May I crave your indulgence to open this business discussion by a formal letter
of this sort.  It is pertinent that a business of this magnitude should have
commenced properly with a formal meeting of you and us to enable us know
ourselves, have a fore knowledge of the nature of the business, discuss and
acquaint ourselves with the responsibilities and functions of parties concerned,
and appropriate shares accordingly.  However, for time factor, confidentiality
and personality of people involved here in Nigeria, we choose this approach for
the remittance of this Twenty Million U.S. Dollars (US$20.0M). Please bear with

It may interest you to know that last two years a similar transaction was
carried out with one Mr. Patrice Miller, the President of Craine International

agreement between both partners in which he was to take 20% of the money while
the remaining 80% for us.

With all the required documents signed, the money was duly transferred into this
account only to be disappointed on our arrival in New York, and we were reliably
informed that Mr. Patrice Miller was no longer on that address while his
telephone and telex numbers have been reallocated to somebody else.  That was
how we lost US$9 Million to Mr. Patrice Miller.

This time around we need a more reliable and trustworthy person or a reputable
company to do business with hence this letter to you.   So if you can prove
yourself to be trusted and interested in this deal then we are prepared to do
business with
you.  What we want from you is the assurance that you will let us have our share
if this amount (US$20.0M) is transferred into your account.  If this proposal is

calendar months, valued at US$25,000,000.00 (Twenty-

ANALISIS COMPARATIVO DE LA PROPUESTA DEL EJECUTIVO FEDERAL SOBRE DERECHOS
INDIGENAS, A LA LUZ DE LOS ACUERDOS DE SAN ANDRES




  INTRODUCCION

El Ejecutivo Federal ha sostenido que su rechazo a la propuesta de la COCOPA se
debe a que el texto del documento de la Comision no es fiel a los Acuerdos de
San Andres. El Ejecutivo ha mantenido ta
bien que su propia iniciativa refleja dichos acuerdos y les da forma juridica.
Por consiguiente, consideramos que la mejor forma de juzgar la validez de la
iniciativa del Ejecutivo es seguir el crit
rio por este expresado. Con el proposito de emitir un juicio puntual, formulamos
el siguiente analisis comparativo, para ver en que medida el texto de la
iniciativa del Ejecutivo coincide con la let
a y espiritu de dichos acuerdos.


  1. SUJETO DE LA AUTONOMIA

PROPUESTA DEL EJECUTIVO FEDERAL, art. 4: El primer parrafo define pueblo
indigena. Coincide con la PROPUESTA DE LA COCOPA, con el CONVENIO 169 DE LA OIT
y con el PRONUNCIAMIENTO CONJUNTO DE LOS ACUE
DOS DE SAN ANDRES. No hay discrepancia.
La PROPUESTA DEL PARTIDO ACCION NACIONAL, en cambio, define pueblos indigenas
como "aquellos reconocidos por la Ley y los tratados internacionales..." No
reproduce ni la PROPUESTA DE LA COCOPA ni el
PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES.
PROPUESTA DEL EJECUTIVO FEDERAL, art. 4: El segundo parrafo indica que "la
expresion concreta de la libre determinacion es la autonomia de las comunidades
indigenas". No vuelve a mencionar pueblos i
digenas salvo en el art. 27, en relacion con los "programas de desarrollo". En
la propuesta del art. 4, VII, reemplaza los "derechos de los pueblos", que se
encuentra en la PROPUESTA DE LA COCOPA y
n las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 2, por "derechos
de las comunidades".
En consecuencia, la PROPUESTA DEL EJECUTIVO FEDERAL reduce el sujeto de la
autonomia a las comunidades indigenas, en contra de lo establecido en el
PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN AN
RES y en las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES.
PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 2: "El reconocimiento de
la autonomia se basa en el concepto de pueblo indigena." II, 3: "La legislacion
nacional debe reconocer a los pueblos
indigenas como los sujetos de los derechos a la libre determinacion y
autonomia."
PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES, 3, 1: Despues de
reconocer el derecho a la libre determinacion de los pueblos indigenas, senala
que este derecho "se ejercera en un marco cons
itucional de autonomia asegurando la unidad nacional". El mismo documento, en 5,
6, senala criterios para determinar las modalidades de autonomia, "en la que
cada pueblo indigena encuentre mejor ref
ejada su situacion y sus aspiraciones".
PROPUESTA DEL PARTIDO ACCION NACIONAL: Manifiesta que "las comunidades indigenas
gozaran de autonomia expresada y ejercida dentro del ambito municipal".

EN CONCLUSION: Hay dos conceptos de autonomia:
El de la PROPUESTA DEL EJECUTIVO FEDERAL y la PROPUESTA DEL PARTIDO ACCION
NACIONAL, que la reduce a las comunidades, sin definir estas ni concederles
entidad juridica propia. Por lo tanto, la auton
mia es un derecho que solo puede ejercerse en el ambito municipal.
En contraposicion, el concepto de autonomia DEL PRONUNCIAMIENTO CONJUNTO DE LOS
ACUERDOS DE SAN ANDRES y LAS PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES,
(recogido por la PROPUESTA DE LA COCO
A) se refiere a los pueblos, los cuales pueden abarcar varias comunidades y
municipios indigenas.


