Fla. Vote: From Politics To Courts
Both Sides Looking To Win Recount
A Possible Legal Challange To Final Tally?
CBS.com Legal Analyst Andrew Cohen Reports
(CBS) As officials in Florida recount the vote totals there, the unresolved
presidential race still is in the realm of the political, as opposed to the
legal. But that could
change, and change quickly, depending upon how that recount goes and whether
more astonishing news comes out of the Gold Coast.
There are so many possible scenarios that focusing on a few would unfairly
underemphasize the rest. But since teams of lawyers for both the Gore and
Bush camps
already are swarming down to Florida, it's worth hypothesizing a bit about
how this all may play out.
From the Gore perspective, the best-hope scenario, of course, would be to
find a way to win the recount. That's because it is virtually impossible to
win a legal challenge
to an election absent extraordinary fraud, misconduct or other
irregularities. Does the controversy in Palm Beach County - in which perhaps
hundreds or thousands of
Gore votes mistakenly were cast for Pat Buchanan because of a confusing
ballot - constitute voting irregularity? I'm not so sure. Missing ballot
boxes are another story
but judges still are typically loathe to get too involved in the nuts and
bolts of an election.
If after the recount Governor Bush still has the lead in the state, the next
thing to look for will be how big that lead is. If the recount lessens the
Governor's margin to a few
hundred votes or so, the Gore folks may decide to mount a legal challenge
after all, especially if the Democrats can point to enough specific examples
of voting
misconduct to make a difference. In other words, if the Bush lead is reduced
to 500 votes, and the Democrats can identify 750 people from Palm Beach who
are willing to
testify that they mistakenly voted for Buchanan, we are likely to have one
humdinger of a battle.
But if the recount shows that the Governor's lead over the Vice President is
extended to several thousand or so, I don't think we are likely to see a
legal challenge. The
larger the apparent margin of victory, the lesser the chance is that the Gore
team will try to - or succeed - in overturning the result in court or in the
House of
Representatives. That's not really legal analysis, of course, that's just
plain math.
If for whatever reason there is a legal challenge to the final voting tally,
it clearly will be a case where the judge will immediately drop whatever else
he or she may have on
the docket to fast-track this through the legal process so that an ultimate
decision from the courts, or from Congress, comes before mid-December, which
when the
Electoral College is scheduled to meet to implement this vote.
There are many other variables which certainly must be factored into the
equation here. How will Florida officials handle the recount? Will the Palm
Beach folks get to
change their votes? Were their missing ballot boxes from key Democratic
districts? Will the fact that the Governor of Florida is a Republican affect
things? How about the
fact that the state's Attorney General is a Democrat?
And what about those Electoral College voters themselves? Did you know that
none of them can legally be forced to vote for the winner of their particular
state? Can
you imagine the legal fuss that might occur if, say, five of those Electoral
voters decided to abstain from voting for Bush in December because Gore won
the popular
vote? That would leave the Governor short of the 270 votes needed to win
election. And Gore wouldn't have 270 electoral votes, either.
I could go on and on with a "Parade of Legal Horribles" but when it comes
right down to it, whoever wins this first recount is likely to win the state
and the nation and the
right to govern over a dramatically divided country for the next four years.
I am willing to take Gore's Direct campaigning contacts!

records. We have been contacting media for weeks.
The corporate press will not listen. Many of the

... COULD WELL BE DEMOCRATIC. Again, don't believe what the Bushes say about
military personnel. I hear that a lot of these are from Israel, which would
be Democratic. Also, a lot of them I was told are from MINORITY personnel
.... again, Democratic. The election shouldn't be called until every absentee

chilling. So chilling, in fact, that it makes me wonder what the next four
years would be like.(I used to live In Georgia, in Newt Gingrich territory,

scary enough to have me seriously thinking of defecting to Canada.

