Mental health charity Rethink has expressed its disappointment following the government's decision not to introduce a clause in the Equality Bill to stop employers asking job applicants about their medical history before deciding whether to invite them for interview.

After years of campaigning, Rethink was hopeful in July when the Solicitor General Vera Baird indicated that the government might introduce a clause to the Equality Bill which would ban employers from asking job applicants about their health history until after a job offer has been made. However, government amendments published show there is no commitment to following through and ending this discriminatory employment practice which deters so many people with mental health problems from applying for jobs.

Under the current system, employers can ask job applicants whether they have a medical condition or disability before deciding whether to invite them for interview. This has led to shocking discrimination towards people with "invisible" health conditions such as mental health problems. In the United States and a significant number of EU member states it is against the law to ask pre-interview health questions.

Paul Corry, Rethink's director of public affairs, said:

"The government's decision not to introduce the amendment is a massive disappointment not only for Rethink but for the thousands of people who have experienced mental health problems and who want to work. Job applicants with a history of mental illness will have little choice but to continue to lie about their health on application forms just to get an interview.

"Employer discrimination is a real problem. People with mental illness can have fulfilling careers and be an asset to any organisation yet too many employers are unable to see past their own prejudice. By failing to address this in the Equality Bill, the government has condemned job candidates to a future where they will continue to be judged on their diagnosis, not their ability."

Research shows that one in ten employers has withdrawn a job offer from someone who lied about their health on their job application, and seven per cent of employers have dismissed an employee for this reason. However, many of Rethink's members say that being honest about their mental health history on a job application form is tantamount to writing themselves out of the job.

Andy Harley, 36, was a successful banking analyst before he became ill with depression. He says:

"I had worked in a bank for years and everything was going really well but then depression struck and I had to take almost a year off. Fully recovered and ready for work, I found that organisations didn't want me. I was honest and ticked the box on application forms that asked about mental illness. It took two years and more than 150 applications to finally get a job at a much lower grade than my qualifications and capabilities."

Catholic Church asks Garda to examine if clerical child sex ring existed

The archbishop of Dublin Diarmuid Martin has asked the Garda to investigate whether a clerical paedophile ring was operating in the archdiocese.

Dr Diarmuid Martin made the request to the National Bureau of Criminal Investigations after he examined files on paedophile priests in recent years. He was disturbed by close connections between a number of clerics who were later convicted of child abuse, according to sources, and asked gardai to investigate.

The priests included Fr Bill |Carney and Fr Francis McCarthy, neither of whom are any longer in the priesthood, and Fr Patrick Maguire, a Columban priest who is living under the strict supervision of his order. The three are among 46 priests named in the damning report by Judge Yvonne Murphy which found "no direct evidence" of a paedophile ring, but found "worrying connections" between a number of priests.

Fr Carney and Fr McCarthy worked together to prey on vulnerable children, visiting them in children's homes and, in at least one instance, abused the same child. Fr Carney and Fr Maguire brought children on swimming excursions together. Fr Carney also claimed that Fr Maguire could vouch for him when he was under investigation for abusing some of those children.

Fr Dominic Savio Boland, whose real name is John Boland, called to the home of a child who had been abused by another priest, Fr Ioannes, and proceeded to abuse the child himself.

"There is nothing in the evidence available to the commission to show how Fr Boland became aware of this young boy," the report said.

Profiteering pharmacists, hospitals and wholesalers are putting British patients' lives at risk by selling prescription drugs, intended for the UK, to customers in Europe.

Nearly 50 drugs needed by patients, with conditions ranging from breast cancer and Parkinson's disease to depression and epilepsy, are in short supply because traders are selling the drugs for higher prices overseas in a trade worth at least £360m a year.

The medicines and healthcare regulator, the MHRA, is set to write to all drug manufacturers and wholesale licence holders warning them they could face legal action if caught exporting drugs needed by British patients. The move follows recent guidance issued by the Department of Health, regulators and professional bodies to "remind" all potential traders of their legal obligations to prioritise UK patients before profit.

Last week, MPs were told that between 300 and 500 worried patients are calling drug companies because they cannot get their medication.

Pharmacists and patient groups warn "it is only a matter of time before a patient suffers serious harm" unless the whole industry accepts responsibility and starts putting patients first. Industry insiders suggest some patients have been missing doses of essential medicines for more than a year.

