Hi,
  This is my first visit to the list after passing the registration test <G>. I
am a member of several other PI lists and find them very valuable ... if for no
other reason to have a contact where needed. Seeing that this is a private list
much information & referrals could be passed on it. Let's get this thing active
and it will be helpful to all. If I can ever assist anyone in this area please
let me know.

Bill I agree with your post.

I don't know how many of you do pre-employment background checks, but this
revised FCRA really has me concerned.

Federal legislation must be watched carefully, or most of us won't be around
in the next two years. I don't know about the other of the Private
Investigators but after 25 years of being in business it's time we all
became united and had one voice.

I look forward to your comments.

Dear List

The FCRA was amended and took effect Oct. 1, 1997.

Basically it now requires anyone that acts as a consumer reporting agency
(ie. PI's who collect and disseminate information for pre-employment
purposes) must make sure that the end user gets written permission from the
consumer, prior to performing: criminal checks, drivers license checks,
character , general reputation, personal characteristics, credit, or mode of
living which is expected to be used in whole or part for the purpose of
serving as a factor in establishing eligibility for employment, promotion,
reassignment, or retention as an employee.

Adverse Action

Prior to the person intending to take any adverse action they shall provide
to the consumer to whom the report relates.
     1    a copy of the report
     2    a description in writing of the rights of the consumer under title
VI, as prescribed by the Federal Trade Commission under section 609(c)(3).

There are also limits on how far back the information can be obtained.

There are many unanswered questions as to how this effects....

     1    Surveillance
     2    Background checks on existing employees
     3    Under Cover operations
     3    Shopping services

and the list goes on and on and on and on ..... Well you get the idea.

ABSOLUTELY TRUE

My daughter & I had just finished a salad at Neiman-Marcus Cafe in
Dallas & decided to have a small dessert. Because both of us are such
cookie lovers, we decided to try the "Neiman-Marcus Cookie".

It was so excellent that I asked if they would give me the recipe and
the waitress said with a small frown, "I'm  afraid not".

"Well", I said, "would you let me buy the recipe?"

With a cute smile, she said, "Yes."

I asked how much, and she responded,  "Only two fifty, it's a great
deal!" I said, with approval, "just add it to my tab."

Thirty days later, I received my VISA statement from Neiman-Marcus  and
it was $285.00. I looked again and I remembered I had only spent $9.95
for two salads and about $20.00 for a scarf.  As I glanced at the bottom
of the statement, it said, "Cookie Recipe $250.00."

That's outrageous! I called Neiman's Accounting Dept. and told them the
waitress said it was "two-fifty," which clearly does not mean "two
hundred and fifty dollars" by any POSSIBLE interpretation of the phrase.
Neiman-Marcus refused to budge.  They would not refund my money, because
according to them, "What the waitress told you is not our problem. You
have already seen the recipe - we absolutely will not refund your money
at this point." I explained to her the criminal statutes that govern
fraud in Texas, I threatened to refer them to the Better Business Bureau
and the State's Attorney General for engaging in fraud.

I was basically told, "Do what you want, we don't give a crap, and we're
not refunding your money."

I waited, thinking of how I could get even, or even try and get any of
my money back. I just said, "Okay, you folks got my $250, and now I'm
going to make sure that every cookie lover in the United States with an
e-mail account has a $250.00 cookie recipe from Neiman-Marcus...for
free. She replied, "I wish you wouldn't do this." I said, "Well,
youshould have thought of that before you ripped me off", and slammed
down the phone on her.

So, here it is!!!  Please, please, please pass it on to everyone you can
possibly think of. I paid $250 dollars for this... I don't want
Neiman-Marcus to ever get another penny off of this recipe....

(Recipe may be halved):
2 cups butter
4 cups flour
2 tsp. Baking soda
2 cups sugar
5 cups blended oatmeal
24 oz. Chocolate chips
2 cups brown sugar
1 tsp. Salt
1 8 oz. Hershey Bar (grated)
4 eggs
2 tsp. baking powder
2 tsp. Vanilla
3 cups chopped nuts (your choice)

Measure oatmeal and blend in a blender to a fine powder. Cream the
butter and both sugars.  Add eggs and vanilla; mix together with flour,
oatmeal, salt, baking powder,  and soda. Add chocolate chips, Hershey
Bar and nuts. Roll into balls and place two inches apart on a cookie
sheet. Bake for 10 minutes at 375 degrees. Makes 112 cookies.

Enjoy cooking the most expensive cookie in the world - FREE !!

