There was an article in the Colorado Daily today which claimed "risks far
outweigh gains" when it comes to capital punishment. I think it would be good
if we sent in letters agreeing with this opinion. The article mistakingly
claims that the Supreme Court has looked at the electric chair as Cruel and
Unusual punishment and forced Florida to change. It then suggests that it will
do the same in Alabama although the Court did decide not to look at it. I was
thinking we could correct the statement and then discuss why the death penalty
is inhumane, perhaps Vicki could insert part of her article that she wrote
following the execution of Gary Davic. The current article only looked at money
and deterrence for reasons to oppose the death penalty. Check out the article:

The presiding judge in a capital murder trial would have the power to impose
life or death sentences under a proposal that won support in the Colorado
House of Representatives Wednesday.
House Bill 1299, sponsored by Aurora Republican Rep. Gary McPherson, would
replace the state's three-judge panels in death-penalty cases with the trial
judge and correct what McPherson and other bill supporters say is a flaw in
the current system. The bill is expected to come up for final consideration
today and, if approved, would be sent to the Senate for consideration.
"There's been a lot of frustration with the current system. One person could
impose their will over the laws of the state," McPherson said, arguing for
his bill before the full House. The House first killed the measure, then
narrowly revived it on a 33-31 vote.
Proponents say the current system allows judges who are against capital
punishment to control the outcome and enables judges from outside the
jurisdiction where the murder occurred to participate and possibly change the
outcome.
Critics argue that bill supporters simply want more people executed.
Since the law changed in 1995, Colorado's three-judge panels have considered
the death penalty six times and imposed it twice. That's slightly more than
juries. The panel's decision must be unanimous for the death sentence to
stand. Otherwise, life in prison becomes the punishment.
In two of the cases, the panels voted unanimously against execution. But in
two cases that angered death-penalty supporters, a unanimous decision could
not be reached. Rep. Joe Stengel, R-Littleton, and other lawmakers claim the
dissenting judges might have been philosophically opposed to the death
penalty but participated anyway and intentionally tipped the scales, instead
of excusing themselves. The same has happened with juries, they said.
"People lie," Stengel said. "They have an ulterior motive. ... What they'll
do is derail the death penalty." House Minority Leader Ken Gordon, D Denver,
who wants to return to the old system of allowing jurors to decide, chastised
Stengel for his comments.
"We need to move closer to the will of the people," Gordon said.
A competing death-penalty bill up for debate in the Senate next Monday would
return the death-penalty decision to a 12-member jury. Dottie Wham, R-Denver,
sponsor of Senate Bill 28, says that since Coloradans have voted to have the
death penalty, they should decide who lives and who dies in capital cases.
But Senate President Ray Powers, the mastermind behind McPherson's onejudge
bill, says he wants the bill to die a quick death on Monday. Powers
introduced an identical bill to McPherson's in the Senate, but it was killed
earlier this month by the Senate Judiciary Committee.
As Senate president, Powers has the authority to decide in which committee
McPherson's bill lands, but he declined to say Wednesday what he would do.
"At this point, it's important that we concentrate on not passing Senate bill
28," he said.
Lawmakers who argued for a change in the law back in 1995 contended that Colo
rado juries were not imposing the death penalty often enough. They argued for
the one-judge system then, but former Gov. Roy Romer made it known he
wouldn't sign such a bill into law so they passed the three-judge system as a
compromise.
McPherson said that with a Republican governor in office, he is simply
returning to the one-judge plan that lawmakers wanted originally, in hopes
Gov. Bill Owens will sign it if it reaches his desk. Owens is a proponent of
the death penalty but has said he won't comment on the bills.

indeed, anytime there is something in the paper related to our issue, it is
worth writing about. for example, illinois governor's moratorium on
executions, given the number of defendants (12 in the last year?)released
from death row.

