The House Commerce, Trade, and Consumer Protection subcommittee released
details on its hearing set for tomorrow regarding the "Do-Not-Track
Legislation: Is Now the Right Time?"  It will "examine the feasibility of .
providing Internet users a simple and universal method to opt out from
having their online activity tracked by data-gathering firms."

The hearing's purpose is to address growing interest in privacy legislation
or regulations that curb the amount of data collected by Web sites. The
Federal Trade Commission is also expected this week to announce its report
on Internet privacy policy recommendations.

Witnesses expected to be called are:

Daniel J. Weitzner, associate administrator for policy analysis at the
National Telecommunications and Information Administration

David Vladeck, director of the consumer protection bureau at the Federal
Trade Commission

Susan Grant, director of consumer protection at the Consumer Federation of
America

Joe Pasqua, vice president of research at Symantec Corporation

Gail MacKinnon, executive vice president and chief government relations
officer at Time Warner Cable

Eben Moglen, professor of law at Columbia University and founding director
of the Software Freedom Law Center

Daniel Castro, senior analyst, for the Information Technology and Innovation
Foundation

There are a number of bills pending which are concerned with this topic.
ISPLA's evaluation of them, thus far, is that they presently will affect
very few professional investigators, if any. That said, we will still
continue to monitor them to thwart any last minute amendments which may
affect our members.



ABA RED FLAGS LEGISLATION PASSES SENATE

The American Bar Association's all-out attack against the Federal Trade
Commission's attempt to regulate the practice of law was helped yesterday by
the U.S. Senate unanimously voting that the commission's "red flags rule"
doesn't apply to lawyers. Senators John Thune [R-ND] and Mark Begich [D-AK]
sponsored the bill to narrow the scope of the Red Flags Program
Clarification Act of 2010 in reference to Section 114 of the Fair and
Accurate Credit Transactions Act of 2003 (FACT Act).

The legislation at issue, which seeks to curb identity theft among credit
and financial regulatory agencies through prevention and detection programs,
"makes clear" that lawyers, doctors, dentists, accountants and other heath
care and service providers "will no longer be classified as 'creditors' for
the purposes of the red flags rule just because they do not receive payment
in full from their clients at the time they provide their services, when
they don't offer or maintain accounts that pose a reasonably foreseeable
risk of identify theft," stated Sen. Chris Dodd (D-CT) into the record after
the vote. A vote is now expected on similar new legislation by the House.
The vote regarding the Red Flag Program Clarification Act of 2010 came as
the ABA awaits a ruling from the U.S. Court of Appeals for the District of
Columbia Circuit to affirm the district court's ruling to exempt lawyers
from the original legislation, the Fair and Accurate Credit Transactions Act
of 2003.

Even though I do not understand Russian, the pictures speak for
themselves.


The video shows Russian Marines on board a Somalia pirate ship shortly
after the Russians had rescued an oil tanker from its Somalia captors. All
conversations are in Russian with the single exception of a wounded pirate
saying something in English and the Russian soldier responding, "This is not a
fishing boat."

After the soldiers freed  their compatriots and the tanker, the  Russian
Navy Commandos moved the pirates back to their own (pirate) ship then
searched the pirate ship for weapons and explosives. The commandos then  left
the
ship and exploded it with all remaining pirates hand-cuffed to  it.  They
sank the pirate ship along with the pirates . . .  without  any court
proceedings, lawyers etc. They used the anti-piracy laws of the  18th and 19th
centuries where the captain of the rescuing ship has the right to  decide what
to
do with the pirates. Usually, in those circumstances, pirates  were hung.

It's likely that in the future, Russian ships will not be targets for
Somalia pirates. Problem solved. It would be refreshing to see our government
give our Naval Commanders the same latitude.

I do think it is hysterical that the stupid pirates would insult the
Russian Commandos by pretending to be a "fishing boat" when it is so obvious
that is not true.

