Beyond Guantánamo: How to Restore the Constitution

 

The Center for Constitutional Rights filed the first Guantánamo case in 2002, just 6 weeks after the first detainees were brought to the camp. It resulted in the landmark victory Rasul v. Bush, in which the Supreme Court ruled that the detainees did indeed have the right to habeas corpus. On December 5th, CCR again represented Guantánamo detainees before the Supreme Court.  The case will decide more than the fate of these detainees; it will impact many of the central issues we face today—the existence of meaningful congressional oversight and independent judiciary reviewing executive and legislative actions, both necessary for creating real checks to excessive claims of executive authority. To move beyond our country’s mistakes, to move beyond Guantánamo, will take courage from

citizens and elected leaders alike, who each can play a part in insisting that basic rights be reinstated and

human dignity be restored.
