i would like to express my concern over the issue and also to some extent agree with ur views. i personally feel that this concept of being a pervert and the current trend of social deviation is nothing but a fashion statement practised by many in the page 3 social circles and by many more to earn some easy money. otherwise how could something that constituted a neglible minority some time back become a mainstream phenomenon. what mighthave been an act of deviation earlier has now become a trend.
 
however, most people who support the cause, agree with the fact that this might lead to child sexual abuse and same sex rape, and therefore agree with the fact that the mere scrapping of S 377 without appropriate amendments in rape laws, would rather be an even worse backfire.
 
the proposed amendments to the existing rape laws worked upon by the National Commission for Women takes care of this. child sexual abuse which, till now was trated as an offence under S 377 and thus called for lesser punishment, has now been proposed to be made an aggravated form of sexual assault.
 
if this is put forward as an argument, it might weigh heavily in favor of the NAZ foundation, beacuse these amendents may soon become a law, looking into the fact that there is enough political will to pass the bill. 
 
anyway, lets see what stand does the SC take on this.

Sub: Reasons for preserving section 377 of Indian Panel Code and rejecting
the appeal of NAZ foundation

Honorable Sir,

1.      I, Muhammad Mukhtar Alam, s/o Janab Abdur Rahman and permanant resident
of village Mathurapur, district –Bhagalpur, Bihar, would like to draw your
attention to the petition of Naz Foundation that has been rightly rejected
by the High Court of Delhi. The petition challenges "the constitutional
validity of section 377 of the IPC on the grounds that it criminalizes
homosexual act even between two consenting adults". (The Hindustan Times
December 8, 2001).