  2. RECONOCIMIENTO DE DERECHOS

PROPUESTA DEL EJECUTIVO FEDERAL: "derechos que esta Constitucion otorga a las
comunidades indigenas".
PROPUESTA DE LA COCOPA: "derechos que esta Constitucion reconoce a los pueblos
indigenas".
La ultima de las redacciones es conforme al PRONUNCIAMIENTO CONJUNTO DE LOS
ACUERDOS DE SAN ANDRES, 3, 1 y a las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN
ANDRES, II, 2 y 3, antes citados, que hab
an expresamente de "reconocimiento de derechos", en lo cual son coherentes con
el CONVENIO 169 DE LA OIT.

EN CONCLUSION: Hay dos conceptos sobre el fundamento de los derechos de los
pueblos.
El de la PROPUESTA DEL EJECUTIVO FEDERAL los concibe como fundados en la libre
decision del Legislativo.
En cambio, el PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES y las
PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES los establece como no
dependientes de esta decision, puesto que, segun e
  art. 4, los pueblos indigenas son originarios y, por tanto, fundamento de la
nacion mexicana.


  3. SISTEMAS NORMATIVOS INDIGENAS

PROPUESTA DEL EJECUTIVO FEDERAL, art. 4, II: Admite la aplicacion de los
sistemas normativos, pero "sus procedimientos, juicios y decisiones seran
convalidables, en los terminos que las leyes senale
, por las autoridades jurisdiccionales del Estado."
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, III, 2, en cambio,
establecen el "reconocimiento a los sistemas normativos" indigenas, de manera
que "mediante procedimientos simples, sus jui
ios y decisiones sean convalidados por las autoridades jurisdiccionales del
Estado", texto al que es fiel la PROPUESTA DE LA COCOPA al declarar sus juicios
"convalidados por..."
PROPUESTA DEL EJECUTIVO FEDERAL, art. 4, II: Omite mencionar el ambito
jurisdiccional en que se aplicarian los sistemas normativos indigenas, ambito
mencionado en la PROPUESTA DE LA COCOPA.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 5, b), en cambio,
dicen: "La jurisdiccion es el ambito espacial, material y personal de vigencia y
validez en que los pueblos indigenas ap
ican sus derechos. El Estado Mexicano reconocera la existencia de los mismos."

EN CONCLUSION: El cambio gramatical, que en la PROPUESTA DEL EJECUTIVO FEDERAL
convierte el termino original convalidadas en convalidables, suprime el
imperativo juridico, al subordinarlo a la volun
ad discrecional de autoridades estatales y municipales.
La PROPUESTA DEL EJECUTIVO FEDERAL reconoce los sistemas normativos indigenas,
pero los supedita a la convalidacion por la jurisdiccion del Estado y no admite
que tengan un ambito de jurisdiccion pr
pio.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES y la PROPUESTA DE LA
COCOPA determinan su ambito de jurisdiccion, que coincide con el de las
autonomias, y no lo supedita a la convalidacion de
  Estado.


  4. RECURSOS NATURALES. TERRITORIOS

PROPUESTA DEL EJECUTIVO FEDERAL, art. 4, V: La autonomia de las comunidades
indigenas se entiende para: "De acuerdo con las formas y modalidades de
propiedad previstas en el articulo 27 de esta Cons
itucion, acceder de manera colectiva al uso y disfrute de los recursos
naturales, salvo aquellos cuyo dominio directo corresponda a la nacion."
En la propuesta anterior, se anade la primera frase al texto original de la
PROPUESTA DE LA COCOPA, mientras que se suprimen de este las palabras tierras y
territorios.
En cambio, las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 5, a),
definen territorio del pueblo indigena como su habitat, en conformidad con el
CONVENIO 169 DE LA OIT.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, III, 6, establecen el
derecho de los pueblos indigenas "al uso sostenible y a todos los beneficios
derivados del uso y aprovechamiento de los
ecursos naturales de los territorios que ocupan o utilizan de alguna manera".
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 6, d), les conceden
el derecho de "acceder de manera colectiva al uso y disfrute de los recursos
naturales, salvo aquellos cuyo dominio di
ecto corresponda a la nacion".

EN CONCLUSION: La PROPUESTA DEL EJECUTIVO FEDERAL restringe el uso y disfrute de
los recursos naturales a las modalidades de propiedad del articulo 27. Deja
abierto, por tanto, que dicho uso y disfr
te sea en beneficio de propietarios privados, tal como lo establece el articulo
constitucional vigente.
Por otra parte, al suprimir el concepto de territorio indigena en relacion con
los recursos naturales, elimina el ambito en que un pueblo o comunidad podria
utilizar colectivamente esos recursos.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, al igual que el CONVENIO
169 DE LA OIT y la PROPUESTA DE LA COCOPA, en cambio, delimitan ese ambito
territorial. Ademas, definen territorio de
manera que no pueda confundirse con el espacio de vigencia de un poder politico
o juridico, lo que pudiera temer el Ejecutivo Federal.
La PROPUESTA DEL EJECUTIVO FEDERAL aparenta la creacion de derechos indigenas
donde la legislacion mexicana hoy vigente ya concede esos derechos a cualquier
ciudadano, y aun a las sociedades mercant
les. En otras palabras, la PROPUESTA DEL EJECUTIVO FEDERAL promueve una reforma
constitucional para "otorgar" a los indigenas lo que ya les corresponde por
derecho.


