The following message is being sent on behalf of Jack Reed:

Dear Colleagues:

I have spent an excessive amount of time and money in researching and
revising the attached amendment.  The amendment is based upon the
Banking Committee's rejection of a previous amendment, which they said
was too broad.  It was then determined that we had to narrow our focus
to get approval for exceptions.  My Congressman, Ed Royce, and
Congresswoman Roukema had reserved space for an amendment, which was
approved by Jim Leach, to address their concerns.  Jim Leach and the
staff had told NCISS that there would be no exemptions for PIs because
there are some "bad guys" out there, and in a private memo prepared by
Eddy McClain, he stated that the staff was not in favor of the amendment

he is now proposing.  I had our amendment drafted based upon amendments
to the bill, which included the Federal Reserve having oversight
authority and the FTC having enforcement authority. The word I get is
that If they do not have the authority to supervise who is going to
access the information and how, no amendment will be accepted.  If the
amendment I have proposed is accepted, we will have nine months to work
out the details with the FTC and Federal Reserve.  It is now up to you
to support one of these amendments.  If you choose to support mine, I
ask that you send a copy of your letter to Ed Royce's office in
Washington, DC, a copy to the Banking Committee and a copy to your
Congressperson.  You should do this immediately, as every hour makes a
big difference with all that's going on in Washington. The ball is now
in your court!

PROPOSED AMENDMENT TO HR 4321


Add the following after Section 1003(e):

(f) NONAPPLICABILITY TO CERTAIN ACTIVITIES OF LICENSED PRIVATE =
INVESTIGATORS -

(1) No provision of this section shall be construed so as to prevent a =

qualified licensed private investigator, or its officers, employees or =

agents, acting on behalf of a client, from obtaining customer =
information of a financial institution, to the extent reasonably =
necessary to do so in order to facilitate -

(a) execution of a judgment entered by a federal or state court;

(b) collection of child support;

(c) collection of fines or assessments ordered by a federal or state =
court or agency.

(d) Enforcement of an order entered by a federal or state court for =
attachment of assets; or

(e) Tracing of assets conveyed fraudulently within the meaning of Title
=
___, United States Code.

(2) For purposes of this subsection, a "qualified licensed private =
investigator" is an investigator or an investigative agency that -

(a) is licensed and in good standing under the laws regulating the =
business of private investigative or security services of the state in =

which the investigator takes any action that would otherwise be subject
=
to this section; and






(b) beginning one year after the effective date of the Financial =
Information Privacy Act of 1998, is in substantial compliance with =
applicable regulations issued by the Federal Trade Commission and the =
Board of Governors of the Federal Reserve System, as provided in =
paragraph (3) of this subsection.

(3) Within nine months after the effective date of the Financial =
Information Privacy Act of 1998, the Federal Trade Commission and the =
Board of Governors of the Federal Reserve System, pursuant to a joint =
rulemaking proceeding, shall promulgate such regulations as those =
agencies deem sufficient to further define and limit the class of =
licensed private investigators whose activities fall within the =
provisions of this subsection.  Such regulations may include:

(a) a requirement that licensed private investigators subscribe to and =

meet the requirements of a self-regulatory system or procedure =
designated by the Commission and the Board as adequately protective of =

the personal privacy interests of customers of financial institutions;

(b) a requirement that licensed private investigators register with, =
make periodic reports to, and respond satisfactorily to inquiries of =
the Commission, or the Board or both of them, or any other entity =
jointly designated by the Commission and the Board, including a further
=
requirement that licensed private investigators subject to this =
requirement be assessed fees sufficient to cover the reasonable costs =
of maintenance of such registry, reporting system, and inquiry and =
response system as the Commission and the Board may jointly institute; =

and

(c) such other regulations as the Commission and Board shall deem =
appropriate to protect the personal privacy of customers of financial =
institutions, while ensuring that the implementation and enforcement of
=
this Title does not unduly interfere with the legitimate activities of =

qualified licensed private investigators in support of civil or =
criminal litigation in the federal or state courts.

Differences in amendment proposals, IRSG vs.NCISS from Jack Reed

In response to a question from Robert Parke (NALI ASST ND) about
differences in proposed amendments of Jack Reed & NCISS, Reed posted:

I have stated my reasons three or four times.
Briefly; Jim Leach Chairman of the banking committee told NCISS that he
would not approve an exemption for PI's.
He wanted to know if Eddie was a member of IRSG, Eddie said "NO".
The questioning ended.
Eddie said in one of his memos that the Banking Committee staff had not
responded favorable to the NCISS proposed amendments.
I read the NCISS amendments as exemptions with no guidelines.
The last amendments to the bill included booth the FTC and the Federal
Reserve as the enforcers.
Can you believe they will accept any amendment without having the
ability to regulate.
Also I am sure that Leach wants to see some form of self regulation,
NCISS did not include either, I did.