2.      I would like to respond to this as a citizen of this country and a
world citizen and call for a dismissal of this petition. A favorable
judgement for the petition will violate the rights of children to have
reverent role models, and, most importantly will create a supportive
social climate for the adoption of homosexuality in India.
3.      I would like to strongly oppose the move of Naz Foundation as an
anti-children, anti-family and anti-God. Also through my research work I
have proved that environmental factors for the adoption of homosexuality
are ignored by all these campaigners of civil liberties while
overemphasizing the contribution of genetic determinism. There is a case
for "hijras" but then there is no case for the homosexuals who have been
imitating a deviant and degenerate sexual practice that has been approved
in the European and American laws. My related academic submissions
pointing out the need to review of the decision of American Psychiatric
Association contained in my conceptual organization for description,
analysis, prediction and control of the personal/ social / world order can
be seen at http://muhammad_mukhtar_alam.tigblog.org  . The submissions are
web referred at a youth site and are part of the findings of the discourse
analysis for my Ph.D. dissertation on "A Study of the Cognitive
Representations related to the Concept of World Citizen" that has been
presented to University of Delhi in September 2000.
4.      The petition contends that article 377 of the IPC violates the
liberties enshrined in the constitution under article 14.15,19 and 21 in
so far as it penalizes predominantly homosexual acts in private between
consenting adults. This can be seen that this is an instance of
overgeneralization for the provisions of the cited articles. There is a
concern for the rights of the children for reverent role models. Making
homosexual act lawful will mean endangering the lives of many children who
are being already provided with an overdose of atheistic libertarian
values where pre-marital and extramarital affairs do not get denounced,
punished and condemned.
5.      The article 377 of the IPC deals with the subject of unnatural offences
and states that "whoever voluntarily has carnal intercourse against the
order of the nature with any man, woman or animal shall be punished with
imprisonment for life, or with imprisonment of either description for a
term which may extend upto ten years and shall also be liable to fine".
There is a need to preserve this provision as its deletion even with
regard to the homosexuals and lesbians will create problems for the
collective social health and individual health.
6.      It has been argued, "section 377 creates an arbitrary and unreasonable
classification between natural (penile-vaginal) and unnatural (penile-non
vaginal) sexual acts that violates article 14's equal protection before
and under law". Here Naz Foundation already assumes the existence of a
"sexual minority" whose rights are considered to be violated. There is no
recognition of such minority in the constitution. There should not be any
recognition to such a minority in the law. Also classifications of the
sexual acts are very reasonable. Naz foundation is absolutely misguided in
mimicking the deviant atheistic intellectual and political currents
originating in Europe and US in this regard. Also Naz Foundation is
misguiding the court on its understanding of constitutionally recognized
minorities. There is no violation of the article 14 of the constitution
with reference to the provisions of article 377 as there is no recognition
for "sexual orientation" as a category. If there is recognition for sexual
minority there can be also a call to recognize the human rights of the
thieves and pickpockets to indulge in their smart acts of fooling,
cheating and looting.
7.      It has been argued that Section 377 imposes traditional gender
stereotypes concerning the "natural" sexual roles for men and women upon
the sexual minorities". Here again there is an explicit reference to the
"sexual minority" which refers to men and women who have been misguided
for appropriating homosexual acts. Instead of calling for help in
correcting the deviant behavior an appeal is being made to recognize it as
a normal and natural act. All traditional gender roles cannot be
denounced. Atheistic feminist discourse needs to have recognition of the
limits that are imposed biologically, ecologically, and morally. "Hijras"
need a special rehabilitative attention and for them there is no
imposition of gender roles. Hijra's are sexually challenged with reference
to reproductive capacities and there is no imposition of gender roles on
them. For homosexuals and lesbians, specific gender roles will continue to
be socially desirable as for many they will be known as men and women..
8.       According to the petition, the social effects (of article 377) drive
gay men underground with a devastating impact upon HIV prevention efforts
as " it becomes difficult to identify and target this population for HIV
/AIDS prevention efforts through education and provision of medical
services". I would like to denounce this contention, as most of men who
have unnatural sex with men cannot be considered to be so ignorant and
illiterate. As per journalistic accounts most of the men and women
identifying themselves, as gays and lesbians respectively are quite well
educated. There is no need for making homosexuality lawful in our country.
There is need to campaign for the reverting to the pre-1973 position in so
far as the related categorization in Diagnostic and Statistical Manual of
US is concerned.  Sheldon B. Korchin has noted the fact interestingly in
his book on Clinical Psychology that it was the gay movement in US that
compelled APA to change the understanding of homosexuality in 1973.
"Homosexuality was no longer considered a sexual deviance rather it was
just an 'alternative orientation'" (Sheldon J. Korchin (1998),"Modern
Clinical Psychology, Principles of Intervention in the Clinic and
Community", CSB Publishers). It may be noted that there is hardly anything
"oriental" about this "orientation". Homosexuality is a product of lack of
moral control and absolutely wrong socialization .It is curable. The best
cure can be tried by seeking forgiveness for the past sinful deeds.

9.      It is important to campaign for the restoration of the old definition
of degenerate practice of homosexuality that is being celebrated and
paraded in the dancing halls and bars of the irreverent and atheistic West
whereas practice of religion is propagated to be restricted to the privacy
of the homes. Also, I would like to appeal the people in the "orient" to
campaign for deleting the word orientation as this word has been abused by
referring this to a sexual deviance in DSM manual of American Psychiatric
Association.

10.      According to a study conducted by Himachal Pradesh Voluntary Health
Association, Shimla 20% of the children have experienced homosexual
atrocities. "Another after effect of this is sharp increase in
Transportation work which mainly comprise of rural people of HP with large
involvement of children working as cleaner. For one Big Cement plant viz.
ACC Cement Barmana approximately 8000 trucks are operating. As per one
small study 20% of such children have experienced homosexual atrocities".
There are other studies that have shown the involvement of homosexuals in
sexual abuse of the children through internet as well. Thus, I would like
to argue that granting revision and elimination of the prohibitory
provisions of article 377 will further increase the incidence of child sex
abuse by male homosexuals. In UK, there had been a demand by the gays for
reducing the age of consent from 18 to 14. Considering the dominance of
the atheistic liberal ethos, many children and adults will be become prone
to the abuse of homosexuals. Also there had been a study where 70% of the
abused children had been the victims of sodomy by homosexuals.

