In reading the sample letter in the warning post in which Customs cited New York
statistics, I smell the foul stench of New York Mayor Michael Bloomberg at work.
This is the same man who sent rogue straw men to gun stores outside of New York
City and New York State, had them purchase firearms with phony i.d.'s, and then
had ATFE close down the law abiding gun stores and fine or imprison the owners.
I would also not be supprised if the U.N. was not in the backround on this. Why?
Because they do not want people to be able to protect themselves in any way,
shape, or form. They are trying to follow the European Union in banning all
firearms and edged weapons. We all need to write not only our elected
representatives but President Obama, as well(with paper snail mail letters, not
e-mail).
My wife and I, along with my sister-in-law, her husband, and my nephew all carry
assited open knives. I find it to be indispensible in daily use. I have even cut
steak at a restaurant that ran out of steak knives.

Subject: Assisted Opening Knives are GONE thanks to U. S. Customs

U. S. Customs has already ruled that assisted opening knives are
switchblades and therefore banned from import--this is a new ruling despite four
previous ruling that said they were not. This was announced May 25th, with a
comment period that expires June 21 (which is on a Sunday with no mail
delivery). They have refused to extend the comment period despite a request
from the American Knife and Tool Institute.

As a knife owner your comments can only been heard by Customs in written
form, and that comment has to be received in writing by them by this weekend. If
you care about your knife rights, you HAVE TO WRITE TODAY, and MAIL IT TODAY!
We have no time.

I have emailed and called my congressman and both U. S. Senators and
requested they do something--but since this is a ruling and not legislation
there is not a lot they can do before this ruling goes into effect on July 21.
Call your congressmen and senators and cite a local tie in on how it is
affecting voters in their districts or states, and request they rattle the cages
of the bureaucrats at U. S. Customs who are attempting to restrict our freedom
of knife ownership.

For your reference here is the address and a copy of my letter:

19 CFR Part 177
U.S. Customs and Border Protection
Office of International Trade, Regulations and Rulings
Attention: Intellectual Property and Restricted Merchandise Branch
Mint Annex, 799 Ninth St. N.W.
Washington, D.C. 20229

Gentlemen:

I write this letter to protest the reversal of your definition of assisted
opening knives from that of functional knives to that of illegal switchblade
knives.

These knives are utilitarian as any knives are in the kitchen and the
workplace. They are no more designed as weapons any more than an ax,
screwdriver, or baseball bat is designed as a weapon. The knife has the curse of
being one of man's most useful tool—and can be utilized as a weapon outside it's
original designed purpose just as much as any of the aforementioned items. The
use of a knife as a weapon in an illegal manner is already a crime, and
therefore the legal deterrent is in place for illegal knife use, and doesn't
need Customs adding to the regulation.

Your designation changes an inanimate tool into the class of a weapon
based totally on language without any specific facts or crime statistics that
proves an assisted opening knife is more dangerous or more of a weapon. I would
suggest that before your agency bans importation of a type of knife that has not
been proven dangerous and whose ban would unemploy a large number of Americans
that you have some statistics to back up your actions.

I noted in your rationalization of the revocation of the assisted-opening
knife letters that you cited several cases on the state level from New York,
certainly one of the most restrictive states out of all 50 when it comes to
personal rights. However, I question why would you put the New York decisions in
your rationalization while leaving out the state ruling in Oregon, (Oregon vs.
Delgado) in which that state switchblade act was held as unconstitutional. If
you bring state law into it your omission of that state case, or of other state
decisions in which those state courts have determined assisted opening knives
were not switchblades, it appears that this has been an arbitrary decision
without sufficient research, forethought, or knowledge of cutlery. Nor does it
appear an objective decision but a blatant attempt to infringe upon our personal
freedoms.

The reality of an assisted opening knife is that it is a convenience. Some
women enjoy small assisted opening knives simply because they can open a knife
without breaking a fingernail. Any first responder can testify to the essence
of a quickly opening knife should a seatbelt need to be cut to extract someone
from an automobile accident. A stockman with a calf tangled in a rope certainly
appreciates a knife that can be opened quickly, with one hand.

There are many other reasons that I could cite here, but for brevity's sake
I would hope I've made my point. There are thousands of others who would have
weighed in on this issue had Customs been willing to extend the comment period
as requested. This rush to make this change with a short comment period denies
thousands of knife collectors' and owners' comments to be heard, as it is
impossible for knife magazines to properly inform their readers on this assault
on yet another one of our freedoms.