  5. COMUNICACIONES

PROPUESTA DEL EJECUTIVO FEDERAL, art. 4, VII: Las comunidades indigenas
autonomas pueden "Adquirir, operar y administrar sus propios medios de
comunicacion, en los terminos que las leyes de la mater
a lo establezcan."
La ultima frase es un anadido a la PROPUESTA DE LA COCOPA.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, III, 8, en cambio,
establecen que "es indispensable dotar a estos pueblos de sus propios medios de
comunicacion..." para lo cual propone "la e
aboracion de una nueva ley de comunicacion que permita a los pueblos indigenas
adquirir, operar y administrar sus propios medios de comunicacion".

EN CONCLUSION: Mientras las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES
establecen la obligacion de dotar medios de comunicacion a los pueblos indigenas
y garantizar su uso y operacion median
e una nueva ley, la PROPUESTA DEL EJECUTIVO FEDERAL deja en la incertidumbre
tanto la dotacion como la promulgacion de una nueva ley.
La PROPUESTA DEL EJECUTIVO FEDERAL promueve una reforma constitucional que no
modifica la legislacion actual.


  6. EDUCACION

PROPUESTA DEL EJECUTIVO FEDERAL, art. 4, VII: "El Ejecutivo Federal, en consulta
con las comunidades indigenas, definira y desarrollara programas educativos de
contenido regional, en los que reconoc
ra la herencia cultural de los pueblos indigenas."
La PROPUESTA DE LA COCOPA en lugar de decir "El Ejecutivo Federal", indicaba
"Las autoridades educativas federales, estatales y municipales." Ya restringia,
asi, lo declarado en San Andres.
En efecto, el PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES, 3, 5,
dice: "El Estado debera respetar el quehacer educativo de los pueblos indigenas
dentro de su propio espacio cultural"; deb
ra tambien asignar recursos para las "acciones educativas y culturales que
determinen las comunidades y pueblos indigenas".
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, III, 4, vuelve a
mencionar el "quehacer educativo de los pueblos indigenas".

EN CONCLUSION: Mientras el PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN
ANDRES y las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES conceden a los
pueblos y comunidades determinar sus propios
programas educativos, sin mencionar su relacion con las autoridades federales,
la PROPUESTA DE LA COCOPA concede ese derecho a las "autoridades federales,
estatales y municipales, en consulta con lo
  pueblos indigenas", y la PROPUESTA DEL EJECUTIVO FEDERAL solo lo concede al
"Ejecutivo Federal, en consulta con..."


  7. PROGRAMAS DE DESARROLLO

PROPUESTA DEL EJECUTIVO FEDERAL, art. 26: Los programas de desarrollo "tomaran
en cuenta a las comunidades y los pueblos indigenas en sus necesidades y sus
particularidades culturales". Este parrafo
es igual al de la PROPUESTA DE LA COCOPA; pero luego la PROPUESTA DEL EJECUTIVO
FEDERAL anade un parrafo nuevo: "Asimismo, promovera la igualdad de
oportunidades a fin de que los pueblos indigenas,
  partir de su propio esfuerzo, tengan acceso equitativo a la distribucion de la
riqueza nacional."
Este texto de la PROPUESTA DE LA COCOPA no se encuentra en el PRONUNCIAMIENTO
CONJUNTO DE LOS ACUERDOS DE SAN ANDRES ni en las PROPUESTAS CONJUNTAS DE LOS
ACUERDOS DE SAN ANDRES.
En cambio, en las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 5, d),
se lee: "Son las propias comunidades y pueblos indigenas quienes deben
determinar sus proyectos y programas de desarr
llo."

EN CONCLUSION: Hay dos ideas acerca de los programas de desarrollo:
La PROPUESTA DEL EJECUTIVO FEDERAL deja su proyeccion e implementacion al
Estado, "tomando en cuenta" a los pueblos indigenas, e insiste en la
responsabilidad de estos de elevar su nivel de vida med
ante "su propio esfuerzo", redaccion que es un retroceso frente a lo establecido
en el articulo 26 constitucional vigente.
Las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, en cambio, conceden a
los pueblos libertad para determinar sus programas de desarrollo.


  8. COMUNIDADES INDIGENAS

La PROPUESTA DEL EJECUTIVO FEDERAL omite reconocer a las comunidades como
entidades de derecho publico.
El PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES, 5, 2, y las
PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 4, en cambio, las
reconoce como "entidades de derecho publico".
La PROPUESTA DEL EJECUTIVO FEDERAL, art. 115, IX, concede que "en cada
municipio, las comunidades indigenas tendrian derecho a asociarse libremente a
fin de coordinar sus acciones para la promocion
e su desarrollo economico y social".
El PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES, 5, 2, y las
PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 4, conceden a las
comunidades un derecho menos restrictivo: "el derecho
de asociarse libremente en municipios con poblacion mayoritariamente indigena,
asi como el derecho de varios municipios para asociarse, a fin de coordinar sus
acciones como pueblos indigenas".
La PROPUESTA DE LA COCOPA recoge esta idea en el art. 115, IX.