11.     Considering the above I would like to appeal for the dismissal of the
petition of Naz Foundation while also seeking the deletion of references
to adoption of homosexuality as matter of human right in the documents of
Amnesty International.

12.     Considering the developments in Europe and US in this regard there
might be a call for redefining institution of family so as to incorporate
homosexual couples as family. There may be also be call then for them to
be considered as legitimate recipient of abandoned children for adoption.
Thus it can be seen that for many youth, children and future generations
permission of deletion in provision of article 377 of IPC, there will be a
great intellectual and moral confusion. This will also have significant
adverse impact in the families where some boys and girls under the
persuasion of such neo-liberal atheistic "social workers" and homosexuals
will be called on to "come out of closet" and announce to the families and
relatives that they are gay.

13.     According to a study reported in Hindustan Times of 10 May 2001, two
psychologists led by Dr.Robert Spitzer proved that highly motivated
homosexuals could be converted. They also repudiated the attitude of the
mental health professionals "who have bought the idea that once you are
gay you cannot be changed". He and his colleagues have found that 66% of
men and 44% of women had achieved good heterosexual functioning. With
reference to the petition of Naz Foundation it can be seen that there is
no reference for the existence of controversy on the etiology of
homosexuality. Instead, they have been calling for making homosexuality
lawful.

14.     In case, there is a favorable judgement, there cannot be an end to the
social denunciation of lesbians and homosexuals in India considering the
strong conservative values that are shared across the religious groups in
this regard. If the petitioners and their tutors think that they are
"progressives" then they must recognize that RSS, practicing Muslims,
Christians, Jains and Buddhists will continue denouncing them for their
misguided understanding and seek correction in attitudes. Considering the
history of dissidence this may be noted that appropriation of
homosexuality is an instance of the most extreme and worst development in
the anti-Christian discourse in Europe that was championed by Michel
Foucault who could have excluded gays and lesbians while advocating for
better treatment of women, blacks and prisoners. But then in his zeal for
unearthing the archeology of knowledge he tried to have "limit experience"
in the bars with provisions for sadomasochist experiences and liberated
the gays and lesbians from the psychiatric label. Formation of groups of
lesbians and homosexuals across the world are seeking a change in the
legislation in all societies. Unfortunately, Richard Falk has also
included such a change in the existing legislations as part of "humane
governance" (Falk, Richard (1995), "Towards a new global politics ,world
order model project report of the global civilization initiative", Polity
Press  Cambridge, UK )

15.     Considering the exclusive studies by the undersigned, I may be called
in person for presenting my case.

Considering the above I would like to appeal for the dismissal of the
petition with a severe reprimand for Naz Foundation while suggesting them
to use faith based instruments for gays and lesbians. They can do better
prevention of AIDS by faith based counseling than seeking legitimacy for
deviant sexual acts. I would like to earnestly request you to reject the
petition and affirm the judgment of the Delhi High Court in this regard.

ABHAY AND RANI BANG

Like many great medical breakthroughs, Drs. Abhay and Rani Bang's discovery of how to reduce child deaths in the developing world as much as 75% came from a deceptively simple premise. "We decided to listen to our patients," says Abhay. That may sound obvious, but in 1986, when the pair returned to their poor, central Indian hometown of Gadchiroli with master's degrees in public health from Johns Hopkins University, it was a novel approach.

Then, explains Abhay, 55, priorities for the developing world were decreed in abstract by the medical establishment. "For example, everyone said population control was the No. 1 priority and family planning the No. 1 solution," he says. That approach ran counter to principles Abhay learned growing up in Mohandas Gandhi's ashram at nearby Sevagram (literally, Service Village), which favored community and consensus over hierarchy and imposition.

He and Rani, 54, had already decided to follow Gandhian principles and live and work with the poor, founding a trust they called the Society for Education, Action and Research in Community Health. After setting up a lab in an old warehouse, they began surveying two nearby villages. The results were immediate. "If you actually talked to the mothers, you discovered women had other needs than just contraception," says Abhay. "We found 92% had gynecological diseases."