A detailed "shopping list" of drugs wanted for export in November currently circulating among pharmacies, dispensing doctors, wholesalers and hospitals and seen by the IoS includes several drugs in short supply, including Azilect for Parkinson's and Femara for breast cancer, which no one should be buying or selling.

Norman Lamb MP, the Lib Dem health spokesman, said: "There is no doubt there are unethical and criminal activities going on, yet the reaction so far has been wholly inadequate and the problem has been allowed to get worse. While a total crisis may have been averted so far, in that no one has died as far as we know, this is causing immense disruption and distress for many patients already struggling to cope with illness."

Research by the consultants IMS revealed that 11 per cent of UK pharmacies and a small proportion of dispensing doctors are exploiting the European market and effectively diverting £30m worth of medicines meant for Britain to patients overseas every month. Wholesalers are also believed to be playing a "very significant role", says the pharmaceutical trade association, ABPI. An increase in production has led to more exports while the shortages have continued.

Many pharmacists find themselves caught between wholesalers and manufacturers, who blame each other. There were 77,000 emergency deliveries made to pharmacies by just three drug companies in the first five months of this year – a 12-fold increase on the same period last year, says the ABPI.

James Wood, a pharmacist in Sheffield, spent two hours on the phone last Wednesday trying to secure emergency supplies for four patients. This is now part of his daily routine and means he, like thousands of other pharmacists, has less time to spend with patients.

Drug companies sell the same drug at different prices in every country. In the past, Britain was one of Europe's biggest importers of "cheap drugs" from Spain and Greece. But since the pound fell against the euro and UK drug prices dropped, the tables have turned and there is now a massive demand for British medicines overseas.

The MHRA has issued 180 new wholesale licences so far this year – a 59 per cent rise on the total number issued in 2008. Authorised traders do not need to seek permission to import or export within the EU as free-market principles also apply to medicines. But they do have a legal duty to ensure UK patient needs are met.

Yet the expanding list of scarce drugs suggests these rules are being flouted. Mr Lamb said: "The DoH must initiate an urgent investigation into those companies and individuals involved and put a stop to this despicable, unethical and illegal trade."

David Pruce, from Britain's Royal Pharmaceutical Society, said: "Everyone else as the perpetrator when the reality is that everyone on the supply chain has a proportion of the blame. We want an independent inquiry to bring all sides together and resolve this problem. We don't care who's to blame. Let's just get it sorted because it won't be long before a patient is seriously hurt. There are 46 drugs on the list; this is hugely serious and my impression is that it's getting worse."

A DoH spokesperson said: "We have made clear the legal and ethical duties on wholesalers and manufacturers to supply medicines to patients. Breaching the legal duties could lead to investigation and action by the regulator, the MHRA."

Victim 1: 'It is criminal that market forces come ahead of people'

Kip Chillingworth, 22, from north London, was diagnosed with epilepsy when he was five years old. In April, neurologists recommended he start taking the anti-epileptic drug – Keppra – because he was still having seizures on his existing medication. His mother, Dr Saddi Chillingworth, struggles to get hold of it.

"Kip has been the drug Lamotrigine for years, but it was not controlling his seizures very well. A consultant recommended Keppra. We were to start with a low dose and increase it slowly. So in mid-April I got the prescription from the GP and went to my local pharmacy, but I couldn't get the drug. This went on for 10 days, and at that point I phoned Epilepsy Action and was told I wasn't the first person to complain. The distributors of drugs can sell to Europe at a better price, so there's a shortage here. I was crushed and angry.

The pharmacist demanded that the drug be made available and it did eventually come through. But by then I was reluctant to start my son on it, in case the supply was erratic. You never withdraw an anti-epileptic drug suddenly because the consequences can be dire, even fatal. In the end, Kip had to wait two weeks to get the drug.

I make sure I have a prescription at least two weeks before I run out, but this can make life very difficult as you can't always plan in advance. I've been told to 'shop around', but when you are caring for someone you can't just get up and go. Britain has enough drugs, so it is criminal that market forces are coming ahead of people's health and lives. People with epilepsy must be so stressed, and that is a trigger for seizures."

Victim 2: 'Pharmacy had to use their emergency supply'

Marion Wilkes, from Oxfordshire, was diagnosed with breast cancer in June 2007. She is prescribed Arimidex – a hormonal therapy – to treat the tumour and minimise its risk of returning. She has been unable to get a full prescription since July.

