- NESOHR's Second Meeting [Peace Secretariat - LTTE]

Fr.M.X. Karunaratnam opened the meeting and welcomed everyone. He reported that since its formal opening a few weeks ago NESOHR has attracted a lot of interest from outside. United Nations representative also visited NESOHR to learn about its functioning. Fr. Karunaratnam said that the secretariat has received 13 complaints so far from all over NorthEast and it has succeeded in resolving five of these cases.

- Head of the NESecretariat on Human Rights meets with Head of Tamil Eelam Police [Peace Secretariat - LTTE]

The following, in brief, is the outcome of their discussions:

1. It was agreed that NESOHR will facilitate a family counselling centre specifically to address the needs of women and children.
2. The police will give immediate attention where necessary to the problems of women and children.
3. The Police will actively investigate any cases of missing persons.
4. Free access will be granted to NESOHR to visit prisons and to interview prisoners in private.
5. If NESOHR has any concerns regarding particular cases, their officials can refer to any police station and request an investigation.

TAMIL NADU : 29-07-2004

- Court proceedings should be held in Tamil: Minister [News Today]

Union Minister of State for Law K V Venkatapathy has made out a case for conducting court proceedings in Tamil, saying that this alone would enable law to serve the downtrodden in the State. At a seminar on 'Legal Tamil' organised by Sattakkathir, a monthly law journal, he assured to take the initiative to provide financial assistance to local law journals in carrying on their service to law and Tamil language. Measures to implement Legal Tamil would be strengthened once Tamil was declared an official language by the Centre, he added.

Introduction:

"Construct a road by rising Sethu"

Our very familiar and India's freedom Tamil Lyric writer Maha Kavi (Great Poet) Bharathi in one of his famous poems 'Sindhu Nadhienelae'.

However we do not wish either to analyze or discuss whether Bharathi's imagination of the Sethu Road Project was recorded in poetical lines with or without taking into consideration the environmental aspects.

The intention of these memorializes is to bring to your kind notice matters connected with the proposed project of the Sethusamudram Ship Canal Project of the Union Government of India.

A news item that appeared on 'The Hindu', dated 10-07-2004, reported that Union Shipping Minister Thiru. T.R.Baalu ensuring that due precautionary measures were taken and there will be no damage to the Gulf of Mannar [GOM]'s biosphere while implementing the 142 year project SSCP.

We, Manitham [www.tamilinfoservice.com/manitham], working for promoting human rights and protecting environment, feel that this is a mega project and want to ascertain whether in constructing the canal there would be any geological, oceanographic and environmental changes, as well as any land subsidence. Therefore, we decided to fully explore the environmental impact due to SSCP. Because of the urgency we decided to submit Interim Report for your consideration what we have already received so far and assure you to furnish whatever relevant materials that we receive in future, in our Final Report.

SSCP : The Background
 
SSCP is a 144 year dream of Tamils. Commander A D Taylor from Indian Marine planned this SSCP project in the year 1860. In 1952 Sir A Ramasamy [Mudaliar] submitted a proposal and major feasibility report.

As per the present plan, the total length of SSCP would be about 260 km - about 120 km from Tuticorin Port to Adam's Bridge (in Gulf of Mannar), and about 140 km north of Rameswaram from Adam's Bridge to Bay of Bengal channel (in Palk Bay). Overall GOM and Palk Strait [PS] cover an area of 10,500 kms. The canal is being investigated for different drafts (for 9.15 m, 10.7 m and 12.8 m). In general, the canal will have a depth of 12 metres enabling 10,000 to 12,000 GRT vessels to pass through. The Government of India is proposing to dredge a width of 300 meter through 44 nautical miles long stretch.  It is estimated that 32.5 million cubic meter sand will be dredged in the Adam's bridge area and around 52 million cubic meters in Palk Strait.


Geographic Location:

Gulf of Mannar [GOM] : The Gulf of Mannar [GOM] falls in the Indo-Pacific region, considered to be one of world's richest marine biological resources. The Gulf has been chosen as a biosphere reserve primarily because of its biological and ecological uniqueness. The region has a distinctive socio-economic and cultural profile shaped by its geography. It has an ancient maritime history and was famous for the production of pearls.  Pearl has been an important item of our trade with the Roman Empire as early as the first century A.D., while Rameswaram, with its links in legend to the Ramayana, has been an important pilgrim centre. The region has been and continues to be famous for its production of chank (Indian conch). The GOM is famous for its chanks, although irrational chank fishing has severely depleted the stock. In addition, the biosphere reserve in the area has 17 different mangrove species. The GOM thus constitutes a live scientific laboratory of national and international value. It has 3,600 species of plants and animals that make it India's biologically richest coastal region. It is, of course, specially known for its corals, of which there are 117 species belonging to 37 genera. The GOM is a chain of shoal, called Adam's Bridge. It is an inlet of the Indian Ocean, between South Eastern India and Western Sri Lanka. The GOM is 130 km to 275 km wide and 160 km long. During high tide the seawater would raise to more than 1.2 meters above the sea level. Full of beach ridges, the GOB can be grouped into: (i) Beach ridges south of Vaigai River; (ii) Beach ridges between Kotangudi River and Palar River; (iii) Beach ridges between Palar River and Gundar River system; (iv) Beach ridges between Gundar River and Vaippar River; and (v) Beach ridges south of Vaippar River.

The total water logged land has been calculated to be 5.96 km2. Eight serious of Strand Lines can also be observed, apart from the Sea Cliff and Caves.

Adam's Bridge: Adam's Bridge is a chain of Shoal, nearly seven in all, is 30 km long. Sir Emerson Tennet in his book 'Ceylon' writes -" The barrier known as Adam's Bridge which obstructs the navigation in the canal between Ceylon and Ramad, consists of several parallel ledges of conglomerate and sand dunes, hard at the surface and growing course and soft as it descends till it rests on a bank of sand, apparently accumulated by the influence of current at the change of the monsoons". Also according to geological survey, it is apparent that Miocene limestone beds are under the Adams Bridge which connects Jaffna peninsula in Sri Lanka and Rameswaram in India. [Ref: The pre-history of Sri Lanka by S.U.Deraniyagala]. The legends as well as Archeological studies reveal that the first signs of human inhabitants in Sri Lanka date back to the a primitive age, about 1,750,000 years ago and the bridge´s age is also almost equivalent. This information is a crucial aspect for an insig! ht into the mysterious legend called Ramayana, which was supposed to have taken place in tredha yuga (more than 1,700,000 years ago).In this epic, there is a mentioning about a bridge, which was built between Rameshwaram (India) and Srilankan coast under the supervision of a dynamic and invincible figure called Rama who is supposed to be the incarnation of the supreme. This information may not be of much importance to the archeologists who are interested in exploring the origins of man, but it is sure to open the spiritual gates of the people of the world to have come to know an ancient history linked to the Indian mythology.

Palk Strait [PS]: PS is an inlet of Bay of Bengal. The PS is 64 kms to 137 kms wide and 137 kms long. It receives several rivers including Vaigai from India and contains many islands of Sri Lanka.

Nodal Agency:

During 1997 Ministry of Surface Transport made Tuticorin Port Trust [TPT], which has celebrated its Silver Jubilee on last 10-07-2004, as Nodal Agency for this project.

National Environmental Engineering Research Institute [NEERI] :

The Initial Environmental Exam was done by National Environmental Engineering Research Institute [NEERI], Nagpur, in 1998 as directed by Nodal Agency, TPT. It recommends securing a major marine project and a full scale, 'Environmental Impact Assessment' [EIA]. The provisional executive summary submitted by NEERI's EIA in May 2004 to TPT nodal agency expected techno-economic feasibility report by this July, 2004 end. Detailed Project Report [DPR] also has to be submitted before 30th November, 2004 by L & T of India and Rampaul of Denmark, the fixed contractors of SSCP.

Environmental Impact Assessment [EIA] by NEERI :

While reading the EIA, the following doubts emerge which are sought to be cleared.

The introductory part of NEERI's report openly admitting that dredging across Adam's Bridge and in the Palk Strait, and the dredging along the proposed transit, is critical to the project related issue. Other doubts to be cleared are:

- The Presence of Corals along the proposed ship canal alignment in Adam's Bridge area has not been observed.
- It is also intimating us that ecological important species along the proposed alignment is not significant.
- The report has not assessed the affected population on Land Acquisition and Resettlements.
- 6 Km2 areas in the sea floor of Adam's Bridge will be permanently lost.
- Report instruct to control over marine pollution.
- Dispersal could occur to alien rare species in proposed alignment.
- Dhanushkody areas traditional fishing will be totally affected.
- It is also estimated that, 84.5 million cubic meter of sand and spoil would be dredged from the project area. Out of this, a small quantity will be discharged in Pamban Island and the remaining in Bay of Bangal. Here we want to know, a) whether Neeri has worked out the 'under current' of sea water on the excavation area as well in discharging are! a. b) It is also not mentioned the exact location, where the dredged materials going to be discharged in Bay of Bengal.
- In the EIA report, under 6.1, 'construction phase', it is said that the dredged sand and spoil will be discharged in Pamban & Bay of Bengal. Contradictory to this statement, in the same EIA report, in 6.2, 'operational phase', it is reporting that dredged materials will be mostly silt and clay and will not be disposal in sea.
- NEERI asking a strict vigilance of crude oil tankers to avoid oil spill in the sea. If oil spill happened due to unavoidable circumstance, the agency has not suggested any remedial measure.
- The Agency suggesting that a trained pilot or environmental watcher should be board in the ship to watch marine mammals. Is this suggestion is possible in practical day-to-day life. Say for e.g., if a vessel sailing during night or in rainy or in dark cloudy time, this suggestion will be a meaningless one.