In 1989, the pair published their research in the journal Lancet. "Within a year or two, there was an entirely new approach to women's health worldwide," says Abhay. "The global population policy changed from looking at mere reproduction to the whole issue of women's reproductive health. That was our first experience of how powerful this approach could be."

Encouraged, the Bangs listened some more. They identified alcohol abuse as another big issue and began addiction treatment. And given that half their patients were from the forest-dwelling Gond tribe and wary of city hospitals, the Bangs asked them what a Gond hospital might look like. The result is what Abhay named Shodhagram (Research Village), a medical center outside Gadchiroli that resembles a village, with separate huts housing the lab, surgery, pharmacy, wards, library and even a shrine to the Gond goddess Danteshwari.

It was soon after moving to Shodhagram that Abhay and Rani were presented with the tragic inspiration for their greatest innovation. "A tribal woman came in with a tiny baby boy," Abhay says. "We took him, laid him on our bed, and he died, right there and then." The child's death haunted the two doctors. They decided to tackle a subject the medical community had long abandoned: the stubbornly high child-mortality rate in the developing world. Abhay and Rani identified 18 causes of newborn death, from the obvious, like malnutrition, to the surprising, like the habit of expectant Gond mothers of starving themselves and their unborn child for an easier birth. The Bangs found no problems that couldn't be treated by a health worker with rudimentary skills, some infant sleeping bags and an abacus on which to record every 10 heartbeats.

So Abhay and Rani got a seamstress to stitch the sleeping bags and a carpenter to make the abacuses, and they drew up a health training program that they taught to a newly assembled corps of village health workers. In 1999, the Bangs published the results of their efforts, again in the Lancet. They had cut child mortality in half--a figure that would fall to a quarter by 2003--for a cost of $2.64 for each child saved. The program is being adopted across India, where more than a quarter of the 4 million annual newborn deaths occur, and in Nepal, Bangladesh, Pakistan and parts of Africa.

We are individuals from communities affected by the worldwide pandemic of tuberculosis (TB). We have seen the unnecessary suffering and death that TB causes, amplified by the overlapping HIV/AIDS pandemic. Up to two billion people worldwide are infected with the bacteria which causes TB. Each year, eight million people develop TB disease and two million die from it. Yet TB is preventable, treatable, and curable. The suffering and death it causes are unnecessary and unacceptable.

No one should die of a curable disease because of poverty or underfunded health systems. Human rights, public health, and social justice approaches all demand a better global response to stopping TB.

Universal access to existing TB diagnosis and treatment, and massively accelerated research to develop new and better tools are both urgently needed.

We can reduce the suffering caused by TB to 80 million people over the next ten years, prevent 20 million unnecessary deaths, and accelerate the day when tuberculosis - one of humanity's most ancient diseases - is finally stopped.

What has been lacking is the political will, the scientific determination, and the popular support.

We call upon leaders, governments, and all sectors of society to take the following steps:

Recognize the importance of community participation in TB control efforts:
People living with TB must be at the center of all TB awareness, prevention, care and treatment programs. Their rights and dignity must be respected. People living with TB have the right to participate fully in all organizations concerned with their care, at all levels including governance, planning, implementation, and evaluation of TB research, prevention, care, treatment, and advocacy programs.

Increase investment to support community participation:
Community activism is essential to ensure the growth and sustainability of TB control programs. Massively increased resources are needed to support community mobilization, awareness, education, literacy, and participation in TB control programs worldwide by people living with or most vulnerable to TB.

Ensure expanded access to TB treatment:
All people with active TB - not just those with sputum smear positive pulmonary TB - must be promptly and properly diagnosed, treated, and cured. This includes those with smear negative pulmonary TB, extrapulmonary TB, pediatric TB, HIV-related TB and multi-drug resistant (MDR) TB.

Provide TB services to vulnerable populations:
All affected communities must have full access to TB prevention, care and treatment, including women, children, homeless people, the unemployed, the uninsured, the incarcerated, populations regardless of immigration status, drug users, people living with HIV, and those with other life-threatening diseases.

Incorporate TB program expansion into stronger health systems:
TB control programs should be expanded in the context of strengthening health systems.

