smith spearheads an organization which is called
   Citizens Against Paternity Fraud. The website can be
   accessed by going to www.stop.paternityfraud.com
   Georgia's House of Representatives recently passed
   paternity fraud legislation lobbied for by Smith and
   others by a vote of 163-0. Sounds like the state that
   can change it's own flag can do something about
   horrific fraud, right?

   Wrong. When the bill was presented to Sen. Charles
   Tanksley, Chairman of the Senate Judiciary Committee,
   he stalled and did not call for a vote. This, despite
   HB369 flying through the House of Representatives
   163-0. Instead, Sen. Tanksley called for a vote on
   HB130 which allowed DNA testing---on the deceased.

  So, in Georgia, we the living are not allowed to be
   free of paternity fraud via DNA testing. Undaunted,
   Carnell Smith and his supporters are keeping up the
   fight because paternity fraud has unbelievable
   consequences for America's families.

   America's families have plenty of challenges to deal
   with every day of the week. We don't really think that
   it's an unfair expectation to know that the man you
   call dad every day is really yours for keeps, do we?

   Paternity fraud is a crime, and crime shouldn't pay.

  When I heard this story on the radio, I had difficulty believing my
ears.

A guy is being forced to pay for another man's child even although DNA

has conclusively proven that he is not the father.!!!???!!!

Give me a break here. If we expect men to behave like gentlemen, women
ought to behave like ladies, not whores.

What next? Some jerk gets his mistress pregnant and Georgia and
Massachusetts courts insist that  his wife pay child support and babysit the
kid?

To lie and cheat and steal and then to be aided and abetted in the criminal
extortion  of your victim  by US courts is unconscionable and a total
travesty
of justice. If anyone should be censured by the courts it's these pathetic
examples of womanhood.

I will send letters criticizing these verdicts to both these states. Either
we get
laws passed clearly stating that child support can not be ordered from
anyone who is not the proven father or this one needs to go to the Supreme
Court. Isn't the ACLU involved? Plainly,these men's civil liberties are
being infringed.

PLUO - Pathological Liar Under Oath

 

Once again this comes across my desk. It is times like these that we
all
need to remember who true Americans are and WHO ARE NOT..

   This is for all the kids born in the 70's who do not remember  this,
and didn't have to bear the burden, that our fathers, mothers, and
older brothers  and sisters had to bear.  Jane Fonda is being honored
as
one of the "100 Women of the  Century."  Unfortunately, many have
forgotten and still countless others have never known how Ms. Fonda
betrayed not only the idea of our country but  specific  men who
served
and sacrificed during Vietnam.
  The first part of this is from an F-4E pilot. The pilot's name is
Jerry  Driscoll, a River Rat. In 1968, he was a  POW  in Ho Lo
Prison -
the "Hanoi Hilton." Dragged from a stinking  cesspit of  a cell,
cleaned, fed, and dressed in clean PJs, he was ordered to  describe
for
a visiting American "Peace Activist" the "lenient and humane
treatment"
he'd  received. He spat at Ms. Fonda, was clubbed, and dragged  away.
During the subsequent beating, he fell forward upon the camp
Commandant's  feet, which sent that officer berserk. In '78, the AF
Col.
still  suffered  from double  vision (which permanently ended his
flying
days) from the  Vietnamese Col.'s  frenzied application of a wooden
baton.
From 1963-65, Col. Larry Carrigan was in the 47FW/DO (F-4Es). He
spent
6  -years in the "Hilton"- the first three of which he was "missing
in
action".  His wife lived on faith that he was still alive. His group,
too,  got the cleaned/fed/clothed routine in preparation for a "peace
delegation" visit.  They, however, had time and devised a plan to get
word to the world that they were still alive. Each man secreted a tiny
piece of paper, with his SSN on it, in the palm of  his hand.  When
paraded before Ms. Fonda and a cameraman, she walked the line, shaking
each man's hand.  Believing this HAD to be an act, they each palmed
her
their sliver of paper. She took them all without missing a beat. At
the
end of the line and once the  camera stopped rolling, to the shocked
disbelief of the POWs, she  turned to  the officer  in charge and
handed
him the little pile of papers. Three men died  from the subsequent
beatings. Col. Carrigan was almost number four but he survived,  which
is the only reason we know about her actions that day.
I was a civilian economic development advisor in Vietnam, and was
captured by  the North Vietnamese communists in South Vietnam in 1968,
and held  for over 5 years. I spent 27 months in solitary confinement,
one year in a cage in Cambodia, and one year in a "black box" in
Hanoi.
My North Vietnamese captors  deliberately poisoned and murdered a
female
missionary, a nurse in a  leprosarium in Ban me Thuot, South Vietnam,
whom I buried in the jungle near the Cambodian border. At one time, I
was weighing approximately 90 lbs. (My normal  weight is 170 lbs.) We
were Jane Fonda's "war criminals."  When Jane Fonda was in Hanoi, I
was
asked by the camp communist political  officer if I would be willing
to
meet with Jane Fonda. I said yes, for I would like to tell her about
the
real treatment we POWs  received different from the treatment
purported
by the North  Vietnamese, and  parroted by Jane Fonda, as "humane and
lenient." Because of this,  I spent  three days on a rocky floor on my
knees with outstretched arms with a large amount of steel placed on my
hands, and beaten with a bamboo cane  till my  arms dipped.
I had the opportunity to meet with Jane Fonda for a couple of  hours
after I  was released. I asked her if she would be willing to debate
me
on  TV. She did  not answer me.  This does not exemplify someone who
should be honored as part  of "100 Years  of Great Women." Lest we
forget..."100 years of great women"  should never  include a traitor
whose hands are covered with the blood of so  many patriots.  There
are
few things I have strong visceral reactions to, but  Hanoi Jane's
participation in blatant treason is one of them.  Please take the time
to forward to as many people as you possibly  can. It  will eventually
end up on her computer and she needs to know that  we will never
forget.

We must warn all of the Men in the US Military about the War against
paternity fraud before they are deployed to War. If not many of them
will come home to another WAR, that Uncle Sam will help the
enemy "rob him & beat him to the curb".

The family court said these men should pay the fraud moms for her
infidelity even after DNA tests proved the men had NOT fathered any
of the kids. One of the men is a paternity fraud victim, he was NOT
told who his real father was and later he enlisted in the Army to
find his dad in Vietnam. What happened?