I would ask that you reconsider the revocation of your earlier letters,
and instead of Customs' decision being a danger to our personal freedoms,
concentrate on genuine dangers to our country's security.

The fact that we have government officials that consider this an important
issue on which to spend research time, effort, and if it goes into effect, into
enforcement, is an appalling waste of limited government resources.

       Sincerely,

      J. Bruce Voyles, Editor
      Knives Illustrated Magazine

      P. S. My qualifications for commenting on this subject are as follows:

I personally have written numerous knife books, edited the Knife entry for the
World Book Encyclopedia, been accepted as an expert witness on knives in US
District Court. I have appraised knives for donation to the Smithsonian
Institution, and have been a auctioneer of knives for over 10 years.

The only threat that assisted opening knives have over any other type of knife
is simply in the mind and imagination of a non-knife owner who has never carried
or used them.

In my opinion Custom's action in this issue is a misuse of government assets on
a issue that had no need even be considered.

We are circulating this letter as this is a very real danger that is going into
effect in less than 60 days unless we raise enough of a stink that the
bureaucrats are forced to change their minds. The letter explains it--but keep
in mind the decision to ban one-hand opening knives, and assisted opening knives
has ALREADY BEEN MADE!
We have to put pressure on them to convince them it is better for them if the
change their minds. This is the most dangerous threat to our knife rights since
1983.

Read this and send a letter to customs--and call your politicians today. This is
a CLEAR DANGER TO OUR KNIFE RIGHTS.

Bruce Voyes.

P. S. Please send this along to every knife collector you know and urge their
action as well.
AKTI is on it as well. The major manufacturers are assembling a legal team to
fight it, but it will not matter once this law takes effect. THIS IS NOT
LEGISLATION BUT A BUREAUCRATIC RULING THAT GOES INTO EFFECT WITH NO DEBATE.

Here's Doug Ritter's letter.

The U.S. Government Is Trying To Take Away Your Pocket Knives!

The U.S. Government is after your Pocket Knives! In a sneak attack, U.S. Customs
has proposed revoking earlier rulings that assisted opening knives are not
switchblades. The proposal would not only outlaw assisted opening knives, its
overly broad new definition of a switchblade would also include all one-handed
opening knives and most other pocket knives!

Knife Rights is geared up to help win this fight, but we cannot do it without
your help, your emails, your letters. The fight can only be won if we raise
enough hell that they are convinced they will not get away with this. YOU are
the most effective arrow in our quiver, the most powerful cartridge in our gun.

Read on for the whole story and how you can make a difference and save your
Knife Rights.

Knife Rights was formed three years ago because we knew it was only a matter of
time before there would be a major attempt to take away our knives, as has
occurred in England, Europe and elsewhere. Up until now, the battles have been
fought at state and local legislative levels, such as the recent scare in
Hawaii: <
http://www.kniferights.org/index.php?option=com_content&task=view&id=72&Itemid=2\
9
>. It has been a battle of a million little cuts. Little did we guess that the
first major battle at a national level wouldn't come head on, but with
government bureaucrats trying to sneak it by everyone, avoiding a more
conventional legislative battle, which they'd likely lose.

U.S. Customs & Border Protection (CBP) just a bit over two weeks ago on May 21st
proposed revoking earlier rulings that assisted opening knives are not
switchblades. The proposed new rule would not only outlaw assisted opening
knives, its new broad definition of a switchblade would also include one-handed
opening knives and could be easily interpreted to cover most other pocket
knives, even simple old-fashioned slip-joints. At this point, one-hand opening
and assisted opening knives are 80% of U.S. knife sales (per AKTI industry
sources). For most knife companies, they represent all or the majority of their
product lines. These are the knives Americans take with them to work and to play
everyday.

Note, please, that CBP's interpretation of the Federal Switchblade Act forms the
basis for national, state and even local law and judicial rulings in many cases.
This ruling by CBP is NOT limited to just imports. This WILL affect virtually
everyone who carries a pocket knife, no matter the type!

CBP came up with this absurd proposal and then tried slipping it into their
regular notices, apparently hoping nobody would become aware of until too late.
They provided for only the minimum 30-day comment period, and there's no email
comments allowed. Obviously, they'd just as soon not hear from us. We're
intending to disappoint them in that.