Notably, NEERI has not considered the most important international instruments, UN Law of Sea Convention 1982 and its 2 protocols anywhere in its report.

Problems Facing on Implementation of SSCP:

Geological: There will be a dredge of sea floor of 12.8 meter deep, 300 meter wide for 2 way traffic. If this happens to be sudden, tilt in the sea bed, may cause numerous violent process, as like; a major change in drift, possible change in gravitational pull etc.

Biological: This whole SSCP area is a biologically rich and rated among the highly productive sea of the World. The zooplankton was dominated by copepod. Macrobenthos were represented by 78 varieties, meiofauna comprised larval polychaetes, nematodes, worms and shrunken bodies of a new forms.

Coral Reefs: Coral reef system as also the ecosystem of the tropical rain forest, are the most matured marine ecosystems of our planet. They play an important role in global biochemical processes and in the reproduction of food resources in the tropical regions. Coral reefs act as a barrier against wave action along coastal areas thus preventing coastal erosion. In addition, coral reefs protect mangroves and sea grass beds in certain areas, which are the breeding and nursing grounds of various economically important fauna. Coral reefs are also important breeding, spawing, nesting, and feeding areas for many economically important varieties of fishes and other marine organisms. Coral reefs are a distinctive shoreline habitat of stunning visual appeal found only between latitudes 30oN and 30oS. They grow only where sea surface temperatures are above 20oC, the seabed is kept silt-free by prevailing currents and waves, and there is intense surface sunlight. Most living coral communities do not grow at depths of more than 50 m, although some grow at depths of 100 m. The people living along the coast obtain a considerable proportion of their food and earnings from the productivity of coral reefs. Coral reef ecosystems are very sensitive to external impacts both natural and manmade, which violate their homeostasis (Sorokin 1992). Mangrove, sea-grass and sea algal eco-systems have not been affected much by the acts of anti-environmental elements; the important coral reef system continues to be targeted. According to the Wildlife Warden of the Gulf of Mannar National Park, Naganathar, [The Hindu, Tuesday, Jun 08,2004] that the Forest department officials could not take any action against the `so-called groups' because the matter was in court. Considering the importance of preserving the eco-system, the department would prefer an appeal in the Madras High Court to get vacated the stay, which was in favour of limestone industrialists, he said. Environmentalists feel that unless tough action is initiated against the "anti-environmentalists," the lives of nearly five lakh fishermen would be affected. For, breeding and feeding of fish cannot take place in the absence of coral reef, which serves as a habitation for more than 750 fish varieties. In GOM, Geomorphologically, coral reefs in this area are of fringing type, though some patchy corals are also observed in between Appa Island and Pilliyarmuni Island, and in some areas like Bharathi nagar coast and southeast coast of Kariya Shuli Island. The major causes of coral reef degradation are:

- Over fishing and destructive fishing practices
- Sea weed collection
- Commercial shell collection
- Coral mining
- Poor land use practices
- Coastal urban development
- Harbour and dredging activities
- Industrial development and pollution

Rainfall in both GOM and PS is estimated around 900 mm annually. This is due to coral reef as per scientist version.

According to the above reports, the project implementation may destruct coral reefs which, in turn, would tend to cause:

-  High sea tides
-  Surges might occur
-  Hurricane, cyclone etc might take place

National Marine Park or Biosphere Reserve: The Tamil Nadu Forest Department and the Ministry of External Affairs have already declared 21 islands in 623.12 hectors, as National Marine Parks. But now the Government of India through the NEERI says that the proposed alignment will be far away from this National Marine Park. i.e., 'Van Tivu' - the nearest island will be about 6 km and 'Shingle' island will be 20 km.

Marine Mammals: Rare Species like sea turtles, dolphins, sea cows and whales are already located and these areas said to be their natural habitat and grazing region.. There are also dangers of oil spills and other forms of pollution. Sea turtles are frequent visitors to the GOM as are sacred sharks, dugongs, and dolphins.

One expert from Sri Lanka Lareef Zubair, formerly of the Institute of Fundamental Studies, Kandy, wrote in a Sril Lankan newspaper 'Daily News' dated 07-04-1999, that the SSCP would disturb the marine life in the Palk Strait 'gravely'.

Archaeological: We have come to know in our life time itself that Dhanskodi, a part of India's coastal area submerged due to land submission. In the Sangam period, we have learnt about the city of Poompukar etc.

Even though the NEERI reports deny the existence of archaeological structures under the sea bed, we insist to investigate more on this. Otherwise, after the dredging, there is possibility of loosing the archeological treasures that may be lying beneath the sea.

Oceanographic : A fear has also been expressed that, after the Gulf of Mannar is dredged to cut the ship canal, nearly 85 islets in the Western coastal region of Sri Lanka  will be  submerged into the sea. According to Oceanographers' view, Indian Ocean around the tip of the Indian peninsula is an ancient area in natural transition which has not yet completed its full formation. This section is the most complex relief and the earth crust is still in motion. For example, according to Mr. K. Arulandam, Oceanographer at the National Aquatic Resources Research and Development Agency [NARA], since implementation of the project would cause an impact on environment affecting marine life, remedial measures should be taken to care ('Hindustan Times', 15-06-2004).

Socio-Economic: Fishing has been the sole occupation of 20 million fisher folks living along the coast of Gulf of Mannar and in Palk Strait. They have been in close proximity with the sea, so that, their life-style, culture, community and social life have centered on the sea. The main livelihood activities of the fishermen residing in the villages adjoining to the coastal area are (i) fishing, (ii) seaweed collection, (iii) chanks collection, (iv) coral mining, (v) fire wood collection and (vi) agriculture. 

There are 87 fish landing stations between the south of Point Calimere and Pamban and 40 fish landing stations in the Gulf of Mannar. The fisher folk want irksome fishing regulations to be repealed. As of now, fishermen are allowed to venture into the sea between 5 am and 9 pm for three days in a week. However, bad weather conditions keep them shore-bound for 45 days in a year.

The NEERI report accepts that 200 out of 600 varieties of fishes are commercially important. If we look at the past, fish production in 1992-1996 recorded 55,325 tonnes. In 2001, a huge increase of 2,05,700 tonnes has been registered because of coral reefs.

There are 138 villages and towns spread in 5 districts through the coastal area from Gulf of Mannar to Palk Strait in Tamil Nadu State. More than 50% of the fishing populations in this area are in debt. If this project is implemented, socio-economic problem will multiply due to unemployment.

UN Law of Sea Convention, 1982:

The dangers posed by the project violate the UN Law of Sea Convention, 1982.

- Part II, Section2, Article 6 deals with Reefs, Article 9 tells on Mouths of Rivers, Article 10 speaks about Bays.
- Part V, Article 61 - Conservation of the living resources, Article 64 - Highly Migratory species.
- Part V, Article - 65 and Part VII, Section 2, Article 120 also speaks on Marine Mammals.
- Part VII, Section 2, Article 116 speaks on fishing rights.
- Part XI, Section 2, Article 145 and Article 237 emphasizing that protection of Marine Environment is obligatory. In the same part Article 146 urges the need for protecting the Human life, Article 149 and Part XVI, Article 303 both deals with Archaeological and historical objects.
- Part XIII, Section 3, Article 254 dealt with Rights of neighboring land-locked and geographically disadvantaged States.


Considering our Neighborhood, Sri Lanka:

- Till now the Indian Government has not even officially notified to Sri Lanka of SSCP proposal even as a matter of courtesy.
- There were no clear markings of the territorial waters belonging to India and Sri Lanka.  As such, the criterion upon which it was announced that the entire project would remain within the Indian waters is still unclear. 
- Jaffna Peninsula in Sri Lanka and Rameswaram in India are linked via Miocene era lime stone reefs.  And if, for the purpose of SSCP dredged, there is a notion that half of Jaffna peninsula & nearly 85 islands on the western and north western coast of Sri Lanka and half of Rameswaram in India will go under water.
- There is a fear that a sizable fisher folks in North and North western part of Sri Lanka will also be affected and there is also fear that Republic of Mal Dives fishermen also be affected.
- Indian Government should have considered obtaining "no objection" from the Government of Sri La! nka as per UN law of Sea Convention, 1982.

'Manitham' Survey Report:

We, "Manitham", undertook extensive travel through Tamil Nadu Coastal areas and gathered opinions of persons from various walks of life such as: fishermen, educationalists, politicians, experts from marine engineering, oceanographers, environmental consultants etc. We surveyed from Nagoor in Nagapatinam on 18-07-2004, Rameswaram- 19-07-2004, Tuticorin, Tirnelveli & Nagarkoil - 20-07-2004, and ended on 21-07-2004 at Thiruvanandapuram.

The following are the results:

- - Most of the persons we met just know name of the project and do not know anything else.  Those who know they will be affected oppose this project.

