The Mortgage Industry changed dramatically in the late 1970's with the Introduction of securitization. The Tax Reform Act of 1986, Public Law 99-514, 100 Stat. 2085, statutorized the tax benefits of securitization under what is statutorily defined as the Real Estate Mortgage Investment Conduit. This statutory provision of the Federal Tax Code is generally known as Asset Backed Securities, which may be found listed on the Security and Exchange Edgar Search Engine.

The Internal Revenue Service publishes on line only; an annual report listing newly minted Real Estate Mortgage Investment Conduits in the agency publication known as Publication 938.

Knowledge is the key to success, that comes from learning local State laws, and the procedures involved in the foreclosure process, to show why the alleged holder in due course is wrong by discovering and subsequently exposing the inherent errors of the statutory parties that collectively lie within the Real Estate Mortgage Investment Conduit, which may be referred to as a “Loan Trust”.
