Dear Dr. Fangohr:
My probation officer, Ms. Cathcart, has informed me that my request for
my psychiatric records from Magellan Health Services has been denied.
The reason for the denial was extremely frivolous. A false accusation
was made that I had used crude and inappropriate language when
complaining to my case manager about the inordinate delays in
processing my request, and that supposedly was the reason, or rather
lame excuse, for denying my access to my records.
Even if there had been truth to that accusation, the right of a
patient, even an unwilling patient, to access his health records is not
contingent upon how "polite" he is perceived as being and may not be
denied on a whim. Since I have failed to secure the voluntary
cooperation of Magellan Health Services in granting access to my
records, I make this request directly to you. I remind you that your
duties as a physician supersede the wishes of your employer and that it
is your duty to provide me with access to my records even if Magellan
opposes this.
Magellan, it seems, has something to hide. I hope that you, as my
physician, have nothing to hide. I also hope that you would not be so
unethical as to withhold my access to my records to conceal from me the
wrongdoing of a colleague.