- Swami Pranavanda of Rameswaram opposed this project during the year 2000. He wants to transfer the project borderline to the east of Sri Kothandaram Temple located at Rameswaram. He organised a signature campaign and passed it to the then Prime Minister A. B. Vajpayee to Defense Minister George Fernandes. Mr. Fernandes also visited Vivekanda Kudil, where Swami Pranavanda lives ["Kumudam-Reporter", 20-05-2004].

- At Tuticorin, a bore well was recently laid 0.5 kms from Sea Shore in which soil was seen up to 23 feet while there were only shells from the next 10 feet. At Eral village we can see even now that only shells are available in the ground level itself.

- According to retired Marine Engineers whom we met, revenue-wise also the project will not be a profitable one. For example, as per Government of India, the 36-hour voyage time can be saved by SSCP. Here we have to look after the following limitations and constraints:
  a] Only 30 feet draft ships can be allowed to cross SSCP.
  b] The ships have reduced its speed while crossing SSCP.
Practically speaking, a ship will take at least 20-24 hours to cross SSCP. Also, ships have to pay toll charges for crossing. Naturally, as ships visiting Chennai and Visakhapattanam need to use this way, we have to assess how many ships would be daily sailing through SSCP. According to retired marine Engineers who worked in Tuticorin port hardly 2 or 3 ships won't be crossing daily? Therefore, even in revenue terms, the project cannot be treated as a profitable/feasible one.

- We met the Nodal Agency Chairman Mr.Ragupathy at his office on 20-07-2004. However, he and his associates refused to give information on SSCP. He simply directed our team to his PRO, who appeared to, do not know anything about this project. The Chairman also told us to attend the public hearing, if any, conducted by the Nodal Agency in future. [We received information that the Public Hearing will be held on August, 24 & 25, 2004]

- We also met Environmental Consultants. In general they accepted that there will be a small impact on environment and this project definitely affect the coral reefs, coastal people, marine mammals etc.

History of World Canals:

We have also conducted a small study on canals. Before 4000 B C, King Menc built a canal in Upper Egypt, which was considered to be the first of its kind. In 1666 A D, the Pierre Paul Riguet dredge, Languedoc canal [also known as 'Canal Du Midi'], was constructed to connect Atlantic Ocean and Mediterranean Sea, which was the first canal that connects two seas.  The man-made waterway, the Suez Canal of present, was originally 15 meter deep to allow 50 feet of draft to pass.  The work was started to increase this to 22 meter deep by 2010 so as to allow super tanker passage. Notably, out of total 1.5 million Egyptians who worked on Suez Canal, 1,25,000 had died.  The above canals are dredged on land and not on coral reefs as in our area. In the Suez Canal, in particular, only 90% sand and 10% rock were dredged.

Controversial SSCP issue:

The project was criticized by Mr. Ti. Shamugarasa in his article in Dinamani (26-07-1999).

In Tamil Nadu coastal region, the 'Tamizhaga Meenaver Tennurimai Iyyakkam' conducted agitation in 2000 against this project.

An article by Bangkok-based online daily  'Asian Tribune' Editor K.T.Rajasingham, 'India-canal the Genocidal SSCP', and another article 'A Canal.....and an Island' it carried (both on 28-08-2202), reflected natural calamities that might result out of this project.

MANITHAM's Demand:

Manitham is not totally objecting SSCP. Instead, we only want to know the absolute truth behind SSCP. We are asking for it as we have a right under UN Law of Sea Convention, 1982 Part XI, Article 169 - before implementation of the SSCP, consultation should be held with Independent International NGO's on this project for perfect clearance in all forms and terms. On this criteria, we want 'Independent International Experts Report' be allowed to give a fair report on SSCP.

Suggestion:

We suggest that a canal to qualify as a ship canal must have a minimum depth of at least 5 meter [16 .4 feet]. Therefore, at present, we can do the minimum depth so as to avoid big environmental problems.

Conclusion:

We request you that before issuing 'no objection certificate' by the Tamil Nadu Pollution Control Board, Tamil Nadu Department of Forests and Environment, and Union Ministry of Environment, to make the Nodal Agency to come forward to clear all the lingering issues connected with this project with the help of 'Independent International Experts' Report'.

India and Sri Lanka last Monday agreed to expedite the proposed defence cooperation agreement, Indian press reports said.Delivering the presidential address at the second anniversary of the confederation here, Tamil Nationalist Movement (TNM) leader P Nedumaran said any such move would be detrimental to the cause of Tamils, Indian press reports said."Why do they need a security pact with India? It is an island nation and has no visible enemy in the region,” Nedumaran, who is the confederation president said.“Why is that they want to have a defence pact? Because, they want to use the Indian army to crush the Tamil population in Sri Lanka," Nedumaran said, Nedumaran maintained that most of the Sri Lankan leaders including the Presi! dent, Prime Minister and External Affairs Minister are making trips to Delhi and insisting that India sign the defence pact. He pointed out that Colombo had "backstabbed" Delhi during its period of crisis."Hope people in Delhi realise that they are being lured into a trap. If you once again fall into the trap of Sri Lanka, you will once again get cheated," he warned. Amongst other aspects of military cooperation, the proposed pact envisages training of Sri Lankan personnel at Indian defence establishments and supply of military equipment to Colombo’s forces, Indian press reports said.The Liberation Tigers have opposed the proposed pact on grounds that it would disturb the tenuous peace process by alter! ing the balance of forces in Colombo’s favour. "A military pact with India would encourage the Sinhala political leadership to take a hard-line, belligerent attitude towards the Tamils and eventually destroy the mutual trust between the estranged communities, a crucial factor necessary for the consolidation and promotion of peace," the LTTE's political strategist, Mr. Anton Balasingham, said when the proposal was first announced early this year.Mr. Balasingham said the defence pact would upset the balance of forces to the disadvantage of the LTTE and that “disturbing that military equilibrium would lead to the disturbance of the ceasefire agreement, the very foundation on which the Sri Lankan peace process stands.”

Sir: It is with great concern that we note that nine years after TADA was allowed to lapse the state is still using it to crush political dissent and democratic protest. It is shocking that this draconian law is still in use while most political parties have agreed that its successor, POTA, should be repealed. We invite your attention to two cases, where this becomes evident.

In the case of the Bhadasi village of Arwal Police Station (Bihar) those charged under TADA during the trial, conducted in August 2003 by the sessions court of Jehanabad, includes Shah Chand, Dr Jagdish Yadav, Churaman Bhagat and Arun Bharati. They are well known activists of Arwal, who have struggled against social inequalities by leading mass protests against police highhandedness and feudal terro! r of the landlords. The other accused (and now imprisoned) are poor landless peasantry, including two persons, who were children, aged 13 and 14 years when charged under TADA in 1988. Shah Chand, the main accused in the case has been an elected Mukhiya of Bhadasi village since 1978 and has been awarded by the district administration for outstanding developmental work. He is also a leader of the Inquilabi Muslim Conference and was appointed a member of the Jehanabad-Arwal wakf board in 2002. He has also contested the assembly elections from Jehanabad in 2001as a CPIML candidate. Today, all these persons, who have been involved in legal social and democratic struggles, are being called as terrorists after having been tried under TADA.

Sri Lanka's government has prepared an agenda to revive stalled peace talks with Tamil Tiger rebels and was awaiting a response from the guerrillas, President Chandrika Kumaratunga's office has said.

Kumaratunga also discussed the island's faltering peace bid with the visiting German Foreign Minister Joschka Fischer shortly before he left the island Monday, the presidential secretariat said in a statement.

"Mr. Fischer said his country would like to invest more in Sri Lanka and that they are keenly observing the progress of the peace process," the statement said.

It said Kumaratunga briefed Fischer on her government's commitment to reach a negotiated peace settlement acceptable to all communities in Sri Lanka and end fighting with the rebel Liberation Tigers of Tamil Eelam (LTTE).

"The government has moved ahead in formulating the agenda for the talks and is awaitin! g the LTTE's response on the resumption of talks," the president told the German minister.

Defense Secretary Cyril Herath denied the army was backing Karuna. "Karuna's people can act on their own -- they don't need help," he told Reuters.State-owned radio recently carried a long interview with Colonel Karuna in which he accused Tiger leader Vellupillai Prabakharan of planning for war while talking peace.The interview drew sharp reactions from the rebels of the Liberations Tamil Tigers of Eelam (LTTE). "The truth is out today beyond any doubt that the Sri Lankan state is providing him (Karuna) state facilities to wage a proxy war of black propaganda against the LTTE and to carry out terrorist attacks with the assistance of Sri Lankan military intelligence to derail the ceasefire," said the leader of the rebels in eastern Sri Lanka, E. Coimbatore, 12 July: Manitham - Humanism, a Tamil Nadu regional based human rights organization, has taken up the issue of Sethusamudram Ship Canal Project to explore and ascertain the impact it might have on humanity and on Sri Lanka, once the construction – actually cutting of the canal starts in the Gulf Mannar Sea.

In a statement released by “Manitham” states: “Now, ‘Manitham’ has undertaken Sethusamudram Ship Canal Project [SSCP] in our hands, because, we are receiving conflicting reports that the construction of this project might cause untold miseries to humanity.”

In the statement “Manitham” has said: SSCP is a mega project in its kind and by constructing the canal we want to ascertain whether there would be any geological, oceanographic and environmental changes, by which whether there would be any land subsidence which would cause a major portion of Sri Lanka going under water.