Provide universal access to high-quality TB services:
TB preventive measures, diagnosis, treatment, and cure must be made universally accessible, available, and free at the point of use to persons being screened or treated for TB, including those with multi-drug resistant (MDR) TB or with TB/HIV.

Expand use of existing TB prevention methods:
More emphasis is needed on use of existing tools to reduce TB transmission and treat latent infection, including administrative measures to reduce transmission in confined settings and isoniazid preventive therapy in people at high risk of progression to active TB, including those with TB/HIV.

Scale up research on new tools to stop TB:
Massively accelerated and greatly increased research funding is needed for new tools to prevent, diagnose, treat, and cure TB. Funding for this research should come from all countries from both public and private sectors. Community activism is needed to secure full funding of and community involvement in all stages of this research.

Disseminate existing TB diagnostics and develop new ones:
New diagnostic tests to accurately diagnose TB - pulmonary and extrapulmonary, drug-sensitive and drug-resistant, adult and pediatric, and HIV-negative and HIV-positive - are urgently needed. These tests must be usable where the vast majority of people with TB get their care, in district hospitals, private providers, and health centers. Optimally, these point-of care assays must be rapid, require little technical training, not require electricity or refrigeration, able to withstand high heat and humidity, and be affordable for all public health systems. Currently available diagnostics such as culture and drug susceptibility testing (DST) must be made much more broadly available in resource-poor settings to increase the ability to diagnose smear-negative, extrapulmonary, pediatric, and drug-resistant TB.

Develop shorter TB cures:
New drugs and combination treatment regimens for TB are urgently needed which will fully cure over 95% of drug-sensitive and drug-resistant cases of TB within two months. These drugs must be affordable, available, safe, and effective especially for persons infected with MDR-TB or TB/HIV.

Discover new TB vaccines:
New vaccines for TB are needed which will prevent TB infection or disease in over 75% of those vaccinated without side effects, ideally in a single dose given once a lifetime.

Stopping TB is a job for everyone:
Governments around the world must commit the full resources, leadership, and long-term effort necessary to make TB a disease of the past. We call for strong, vocal, and persistent commitment by political leaders and systems worldwide, and by all sectors of society and community, to provide the resources needed to make TB a disease of the past.
For the past ten years, governments around the world have stated their commitment to stop TB. Now is the time to intensify this commitment by turning declarations into deeds, promises into programs.

Community activism and advocacy are essential to ensure the growth and sustainability of TB programs. We commit to redouble our efforts to mobilize communities to respond to the TB epidemic by increasing our efforts in education, information dissemination, advocacy, support, and participation. We call for the same commitment from all with the power to help make the future one free of TB.

     On passing out from IIT Chennai Mr. Narayanaswamy was offered scholarship by the prestigious
     Massachusetts Institute of Technology, USA. He who came from a middle class family believed
     that he had a moral obligation to give something in return for the lakhs of rupees the
     government spent on him as an IIT student. He had the intelligence and conviction to realize
     that this money came also from the poorest of the poor - who pay up the excise duty on
     textiles when they buy cloth, who pay up customs, excise and sales tax on diesel when they
     travel in a bus, and in numerous other ways indirectly pay the government. So he decided to
     join IAS hoping he could do something for the people of this country. How many young men
     have the will power to resist such an offer from USA? Narayanaswamy did never look at IAS as
     a black money spinner as his later life bears testimony to this fact.

 

     After a decade of meritorious service in IAS, today, Narayanaswamy is being forced out of the
     IAS profession. Do you know why?

 

     A real estate agent wanted to fill up a paddy field which is banned under law. An application
     came up before Narayanaswamy who was sub collector the, for an exemption from this rule
     for this plot of land. Upon visiting the site he found that the complaint from 60 poor families
     that they will face water logging due to the waste water from a nearby Government Medical
     College if this paddy field was filled up was correct. Narayanswamy came under intense
     political pressure but he did what was right - refused permission for filling up the paddy field.
     That was his first confrontation with politicians.