'save' Gore's election chances.
Maybe not... But even if it is - What about the next election? And the next?
Are you guys really sick of the Electoral College? Are you really tired of
all the blatant disorganization and carelessness (heaven forbid we even call
it 'fraud') in elections? Then fight it. We have a powerful tool here, with
the internet and other things as well...
Folks like Monica, Donna, Susan and I are willing to start something here
that will make something of a difference in the future, if not today.
Here are a few ideas.
It is /amazingly/ easy to access your state's (and any other state in the
union's) Democratic Party online. Just go to Yahoo!, type in a search for
'Democratic Party'. It will give you an option to chose by state. If all
else fails, go down state by state (I did) and visit the websites.
Many of the sites list that state's government officials who are democrats.
E Mail them! We elect these government officials to represent us, and to be
our voice. Mkae them live up to our expectations of them. Put them to work
for us!
In these next four years to come (no matter who wins this election) we have
a lot of work to do to make the system actually work /for/ us. Use it. Use
the system!
Who says we can't change the way our country works... Afterall, maybe it's
about time there were some changes, right? Look around us, change is
happening, with or without us... Let's make sure we at least have a decision
in it!

Hi, Autumn. Yes. First, I would like to know
what we will be doing and saying. I.e., I want
to know what the focus or foci will be in our

By the way, we are in Washington state, on the
Olympic Peninsula, having moved from Seattle
recently.
My daughter, who voted for the first time
yesterday -- she turned 18 in September, will
help. She was inconsolable last night. She holds
out a slim hope, but we are realists -- there's
too much Republican control in Florida, and
there's too little hard-hitting investigative
work being done right now by the media.

anyone other than myself. Like most people here I'm still in shock and a daze
about all this. All I can tell you is what's I'D LIKE TO SEE HAPPEN.
Obviously the question is HOW to make it happen, but I don't think it's
impossible. I'd like to:
(1) See people in the streets protesting the fraud and the election of
someone against the popular vote -- massive protests that would be covered by
the media
(2) Should Smirk be declared the winner, start a national movement that would
bring hundreds of thousands, maybe millions of protesters to Washington the
day of the Inauguration. We couldn't stop it, but we would send a strong
signal that he was put in office against the wish of the American people.
There must be hundreds of Democratic groups, labor unions, political action
committees, Gore supporters, plus minority groups of every kind that are
already organized and could join the fight.

The answer is no, which is why he changed his residency so quickly and
quietly. The Federal law states that the Presidential and Vice Presidential
candidates on the same ticket can not be from the same state. I believe that
this is one of the matters being brought to court as we speak....although I
have no details as of yet.
There are also investigations regarding the possible voter fraud in Florida.

Ok, here's a suggestion of how we can START a plan of action: Why don't we
ALL take it upon ourselves over the next few hours and days to look all over
the web or anywhere else we can think of to come up with e-mail lists and
other important contact of all Democratic or anti-Bush groups that could take
our message out to the people and create a national movement. Let's share
them here and together built a HUGE list of contacts that we can all tap into
. It may sound crazy, but there are enough of us here that if we POOL OUR
RESOURCES AND BRAINS we can put something in motion. Deal?

I am doing the same. I KNOW in my bones that
this is a fraud.
It makes no sense that all of the news orgs.
declared Gore the winner in Florida. The Bush
families (Sr. and Jr.) abruptly leave their hotel
restaurant dinner and rush back to the governor's
mansion. Then, the news anchors, including NPR,
are flustered, confused -- they can't believe
what they are seeing -- that Florida is all of a
sudden undecided?
I am contacting every news organization as well
to beg them to get a herd of reporters into
Florida. I also pass on important information to
other lists.

Dear Autumn-I agree. Personally the thought of being governed by another
Bush is so repugnant to me that I feel like the entire Gay and Lesbian
Community-as well as others for whose lives would become disaster if Bush
were elected President-should be given a large Federal check to relocate to
Canada. If Bush is elected, I will defect as soon as humanly possible.

turns out to be sour, OR in case folks decide to sway the electoral college
to stand FOR the popular vote - I am E Mailing all the Democratic Party
heads, and Al Gore's campaign managers to beseech aide, advice, etc.
That, I feel is the best place to start.... I guess it would help a lot if
we all did this for starters. I have been reading and writing all morning,
and feel as if I have gotten nothing accomplished, so I think I am going to
try and /do/ something about it...

this country, and I will mourn for the country that they built and
they loved!
We must get rid of him-and the means is unimportant at this point. I
dont want to governed by someone who has "ridden on Daddy's coat-
tails" his entire life.