         The Senate Banking Committee this morning approved HR 10, a huge

         financial modernization bill, to which the text of S 2433
(D'Amato's
         companion bill to HR 4321) was attached as an amendment.  No
changes
         were made to S 2433 as introduced (which conforms to HR 4321 as
reported
         by the House Banking Committee, i.e., with the law enforcement
exception
         and the other changes).

         I spoke today with the Senate Banking staffer whom Pat McCarty
suggested
         I call -- Dean Shahanian.  He said that HR 10 was moving but not

at
         lightning speed and there was time to talk about either report
language
         or even amendments to appear in the Manager's Amendment when the

bill
         goes to the floor in the next couple of weeks.  I sent him our
material
         (cc to you via fax) and will follow up with him next week.  I
will also
         pursue the contact on the majority Senate staff (Shahinian is
minority)
         whom McCarty had given to me.

         What I don't know at this point is whether HR 10 is still
controversial
         and therefore is unlikely to be able to move through the Senate
at this
         late date in the session, or whether all the controversial
issues have
         been worked out and the bill is likely to move quickly once it
gets to
         the floor.  I would bet on the former, not the latter, but I
will try to
         find out more next week.

I applaud and T H A N K  Y O U  for your comminique' asking CALI members

to send letters to Congress and Senators.

Cali and many of it's members are also members of NCISS. We are all on
the same  TEAM  and  ALL  after the same goal, an amendmant to HB 4321
SB 2433.There are obviously differing opinions as to how to reach said
goal.

DILEMA may appear to some members of CAlI  as to which of the two
official "sample letter" they should send. At this point no matter which

version you choose  SEND NOW.

Differences in the two samples are many. At this juncture I wish to only

query one. I do ask for your thoughts in this area..

(3)(b) I partially quote, "private investigators subject to this
requirement be ASSESED FEES sufficent to cover the reasonable cost of
maintenance"   etc.

My comment to the above is that I feel I am being Taxed (in place of
assesed) enough. In some cases of PIs they are being taxed for:
City tax
County tax
Federal tax
PI tax
Income tax and so on and so on.

I am asking in a Professional Manner why we want to allow the proverbal
"fox in the hen house" (fed govt) to tax or assess us more?????

We of course have no way of knowing if either letter or the strong
lobbying efforts will be victorius. We can only hope all the
monies,hours and efforts will be fruitful. Surely no one should
question why they should be a part of an association (team).

The  H E L P  of all PIs  need to    and   must  send letters in order
to have  a chance.  Additionally it won't hurt for PIs to ask friends
and relatives to also write.  Remember Washington only cares about
votes.

Many thanks to all who responded to our request for Alabama Process
Server Agents. We would also like to thank all of the other professional
process servers who responded from other areas of the country as well.
All company information was entered into our database.  I will be
sending additional information to all who responded to my post on
Monday.

We currently have approx. 50-100 documents that need to be served within
AL (and some bordering states) each month.  I will contact each agency
by phone to explain details, etc.

I would also like to thank all of the list/network moderators for
offering these forums for everyone's benefit.  It proves to be the BEST
INVESTIGATIVE TOOL for anyone in the business!  Also, if anyone has yet
to subscribe to PI Magazine, which I feel is the best professional

Well, I have one.
Is there any propram available that will accept entries for "name"
"address"  "phone"  "license plate #"  etc.  Naturally that exists.  But
what program will flag those entries so that if one is entered again, it
will alert you.  That may be a very valuable program over the long
term.  It would let you know if you've worked a subject, worked at an
address, or ran a plate before.  How many of us could use a program like
that ? ? ? ? ?

You bet your license we all would. Of cource the only one were all
familiar with is our formerly accessible NCIC.

To have an internet data base for PI use similar to what you describe,
all PIs must become aware of it and second, must make data entries. That
kind of web page internet based would cost some real bucks to set up and
make operational.  I am aware of one company on the web that could
accomplish such a task. Lets get some more input from others and see
where it leads.

advertises an asset search which will flag a social security number for a
year and notify you if it enters any of their databases. The Company is

Re:  Final Legislative Up-date

It is safe to allow your family out in the street.  Congress has adjourned.

The Financial Privacy Act of 1998, HR 4321 and S. 2433 was never brought to
the floor of either House for a vote and has died as a result.  We are unaware
of organized opposition to the bill except for that of licensed investigators.
NCISS was successful in causing the bill to stop after it passed out of the
Banking Committee and it was fortunately not lumped in with the massive, last
minute appropriations bills.  An effort was made in the Senate to include the
bill by Unanimous Consent, but that failed.

So what does this mean?  No major unfavorable federal legislation was passed
in this session of Congress which would adversely affect investigators.