 

     Soon after his marriage his father-in-law closed down a public road to build compound wall for
     his plot of land. People approached Narayanaswamy with complaint. When talking with his
     own father-in-law did not help, he removed the obstructing wall with police help. The result,
     his marriage broke up.

 

     As district Collector he raided the house of a liquor baron who had defaulted Rupees 11 crores
     payment to government and carried out revenue recovery. A Minister directly telephoned him
     and ordered to return the forfeited articles to the house of the liquor baron. Narayanswamy
     politely replied that it is difficult. The minister replied that Narayanaswamy will suffer.

 

     In his district it was a practice to collect crores of rupees for earthen bunds meant for poor
     farmers,but which were never constructed. A bill for rupees 8 crores came up before
     Narayanaswamy. He inspected the bund. He found it very weak and said that he will pass the
     bill after the rainy season to ensure that the bund served the purpose. As expected the
     earthen bund was too weak to stand the rain and it disappeared in the rain. But he created a
     lot of enemies for saving 8 crores public money.

 

     The net result of all such unholy activities was that he was asked to go on leave by the
     government. Later such an illustrious officer was posted as "State Co-Ordinator, Quality
     Improvement Programme for Schools". This is what the politician will do to a honest officer
     with backbone - post him in the most powerless position to teach him a lesson. Since he found
     that nothing can be achieved for the people if he continued with the State Service he opted
     for central service. But that too was denied on some technical ground. What will you do when
     you have a brilliant computer career anywhere in the world you choose with the backing of
     several advanced technical papers too published in international journals to your credit? When
     you are powerless to do anything for the people, why should you waste your life as the
     Co-Ordinator for a Schools Programme?

 

     Mr. Narayanaswamy is on the verge of leaving IAS to go to Paris to take up a well paid United
     Nations assignment. The politicians can laugh thinking another obstacle has been removed. But
     it is the helpless people of this country who will lose – not Narayanaswamy. But you have the
     power to support capable and honest bureaucrats like Narayaswamy, G.R.Khairnar and Alphons
     Kannamthanam who have suffered a lot under self seeking politicians who rule us. You have
     even the power to replace such politicians with these kind of people dedicated to the
     country. The question is will you do the little you can do NOW? At least a vote or word in
     support of such personalities?

MOVEMENT FOR EMPOWERMENT OF MUSLIM INDIANS(MOEMIN)
 
Dear Colleagues
 
An eleven member team of civil society representing two organisations namely MOEMIN  & ANHAD visited the earth quake areas of J&K from 21 October 2005 to 28 October 2005. 
 
The members of the team includes ANHAD members Ms. Shabnam Hashmi (Member National Integration Council, Governemnt of India) &  Mr. Manan and Mr. Navaid Hamid, Member National Integration Council & General Secretary MOEMIN; Ms. Azra Razzack; Mr. Asim Usman; Mr. Fareed Ahmed; Mr. Sagheer Akhtar and two local activists from J&K, Mr. Tanveer Hussain Khan of Anantnag & Mr. Amjad Khan from Jammu.
 
The members of the team had a meeting with  Mr. Managat Ram Sharma, Deputy Chief Minister of J&K and Mr.Yosuf Tarigami, leader of CPM to disuss the relief measures in the State.
 
The team visited the Tangdhar region after crossing  Sadhna Pass located at the height of 10400 ft above sea level and reached Tanddhar valley located at the height of 6300 ft. The Tanggdhar Tehsil has a population of 43000 and has 7000 house-holds. The literacy rate of the area is around 57% and the literacy rate of the girls is about 29%. About 70% of the buildings of the Tangdhar, Tehsil Karna, Distt. Kupwara are fully or partially demaged or had developed major cracks due to the tremors of earthquake.
 
As most of the releif teams of NGO's & individuals are visiting the Uri sector, the team decided to visit the Tangdhar area. The team had a fruitful meeting with the SDM, Tehsildar and the Relief Commissioner of Tangdhar before starting the relief work.
 
We got informations that the teams of Acion Aid, COVA, Jamiat Ulama i Hind, Jamat i Islami &  Satsang Vyas had also visited the area.
 