"The pharmacy has had to use their emergency supply to fill my prescription since July. Until then, there wasn't a problem. The pharmacist told me that they can only supply me at the beginning of each month because they are given a quota, yet my medication is prescribed in two monthly amounts. This has been going on since the summer and every month now seems like they are doing a juggling act. From what I've understood, the Boots pharmacy put in their orders but they don't know what will be delivered. But they can't know how many people are going to come in and ask for the drug, so then what happens?

I'm really concerned about it, even though I'm fairly assertive and articulate and work as a volunteer for Macmillan. What worries me is that people, if refused the full supply of the drugs, might just walk away and accept this. My conversations with Macmillan and other patients have led me to believe that this is quite widespread. At the moment I have a few weeks' supply. Usually I would renew about a week before I'm due to run out, but now I know I'll have to go much sooner. I'm worried that one of these days I might go in and not get my supply."

Today hundreds of people with mental health problems will attend Mind's annual conference in Brighton to help the charity launch a fresh debate around 'wellbeing' and discuss how we can improve the mental health of the nation.

As public awareness grows for the idea that everyone can do something to improve their mental health, conference delegates will be challenging the experts on how the wellbeing agenda will shape our lives and change the face of mental health care in the future.

Over the last decade the government's plan for mental health care has been set out in the National Service Framework, and this winter the 10-year strategy has come to a close leaving the door open for a rethink on mental health care.

Wellbeing will be at the heart of the Government's New Horizons strategy, due to be published shortly, and will look not just at mental health services but at how wellbeing can be made a priority in other areas of our lives. At this pivotal moment, the Mind conference is calling on delegates to air their views and concerns on how mental health services will be affected, and to help inform Mind's work.

Expert speakers will include Dr Liz Miller, mental health specialist and author whose new book Mood Mapping on managing mood and mental health is quickly becoming a bestseller. Dr Miller's expertise on wellbeing helps her to manage bipolar disorder medication-free. Other speakers include wellbeing advocate and headmaster of Wellington College Dr Anthony Seldon, along with some of his students who will talk about how the school instils young people with wellbeing skills and positive psychology, and author Dr Richard Bentall who is renowned for his work on clinical psychology.

Mind's Chief Executive Paul Farmer will be speaking and chairing at the conference, he said:

Wellbeing is a popular term at the moment that is cropping up in all kinds of places, and we're looking to dig beneath the buzzword and discuss what it means for people with mental distress, and how wellbeing should be integrated into the future mental health agenda.

Mental health issues cost £77 billion a year and investing in mental wellbeing has the potential to not only transform the experiences of millions of people with mental health problems, but to bring wide-ranging benefits to the economy and society as a whole.

We hope to see a shift in focus towards the promotion of wellbeing as a way of preventing mental distress and these conferences will be a great way to inform Mind's future work in this area.

The safety of drugs these days is a major issue not only with

linked to birth defects.

Take the case of Michelle David and her son, Lyam Kilker. David's
lawsuit alleges that Paxil hid evidence that the drug caused severe
birth defects. As a result of that negligence, her son arrived in this
world with life threatening heart defects. This case went to trial in
Philadelphia and resulted in a $2.5 million jury award.

As little Lyam grows up, he will need additional surgeries to repair
his damaged heart and will need to be on various medications for the
remainder of his life. He will also be spending a lot of time with
doctors, surgeons and other medical professionals. In other words his
injuries, caused by the drug Paxil, altered his life significantly and
the award reflected the reality of those facts.

The attorney for the boy in jail for shooting and killing his father talked with Eyewitness News about Thursday's decision to overturn the boy's conviction.

 

In 2006, a jury sentenced the 14-year-old to 10 years in custody. Police say he killed his father, Dr. Rick Lohstroh, in west Houston in 2004. Defense attorneys say the child was caught in the middle of his parents' bitter break-up and that he grew up in an abusive household.

"The thing that reversed this case was not allowing our expert to testify regarding his state of mind and how a 10-year old could get to the point where he could shoot his father," said defense attorney Chris Tritico.

