* or a private citizen in the unorganized militia, operating under the auspices of

- the Second Amendment of the U.S. Constitution
- Article 2, Section 6 of the New Mexico State Constitution
- Article 18 of the New Mexico State Constitution
- Title 10 USC 311
- NMSA 20-2-2