EN CONCLUSION: La PROPUESTA DEL EJECUTIVO FEDERAL solo considera a las
comunidades como parte de la estructura municipal; su asociacion esta
restringida a los aspectos economicos y sociales, no a lo
  politicos ni a los juridicos.
El PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES y las PROPUESTAS
CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, en cambio, ven en la libre asociacion
de comunidades una manera de reconstituir lo
  pueblos indigenas.


  9. MUNICIPIOS INDIGENAS

PROPUESTA DEL EJECUTIVO FEDERAL, art. 115, IX: "En terminos del ultimo parrafo
de la fraccion III de este articulo, los municipios con poblacion
mayoritariamente indigena podran coordinarse y asocia
se para promover su desarrollo." El ultimo parrafo de la fraccion III citado
restringe la coordinacion y asociacion de municipios a "la mas eficaz prestacion
de los servicios publicos que les corres
onda".
La PROPUESTA DE LA COCOPA, en cambio, dice: "los municipios que reconozcan su
pertenencia a un pueblo indigena tendran la facultad de asociarse libremente a
fin de coordinar sus acciones".
Ninguno de los dos textos anteriores es fiel al PRONUNCIAMIENTO CONJUNTO DE LOS
ACUERDOS DE SAN ANDRES y las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES.
En efecto, las PROPUESTAS CONJUNTAS D
  LOS ACUERDOS DE SAN ANDRES, II, 3, hablan, igual que la PROPUESTA DEL EJECUTIVO
FEDERAL, de "municipios con poblacion mayoritariamente indigena", y no, como
dice la PROPUESTA DE LA COCOPA, de "muni
ipios que reconozcan su pertenencia a un pueblo indigena". No incluyen, por
tanto, la autoadscripcion a un pueblo indigena. Por otra parte, las PROPUESTAS
CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, 2,
4, no restringen la finalidad de la asociacion de municipios, como lo hace la
PROPUESTA DEL EJECUTIVO FEDERAL, a la prestacion de servicios publicos. Sus
finalidades son constituirse como pueblos.
PROPUESTA DEL EJECUTIVO FEDERAL, art. 115, X: "Las legislaturas de los estados,
al aprobar la creacion de nuevos municipios, tomaran en cuenta la distribucion
geografica de las comunidades indigenas
  previa opinion de las poblaciones involucradas."
La PROPUESTA DE LA COCOPA dice, en cambio: "Las legislaturas de los estados
podran proceder a la remunicipalizacion de los territorios en que esten
asentados los pueblos indigenas... en consulta con
las poblaciones involucradas."
Este texto es fiel al PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES,
II, 4, que dice lo mismo.

EN CONCLUSION: Hay dos ideas de la facultad de asociacion de los municipios:
La PROPUESTA DEL EJECUTIVO FEDERAL la restringe a lo ya dispuesto por el actual
art. 115 constitucional.
El PRONUNCIAMIENTO CONJUNTO DE LOS ACUERDOS DE SAN ANDRES y las PROPUESTAS
CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, en cambio, la consideran una medida
para reconstituir los pueblos indigenas.
Por otra parte, la remunicipalizacion, considerada en el PRONUNCIAMIENTO
CONJUNTO DE LOS ACUERDOS DE SAN ANDRES como una via para constituir municipios
mayoritariamente indigenas, en la PROPUESTA DE
  EJECUTIVO FEDERAL solo es tomada en cuenta para la creacion de nuevos
municipios.
Por lo que toca al derecho de asociacion municipal, el Ejecutivo Federal vuelve
a proponer una aparente reforma constitucional para crear un derecho
constitucional ya existente, el de la libertad de
asociacion de los municipios, derivado de lo prescrito por los articulos
constitucionales vigentes 9 y 115, fraccion III. No solo esto, sino que, en el
caso de los municipios mayoritariamente indige
as, pretende restringirlo.


  10. ELECCION DE AUTORIDADES

PROPUESTA DEL EJECUTIVO FEDERAL, art. 115, X: Omite mencionar el derecho de las
comunidades y de los municipios mayoritariamente indigenas a elegir sus propias
autoridades y formas de gobierno, conf
rme a sus normas.
En cambio, las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, II, 6, h),
establecen el derecho a "designar libremente a sus representantes, tanto
comunitarios como en los organos de gobierno mu
icipal, y a sus autoridades como pueblos indigenas, de conformidad con las
instituciones y tradiciones de cada pueblo". La idea se repite en V, 1, e) del
mismo documento.
La misma idea se recoge en la PROPUESTA DE LA COCOPA, art. 115, X.

EN CONCLUSION: La PROPUESTA DEL EJECUTIVO FEDERAL ignora totalmente este
acuerdo.