The statement went on to state that according to reports “Manitham” has received, that by constructing the project a section of the humanity faces danger of land subsidence of their residential areas and even uncertainty of their lives.

According to the reports, it will be not one or two persons who are going to be affected, but it may be a few million people whose lives are in danger of being marooned to death, when their residential areas goes under water.

We are of the opinion that this fear expressed by a section of humanity may be unfounded, and may be not. But when the fear expressed involves the life and death of a section of humanity, then it cannot be simply dispelled or ignored.

Recently when delivering his budget speech in the floor of lower house of parliament, India’s Finance Minister P.Chidamparam, a native of Tamil Nadu said : “The Sethusamudram Ship Canal Project is a longstanding demand – nay dream – of the people of peninsular India. I am! happy to inform the House that the Environmental Impact Assessment study of the project has been completed by the National Environmental Engineering Research Institute (NEERI), Nagpur. NEERI is now preparing the techno-economic feasibility report and the report is expected to be submitted shortly. The Ministry of Shipping proposes to establish a special purpose vehicle (SPV). The SPV will raise funds for the project and Government will participate in the funding through a mix of equity support and debt-guarantee.”

Thank God, though the Minister spoke of the dream project, he failed to allocate even the initial fund for the construction of the project, but he announced of “Environmental Impact Assessment study of the project has been completed by the National Environmental Engineering Research Institute (NEERI), Nagpur.”

“Manitham” alleges “Our investigation reveals that NEERI has not considered UN Law on Sea Convention 1982, while making their reports.

Human rig! hts organization went on to say: According to our survey it reveals that the Sethusamudram canal would originate from Tuticorin Port, extend in a north-north east direction in the Gulf of Mannar up to Rameswaram area, then cut through Adam's Bridge and proceed in Palk Bay area, almost parallel to the Indo-Sri Lankan boundary line (about 3 km from the boundary), and join the Bay of Bengal opposite Point Calimere.

The total length of the canal would be about 260 km - about 120 km from Tuticorin Port to Adam's Bridge (in Gulf of Mannar) and about 140 km north of Rameswaram from Adam's Bridge to Bay of Bengal channel (in Palk Bay). The canal is being investigated for different drafts (for 9.15 m, 10.7 m and 12.8 m).

Further it was said that the entire alignment would be within Indian waters.

It was unfortunate up to date, there was no clear markings of the territorial waters belonging to India and Sri Lanka and it is unclear based on what criteria it was announ! ced that the entire project would remain within the India waters, “Manitham” raises this pertinent question

. “Manitham” further points out, when India proposes to do something within close proximity of the neighbor’s territorial waters then Indian Government should have considered to obtain “no objection” from the Government of Sri Lanka.

Unfortunately, “Manitham” went on to state, according to our reports that this proposal of this Sethusamudram Ship Canal Project, up to date, Indian Government has not even officially notified to Sri Lanka of their proposal even as a matter of courtesy.

Therefore, “Manitham” has decided explore fully the impact of the Sethusamudram Ship Canal Project. “Manitham” representatives will be visiting the coastal areas and meet the local fishermen for their feedbacks and discuss the issue with leading geological, marine and oceanographic experts before sending our report to Tamil Nadu Government of our finding for necessary actions.

Bodhi's Tamil Afterglow [Out Look]

Bus stop in a small south Indian town seems an odd place to find an image of a Buddha. But, in recent years, archaeologists and historians have been discovering these statues all over Tamil Nadu. Just 40 km away in Jayamkondam, a granite Buddha sits on a porous laterite pedestal. An Archaeological Survey of India sign warns would-be desecrators that it is a protected monument, but says nothing about the age of the statue. In any case, local concerns with the image seem to be more prosaic. A woman dries vendekkai (okra) on the pedestal, "Because the goats can’t reach there." Behind the Buddha hangs a clothesline.

There are some ancient Tamil inscriptions behind the temple and an unfinished kalyana mantapa to the south. A further trek of two km to the west takes you to another village called Paparajanahathi. The speciality here is a stone umbrella that has been carved out of a single stone in front of the Shiva temple. The village is also known for the Baba Hazrat Khaja Usman Shawali Dargah, visited by one and all. Those not interested in walking can reach these places by road also. On the way back you can have a good view of the entire range of hills of Kolar better known as Shathashringa Parvatha with the highest point rising to 4026 feet.

HRD Ministry lifts ban on 'Thirukural' [Sify]

In a quick reversal of its decision, the Human Resource Development Ministry lifted the ban on printing of Tamil classic 'Thirukural' and 'Vedanta', a book by senior Congress leader Karan Singh. The withdrawal of ban on Thirukural came after Union Minister and DMK leader Dayanidhi Maran had a meeting with HRD Minister Arjun Singh in this regard. Maran is understood to have conveyed to Singh that the action against Thirukural hurt the sentiments of not only people of Tamil Nadu but all lovers of classical Indian literature. Printing of an English translation of Thirukural, the two-millennium old Tamil classic, and Singh's "Vedanta" were banned as they were linked to the "saffronisation" drive of the previous BJP-led government. The inclusion of Thirukural in the list of "suspect saffron" books had raised many an eye-brows as this book has sold more copies than any other Tamil book. It is regarded more as a spiritual guide than a religious book. 

- 'Sethu project is no threat to biosphere' [The Hindu]

Thiru T R Baalu, Union Minister for ShippingAll precautionary steps will be taken to ensure that no damage to the Gulf of Mannar biosphere is caused while implementing the Sethusamudram canal project, the Union Minister for Shipping and Transport, T.R. Baalu, said today. Addressing newspersons here, he said the nearest island would be 20 km from the canal. As one who had been Environment Minister, he was aware of the need to protect the biosphere and hence a new alignment was chosen in the place of two earlier ones. The third alignment was drawn up in a manner which would not affect the biosphere. The National Environment Engineering Research Institute presented its report on the environment impact of the project and a techno-economic feasibility report was expected by ! this month-end. The ICRC has worked in Sri Lanka since 1989, focusing in recent years on areas in the northeast that were most affected by the conflict between the government and the Liberation Tigers of Tamil Eelam (LTTE).

Now that the ceasefire agreement is in effect, the ICRC's main goals are to: protect civilians from violations of IHL, including the recruitment of minors; serve as a reference in efforts to resolve the problem of persons missing in relation to the conflict; ensure the safe flow of people and goods through crossing points into and out of the Vanni; promote IHL training in military forces of both parties; increase the response capacity of the Sri Lanka Red Cross Society; and ensure the coherence of Red Cross/Red Crescent action in the areas affected by conflict by coordinating activities of Movement components working there.

Key Points in 2003

Wit! h the ceasefire holding, thousands of civilians and hundreds of trucks crossed between LTTE- and Government-controlled areas each day to engage in trade, provide services and carry out reconstruction and repair work, leading to significant improvements in living conditions in LTTE areas; the ICRC's full-time presence at crossing points helped maintain the flow of traffic and avert problems.

Reconstruction funding tied to progress in the peace process was held up when negotiations stalled, leaving gaps in services where humanitarian activities had scaled back. ICRC support for basic health services and maintenance of wells continued in the Vanni; other assistance activities were discontinued or handed over to government, local, or international organizations.

The fate of missing persons remained of central concern to the ICRC, which was designated by both parties as a reference organization in the efforts to develop a mechanism for dealing with the problem.

Context

After making dramatic progress in 2002, the peace process in Sri Lanka lost momentum in 2003. Three rounds of talks (brokered by the Norwegian government) were held during the year before the LTTE suspended its participation in April. After this, the parties exchanged proposals for establishing an interim administration for the north-east.

A divergence between the positions of the president and prime minister set off a political crisis in November, which stalled all dialogue.

Serious incidents at sea, strikes, riots, and assassinations fuelled distrust between the government and the LTTE, while friction between Muslim and Tamil populations continued to threaten stability in the east. In spite of these problems, the ceasefire signed in February 2002 held throughout the year, giving Sri Lanka its longest period of calm for well over a decade. The Sri Lanka Monitoring Mission verified compliance with the agreement.

Political ! and diplomatic setbacks did not prevent people from benefiting from the ceasefire. Its implementation enabled many displaced people to return home and allowed a revival of trade. Roads, communication lines, wells and buildings were rebuilt or repaired and civilian air links between Colombo, Trincomalee and Jaffna were re-established. In Jaffna and areas of the Vanni reached easily from the main highway (especially Kilinochchi) there was a marked upsurge in business activity and reconstruction work. These changes did not, however, spread to areas of the Vanni still isolated as a result of the poor road network. In spite of large-scale return of displaced people to former battle zones, relatively few mine injuries were reported. Both sides undertook mine clearance (expected to last four years) and there was considerable international support for mine action.

At an international donor conference in Tokyo in June, 4.5 billion US dollars were pledged for the reconstruction of! Sri Lanka, broadly conditioned upon progress in the peace talks.

ICRC Action

The ICRC’s offices remained open in all the key locations in the north-east. As needs diminished and the government, the local authorities and other organizations were able to improve public services, the ICRC further scaled back its assistance there. In isolated areas of the Vanni not yet covered by government or other services, it continued to maintain water sources and support basic health services, working to ensure their sustainability in preparation for handover.