CBP's proposal which would have effects far beyond that suggested in the title
of the proposal, "Proposed Revocation Of Ruling Letters And Revocation Of
Treatment Relating To The Admissibilty [sic] Of Certain Knives With
Spring-Assisted Opening Mechanisms," which would be bad enough even if it only
did that. However, this proposal would make it illegal for the estimated 40
million law-abiding Americans who own and carry pocket knives to do so. It would
also cost this country dearly in destroyed businesses, lost jobs and ruined
families. Thousands of jobs and billions of dollars would be lost. CBP clearly
appears to not have considered the consequences of this unnecessary,
inappropriate and even illegitimate action. Since CBP is not required to
consider the effects of their actions, only Congress or the courts can rein them
in. If left to the courts, the industry and our rights will be devastated and
America will lose much, regardless of who wins the legal fight.

The definition of what is a switchblade has been clear and settled for the most
part since the Federal Switchblade Act was passed in 1958 and has been
reaffirmed by many years of legal decisions. The Act is very clear that a
switchblade must have an activating button on the handle. Without a button, it
is not a switchblade and this has been upheld by numerous cases on many levels
over the years. CBP's convoluted reasoning in their proposal to reach back
beyond the law and to expand their regulatory purview by rationalizing "intent"
as justification for this new interpretation is a stretch, at best, and
illegitimate at worst. It simply doesn't meet the common sense test.

CBP's reaching beyond the clear language of the Act in making this proposal is
particularly questionable and irreconcilable because it flies in the face of
virtually unanimous recent state court rulings (including several cases in
California, Texas, Illinois and Michigan) where the issue of assisted-opening
knives has already been decided in favor of the existing clear interpretation,
that they are not a switchblade. They cherry-picked a few bizarre and untypical
rulings from New York state from some years ago to provide support for their
proposal, ignoring the many more recent rulings.

For CBP to ignore this overwhelming existing body of law is inexcusably arrogant
and borders on a reckless abuse of their power. For them to suddenly do an
about face is akin to moving the goalposts after starting the game, and then
completely changing the rules of the game besides, making every play ever
devised illegal.

Beyond that, their significantly expanded interpretation of gravity and inertia
knives, also included in the Act, would clearly make one-hand opening pocket
knives illegal and according to industry sources, 80% of pocket knives sold
today are one-hand or assisted openers. Beyond even that clearly excessively
broad seizure of authority, we know from past unfortunate experience in many
cases over the years that this sort of misinterpretation leads to potential
abuse by law enforcement where even the most simple and innocuous Boy Scout
folding pocket knife can be opened one-handed by use of dangerous and unsafe
tricks, so that these too would be covered under this expanded federal
definition. This ruling would therefore make almost all pocket knives subject to
being considered switchblades.

The impact of this CBP ruling would go far beyond just imported knives because
this "agency determination" will be used by domestic courts and law enforcement
to determine what is a "switchblade" under both federal and state laws. Many
states do not themselves define switchblades and simply rely on the federal
definition and interpretation, which is only found in rulings by CBP. Since
interstate commerce in switchblades is prohibited, except under very limited
conditions, simply driving across a state line with a pocket knife in their
possession would make someone a federal felon.

Knifemaking in the U.S. has enjoyed a renaissance in the past decade or two as
the genius and innovation of American knifemakers, designers and manufacturers
has created a booming and vital American industry with thousands of exciting new
knife designs that improve the function, utility and safety of the lowly pocket
knife, one of man's oldest and most useful tools. Millions of Americans have
responded to this innovation, creating a vibrant industry. For the most part
these are family owned businesses that are American success stories, the core of
America's economic strength. This proposal by CBP would destroy all that for no
good reason. They don't need a bailout; they just need to be left alone to
prosper.

The knife industry tells us they employ nearly 24,000 Americans and have a
nearly 6 billion dollar annual impact on our nation’s economy. If this
proposed ruling is allowed to stand, thousands of jobs will be lost at the
direct cost of billions of dollars. That doesn't even begin to cover the
enormous cost to the country of those that would become unemployed, the ruined
businesses, foreclosed homes, years of litigation by both industry against CBP
and who knows how many criminal trials and appeals as law-abiding Americans
fight this abusive attempt to take away their knives, as well as many other
devastating unforeseen effects of this ill-considered proposal. Thousands of
American citizens’ lives would be ruined. Millions of Americans would be
impacted. The cost would be tragically huge, more so because it is neither
necessary, nor desired by the vast majority of Americans.

We are in for the fight of our lives to save our Pocket Knives and our essential
Knife Rights. We can only win if you do your part. You have to write!

Our first step is to convince CBP that we deserve more time to respond. Knife
Rights has sent a letter to CBP requesting an extension to the ridiculously
short 30-day comment period:

http://www.kniferights.org/CBP-extention_request_FINAL.pdf

We need your help to make an impression on CBP. They figured that they could
slip this by everyone with little notice. We need to let CBP know that they are
not going to get away with it; that we noticed and we are not happy and that we
will not stand by while they take away our pocket knives.