  11. REPRESENTACION EN CONGRESOS

Ni la PROPUESTA DEL EJECUTIVO FEDERAL ni la PROPUESTA DE LA COCOPA hablan de la
representacion politica de los pueblos indigenas en los congresos estatales y
federal, lo cual si esta considerado en
as PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES, III, 1, a): Se pide alli
que se prevean, a nivel constitucional, mecanismos que "aseguren una
representacion politica adecuada de las comunidad
s y pueblos indigenas en el Congreso de la Union y en los congresos locales...
con delimitacion de los distritos electorales que correspondan a las comunidades
y pueblos indigenas".
Sin embargo, la PROPUESTA DEL EJECUTIVO FEDERAL, art. 53, establece que "en la
demarcacion de los distritos electorales uninominales debera tomarse en cuenta
la ubicacion de las comunidades indigena
  a fin de asegurar su participacion y representacion politicas en el ambito
nacional."
La PROPUESTA DE LA COCOPA, art. 53, tiene igual redaccion, salvo que anade "las
circunscripciones electorales plurinominales".

EN CONCLUSION: Tanto la PROPUESTA DE LA COCOPA como la PROPUESTA DEL EJECUTIVO
FEDERAL rechazan la demanda de las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN
ANDRES de representacion proporcional de
los pueblos indigenas en los congresos; pero pretenden acercarse a ella mediante
una nueva demarcacion de los distritos electorales.



II
OBSERVACIONES GENERALES A PARTIR DEL ANALISIS COMPARATIVO




1. La PROPUESTA DEL EJECUTIVO FEDERAL incorpora varios textos de la PROPUESTA DE
LA COCOPA. Sin embargo, en los 11 puntos arriba senalados difiere de los
ACUERDOS DE SAN ANDRES y acota los de la PRO
UESTA DE LA COCOPA.
2. Estas diferencias obedecen a una concepcion distinta de la libre
determinacion y de las autonomias indigenas. La PROPUESTA DEL EJECUTIVO FEDERAL
las reduce al ambito municipal, y en esto coincide
con la PROPUESTA DEL PARTIDO ACCION NACIONAL. El PRONUNCIAMIENTO CONJUNTO DE LOS
ACUERDOS DE SAN ANDRES y las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES,
en cambio, conciben las autonomias d
  las comunidades como vias para la reconstruccion de los pueblos indigenas
autonomos.
3. No obstante estas diferencias, es posible la convergencia de ambas
posiciones, puesto que no existe lo que seria el obstaculo mayor: ni la
PROPUESTA DEL EJECUTIVO FEDERAL, ni el PRONUNCIAMIENTO C
NJUNTO DE LOS ACUERDOS DE SAN ANDRES ni las PROPUESTAS CONJUNTAS DE LOS ACUERDOS
DE SAN ANDRES entienden territorios indigenas en el sentido de espacios de
aplicacion de un dominio politico. Tanto l
  PROPUESTA DEL EJECUTIVO FEDERAL, como el PRONUNCIAMIENTO CONJUNTO DE LOS
ACUERDOS DE SAN ANDRES y las PROPUESTAS CONJUNTAS DE LOS ACUERDOS DE SAN ANDRES
conciben las autonomias como entidades que n
  alteran, en lo sustancial, la estructura del Estado Federal actual.
4. Analizadas las PROPUESTAS DEL EJECUTIVO FEDERAL, puede advertirse que este
promueve una reforma constitucional que no reconoce a los pueblos y comunidades
indigenas ningun derecho que no este ya
onsignado en la Constitucion vigente.
5. Para adecuar la PROPUESTA DEL EJECUTIVO FEDERAL a los ACUERDOS DE SAN ANDRES
cabrian dos lineas de argumentacion muy solidas:
a. Tomar en cuenta las coincidencias de fondo senaladas en el punto 3.
b. Tomar como criterio la letra y el espiritu de los ACUERDOS DE SAN ANDRES, que
el Ejecutivo Federal ha prometido respetar.


III
CONTEXTO HISTORICO DEL LLAMADO A LA CREACION DE UNA REFORMA CONSTITUCIONAL QUE
GARANTICE
EL CUMPLIMIENTO DE LOS ACUERDOS DE SAN ANDRES