This reduction in assistance enabled the ICRC to concentrate more on protection activities. While it continued to visit detainees, restore family links and document violations of international humanitarian law (IHL), the volume of work diminished and more effort was put into two activities contributing to the transition towards peace: resolving the problem of missing persons and serving as a neutral intermediary to ! ease the flow of traffic at crossing points. The ICRC also explored ways of adapting its preventive activities to the new situation.

The progress made by the army in developing and running its own IHL training demonstrated the positive impact of the ICRC's efforts to anchor this body of law in national institutions and practices.

Civilians- Facilitating travel and trade

The growth in trade and strengthening of public services improved living conditions in the north-eastern areas that had long been cut off as a result of the conflict. Over the year, more than three million trips by civilians and 430,000 by trucks were registered at three different crossing points into the Vanni: this movement enabled people to do business, visit family members, go to school, receive medical care and take part in a wide variety of social, cultural, and religious activities. At the request of both parties, the ICRC was present without interruption at the crossing points, helping th! e two sides work together to solve the problems that cropped up daily. This averted incidents that could have held up traffic or had repercussions on the peace process.

Helping the families of the missing

Thousands of people, many of them women struggling to support dependents, remained without news of missing family members. This often left them unable to resolve serious psychological, economic, administrative and social problems stemming from their loss. Since the early 1990s, the ICRC had documented some 20,000 cases of persons (both civilians and combatants) reported missing; in 2002 it began to review the approximately 11,000 cases that remained unresolved, and in 2003 it continued this work, visiting the families of missing persons in their homes in order to update information and determine whether the cases ought to be pursued. During the peace talks, both parties requested that the ICRC help them clarify the whereabouts of persons still unaccounted for. Expe! rts from Sri Lanka were involved in the ICRC's worldwide project on the issue of missing persons and took active part in the international conference in February. The ICRC worked with both parties, and in particular with deminers, to find ways of handling human remains that would improve the chances of identification. It also maintained contacts with family associations and other related groups to determine how best to meet the needs of the families of the missing.

Reacting to IHL violations

Except for those involving the recruitment of minors, allegations of violations of IHL remained fewer and less serious than before the ceasefire. They were most common in the east of the country. The ICRC continued to document allegations and take them up with the relevant authorities. Follow-up of allegations of the recruitment of minors was coordinated with UNICEF, which in October set up the first transit camp for minors released by the LTTE.

Ensuring sustainability of th! e water supply

Starting in 1996, the ICRC sank wells and boreholes and installed or repaired hand pumps, thus guaranteeing water supply for over a hundred thousand residents in isolated areas of the north-east. After the ceasefire, it began to hand over responsibility for maintenance of these water sources to the national water board. In the east, this process was nearly complete by 2003; responsibility for the last wells (37 wells in Batticaloa) was transferred in June. In the Vanni, slow progress in setting up a system for maintaining wells delayed plans for handover, and the ICRC continued to do the work while at the same time helping the national water board, the Tamil Relief Organization and the local authorities to set up a maintenance system and train technicians. 97 boreholes were repaired/ improved and 38 hand pumps were installed/improved for 48,000 beneficiaries.

Restoring family links

As postal and telephone services reached almost all areas and peo! ple were free to travel, residents of the north-east were able to restore and maintain contacts with their families on their own, and there was little demand for ICRC services. The organization helped families find relatives who were reported to have disappeared in connection with the conflict. When necessary, it also helped trace the families of released minors. 46 RCMs were delivered409 people were located via tracingrequests3,101 cases of missing persons were updated as a result of family visits.

People deprived of their freedom

As implementation of the ceasefire agreement reduced arrests and accelerated releases, the number of people detained by the government in connection with the conflict had dropped sharply by the beginning of the year and continued to do so over subsequent months. The ICRC visited the remaining detainees regularly, in accordance with its standard procedures. It covered transport costs for families who had to travel in order to visit detained r! elatives. It also provided educational, leisure and hygiene materials for use by all those detained in the places visited.

The ICRC also visited a small number of Sri Lankan military personnel held by the LTTE. It made visits to two LTTE detention facilities and maintained its request for access to other detainees allegedly held by the LTTE. 3,356 detainees were visited (including 186 newly registered,373 followed up individually, 56 women and 33 minors) in44 places of detention 141 family visits to detained relatives were funded.

Wounded and Sick: Exchanging expertise on war surgery

With fighting suspended, fewer people were injured in 2003. The ICRC organized its third annual war surgery seminar in Anuradhapura for 80 surgeons, more than half of whom were civilians, as a way of fostering exchange on the subject.

Making basic health services more sustainable

A project delegated to the Canadian Red Cross continued to support the mobile health teams ! and health centres run by the Sri Lanka Red Cross Society (SLRCS) in areas of the Vanni whose residents had no access to other facilities. Although other organizations were working in the region and health services there had been expanded, these were concentrated near the main highway, leaving less accessible areas underserved. Some Red Cross health centres and mobile health teams closed down as population shifts and the improvement of local facilities altered demand, and the last teams ceased work in December after an ICRC/ Canadian Red Cross evaluation showed that the level of curative care needs no longer justified their existence.

Meanwhile, the Red Cross health centres were found still to be necessary, so this programme was pursued. As the shortage of trained personnel in the Vanni continued to hamper improvements in health services there, the ICRC promoted integration of Red Cross community health workers in the national health system. 30 Red Cross health centres w! ere supported 83,867 consultations were given.

Amputees and other disabled people

The Friends in Need Society (FINS) workshop was the only facility providing artificial limbs on the peninsula; with travel restrictions lifted, it also served some patients coming from the Vanni.

The ICRC provided it with the materials, equipment and training needed to produce lighter and more comfortable polypropylene appliances. Having continued to supply materials through most of 2003, the ICRC ended its involvement after an evaluation in September confirmed that its objective of improving the capacity and quality of patient service had been met. After the ICRC's withdrawal, the NGO Motivation took over the provision of materials. 273 prostheses (145 for mine victims) and 32 orthoses were delivered 91 prostheses and 4 orthoses were fitted on new patients 7 wheelchairs and 24 pairs of crutches were produced.

Authorities

A national IHL committee was set up in 20! 00 under the auspices of the Ministry of Foreign Affairs. It stepped up its activities in 2003, drafting an act for submission to Parliament on implementation of the Geneva Conventions. In addition to supporting the committee’s efforts and extending its network of contacts for promoting the ratification and implementation of IHL treaties, the ICRC conducted introductory sessions on the principles of the International Red Cross and Red Crescent Movement, for instance for civil servants working in the north-east.

Armed Forces and Other Bearers of Weapons: Supporting integration of IHL into military training.

The Sri Lanka Army further developed its own IHL training programme, holding sessions at all levels both at training institutions and in the field. The ICRC had helped the army set up the programme by training trainers, helping develop materials and providing other technical assistance. By 2003 the army was delivering most of the IHL training itself; the ICRC evaluat! ed the curriculum of army training establishments and gave some technical assistance in developing materials.

The army reported that its ICRC-trained instructors were teaching IHL to hundreds of soldiers and officers. Advanced army instructors began to take over instructor training, conducting a full course for non-commissioned officers and working with the ICRC to present part of the officers’ train-the-trainer course. The ICRC encouraged the navy and air force to develop similar programmes: it conducted IHL trainer training for the navy and organized an IHL workshop for air force officers.

The ICRC also continued to give presentations for military, police and security force personnel deployed in the north-east, to explain the ICRC's role and the basic rules of IHL. In an effort to develop IHL training within the LTTE, sessions were organized for members of its military, police, political and administrative wings.

64 IHL instructors were trained (army, navy)! 320 military personnel attended ICRC seminars/workshops introductory presentations were held for over 3,050 military,1,500 police/security, 250 LTTE members.

Civil Society

The ICRC worked through the press, NGOs and other groups to transmit information about humanitarian issues and activities, raise awareness of IHL and encourage respect for its rules. In the north-east, it held group sessions on the principles of IHL for representatives of the Muslim community, Red Cross branches, NGOs, students and teachers, journalists and others.

350 leaders and opinion-makers attended a seminar on IHL organized in conjunction with the Judge Weeramantry International Centre for Peace Education and Research over 2,500 people in the north-east attended introductory sessions on ICRC and IHL

National Society

With the support of the ICRC and the International Federation of Red Cross and Red Crescent Societies, the SLRCS continued to restructure its management b! ase. In September, it held its first General Assembly based on its new constitution, adopted in October 2001, and initiated a review of its implementation. To help strengthen the National Society’s legal basis for independent action, the ICRC helped it draft the Sri Lanka Red Cross Society Act for submission to the authorities.

The ICRC and the SLRCS continued to cooperate closely in the areas of tracing, dissemination and conflict preparedness (including first aid and assistance to victims). To clarify respective roles and responsibilities in the country's fast-changing environment, the ICRC, the International Federation and the SLRCS signed a trilateral agreement that formed the basis for close coordination of their activities, as regards both organizational development and operational cooperation.

The ICRC maintained its role as lead agency, coordinating Movement activities in the north-east, including bilateral support for the SLRCS provided by internationally act! ive National Societies.