You are all correct.  It (FCRA) is a big problem.  NALI is going to be
involved by rapidly joining forces with virtually all the state investigator
associations to network and promote letter-writing to the appropriate
legislators.  This one sneaked up on us pretty quickly, and we have to be more
on top of these knee-jerk responses by congress and legislatures.  Jack Reed
has been appointed for his 5th term as Legislative chair.  He and I are going
to work closely so that information can be rapidly disseminated to NALI's
Regional Directors and Assistant Regional Directors, and on to the various
states' associations.

Jack advises that legislators translate one letter into 500 votes.  We can't
afford high-priced lobbyists, but if we could generate as few as 1000 letters
on an issue, these politicos would definitely sit up and notice.  5000 letters
would make them squirm, and 10,000 would make them dance.

It comes right down to how much effort each individual is willing to put
forth.  If the profession simply sits back and bemoans its fate, we're in
trouble.  If we get involved and encourage others to get similarly involved,
we can impact the problem.

How to start?  Call your Regional Directors.  Offer to serve as an Assistant
Regional Director (the pay is terrible, but the rewards have the potential of
being immense).  Get involved in raising your own awareness, and that of your
friends and colleagues.  Encourage everyone to DO, not just TALK.

Good news and bad news.  Good news is I know of software that may meet your
needs.  It's called "Investigative Works" version 2.14.

Bad news is it is regularly $345.00, but "on sale" now for $245.00.  Only
you can decide if that price is worth the investment.

Speaking of, does anyone have a decent WWW source/URL for generating
neighbors (for telephone canvasses, activity checks, etc.).  I know that
several commercial databases/infobrokers offer this service (e.g.,
Metronet, Equifax), and that you can purchase the Prophone CD rom, but I
was curious if any other investigators have ever stumbled upon a web
page that would allow one to generate this.  They can come in very handy
in backgrounds, etc. when attempting to fashion a reasonable pretext.

I don't know of a specific URL that will do what you are asking, most search
engines for people are set up find the person--not everyone around the
person.  You could construct what you wanted through several engines working
together and pooling the results, but it would be very tedious.

My suggestion is to get some CD Phonedisks and they will produce a list for
you quicker than you can click from one web site to another.

Connie Faubel in Oregon has some extra sets she is selling for $15 a set.
And that's an extraordinary offer (if she still has any)!  I know because I
bought a set from her.

Hi Randy, And Greetings To The List

If in fact I correctly understand your request, there are two websites that
will generate neighbor lists and phone numbers of same. The first site is:
http://www.anywho.com.  After getting your (People) search result from this
site just click on the Street Address Hyperlink and that will generate a
neighbor list.

The second site is: http://www.infospace.com.  After getting your search
result from this site, click on the resultant name and that will generate
another window.  At the lower right of the window you will see a group of
links under neighborhood.  Click on neighbors and you should get a list of
neighbors.  Click on business and it will give you a list of businesses
within the neighborhood (if any).

Both sites are Reverse capable as well and will also allow first name
search. Hopefully I haven't confused the issue and you will find this
information useful.

This is also my first post to the list and I too look forward to the
exchange of information and ideas with all the list members. Oh, and Randy,
you might check your computer Date and Time or maybe I have lost a few
days. <G>

Welcome to the list.

I have not noticed or have I heard of a URL in reference to your question.
We have access to many databases that allow us to conduct this type of
research, and I'm not speaking of the databases that you have mentioned.
We have found over the years that the big boys want the big bucks for
information that in most cases is available from almost any CD Rom, as
mentioned by a previous post list member. I believe that Phone Disc Power
Finder will produce your information in question. These CD ROM's are sold
in a 5 CD set. Available from Digital Directory Assistance, Inc.
800-284-8353.
Office Depot, Office Max, Best Buy etc. The product allows users to research

in many types of fields. Should you have any questions ?  Please feel free

Yes, I do have a good web site for checking neighbors of an individual. Click on
to:
http://peoplefind.lycos.com/lycos.lycos/reverse.htm
and enter the individual's name, address or phone number. Then choose
"neighbors" from the available selections. This will provide a list of names,
addresses and phone numbers of the neighbors of your chosen party.

I had a bail recovery case where detectives watched a fugitives' parents
use a payphone every Sunday night at 6:00 pm for six months.  The
parents would
drive by several payphones going across town to use just this one.  This
was not strong enough for the Judge to sign a subpoena. (had the records
been pulled the case could have closed 18 months earlier.

It is my understanding that records are maintained on payphones and
would suggest
using an information broker who can access the records directly.

My question is were can I aquire a directory of payphones (to cross-ref.
the
number to an address).