Dirigimos a los legisladores del Congreso de la Union una peticion vehemente
para que, al tomar en cuenta la magnitud de sus cargos y responsabilidades
frente al pueblo mexicano, acojan la reiterada
manifestacion del Ejecutivo Federal de respetar los Acuerdos de San Andres, y
elaboren, a fin de llegar a una verdadera reforma constitucional que beneficie a
los pueblos indigenas de Mexico.
En caso de cumplir patrioticamente con una mision que rebasa los limitados
intereses partidarios, haran justicia a amplios sectores de la poblacion
mexicana que durante siglos han padecido las peore
  condiciones de existencia y evitaran el peligro de una contienda intestina
cuyos efectos nadie es capaz de prever.
Con este proposito, instamos a los legisladores a tomar en cuenta el desarrollo
de los acontecimientos que han llevado al pais a la critica situacion en que hoy
se encuentra:
   1.  Despues de la ofensiva gubernamental policiaco-militar del 9 de febrero de
1995 en contra del EZLN, que fue detenida tanto por las grandes movilizaciones
de importantes sectores de la sociedad
mexicana como por la expresion humanitaria de sectores conscientes en el
extranjero, el mismo Gobierno propuso ___y el Congreso la aprobo unanimemente___
la Ley para el Dialogo, la Conciliacion y la
Paz Digna en Chiapas del 11 de marzo, la cual llevo a la creacion de la Comision
de Concordia y Pacificacion (COCOPA).
   2.  En el marco de esta ley, las partes acordaron los principios, agenda,
bases, reglamentos y procedimientos que guiarian el proceso de dialogo y
negociacion.
   3.  En la agenda se establecieron cuatro temas de negociacion:
Derechos y cultura indigena
Democracia y justicia
Desarrollo y bienestar social
Mujeres
El tema de Derechos y cultura indigena fue el unico sobre el que se dialogo y
negocio, mientras que el de Democracia y justicia quedo inconcluso, y no fueron
abordados los restantes.
   4.  La Mesa I: Derechos y cultura indigena, concluyo con la firma de los
primeros Acuerdos de San Andres, el 16 de febrero de 1996.
   5.  A partir de marzo de 1996 el dialogo de la Mesa II: Democracia y justicia,
se empantano por la postura del Ejecutivo Federal, que no discutio ni presento
asesores. La participacion del EZLN se
interrumpio el 29 de agosto del mismo ano por el deterioro de las condiciones
necesarias para continuar el dialogo.
   6.  La CONAI y la COCOPA llevaron a cabo una serie de esfuerzos para destrabar
el dialogo. Con el reconocimiento del Gobierno Federal, se reunieron con el EZLN
en forma tripartita. A partir de est
s discusiones se acordo que la COCOPA elaborara una iniciativa de reformas
constitucionales que recogieran el espiritu de los acuerdos de la Mesa I.
   7.  La propuesta de la COCOPA fue aceptada por el EZLN, a pesar de que estaba
por debajo de los Acuerdos de San Andres. El Gobierno Federal no acepto dicha
propuesta, y presento una contrapropuest
  que el EZLN rechazo en enero de 1997.
   8.  Desde entonces no solo no se destrabo el dialogo, sino que tampoco se
avanzo en otros aspectos establecidos por la Ley para el Dialogo, la
Conciliacion y la Paz Digna en Chiapas, como es el fu
cionamiento normal de la Comision de Seguimiento y Verificacion.
   9.  En enero de 1998 el Ejecutivo Federal presento una iniciativa de Reforma
Constitucional sobre Derechos y Cultura Indigena, aun mas limitada que su
contrapropuesta de diciembre de 1996.
10.  Con posterioridad, el Ejecutivo Federal ha lanzado una campana
desinformativa, planteando que el Gobierno si cumple con los Acuerdos de San
Andres. Los mensajes implicitos de esta campana son l
s siguientes:
a) que el EZLN es la parte intransigente; y mientras que el Gobierno esta
dispuesto al dialogo, el EZLN quiere la violencia;
b) que con la iniciativa de Reforma Constitucional sobre Derechos y Cultura
Indigena el Gobierno esta llevando a la practica los Acuerdos de San Andres;
c) que al cumplirse de esta manera los Acuerdos de San Andres, ya no hay razon
para que el EZLN siga en armas.
11.  Con esta iniciativa y con la campana de desinformacion, el Gobierno podria
acabar de un plumazo con los principios, agenda, bases, reglamentos y
procedimientos acordados en el marco de la Ley p
ra el Dialogo, la Conciliacion y la Paz Digna en Chiapas, y con ello anular la
ley que es el marco legal que protege hasta hoy al EZLN.

17th, the following article by a former Australian Labor Party member of
Parliament.

In his provocative argument against General Pinochet's arrest (The Age,
15/12), Gerard Henderson claims "on the scale of dictators Pinochet is
towards the bottom end of the brutality stakes", a cruel insult to the
thousands of Chileans murdered, tortured and imprisoned during his vile,
17-year regime.

Mr Henderson then made the outrageous statement that "Castro inflicted far
more suffering on Cuba than Pinochet did on Chile".

The Cubans' suffering has not been caused by Castro but by the strangling
economic blockade of their island by the most powerful nation on earth and
by Washington's not-so-secret dirty war of overflights, bombings, sabotage
and assassination attempts.

Despite everything, Cubans are still better fed, housed, educated and
provided for medically than other Latin-Americans and many North Americans
living in capitalism heartland.

When Hurricane Mitch struck Central America, wealthy Australia offered a
miserable $1 million in aid, while Cuba, a poor country, wrote off
Nicaragua's debt of $US 50.1 million, sent five medical brigades to
Honduras, two to Guatemala, and offered -free of charge- an extra 2000
physicians to work in the region.

Gerard Henderson should remove his right-wing blinkers and go to Cuba and
talk with the people. He might learn something about sharing and human
compassion.