The Attack in Colombo: Actions of those Against Peace [Peace Secretariat - LTTE]

We consider the attack in Colombo on 7th July 2004 to be one of the operations of some elements who are working to disrupt the peace efforts between the Sri Lankan Government and the Liberation Tigers of the Tamil Eelam. We strongly condemn this act, which could, confuse the people who are hoping for peace, and disrupt the prevailing peaceful environment. It is well known that as a result of activities by armed groups, aimed at disrupting the peace efforts, our cadres and civilians are being killed in the east. We strongly believe that these groups are operating with the help of the Sri Lankan military intelligence unit and the SriLankan Armed Forces. We have informed the SriLa! nkan government, through the Norwegians and the SLMM, that the peaceful environment can be preserved only if the military intelligence wing and the security forces halt all assistance given to these armed groups. We are suspecting that it is, the granting of refuge to these groups, and the permission given to them to act freely, in Colombo that has paved the way for yesterday's attack in Colombo. Clause 1.8 of the ceasefire agreement states that all armed groups in NorthEast must be disarmed. Accordingly all these armed groups involved in disruptive activities must be disarmed immediately. We request that, the Sri Lanka military intelligence unit and the Sri Lankan Armed Forces, act according to the rules of the ceasefire agreement, and stop all such activities aimed at disrupting the peace efforts, and create an environment amiable for the peace efforts soon. We like to reiterate again at this juncture, that as one of the signatory to the ceasefire agreement, we will, preserve ! the environment for the peace efforts, and abide by the ceasefire agreement.

Water to Chennai

The city of Chennai and other cities suffer from acute scarcity of drinking water. It is proposed to install the first large desalination plant near Chennai in the State sector, and more such plants will be installed along the Coromandel coast. A desalination plant with a capacity of 300 million litres per day (MLD) is estimated to cost Rs.1000 crore, and there will be other costs for transmission pipelines and a captive power plant. It is proposed to implement the project through public-private partnership.

Sethusamudram Ship Canal Project

The Sethusamudram Ship Canal Project is a longstanding
demand – nay dream – of the people of peninsular India. I am happy to inform the House that the Environmental Impact Assessment study of the project has been completed by the National Environmental Engineering Research Institute (NEERI), Nagpur. NEERI is now preparing the techno-economic feasibility report and the report is expected to be submitted shortly. The Ministry of Shipping proposes to establish a special purpose vehicle (SPV). The SPV will raise funds for the project and Government will participate in the funding through a mix of equity support and debt-guarantee.

Fourteen Karuna men arrested in Hinguragoda are released on bail [Peace Secretariat - LTTE]

Accordingly, the fourteen men were brought to the Polonnaruwa magistrate court. The magistrate court does not have the authority to release on bail those arrested with dangerous weapons. However, the police placed a new explanation at the courts, which said that the men were arrested at a location in the temple that is different from the location where the weapons were found. The police submitted that since these men were arrested without any weapons in their possession, the police have no objection to releasing them on bail. Therefore the judge released all fourteen men on bail for Rs2500 each and postponed the case.

At least five people were killed and 11 wounded when a woman blew herself up in a police station in the Sri Lankan capital of Colombo. The rebels had no immediate comment on the blast. Television reports suggested the target of the attack was Douglas Devananda, a cabinet minister who belongs to a rival Tamil party and whose office was next door to the police station. The woman was brought from Devananda's office into the police station, it said.

- MOST CRUEL FORM OF UNTOUCHABILITY IN T. SHANMUGAPURAM VILLAGE [MANITHAM]

T. Shunmugapuram is a village in Ettayapuram Taluk of Tuticorin District in Tamilnadu. Nearly 50 houses of Dalits (Arunthathiyar), 150 houses of Rettiyars and 3 houses of Thevars are there. The Dalit people are subjected to the following crucial form of untouchability by the upper caste people.

1. The Dalit people should not rear male dogs to prevent the male dogs of the Dalit colonies from mating with female dogs roaming across caste Hindu area. This is a most cruel form of untouchability.

2. Whenever Dalit people went to the area of upper caste to fetch water from the hand pump, the upper caste people alone operate the hand pump. The Dalits are prohibited from operating the hand pump.

3. In the school, the Dalit students are seated seprately as to visibly expose the discrimination. The Dalit students are also provided with separate arrangements for ! drinking water.

4. A tea shop owner was sent out of the village for permitting the Dalits and upper caste people to sit together and have their tea/tiffin.

5. The V.A.O. and Thalaiyari concerned had obtained money of Rs.500/- each from 32 Dalits for providing Free Houses under Government Schemes. But so far no Dalit is given such free houses. The Dalit people are thus cheated by the Revenue Officials.

6. Only ladies of upper caste community are permitted to take bath in the public place built by the Government. Dalit ladies are not allowed. After the upper caste ladies taking bath, the place is locked. 

Our fact finding team sent to the village on 16-06-04 have confirmed the above acts of untouchability.

The officials at the helm of affairs are very much reluctant to deal with this case. As the Dalit people solely depends on the upper castes for their livelihood, they do not want to precipitate the matter. Anyhow, democratic and human minded p! eople and the Government cannot allow the above forms of untocuhability, even if there is no protest from the affected Dalits. Representation to the officials of Revenue and Police Department and Government of Tamilnadu were sent by the Communist Party of India (Marxist), Tuticorin District Committee, to intervene effectively so as to ensure social justice to the Dalit people.

A protest demontration is organized on 05-07-04 at Ettayapuram by Communist Party Of India (Marxist), Tuticorin District Committee, to draw the attention of Government to intervene. An E-mail to the Chief Minister of Tamilnadu and Chief Justice of High Court, Madras, on the above matter is highly solicited.

The dreadful dead of terror - By Sudha Ramachandran [Atimes]

A similar dread of the power of a dead militant is visible in Sri Lanka. When Sri Lankan forces entered Jaffna town in December 1995 (for several years until then Jaffna was under the control of the Liberation Tigers of Tamil Eelam - LTTE), one of their first targets of attack was a cemetery, where Tigers killed in combat are buried. The celebration of death and the veneration of its martyrs is a core component of Tiger ideology. The LTTE observes "Martyrs Week" from November 21-28 every year, when Tigers killed in combat are worshipped and their families honored. There is a spurt in the recruitment of fighters every year during and after Martyrs Week. Recognizing the immense capacity of fallen "martyrs" to draw new recruits and motivate its cadres, the LTTE's funerals are marked with pageantry. Although bodies of dead Hindus are generally cremated rather than buried, the! LTTE buries its dead combatants, whatever their religious background. A stone with details of the dead Tiger marks the burial site. Memorial stones are erected even for those combatants whose bodies could not be recovered, such as those who died in suicide missions.

Norwegian Foreign Minister Jan Petersen, on a three-day visit that ends Wednesday, will discuss with Indian leaders the deteriorating situation in Sri Lanka, diplomatic sources said Monday.Petersen, who arrived here Monday along with a high-ranking five-member delegation, is to meet Indian External Affairs Minister K. Natwar Singh and National Security Adviser J.N. This was announced on Friday at the ongoing session of UNESCO's World Heritage Committee at Suzhou, China, according to the UN body's web site.

On September 16, just five days after the 9/11 attacks in the US, the LTTE suicide cadres in speed boats attacked 'MV Pride of South', a ship carrying 1200 soldiers returning on leave, killing 11 navy personnel and injuring another 58 service personnel on board.

- Navy arrests 29 Tamil refugees in Talaimannar Sea [Tamil Net]

Sri Lanka Navy (SLN) Friday early morning arrested 29 Sri Lankan Tamil refugees and four boatmen in the Talaimannar Sea when they were returning from Rameswaram in South India. Refugees and boatmen were later handed over to the Talaimannar Police. The Police Saturday produced all the thirty-three persons in the Mannar Magistrates' Court. Acting Magistrate Mr. M.P.Farook remanded the four boatmen who are natives of Pesalai in Mannar district till 16 July for allegedly transporting Sri Lankan Tamil refugees without permission, legal sources said.The acting Magistrate further ordered civil officials that all the 29 refugees to be sent to their native villages in the districts of Vavuniya, Kilinochchi, Mannar and Batticaloa, the sources said.

- Remand extension through video in Tamil Nadu [Telegraph]

Tamil Nadu has become the first state to introduce extension of prisoners’ remand through video-conferencing, thus dispensing with the transportation of prisoners to courts. Chief minister Jayalalithaa inaugurated the Rs 8.61-crore state-wide facility in the secretariat on Thursday, under which all nine central prisons and nearly 270 courts would be interlinked. The facilities have been set up in 72 places, an official press release said. At the inauguration, Jayalalithaa witnessed the extension of remand of a prisoner in Vellore by a Chennai metropolitan magistrate. The police department used to spend nearly Rs 10.69 crore a year for transporting prisoners on remand from various prisons to courts. The new facility will also help prevent prisoners from escaping from police vehicles.

Police on Thursday dismissed allegations that a woman had auctioned her new-born daughter in Tamil Nadu’s Erode district. They claimed that the woman was mentally challenged and the child had been “taken” by a person who wanted to adopt her.An NGO had claimed on Wednesday that the woman auctioned her baby for Rs 4,000, hours after her birth. An inquiry conducted by the police’s special branch concluded that the charges were false. However, the report said a person called Prakash had paid Rs 2,000 to the woman on “humanitarian ground”.The NGO — Campaign Against Child Trafficking — had sent a fact-finding team to Kunnathur village and sought the intervention of the state government to ensure the child’s protection. The police report said that Prakash had told the inquiry officer that he was childless and had, therefore, taken “the helpless infant from its mentally retarded ! mother”. The child is under the care of Prakash, who is making efforts to legally adopt her, the report added.

