Yesterday, media reports carried a statement issued by my friend, Jayathas
of the Human Rights Party (HRP) that Hindraf did not support the Anything
But Umno (ABU) initiative.

Today, sms's have been circulating, allegedly from Uthayakumar and Jayathas,
calling on Hindraf members to not have anything to do with ABU activities.
The media have been hounding me for a response.

I thought I best leave it to the Chairman of Hindraf, Waytha Moorthy, to
clear the air on this matter.

He has issued a statement today which does precisely that.
I reproduce the same below.

HINDRAF would like to reiterate that it will continue to support any
movement from Peninsular and East Malaysia in our attempt to dethrone UMNO
and its mandores from their continued atrocity against the society in
particular the poor & marginalized ones.

We have always been consistent that UMNO has to go but we will never be able
to do it alone. HINDRAF's decision to take a multi-pronged strategy and
engage with any 3rd party opposition forces was taken at the 2nd annual
convention held on 4th December 2011. HINDRAF will work with any forces that
work in tandem with our agenda to uplift the marginalized segment of
Malaysian Indians along with those in similar bracket by working in
partnership and moving forward with any force that seek similar agenda
similar to ABU on a political stance. Naturally, besides ABU, there are many
other organizations like UBF from East Malaysia have sought justice for "Jus
soli" of segment of their society that are continuously marginalized and
discriminated due to the weakness of their representatives within the UMNO
alliance.

HINDRAF's position in working with other 3rd forces against UMNO is solely
on a consensus that human rights and equality should be across the board
starting with the poorest segment of the society like the Malaysian
Indians and their fellow brethren amongst other Malaysians.

The recent statement issued on instructions of P.Uthayakumar the Secretary
General of Human Rights Party with regards to our involvement with ABU was
purely his personal view and we in Hindraf respect his views though
collectively we differ from his personal opinions.

HINDRAF's voice is a mix and marriage of the ground root supporters, not one
based on an individual. All the national coordinators of HINDRAF from the
various states in Malaysia had unanimously agreed that in order to address
the issue of the poor and marginalized Malaysian Indians and those in
similar position, it needs a concerted effort from all parties irrespective
of the race, religion or creed and this is only possible if we heed the
grass root supporters call to bring a fruitful success to upheaval social
injustice perpetrated by UMNO and its mandores.

HINDRAF call upon all its supporters to continue their support for ABU and
any other cause that can ensure the parity stretches amongst Malaysian in
recognizing the cry of the poor and marginalized Malaysian Indians.

Two Eyewitness Lodge Police Report Against ABU Ceramah Attack

KUALA LUMPUR, 27 JANUARY, 2012: Eye-witnesses of the incident during
the Anything But Umno (ABU) and Hindraf ceramah gatecrash incident lodged a
police report today over a victim who was beaten up by a group of youth
during the talk in Jalan Kebun on Saturday.

The two eye-witnesses, Enalini Devi Elumalai and Sivaranjani Mancikam
made the report at the Dang Wangi police station around 3.30pm today.

"We view this incident as serious and a danger to security.

"We also believe that if the police had came earlier and took serious
initiative to control the situation, the scuffle and attack towards the
victim would have been avoided," said the eye-witnesses when met by
reporters outside the police station.

One of eye-witnesses, Enalini, said they had made the report
voluntarily to assist the police in doing their job and bring those who are
responsible for the attack to justice.

Recalling the incident, she said she was in her car when saw the
victim being pulled by the group and beaten up until he was severely
injured.

She said the group had arrived at ceramah venue on motorcycles and
hurled harsh words at the participants, where they even knocked on her car
and told her to leave.

Enalini said one of the motorcyclists had also donned a white "Umno-BN
Selamanya" t-shirt, and also 30 others standing on the roadside holding blue
Barisan Nasional flags screaming "Get out of here! Don't do the ceramah!"

"I want this case to be investigated by the police who are neutral and
we hope that investigations will be done fairly and accordingly," she added.

On Saturday, a rowdy mob had gatecrashed a ceramah organized by ABU
and Hindraf in Jalan Kebun, Shah Alam, causing at least one person to be
seriously injured.

According to a report, the organizers said that one of the volunteers
at the ceramah had to be rushed to the hospital after he was badly
assaulted.

The incident is said to have happened at about 9:15pm as the ceramah
was about to start when some 20 attackers, waving sticks and helmets, rode
their motorcycles into the ceramah hall and rammed into the participants and
chairs.

Others who had followed on foot had allegedly 'caused havoc' by
tossing chairs, throwing away ABU brochures and hurling racist insults at
participants, demanding for them to leave. - mD

Two nights ago, I had supper with the very same UMNO people who told me in
December, last year, that Najib would move to dissolve parliament on
February 17th and have the polls for the 13th GE on 11th March.

They informed me that as of now, nothing has changed.

Those dates are still on the cards.

Is anyone hearing anything else?

NUJ's proposals to the Parliamentary Select Committee on electoral reforms
The Election Commission

The Election Commission must be empowered to form a media monitoring
committee whose duties will include issuing guidelines to print, broadcast
and on-line media.

This is to ensure the media engages in fair reporting so that voters have
access to balanced views for them to make their choice.

The committee should be on duty from the time the Dewan Rakyat/State
Assemblies are dissolved until election results are announced. In the case
of by-elections, the committee should spring into action from the time there
is a casual vacancy until election results are announced.

Public Media - RTM and Bernama News, Bernama Radio and Bernama Television.

The ruling government will become caretaker government and they should be
prohibited from totally monopolising state facilities (RTM and Bernama).
This is because these public media are funded by taxpayers.

NUJ proposes that the number of hours allocated for political parties to
campaign over radio and television should be based on the percentage of
parliamentary seats won in the last election or on the percentage of
parliamentary seats currently they are contesting.

Representatives from both the caretaker government and opposition should be
given time to campaign "live" during prime time over radio and television.
Bernama, like private media, should subscribe to ethical reporting, and
provide fair and balanced coverage to all parties.

Private Media - Online news portal, newspapers, broadcast stations including
Astro.

They should also subscribe to ethical reporting and provide fair coverage.

The right to reply must be given if the media carries adverse report about a
party or candidate.

Newspapers and on-line media must sell space to political parties which want
to advertise their manifesto.

Media regulations

The Commission can draw up regulations for media committee to enforce
regulations under the conduct of election in the Election Act 1958.

It should be emphasised that no candidates, agents or political parties
through the media before and during the election make statements to promote
feelings of ill will, discontent or hostility as stated under section 4A of
the Election Offences Act 1954.

The Commission through the committee should censure the irresponsible media
and display complaints received from aggrieved parties in its website.

The police and election ceramahs

Apart from ensuring a free media during the election, the Commission must
see that the police sparingly and speedily approve permits for political
parties and independent candidates to conduct ceramah.

The role of the police is to ensure public safety and order. If two opposing
parties are conducting ceramah which is close to one another, police should
distance them to prevent any untoward incident.

Conclusion

A free and fair election is an important component of a functional
parliamentary democracy.

Voters must be given the free will to elect their wakil rakyat, their
Federal Government and State Governments who will make decisions on their
behalf over the next five years.

Thus, electorates must have ready access to information, news and
commentaries for them to make an informed decision.

The Commission must ensure the media, whose business is to sell information
and influence the public, play the role of a unbiased referee.

Undisputed election results will give legitimacy to the new government/s and
the mandate to administer the states and the federation.