We need you to write CBP NOW! Their 30 day deadline is fast approaching and
these letters must go via postal mail (or Fedex/UPS). Click below for a Model

However, the reality is that CBP isn't required to listen to our demands, but
they do have to answer to Congress. After you send a letter to CBP, giving them

Congress with emails and letters.

Our second flash auction is now open for bidding, and will close at 11 p.m.
eastern time on Tuesday, June 9. We have 110 lots with a wide variety of knives
ranging from vintage to modern, and includes the extensive library of the late
well known collector Fred Hunter.

This is a working collector's library, and as such some of the books are well
thumbed. On a few he even made tabs for quick reference--so if a quest for
knowledge is a part of your knife collecting, this auction is for you.

Our upcoming schedule includes:
This weekend, National Gun Day, Louisville, KY, Fairgrounds

June 11, 12, 13. Parker's Sevierville, TN Knife Show. (Auction after the show
closed on Friday-no catalog, you have to be there!)

June 20, 21, Kenner, LA, Ponchatrain Center, Kenner Gun Show.

June 27, 28 Gonzales, LA Gun Show.

Coming soon our Legends of Handmade Knives auction. List is on our website.
Also Catalog Auction 48 and the auction for the benefit of the National Knife
Collectors Association's prototype collection of one-of-a-kind knives. All in
the coming weeks.

Quick tip: The Department of Homeland Security's ICE divison (formerly Customs)
has changed their mind and now decided, after giving four separate opinions that
assisted opening knives were NOT switchblades, even the knives have not changed,
they now have ruled that assisted opening knives ARE switchblades, and therefore
banned from import as of July 20, 2009. The industry is banding together to
protest--but remember this is not a legal battle but a bureaucratic decision. We
will keep you updated on our website--but for the moment if you like assisted
openers I'd suggest you try to lay a few back!

Does anyone know the first type of Button knife, that EdgeMaster made?

I have a antique looking silver, with unique swirly lines design,(like
the design of bark from a tree),on the handels. This is old, 1940's
looking, with Edgemaster USA on the blade. It is all stainless steel, no
rusting and has a safety switch, under the button.

Thanks, for any help.......

Hello all. Just a few questions. I recently purchased an older knife
on ebay and it arrived with what seems to be a clear plastic-like
coating coating covering it. anyone know what this might be and how I
would remove it.

2. What are your thoughts about cleaning vintage knives, and how would
you go about doing it without damaging the knife and its value?

Thanks!

- Peter

Can ayonehelp on the price line on some Hen & Rooster knives that I inherited from a death in the family? Two of them are single bladed; one of eight hundred and one of six hunred stamped on the blades. They are bone handle with the emblem of Worlds fair in knoxville, tn. and are in mint condition. The trouble is that I don't know their value t start on the market for sale. Any ideas on their value would all be appreciated.

Hello Group,
I've got two pre 1985 Buck folders which belonged to my Grandfather.
Unfortunately both have broken tips on the main blades. Does anyone
know of a repair service to repair these knives with the appropriate
blades?
Thanks,
Ben

Apologies for the mass of posts from the group--as moderator something
happened that bounced my emails for a few days and Yahoo turned off
access. Up and working now though.

We have a short highlight video on youtube of some of the knives
featured in our auction 43, to close on Feb. 5, 2009.

We now have online bidding at www.jbrucevoyles.com and are taking bids

Hi CW,

I believe I can help you with your Marble Knife. The Marble knife
company you contacted is unfortunately not the same company that your
grandfather purchased his kife from. pPease send me a few pictures of
the knife showing it at different angles. If you want you can send
them to me email address ceberting@... - Let me know if you
have any questions or concerns.

Thanks,

Chris

Hello Group,
I have an old Marble's Hunting knife with stag horn handle. My
grandfather owned the knife and passed it on to me. I have been trying
to find out the age of the knife, with no luck. I have contacted
"marblearms.com" but they have not responded. I have photos of the
knife that I would be willing to send to someone if they would be
willing to help me find some information about it. There doesn't seem
to be a way of posting pictures with this post. I have found out there
is a book, "The Encyclopedia of Marble's Knives and Sporting
Collectibles", that may hold some information, but it cost over
$60.00. I was hoping to find someone with that book or knowledge of
old Marble's knives.
If you think you would have the time and would like to see the
photos, please e-mail me and I would love to send you some.
Thanks for all your help,