“The Tamil Tigers are stealing children from their homes to put them on the firing line,” said Tej Thapa, South Asia researcher for Human Rights Watch. “Despite all their promises, they are demonstrating absolute disregard for the most vulnerable part of the population it claims to represent.” According to the U.N. Children’s Fund (UNICEF) and local human rights groups, the Liberation Tigers of Tamil Eelam (LTTE) are forcibly abducting children from their homes and threatening parents who dare resist or complain about the abductions. The armed group is believed to be focusing on abducting small groups of children rather than large groups, so as to slowly rebuild its forces without attracting too much attention. Its members have been going to villages in the Batticaloa district of easte! rn Sri Lanka, banging on doors, threatening parents with dire consequences in the event of non-compliance, and abducting 8 or 9 children from each village.

Vaiko told a press meet here that UPA's common minimum programme had welcomed the peace talks between the Sri Lankan government and LTTE and said it will support the talks.

The annual meet of the Marumalarchi Dravida Munnetra Kazhagam (MDMK) general council will be held at Tirunelveli on July 11 and 12. He said the meet would be organised to coincide with the anniversary of his arrest under the Prevention of Terrorism Act. The meeting would be held in a grand manner, he said. A conference of district secretaries would be held on July 10.

This tragic event took place yesterday. Although the people assembled at the appointed place at the appointed time of 9.00am the military officers concerned turned up nearly two hours later and when they met the legitimate residents, conditions and restrictions were laid against admitting the people to see their residences. Although the people struggled hard to get these conditions relaxed the officers persisted on them.

Raja has said. The minister said it has been “brought to my notice” that the livelihood of the poor in coastal areas could be adversely affected because of the notification. Several states have complained that it stood in the way of tourism projects worth crores and fishermen’s groups cried hoarse against restrictions on netting their source of livelihood. There are “certain difficulties” in implementing the notification, which impedes development work without contributing to environment conservation, Raja said. Thus, the decision to re-examine it. An expert committee headed by agriculture scientist M.S. Swaminathan has been set up to consider all relevant issues and come out with “science-backed and practical recommendations” to manage coastal resources, Raja said after inaugurating a two-day workshop organised by the Institute of Ocean Management, Anna University. Raja clarified that the review of the notification was an independent exercise that did not have anything to do with two “draft notifications” issued by the environment ministry under T.R. Baalu in the NDA government.

There are LTTE controlled guest houses like the 1-9 Lodge in Kilinochchi where an A/C room goes at Rs. 1,200 per day. Pretty reasonable given that there is no power grid other than gene! rators run by the LTTE. The bar that is in the same compound does brisk business.

Although she had always indicated that while the talks on ISGA proposals
are taken up, the core issues also have to be taken parallel to this, she said that day that since the Tigers have indicated that they can only talk based on the ISGA proposals, she had now decided to speak to them on the basis of the ISGA, not insisting on the core issues immediately.

Patterns coverIndia : The Indian Government remained steadfast in its desire to combat terrorism in 2003 and has worked closely with the United States in this regard. For example, several hundred Indian law enforcement officials participated in training as part of the Antiterrorism Assistance program. During the year, the Indian Government also moved to strengthen its international cooperation in curbing terrorism financing. In January, the Parliament enacted an anti-money laundering law that provides the legal basis for establishing a financial intelligence unit to monitor suspect transactions. In March, the Indian Government announced that 32 terrorist organizations had been listed under the Prevention of Terrorism! Act and, in July, informed Parliament that 702 persons had been arrested under the Act.

Sri Lanka : Sri Lanka continues to support our global efforts to combat terrorism as well as undertaking their own efforts to combat terrorism domestically. Sri Lanka has actively supported international regimes to combat terrorist financing as well. There were no incidents of international terrorism in Sri Lanka in 2003, as the cease-fire signed between the Government of Sri Lanka and he LTTE held, despite a halt in face-to-face negotiations and a serious political crisis within the Sri Lankan Government. There were no LTTE suicide bomb attacks throughout 2003, and the group continues to pursue ways to further peace talks. The LTTE has publicly accepted the concept of internal autonomy within a federal Sri Lankan state, conceding its longstanding demand for a separate Tamil Eelam state. In support of the peace process, the US Government has made limited, working-level contact with! LTTE authorities to facilitate delivery of humanitarian aid.

- Liberation Tigers of Tamil Eelam (LTTE) :

Other known front organizations:
World Tamil Association (WTA), World Tamil Movement (WTM), the Federation of Associations of Canadian Tamils (FACT), the Ellalan Force, and the Sangilian Force.

Description : Founded in 1976, the LTTE is the most powerful Tamil group in Sri Lanka and uses overt and illegal methods to raise funds, acquire weapons, and publicize its cause of establishing an independent Tamil state. The LTTE began its armed conflict with the Sri Lankan Government in 1983 and has relied on a guerrilla strategy that includes the use of terrorist tactics. The LTTE is currently observing a cease-fire agreement with the Sri Lankan Governm! ent. First designated in October 1997.

Activities: The Tigers have integrated a battlefield insurgent strategy with a terrorist program that targets not only key personnel in the countryside but also senior Sri Lankan political and military leaders in Colombo and other urban centers. The Tigers are most notorious for their cadre of suicide bombers, the Black Tigers.Political assassinations and bombings are commonplace.

Strength : Exact strength is unknown, but the LTTE is estimated to have 8,000 to 10,000 armed combatants in Sri Lanka, with a core of trained fighters of approximately 3,000 to 6,000. The LTTE also has a significant overseas support structure for fundraising, weapons procurement, and propaganda activities.

Location/Area of Operations : The Tigers control most of the northern and eastern coastal areas of Sri Lanka but have conducted operations throughout the island. Headquartered in northern Sri Lanka, LTTE leader Velupillai Prabhakaran has established an extensive network of checkpoints and informants to keep track of any outsiders who enter the group’s area of control.

External Aid : The LTTE’s overt organizations support Tamil separatism by lobbying foreign governments and the United Nations. The LTTE also uses its international contacts to procure weapons, communications, and any other equipment and supplies it needs. The LTTE exploits large Tamil communities in North America, Europe, and Asia to obtain funds and supplies for its fighters in Sri Lanka.

Among the participants were country and field representatives from UNICEF, UNHCR, ILO, WHO, ICRC, FORUT, OXFAM, CARE, World vision etc. The participants contributed immensely in the discussions relating to practices and procedures in the areas of development, resettlement, rehabilitation and many of them suggested valuable ways and means of cutting down bureaucratic and administrative delays in effective humanitarian delivery. Associated Mr. Tamilselvan were Mr. Thuyavan, Director of the PDS assisted by Eelamaran who provided the audience with a detailed power point presentation and Mr. Thgangan, Deputy Head of the Political Wing. Mr. Selvin Ireneus, Director of SIHRN explained graphically the necessity of capacity building of civilian based organisations and local NGOs.

As expected by the Tamils, the Sri Lankan president is at her tricks again. That is - giving the impression that she is ready for peace talks in one hand and totally rejecting them on the other. So far, this tactic has worked very well with her Sinhalese political friends and foes. It confuses them and, while they are trying to get out of the confusion, the president moves on. Will it work with the LTTE? There is no sign yet that it does. Tamils have experience from the days of the president's father. Furthermore, she is not doing something that her predecessors haven’t done, as far as Tamils are concerned. The Sinhalese political elites will never want to accept a peaceful solution unless they are forced to by someone. There are several pressures at the movement from inside and outside of Sri Lanka to accept a peaceful solution.

Ritualistic killing of animals has returned to Tamil Nadu despite a law against it with devotees sacrificing more than 200 buffaloes in a temple, 600 km south of Chennai. The offering was made on Friday in the temple of Kaliamman, a fiery Hindu goddess, in Karur district apparently for a good summer crop, without allowing the media to witness it.

The Tamil National Alliance (TNA), a proxy political movement of the rebel Liberation Tigers of Tamil Eelam (LTTE), had its first direct meeting with Kumaratunga since the April 2 parliamentary elections late Thursday. The TNA, which has 22 legislators in the 225-member assembly where Kumaratunga's Freedom Alliance is a minority government, insisted that a Tiger blueprint for self-rule be implemented to jumpstart stalled talks. Tamil politicians who were at the talks said they insisted on the LTTE's proposal for an "Interim Self Governing Authority (ISGA)" granting them financial and political autonomy be the basis for talks.

Death of parents as a result of bombing, death of parents due to shelling, loss caused by landmines, arrest by army and disappearance, shooting, attacks on boats are all in the stories of children. Death of a parent is only the beginning of the trauma faced by children. Many tell stories of how their parents have been injured in the attacks by the military and lost the ability to take care of the children. Parents have become separated from their children during displacement some of them never to be reunited. Perhap! s even more difficult for children to comprehend is how their parents could just walked away from them. Many parents have done so unable to carry the responsibility under extreme hardship. Some of these parents have come back looking for the children after the ceasefire of 2002.

