WARNING-California AB1122 Hearing on Wednesday 5/6/09
Time to get back to work and flex a little Grass Roots Muscle. The Humane Society of the United States has a bill, AB1122, up for hearing before the CA General Assembly Appropriations Committee this Wednesday. This bill seeks to BAN the sale of animals that are NOT "traditionally" sold through pet shops. This would include many different animals INCLUDING Herps. This is an attempt to end ALL Reptile Shows and "face to face" sales that are the basis for much of how the middle and high end of our market distributes animals. It would eliminate almost ALL sales except from pet shops. Reptile Shows and open air auctions/sales would come to an end in CA.
Please don't let this happen! We need to generate hundreds of phone calls and emails to the Committee Members

It's not just this show, but many others! It doesn't seem like an indoor
show would constitute a "swap meet" or "flea market" since it's indoors and
not in the open air, but still.... we should take action on this unclear
bill.

The Issue.
Assembly Member Lieu introduced Assembly Bill AB 1122 which, as amended,
would make it a crime
"to willfully sell, display, or offer for sale, or give away as part of a
commercial transaction, a live animal on any street, highway, public
right-of-way, commercial parking lot, or at any outdoor special sale, swap
meet, flea market, parking lot sale, carnival, or boardwalk." The bill fails
to define a swap meet or flea market and could inadvertently encompass bird
shows, reptile shows, cat shows, and aquarium shows.
The Impact.
As drafted, it could be interpreted that this bill would ban reptile shows,
bird shows, fish shows, dog and
cat shows, etc. that are sponsored events, normally housed within buildings
and under supervision of an
organization specializing in promoting and hosting of such events for such
types of animals. The poor
definition could also prohibit pet fairs such as the annual America's Family
Pet Expo in Orange County,
pet industry trade shows, or other specialty shows that would not fall
within the general perception of a swap meet or a flea market.
Recommended Action.
PIJAC recommends that everyone interested in supporting the ability of
people to host, promote and participate in reptile shows, bird shows, fish
shows, cat shows, dog shows, trade shows, consumer pet
shows, etc. where animals are displayed and/or sold and/or funds are raised
to support the organization's goals and objectives, contact members of the
California Assembly Appropriations Committee and point out the need for an
exemption for such activities or clear definitions of a "swap meet" or a
"flea market."
ACT TODAY - CALL AND EMAIL -- AB 1122 will be heard by the Assembly
Appropriations
Committee tomorrow, Wednesday May 6, 2009, in Room 4202 at 9:00 a.m.
Members can be reached by contacting the members on the following page and
explain why the bill needs
to be amended to clearly exempt such shows and the activities associated
with those events.

I received an unusual letter in the BAARS mailbox recently. It looks like a 3rd grader named David wrote BAARS a letter for his classroom assignment. He typed it out, mailed it to us via the Palo Alto Junior Museum. He is patiently waiting for a response from us. If you can answer some or all of his questions, write David a letter and email it to me. I will print out the letters and mail them to David�s school.

Dear Tortoise Expert:
Even though I am curious about many things, I am most interested in tortoises. I have included information about what I know, what I want to know, and why I am curious.
I know many things about tortoises. To begin with, I know that tortoises are very slow. They go three miles per hour. Additionally, they are vegetarians. They do not eat meat. Finally, they have huge shells.
Although i know about tortoises, I still have some questions. To begin with, how big is their shell? Is it three feet tall? Next, how much do they weigh? I think they approximately weigh 1000 pounds. Last but not least, how many types are there? Are there thirty?
Do you know why I am curious? I am interested because I saw a tortoise at the zoo. Second, they have huge shells. Lastly, they are very old sometimes.
Clearly, I am interested in tortoises. Thank you for taking the time to write back to me.