What can we expect now?  In the next session of Congress,  it is likely that
the above bill and many others will be re-introduced.  Paramount among them
probably will be Senator Feinstein's Personal Information Privacy Act.   It
will take a concerted effort to modify these bills in 1999 and NCISS will make
every attempt to participate in the formulation of language before it is set
in stone.

What about the Fair Credit Reporting Act?  In spite of the modest victory
reported earlier, we will need to build on our initial efforts to get this Act
amended.  NCISS  will need to seek out allies in the insurance, industrial and
legal ranks who need to be apprised of how the current language affects their
interests.

NCISS needs to increase its membership and raise funds to pay for our lobbying
work in the Capitol.  And most importantly, we need to rally all investigators
and their associations to unite and work together so that well-meaning
lawmakers do not legislate us out of business!

Hello All
My name is Rick Burrows. I am an investigator in the St Louis, Missouri
area and I need some help. I don't have much of a budget so here it is.

  I was contacted by someone to find their mother who they have not seen
since 1945 in St. Louis. Her name was Helen Florence Spicer Murray in
1945. She underwent a major religious conversion and became very
trusting in the Lord. She divorced in St Louis in 1945. She then
remarries a man by the name of Al Herzog in St. Louis in May 1947. She
then has a baby girl by the name of Allene Murray Herzog on 9/14/1947 in
the St Louis area. At the time of the marriage to Al Herzog she is now
going by Mary Helen Herzog. In 1952 she goes from Granite City Illinois
to Minneapolis, Mn to the North Central Bible Institute. She was there
until August of 1953. During this time, Al Herzog has the marriage
annulled stating that it is a marriage in name only.
   I am ble to track Mary Herzog and Allene to Showlow, Arizona in the
Fall of 1953. She is living in an 8 room house that she is trying to get
made into a church. She applied to the Assemblies Of God Arizona Council
for certification as a minister or lay person. The last known contact
with them or the people that knew her in the St Louis area is Feburary
1954 and she is writing from Fairfield Texas.
   If Mary Helen Florence Spicer Murray Herzog is still alive, I have
found NO trace of her or the child Allene.
   Mary Herzog has given several conflicting dates of birth with one
exception. Her birthday according to her birth certificate is 21 May
1910 and she was born in Lancaster County Nebraska. She has listed also
,1911, 1913, and 1914 as to years of her birth.
   Her parents names were Ora Spicer and Florence McLin, both being form
Knox City, Missouri.
   I have been unable to locate ANY reference to her parents, or to
Allene ecept her school record from First Grade in ShowLow Arizona.
   If anyone can help me locate these two individuals I would be
thankful.

Would you please send the following message to all hands.  This is in response
to Ted Swift and others who asked about the NCISS Legislative update that
mentioned a "modest victory" with regard to the Fair Credit Reporting Act.

Senate Bill 2561 authored by Senator Don Nickles, (D-OK) at the request of the
trucking industry and supported by NCISS was passed by unanimous consent and
amends the FCRA.  The relevant parts of the amendment are as follows:

S.2561 strikes a portion of  Section 605 of the Fair Credit Reporting Act
which prohibits the inclusion of certain conviction information in a "consumer
report."  As amended, the law will permit the reporting of conviction
information to clients, even if the issue was disposed of more than seven
years prior to the report.  The bill makes the following relevant changes in
law ( deleted language is shown in  all caps,  new language is underlined. . .
can't get aol to take strikethroughs).

Sec.1681c(USC)...no consumer reporting agency may make any consumer report
containing any of the following items of information:

(2) SUITS AND JUDGMENTS WHICH, Civil suits, civil judgments, and records of
arrest that from date of entry, antedate the report by more than seven years
or until the governing statute of limitations has expired, whichever is the
longer period.

(5) RECORDS OF ARREST, INDICTMENT, OR CONVICTION OF A CRIME WHICH, FROM THE
DATE OF DISPOSITION, RELEASE OR PAROLE, ANTEDATE THE REPORT BY MORE THAN SEVEN
YEARS.

(6) Any other adverse item of information other than records of convictions of
crimes which antedates the report by more than seven years.

It gives me great pleasure and honor to announce that NALI's Region 1
Seminar will be sponsored by NALI and a number of state associations. PA and

"Investigative Ethics"  By Robert Parke, CLI, Nali's Assistant National
Director who has over 30 years of experience in the investigative field and
has given a host of imformative and superbly developed presentations.

"Telecommunications Fraud-A Look at the Cable Industry"  By Philip Demming
who is a board member of the recently developed Fraud Training Institute.

"Legislation and Today's PI"  By NCISS Legislative Chair and ALDONYS
"SPOTLGHT" editor Bruce Hulme, who has been instrumental in affecting
Federal Legislation and is currently involved on a state and national level
to protect our industry from the onslaught of proposed negative legislation.