A cinco dias de que se cumpla el primer aniversario de la matanza de
Acteal, la diputada priista Arely Madrid Tovilla sostuvo "los grupos

Freeing poor nations from $220B burden

BOSTON -- A book of the Old Testament is inspiring a global grass-roots
movement aimed at giving a fresh start to the world's most impoverished
countries by the year 2000.

Taking its lead from the "year of jubilee" proclaimed in Leviticus, a
coalition led by faith-based organizations - Jubilee 2000 - is now active
in 45 nations pressing for cancellation of the poor nations' international
debt.

"People are motivated and moved by the biblical roots of this campaign,"
says Carole Collins, US coordinator for the effort. "In the vision of
Jubilee," says an Episcopal Church paper on the subject,  every 50 years,
"'right relationships' are restored, social inequalities are rectified,
slaves are freed, and debts are canceled," in recognition of God as the
provider of all.

As disparities between rich and poor countries widen, social conditions in
the poorest nations are deteriorating. The World Bank identifies 41
"heavily indebted poor countries" (HIPCs), and they are paying an average
of 40 percent of revenues for debt service. Many are diverting scarce
resources from education, health, and infrastructure programs, often with
devastating consequences. Development aid, meanwhile, is at the lowest rate
in a half century.

The question is whether the Jubilee movement can persuade wealthy creditor
nations to cancel the debt - or at least to offer "faster and deeper"
relief than is available under current-debt reduction programs.  Ninety
percent of the approximately $220 billion debt is owed to individual
governments and the multilateral institutions (World Bank and International
Monetary Fund) where industrialized nations hold control.

"We still have a year and a half and this campaign is really snowballing,"
says Justin Forsyth of Oxfam International, which is active in the
coalition, "but we're a long way away from a huge breakthrough on this issue."

Many in the movement are upbeat about prospects, both because of
mushrooming grass-roots enthusiasm and what they see as a new international
mood. They see the next six months leading up to the summit of the Group of
8 industrialized nations (G-8) in Cologne, Germany, next June as crucial.

Calls for change

Jubilee 2000 got its start in 1996 in Britain, where it mobilized 50,000
people for a show of support last May at the Birmingham G-8 summit. The
British government's bid to spur changes on debt at that meeting was
rebuffed, however - most vigorously by Germany. But a new center-left
German government has since been elected, and its minister for
international development in a recent interview indicated an intent to
propose changes that would be presented at Cologne to speed and broaden
relief.  If this becomes official policy, it would be a significant shift.

Germany and Japan have long opposed debt cancellation, says John Sewell,
president of Overseas Development Council in Washington, and other
countries aren't far behind. "There's an ingrained reluctance to forgive
debt."

Cancellation isn't in the interests of debtors, some say, because it would
harm their capacity to borrow in the future. It could also pose a "moral
hazard," rewarding cases of irresponsible management at the expense of
others who have done a good job and creating expectations that future debts
might be forgiven. Advocates say there's an element, too, of creditors
wanting to maintain leverage over economic policies.

"What we are trying to achieve," says a senior United States Treasury
official, "is to reduce the debt to the point where the country can afford
to service it and still have adequate capacity to grow in the future,  yet
get out from under the burden."

There is a growing recognition that the situation is dire. In a meeting
with Anglican bishops in July, World Bank President James Wolfensohn
acknowledged that "we are losing the battle" against poverty, and that debt
repayment was "a principal reason" social and other services cannot be
provided in the poorest countries.

Mr. Wolfensohn has begun meeting regularly on development issues with
religious leaders, including a recent conference at Seton Hall University
in New Jersey on "Ethical Dimensions of International Debt."

The World Bank launched a new debt reduction initiative for HIPC nations in
1996, but so far there are agreements for only seven: Uganda, Bolivia,
Burkina Faso, Guyana, Ivory Coast, Mozambique, and Mali. "We are satisfied
with the progress we have made," says Axel van Trotsenburg, the bank's HIPC
manager, "but also recognize that much more needs to be done."

Debt a moral issue

The HIPC initiative is applauded for reducing, not just rescheduling debts,
but widely criticized for being too strict in its requirements and taking
too long (as much as six years or more) to provide actual relief.

Individuals and corporations have the option of bankruptcy, critics say,
while poor countries simply sink under the weight of their debt burden.

It's a moral issue to many. "Countries that can't afford to provide potable
drinking water shouldn't be forced to make debt payments at the expense of
investing in their own people," says Barbara Kohnen, a policy adviser at
the United States Catholic Conference.

Others point to the debt incurred by corrupt authoritarian leaders that
used loan monies for prestige projects or military spending - or stashed
them in overseas bank accounts. Some were made to strongmen who were
cold-war allies, says Jo Marie Griesgraber, project director at Center of
Concern in Washington. "We need to recognize we got what we paid for - the
votes in the UN by Mobutu [of the former Zaire] and others." The poorest
people in those countries, she adds, shouldn't have to shoulder the burden.

Many churches echo that view. Pope John Paul II, who called in 1994 for
debt cancellation or substantial relief, last month called the debt a
"subtle form of slavery." Anglican Archbishop Njongonkulu Ndungane of Cape
Town criticizes the complacency of well-off countries and points to South
Africa's example: The Mandela government in 1997 cancelled Namibia's debt.