Ruby did not know who to ask for help
When Ruby Holmes was 12 she started to binge eat and purge her food - she was being bullied.
By 18 she was drinking two bottles of wine each night and when she was 24 she felt so alone she tried to kill herself.
It was only then, when she came to the attention of the medical profession, that she was given the psychiatric help she needed.
"After I tried to hang myself I started to talk and people started to listen," she said.
'So ugly'
"It started at comprehensive school as after about six months I was bullied.
I lost my job, dropped out of college, messed up my degree - and that caused the depression to be 10 times worse

"I was led to believe that I was so ugly that even walking down the street people were staring at me and stuff.
"I totally believed it, hook, line and sinker.
"I started to binge and purge four to five times a day. It was out of control and then I started drinking excessively as well.
"I lost my job, dropped out of college, messed up my degree - and that caused the depression to be 10 times worse."
When she was admitted to hospital following her suicide attempt, Ruby was able to talk to a professional about her experiences for the first time, and she found it cathartic.
She was put on anti-depressants and anti-psychotic medication, which has been a big help for her.
But Ruby says that for years she felt alone, and thought she was the only one in her position.
She says young people need to know more about what is happening to them, what to ask and where to go for help.
Today she is getting her life back on track. She does volunteering work for two charities and writes.
She says the most important thing for anyone with a mental health problem is to "speak up, and to speak loud, until somebody listens to you". It is something she wishes she had done earlier.
Now a new section of the website YouthHealthTalk has been launched to advise young people, like Ruby, about all aspects of depression and to show them they are not alone.

The new site includes young people's accounts of their experiences of bullying and feeling different, early signs and symptoms of depression, treatments and other interventions. There are also sections on friendships and family, school and lifestyle.
Dr Ann McPherson, an Oxford GP who is medical director and co-founder of YouthHealthTalk, said she hoped the site could help young people like Ruby cope with a difficult condition.
"It took Ruby a long time to come to terms with what had happened to her - she had felt very isolated and alone," she said.

"Our website can show them they are not alone and where to get help."
Alan Stein, professor of child and adolescent psychiatry at the University of Oxford and Warneford Hospital in Oxford, said the website could provide a vital tool.
"Depression in young people is often under-recognised and highly stigmatised, " he said.
"A lot of young people have depression at different times, but they don't know that.
"They don't know where to turn, but having a website like this that they can go and get help."
Hormones
Erika-Maye, aged 18 and from Brighton, was first diagnosed with depression at 13 - but had already been hearing voices, harming herself and had been battling eating disorders.
She, too, said she felt very isolated by her illness.
"I felt I was alone. The first doctor I saw put it down to hormones because of my age, which I can understand to some level.
"But anyone who says they are suicidal and depressed should be taken seriously."
Lucie Russell, of the mental health charity YoungMinds, said such sites could help young people struggling with mental health issues.
"Websites such as this help young people to understand more about feeling unhappy and ensure they have access to information and support when they need it.
"There is still a lot of stigma about depression and mental distress and so accessible websites like this one help young people to identify what might be wrong and how to get help."

Ruby did not know who to ask for help

When Ruby Holmes was 12 she started to binge eat and purge her food - she was being bullied.

By 18 she was drinking two bottles of wine each night and when she was 24 she felt so alone she tried to kill herself.

It was only then, when she came to the attention of the medical profession, that she was given the psychiatric help she needed.

"After I tried to hang myself I started to talk and people started to listen," she said.

'So ugly'

"It started at comprehensive school as after about six months I was bullied.

I lost my job, dropped out of college, messed up my degree - and that caused the depression to be 10 times worse

"I was led to believe that I was so ugly that even walking down the street people were staring at me and stuff.

"I totally believed it, hook, line and sinker.

"I started to binge and purge four to five times a day. It was out of control and then I started drinking excessively as well.

"I lost my job, dropped out of college, messed up my degree - and that caused the depression to be 10 times worse."

When she was admitted to hospital following her suicide attempt, Ruby was able to talk to a professional about her experiences for the first time, and she found it cathartic.

She was put on anti-depressants and anti-psychotic medication, which has been a big help for her.

But Ruby says that for years she felt alone, and thought she was the only one in her position.

She says young people need to know more about what is happening to them, what to ask and where to go for help.

Today she is getting her life back on track. She does volunteering work for two charities and writes.

She says the most important thing for anyone with a mental health problem is to "speak up, and to speak loud, until somebody listens to you". It is something she wishes she had done earlier.