Exclusive TIS Story on Cauvery A three-member central team will assess water availability in Tamil Nadu and Karnataka in the wake of a row between the two Southern States on sharing of Cauvery waters. And indeed it has taken all the arm-twisting charm of the Dravida Munnetra Kazhagam to correct this historical prejudice, a prejudice that has deep roots in our history and psyche. As early as 1835, Lord Macaula! y was claiming in his "Minute on Education" that "... it may safely be said that the literature now extant in [English] is of far greater value than all the literature which three hundred years ago was extant in all the languages of the world together."

In another development, Central Minister T.R. Balu has announced that the Sethusamuthiram project will start soon. One has to wait and see whether it will really start or not. However, the fact is that the UNF government in Sri Lanka tried hard to get that project dumped. It had agreed in principle with the BJP government to build a bridge between India and Sri Lanka, in order to make sure this project is dumped for ever. It is interesting that the Congress government allowed Mr. T. R. Balu to make that announcement when the BJP could not do that for its Tamil allies. It should be noted that T. R. Balu was part of the BJP government, too. With Sonia Gandhi in the actual driving seat of the Congress Party, is the attitude towards the southern neighbour changing in India? Or, has the Congress government with its formidable leader found courage to do things when BJP could no! t do? How does one interpret the Indian willingness to help the LTTE-controlled areas? Is it a genuine desire to reach out to the Tamils and the LTTE or one of those things to get intelligence operatives in the area? It is a funny old world.

New United Progressive Alliance [UPA] government has been taken charge due to a sea change of the people’s verdict in the recently held parliament election in India. In the Parliament election, World as well Indian people's view focused with eagerly on a particular State. i.e. Kashmir.

A team of Non-Governmental Organisations [NGO] and Human Rights Organisations from various parts of India, voluntarily conducted an Independent Election Observe [IEO] in Kashmir with the help of local NGO Group, JKCCS, situated at Srinagar, Kashmir.

Four phase of elections were held at Kashmir. On behalf of MANITHAM - a Human Rights Organisation based in Tamil Nadu, Southern part of India, its Executive Director, Mr. Agni Subramaniam was one among the IEOs and observed the First 2 phase elections held at Jammu  & Kashmir [J & k]. The excerpts of his views:

Question : You are saying that you were observed 2 phase elections at Kashmir. In which way you have observed?

Agni Subramaniam : In J & K, there were 6 parliamentary constituencies. Elections were held in 4 phases. I observed First 2 phase elections. [I phase in Jammu & in Barammulla and II phase in Srinagar].

We were coercion by Security Persons - Eventhen we won't vote : Kashmir YouthsAt Barammulla, I went to rural areas like Sopur and Rafiabad. These are very border areas of Pakistan. I met lot of people. As per my knowledge, I can tell that Kashmiris has not casted their vote willingly.! This is true story.

In Barammulla district a 16 year old boy came to cast his vote. I enquired,' you are below aged and how can you come for voting?’ He replied that his name is in the voter list and Security Persons knocked his doors in the early morning and compelled to cast his vote. Also the army persons said that after 2 days they will see whether the persons voted or not. This type of voice I heard in several parts of Barammulla district. This evidences shows that free and fair election has not been taken place in Kashmir election.

- "International donor community should respect the Tamil mandate for ISGA" - Tamilselvan [Peace Secretariat - LTTE]

The World Bank official met with Mr. S.P. Tamilselvan today 1st June 2004 at the LTTE Peace Secretariat in Kilinochchi to have further discussions on the feasibility of reactivating the NorthEast Reconstruction Fund to facilitate inflow of donor funds for urgent humanitarian needs. Mr. Tamilselvan stressed the importance of institutionalising the ISGA, fulfilling the Tamil mandate in the general elections of April 2004. "In the absence of an effective Interim Administration as democratically mandated by the Tamil people" Mr. Tamilselvan said "any other mechanism cannot cope effectively to address the urgent humanitarian needs of a nation of people affected by two decades of war." Mr. Peter Harrold acknowledged the validity of the Tamil claim and assured that the international community will remain committed to the Tokyo declaration which specifically reiterates the necess! ity to link aid to progress in the peace process.

- URGENT ACTION : Brutal attack on Dalits settlement in the Kalapatti village of Coimbatore district, Tamil Nadu, India, by the upper caste people on 16/5/2004 [AHRC]

The People's Watch -Tamil Nadu and the Dalits Human Rights Monitoring (DHRM) are deeply concerned over the brutal and inhuman attack on a Dalits settlement in the Kalapatti village of Coimbatore District, Tamil Nadu, India by the upper caste people of the same village. Nearly 100 Dalits' houses were attacked by 200 upper caste members using swords and other sharp and deadly weapons. Many Dalit houses were burnt and properties like televisions, grinding machines and cycles were damaged or set on fire.

Unidentified gunmen shot and killed an ethnic-Tamil journalist in eastern Sri Lanka on Monday, police said. G. Nadesan, correspondent for the Colombo-based Virakesari Tamil daily newspaper, was shot when he was going to a temple in the town of Batticaloa , said a police official, speaking on condition of anonymity.The motive behind the slaying was not immediately known and there was no claim of responsibility.

Brutal attack on Dalits settlement in the Kalapatti village of Coimbatore district, Tamil Nadu, India, by the upper caste people on 16/5/2004

The People's Watch -Tamil Nadu and the Dalits Human Rights Monitoring (DHRM) are deeply concerned over the brutal and inhuman attack on a Dalits settlement in the Kalapatti villag! e of Coimbatore District, Tamil Nadu, India by the upper caste people of the same village. Nearly 100 Dalits' houses were attacked by 200 upper caste members using swords and other sharp and deadly weapons. Many Dalit houses were burnt and properties like televisions, grinding machines and cycles were damaged or set on fire.

The perpetrators also killed the cattle of the Dalits and set fire to the cattle. They assaulted women by sexually abusing them trying to pull off their sarees. Nearly 100 Dalit houses were completely burnt to the ground due to these fires. Most of the people sustained serious injuries all over their bodies including their heads, necks, backs, cheeks etc due to the cuts caused by the sharp weapons. The upper caste people also pushed the Dalits to the ground and stamped them with their legs, abusing them using degrading caste names. The dominant caste mob had taken away money and jewels from the Dalit houses as well during the violence.

This b! rutal attack was carried out for nearly two hours, from 6.30 -8.30 p.m. The Dominant caste mob was so violent that the 8-month year baby boy of Gopal and Nithya, who was sleeping in a cradle, was hit against the wall in a most inhuman manner. Also a 75 year old Muthan s/o Mottaiyappan who was just then returning from work to the village was hit by sharp weapons immediately when he got off from the bus. This innocent old man did not know for what reason he was attacked so brutally. Another old woman named Valliammal (45 years) w/o Kittan was hit on her head and started bleeding badly when she went to rescue her son. Most of the Dalits tried to escape to save their lives. But they were further stopped on their way out and attacked with weapons once again. In this occurrence, 14 Dalits were severely attacked with sharp and deadly weapons, and they sustained terrible injuries, and have been admitted to the Coimbatore Medical College Hospital. Today their lives and security are threat! ened.

In the light of the above occurrence, we would like your solidarity in condemning this brutal attack, which is the result of the horrendous caste system that prevails in India. Find enclosed the findings arrived by our Fact- Finding team, who visited the place of occurrence and met the victims. (Refer to the website address above.)

We request you to demand immediate action by the respective authorities on this violence against the Dalits in India.

- Are They Trying to Take Us for a Ride? - By Rajkumar Sivapatham [Sangam]

The USA and India have recently made statements on the Tamil issue which need some careful examination. The USA’s Ms. Rocca made a statement asking the LTTE to lay down their arms. There have been different reports on exactly what she has said. However, at the outset, she wanted the LTTE to stop the violence. If she meant the same, it is worthwhile for the USA to note that the LTTE stopped the violence in 2001 after signing the CFA. If Ms. Rocca wants the LTTE to disarm itself
that is another matter. If the LTTE disarms, they become a bunch of people who can only scream when the Sri Lankan army beats the hell out of Tamils. We like to think that Rocca's statement is not intended for the LTTE but for the JVP and other hardliners in the south.

Indiaa! nd adivasis (tribal people) – was exacerbated by widespread use of security legislation, political interference with the criminal justice system and slow judicial proceedings in a continuing climate of impunity. Tensions remained high in the state of Gujarat in the aftermath of widespread communal violence in 2002. Witnesses to the violence and human rights defenders were threatened and concerns grew about the impartiality of institutions of the criminal justice system in the state, including the police, prosecution service and elements of the judiciary. In a meeting that lasted for about 90 minutes, Mr. Erik Solheim, the Special envoy to Sri Lanka and Mr. Hans Brattskar, the Norwegian Ambassador to Sri Lanka conveyed to Mr. Tamilselvan the thinking of the President on recommencement of peace talks. Mr. Solheim said that the President is of the view that the discussions on ISGA proposals should take place parallel to the discussions on core issues.

Chief of banned outfit Tamil Nadu Liberation Army (TNLA), Suba Illavarasan was arrested today.Suspected to be a close associate of forest brigand Veerappan, Illavarasan, was arrested by the Special Task Force of Tamil Nadu from Erode area. Illavarasan, who had been evading arrest since long, was wanted in several cases including bomb blasts at Ariyalur, Perambalur and Villupuram TV station.