The Anglican church took a strong stand on debt at its global Lambeth
Conference in July, as did the World Council of Churches this month at its
World Assembly. The Presbyterians, Mennonites, Evangelical Lutherans, and
United Church of Christ are involved.

Firsthand view

Many churches have been galvanized by the experiences of their members in
poor nations, as Christianity spreads in the developing world. "It's a
partnership question, responding to the pleas of our Anglican brethren
abroad," says Tom Hart, government relations director for the Episcopal
Church.

Jubilee 2000 USA was formed in 1997 by a "religious working group" of
denominations. The priority is a legislative strategy, says Ms.
Griesgraber, steering committee chair. They are seeking bipartisan support
to introduce a bill in the next Congress to accomplish "definitive debt
relief."

The bill will seek elimination of the bilateral debt owed to the US for aid
loans; US leadership in reducing multilateral debt; and modifications to
HIPC criteria, including ways to ensure that funds freed up go to reducing
poverty.

Lisa Wright of Church World Service says Jubilee estimates that a little
less than $1 billion will be needed from the US over the next three years
to accomplish this. In the '90s, the US has cancelled $2.7 billion in debts
owed it by the 25 poorest countries, and another $1.5 billion is
outstanding, according to the Treasury Department. But it wouldn't take
that much to cancel it, according to Jubilee, since bilateral debt is
written off according to market value.

To win over Congress, Jubilee will look to committed folks across the
country. "Somehow the spirit is abroad in the land," says David Bryden,
communications director. "I call a group to ask if they've heard about the
effort and they say, 'Oh, we've been working on that for a couple of
months; we've met with our senator and have been collecting petitions in
our church.'"

Ms. Collins, US coordinator, says this "is the one thing that could give
poor countries a significant boost." The aim is 2000, not only because of
the millennium, "but to discipline ourselves and the international
community not to just talk about it for another decade."

las mujeres sean diáconos. "Un diaconato femenino representaría un paso
hacia el sacerdocio", dijo a los periodistas el cardenal Darío Castrillón
Hoyos, que encabeza la Congregación del Vaticano para el Clero.

"Hay tantas otras oportunidades" para las mujeres en la Iglesia, dijo el
prelado, que habló en rueda de prensa convocada para presentar la carta que
el Papa Juan Pablo II dirige a los sacerdotes en todo el mundo antes de la
Pascua.

Más de la mitad de los diáconos del mundo se hallan en Estados Unidos,
donde muchos han cuestionado la prohibición a que las mujeres ingresen al
diaconato, ya que los hombres laicos, incluso casados, pueden ser diáconos.

Hace sólo un año, las autoridades del Vaticano dejaron en claro que la
Santa Sede no estaba considerando que hubiera mujeres en el diaconato. El
motivo de esa prohibición, dijo entonces el cardenal Pío Laghi, se basa en
el hecho de que Jesús era hombre.

I do not mean to be critical, but I took the first posting and request for
financial support and needs very seriously. I was just about to forward it
to people who might be capable of helping, but as I read the follow-up re:
beer money, names, etc., I decided that perhaps the original post was a
"test" and/or a hoax. If indeed it is a serious request, then perhaps the
private discussion that followed should not be posted to the list. It tends
to detract from the seriousness of the issue.

Editorials: Democracy wins in Mexican primary
Tuesday, November 9, 1999

Mexico took a long stride toward political maturity this week, discarding
an autocratic tradition of presidents handpicking their successors in favor
of a nationwide primary.

The world's longest governing political organization, Mexico's
Institutional Revolutionary Party (known by its Spanish acronym PRI), can
count this overdue experiment in democracy a success on several counts.

Turnout was higher than expected, demonstrating Mexican voters were eager
to take part in what used to be an insiders' decision-making process
reputed to be as closed and secretive as the selection of a pope.

Given the PRI's reputation for election-day chicanery, its management of
Sunday's balloting was relatively glitch-free. Reports of abuses were
scattered and seemed minor; fraud and intimidation didn't have a
significant effect on the outcome.

The clear favorite of the PRI's "establishment," former Interior Minister
Francisco Labastida, was the overwhelming choice of Sunday's voters.
Moreover, his chief rival in the four-person contest, former Tabasco Gov.
Roberto Madrazo, quickly dispelled rumors he would remove himself and his
allies from the PRI.

Thus, the PRI can expect to enter next year's general election campaign
reasonably united. Meanwhile, its opponents to the right, the National
Action Party, and to the left, the Revolutionary Democratic Party, remain
divided over the most effective way to challenge the PRI.

An economist with three Cabinet postings to his credit, Labastida appears
to be a technocrat in the mold of Ernesto Zedillo, Mexico's current president.

Indeed, Labastida or whoever wins the presidential election next July 2
would do well to model himself after Zedillo.

More than any modern Mexican leader, he has worked hard for election and
campaign law changes that have advanced the cause of democracy, pluralism
and political stability.

The culmination of his reforms was his refusal to anoint a political heir.
Self-denial like that is good for the body politic.
