Re: [midlothiantexas] Texas Constitution: Second Amendment Regulation

How does regulating where the arms are worn violate the Constitution? Where in the U.S. Constitution does it explicity or even indirectly state that weapons and firearms are to be free from regulations?

The right to keep and bear arms, to me, is not being infringed by a state, in this case Texas, simply regulating where the firearms are worn.

It's all about interpretation. Just because we also have the right to a free press doesn't mean you're going to have one, Gned. Does that make sense?

The interpretation also comes in where our Supreme Court (the federal, not the Texas one) defines what is an "arm." Arms do not include grenade launchers, or do they?

I definitely favor open carry, but Texas' government, by consent of those who elected representatives, allowed for the concealed carry regulations.

- Of course even if by this interpretation of the Texas
Constitution, Texas decides to (as it already does) regulate or
otherwise limit or suspend our RKBA, this would be a violation of
the US Constitution's 2nd amendment. The 10th amendment doesn't give
states the right to ignore the US Constitution's protections of our
rights, in fact even without the 14th amendment, the Supremacy
Clause in the US Constitution is supposed to protect our rights
throughout the US at every level.

Regulation

Joey,

In case you did not get the point of Zack's post:

The Texas Constitution does not protect your right to concealed
carry.
Quite to the contrary, it authorizes the Legislature to prohibit
cancealed carry. All they have to do is "find" that concealed carry
causes crime. Then they can prohibit it.

(They would be factually wrong, but as long as they followed the
correct procedure they could prohibit concealed carry. Concealed
carry reduces crime, but legislatures regularily make findings that
they are unable to prove..)

The Constitiuional Convention (or whatever it was called) was
probably
trying to protect your RKBA but allow the Legisture to restrict open
carry. It just happened that the language they chose allows the
Legilature to prohibit concealed carry.

Once again, your knowledge of Texas laws and procedures has proven
imperfect. You might want to remember that before you make further
sanctimonious comments about other people's understanding of Texas
laws.