NOGALES, Ariz. -- A U.S. Border Patrol agent was killed  during an exchange
of gunfire between agents and several armed individuals near  the
Arizona-Mexico border Tuesday night.
The head of a Border Patrol agents' union said agent  Brian A. Terry was
shot to death north of the Arizona-Mexico border while trying  to catch
"bandits" who target illegal immigrants.
National Border Patrol Council President T.J. Bonner said  Terry was
waiting with three other agents in a remote area north of Nogales late  last
night
when a gun battle with the bandits ensued. No other agents were  injured,
but one of the suspects was wounded in the shootout.
The Border Patrol said that Manuel Arianes, a.k.a. Manuel  Arellanes
Osorio, was wounded in the gunfight.
Arianes, 34, and a Mexican national, was convicted in  Maricopa County
Superior Court in 2006 for aggravated assault on a police  officer, and had been
deported to Mexico twice, according to sources familiar  with his case.
Border Patrol spokesman Eric Cantu and FBI spokeswoman  Brenda Lee Nath
declined to confirm Bonner's account, but said authorities have  four suspects
in custody and are searching for a fifth.
FBI Special Agent Manuel J. Johnson confirmed authorities  were still
searching for a fifth suspect.
Johnson said Terry died shortly after he was shot about  11:15 p.m. in a
remote and rugged area near Rio Rico, just north of Nogales.
No names of those in custody were available, Johnson  said.
"Our thoughts and prayers are with the Terry family for  their tragic
loss," said U.S. Customs and Border Protection Commissioner Alan  Bersin.
"Our commitment to Agent Terry and his family is that we  will do
everything possible to bring to justice those responsible for this  despicable
act"
Bersin said.
The FBI is leading the investigation with cooperation of  the Santa Cruz
County Sheriff's Office, according to CBP.
"Today we are deeply saddened by the loss of Agent Brian  Terry, a patrol
officer from the Nogales Border Patrol Station," the Arizona  Cattleman's
Association said in a news release. "We are thankful for his  dedicated service
to protecting the United States of America."
U.S. Sen. John McCain, R-Ariz., said, "This event is yet  another reminder
of the dangers the men and women of the Border Patrol face  every day as
they put their lives on the line to protect the American people.
"The increased violence in the border region demands that  Congress provide
the necessary resources and personnel to ensure the safety of  all
Americans, especially border patrol agents stationed on the border, and  fulfill
the
Federal government's responsibility to secure our border," McCain  said.

As the work of Congress draws to a close a few last minute items have been
receiving attention.

On December 16, President Obama announced his intention to nominate Center
for Democracy & Technology Vice President for Public Policy James X. Dempsey
to serve on the Privacy and Civil Liberties Oversight Board, an independent
agency within the executive branch tasked by Congress with reviewing the
civil liberties impact of anti-terrorism policies and programs. I worked
with him on a few privacy issues dating back to the DPPA of 1994 when he was
a key Congressional staffer before joining CDT. Years later I met with him
on SSN and credit headers when he was with House Financial Services. He was
always a reasonable advocate on privacy and civil liberty issues.

The position, which is subject to Senate confirmation, is part-time, so, if
confirmed, he will continue in his position with CDT. In August 2008,
President Bush nominated Dempsey, along with three others, to the same
Board, but the Senate did not act on any of those nominations.

The other announced appointment to the same Board is Elisebeth Collins Cook,
a partner at Freeborn & Peters, LLP's Litigation Practice Group. Her her
areas of focus include: Complex Disputes, Constitutional and Civil Rights,
Employment Litigation and Regulatory and Appellate work. She served four
years at the United States Department of Justice, and in 2008 was
unanimously confirmed by the United States Senate as Assistant Attorney
General for Legal Policy. She testified before Congress and prepared dozens
of witnesses for Congressional hearings.  She also served as the
Department's Regulatory Policy Officer and was active with the President's
Identity Theft Task Force, and was a member of the Terrorist Screening
Center Board of Governance. In 2009 she served as Republican Chief Counsel,
Supreme Court Nominations, for the United States Senate, Committee on the
Judiciary.

This week Congress approved the Senate version of an anti-spoofing bill,
S-30, the "Truth in Caller ID" which contains language favored by our
profession as follows:

`(1) IN GENERAL- It shall be unlawful for any person within the United
States, in connection with any telecommunications service or IP-enabled
voice service, to cause any caller identification service to knowingly
transmit misleading or inaccurate caller identification information with the
intent to defraud, cause harm, or wrongfully obtain anything of value,
unless such transmission is exempted pursuant to paragraph (3)(B).

Some of you may recall my relating to you before the summer that the chief
legislative counsel for Sen. Bill Nelson [D-FL], the sponsor, had called to
tell me that the Senate bill would prevail over the House versions by the
end of this year. He was correct in his assessment.

Our thanks to our ISPLA individual and association members, the
manufacturers and distributors of caller ID equipment and their legal
counsel, with whom we met in Washington, and to the other professional
associations we kept advised of our handling and who provided wise counsel,
NASCO, and to an extent ASIS. We also recognize the good work of NCISS in
their efforts.