we need the bill to pass the Senate floor and then it would go to the House.
The bill would probably start in House Judiciary (a good committee for us on
this issue) and then it would have to pass the House floor (much more
difficult). Then we would hope that Gov Owens would not veto the bill. It
is a long road but definitely worth the effort. The testimony today in the
Senate Judiciary was simply outstanding in support of the jury system.. Dan
Hoffman spoke of the long history of juries in our system and the English
system of jurisprudence. Gary Jackson spoke eloquently of the importance of
juries to all minorities in the community. Connie Peterson spoke of her
experience as trial judge and her belief that juries were the best system
that we could have. Bob Miller and Craig Silverman (yes, Craig Silverman)
spoke as ex-prosecutors in death cases in support of jury decision making.
Pat Furman addressed the law in the other 49 states as well as the Colorado's
legal history on death cases. CTLA supported the bill. The lobbyist for the
Catholic Church spoke on behalf of the bishops' in support of the bill. The
Senators on the committee were really quite taken with the quality of the
testimony offered. In my opinion, the DA's were quite unprepared for this
type of discussion. In the end, Senator Arnold, former State Patrol officer
from Adams County, voted for the bill -referencing part of Dan Hoffman's
testimony that he must choose the "citizens" over the "government" in
decision-making. Thank you to all of you who made calls. We will need you
again. Thanks to Gene Cianco who called and talked to Senator Arnold before

as far as i knew, you are on our e-mail list. what is it that you think you
have not been getting?
we are no longer mailing out or e-mailing agendas and minutes, except to the
board. but the agenda can be found at coadp.org. we are hoping that our
quarterly newsletter, mailed out, and available at the web site, will be
sufficient to keep up communication.
thanks for the names/addresses of the 50 organizations. nick gave them to
me at the meeting. i'll forward those to jd, and also try to add those to
the speakers bureau list, though we are minus our secretary at this point.

cadp has not taken an official position on the bills, because the general
consensus was that voicing opposition to the death penalty as a reason to
support returning the penalty phase decision to the jury could be, shall we
say, counter productive.
as an aside, generally, i'd say most folks think that there will be fewer
death verdicts with jury sentencing. however, in our year of 3 judge panel
sentencing, although 2 death sentences are too many, still the majority of
the cases went life imprisonment. but, generally most folks think this trend
won't last given the political pressure on judges.
there are good reasons, other than opposition to the death penalty, to
oppose ray powers' bill for one judge sentencing, and to seek return to jury
capital sentencing. these reasons include the political pressure on judges,
and the need for community members to assess the aggravating factors of
these crimes and the mitigation pertaining to the defendants. most states
have jury capital sentencing though it is not unconstitutional federally
for judges to sentence in capital cases.
i am glad there is information so that cadp friends may call their
legislators about this, and i encourage them to do so. i suggest the calls
be made in their capacities as individuals, not as cadp friends, and they
should say what they wish to say on the matter at hand.

Well, we better have a position that it needs to be returned to the jurors
and not to just the trial judge. See Illinois' moratorium on death
sentences because of the unreliability. One legislator has said that we
need the one judge because it is not fair that one judge who would not want
to go along with the death train (in the panel forum) could stop it from
happening. But, why then should one judge get to make the decision about
death under Power's bill? Answer: Because one judge will always buckle and
get voted out.

I agree with Doug Wilson. With reference to sheer numbers, you have twelve
shots at saving someone at sentencing with the jury instead of three. A more
compassionate and human system. Too much political pressure on the judges to
choose death. Wait until you might have the three judge system in place for a
few more years. OR JUST THE TRIAL JUDGE (GULP!!!). The pressure on judges
will become overwhelming. Even though you have some decent results from the
three judge panel thus far, the pressure has not been turned way up on the
judges yet. And just look at all those fresh out of D.A.'s school the
Governor is picking as judges.
Just a couple of more thoughts.

1. returns the power and decision making to the people of the state where it
should auways be placed.
2. takes some of the politics out of the system. As it stands now, the
judges that vote for life are under heavy attack from the politicians at
retention time. For instance, the Gazette in Springs and ray powers want
the voters to turn out the judges that "did not go along with" the death
vote.

thanks for sending info about the meeting. we try to end at 7:15. at the
next meeting, we are going to discuss when we should have just the board and
council. but so far, it's been good to keep up interest to have interested