We have previously commented on S 3806, the Secure Facilities Act of 2010
which is a bill that may affect our members handling security contracts for
the Federal Protective Service. ISPLA has in the past been conferring with
NASCO lobbyist attorney Steve Amitay and the IASIR security industry
representative Lynn Oliver. The consensus is that S 3806 is a better bill
than either the House Democratic or Republican bills on this matter.

S 3806, the "Secure Facilities Act of 2010" sponsored by Sen. Joseph I.
Lieberman [I-CT] appears to have some last minute movement. Our contract
security members favor his version. We previously provided ISPLA members
with a more detailed account of these bills.

In 2011, Congressmen Fred Upton of Michigan, Peter King of New York, and
Lamar Smith of Texas will all be chairing committees which have jurisdiction
over issues of concern to ISPLA--House Energy and Commerce, Homeland
Security, and Judiciary. (Fortunately, we have ISPLA Executive Committee
members in the home state of each Republican committee chairman. In fact, we
are presently in a much better position than NCISS, NASCO or ASIS in that
regard. I expect we will continue to work with the latter two organizations
in 2011 as we have in 2010 (NCISS has declined our offer to work together.)
These are important committees before which House bills affecting
investigative and security professionals are often reviewed and hearings
held.

What type of cell phones do her and her daughter have?

Google Cell Phone Spyware then look at the top four applications for doing
exactly what you describe, all fairly cheap.

Short answer...yes it can be done.
Yes it can be detected if it is done, but it requires a lot of work.
Yes it is totally illegal.  Title 18 USC Sec 2511 covers both the
interception of oral and electronic (text messages) communications.

available to do this.  This sounds to me to be a tool called flexispy.  This
tool, if deployed on the device will sen all of the telephone activities to
a web site where the person monitoring can log in and review the phones
activities.

PS It is illegal, getting someone to do something is another story.

Only countermeasure is to have them do a security wipe on the phones and
reload a clean operating system from rim OR have the phones replaced with
new ones so the ESN is different.

If you want to look for the spyware, a competent handheld examiner can do
this ( like us) 400 per unit

Dear List Members:

I have a client who claims that her estranged husband has placed a tracking
card on her and his daughter's cell phone which diverts telephone calls and
text messages to his Blackberry. She is claiming that an employee at the
Verizon store told her that this type device is only available to federal
law enforcement.

Is this technology available on the free market? Are there any
countermeasures that may be taken? Would this violate any federal
wiretapping laws? Any information would be helpful.

Merry Christmas Everyone;

I've been reading the post's and there has been several valid and good advise
promoted ... but I would like to start at the beginning if I may ...

1.  What types of phones does the wife and daughter has ... I know the husband
has a blackberry, according to the post ... but the other phones were not
identified ... this goes a long way to determine precisely how we are to approch
this situation ... as the Blackberry system and a non-blackberry system have two
different communications protocols and they would have to be identified for
proper access controls and authentication from one phone system to the
Blackberry prior to the Blackberry accepting any communications ...

2.  Can you please describe to me what you mean by "TRACKING CARD" ... that to
me is describing hardware, an object, something physical which is attached to
the phone ...

2a.  If it is hardware, just detach it ... perform a power off and re-power it
back up for the system to recognize the phone and it's elements and they the
phone should resume normal communications without the "tracking" capability
(because it was removed) ... however, this means someone had to crack open the
phone, install the hardware and then put it back together ... there's not a lot
of room inside the casing of a cell phone, so the person putting it back
together better be very very good at it ... also look on the casing for
scratches that you did not put on yourself from normal wear and tear ... most
owners know when they dropped the phone or somehow scratched it ...

3.  If not hardware, then it must be software ... I'm a cell fone forensic
examiner for Directive 63 out of Fredericksburg Virginia, so I have not seen the
subject phones or phyical pieces of gear to review as evidence.  However, if
there is software attached to your cell phone, then all you need to do to prove
this theory or disprove it, is down log the cell phone(s) logs and perform an
audit on it. There you will find the history of the phone's activities going
back as far as the last purge (if that was performed).

4.  Once you perform your audit examination, if you find a software program that
was not delievered on the phone at purchase or that you did not put on yourself
or were aware of it, then just delete that program ... then complete a power off
of your system, and wait for a minute or so, then power it back on and it will
be as it was prior to the contamination of the software ...

I hope this helps.  I'm sorry I can't provide further information at this time
without actually seeing the phone or receiving specific questions.  If there is
anything else I can do please don't hesitate to drop me a line ...