We have not recieved any information about the visit of any team from any MNC or Corporate world to acess demage or extend help to the effected people in the quake hit region.
 
The  11 member team visited 17 villages of Tangdhar namely Hajitra, Baghbella, Shamspur, Badwan, Kondi, Chandipura, Jabri, Nova Gabra, Tad, Dhani, Gabra, Amroei, Pandla Lohar, Bhatangi, Thangdar Nalkhal and Gali and distrbuted Tents, Blankets, Inners, Jackets, Sweaters, Woolen Caps, Woolen Socks etc. At numbers of the villages team found it to be the first from the Non govenrment sector toreach the villages.
 
Around 55 tents, 1700 Blankets, 1000 Sweaters, 150 Jackets, 2000 woolen caps and 2000 pairs of woolen socks were distributed to the widows, Orphans, families of Below Poverty Line costing around 9 lacs of Indian Rupees.
 
ANHAD had contributed 500 blankets in the releif material.
 
The team found the quality of the blankets distributed by State Government & some NGO,s of ordinary quality and the amount sanctioned by the State government for reconstruction of the demaged houses insufficient. Most of the effected people are living under plastic sheets and the pace of the releif work is slow. The Army is doing a commendable job in the releif distributions and the quality of the relief material is also good.
 
The members of the team were of the opinion that the decision of the Government to distribute tents to the effected people lacks vision as tents cannot  sustain the snowfall which is not far from now. The people needs atleast tin shelter to survive in coming harsh winters.
 
A room of 10x12 sq ft areas needs 21 corrugated zinc G.I. sheets and about 7 wooden ply's for insulation and 8 wooden strips of 3"x3" to screw the sheets and ply over it to sustain life in the cold weather. The aproximate cost of sheets, ply, and wooden blocks comes around Rs. 14000/=.
 
MOEMIN had started to identify around 250 widows, orphans, and families below powerty line living in the Tangdhar area to support them for erecting tin shelters.
 
Another team of MOEMIN activists is leaving in 1st week of November along with relleif material of around Rs. 10 lacs Insha Allah.
 
We have also requested ANHAD and Charity Alliance to help us in the endeavor. Both organisaitons had agreed to accept the Drafts and Cheques in their name. You are requested to send your contribution at the earliest to support the people in dire need of help. Time and genrosity are the key factors for helping the people in need. Please keep severe weather conditions in deciding to extend your help.

I would like to label Mr. Mukhtar as a homophobic and heterosexist as he has labelled homosexuals as 'deviants'. Reading his blog was equally dissappointing because his 'research' is tentative and biased.

Honorable Sir,

1.      I, Muhammad Mukhtar Alam, s/o Janab Abdur Rahman and permanant resident
of village Mathurapur, district –Bhagalpur, Bihar, would like to draw your
attention to the petition of Naz Foundation that has been rightly rejected
by the High Court of Delhi. The petition challenges "the constitutional
validity of section 377 of the IPC on the grounds that it criminalizes
homosexual act even between two consenting adults". (The Hindustan Times
December 8, 2001).

2.      I would like to respond to this as a citizen of this country and a
world citizen and call for a dismissal of this petition. A favorable
judgement for the petition will violate the rights of children to have
reverent role models, and, most importantly will create a supportive
social climate for the adoption of homosexuality in India.
3.      I would like to strongly oppose the move of Naz Foundation as an
anti-children, anti-family and anti-God. Also through my research work I
have proved that environmental factors for the adoption of homosexuality
are ignored by all these campaigners of civil liberties while
overemphasizing the contribution of genetic determinism. There is a case
for "hijras" but then there is no case for the homosexuals who have been
imitating a deviant and degenerate sexual practice that has been approved
in the European and American laws. My related academic submissions
pointing out the need to review of the decision of American Psychiatric
Association contained in my conceptual organization for description,
analysis, prediction and control of the personal/ social / world order can

web referred at a youth site and are part of the findings of the discourse
analysis for my Ph.D. dissertation on "A Study of the Cognitive
Representations related to the Concept of World Citizen" that has been
presented to University of Delhi in September 2000.
4.      The petition contends that article 377 of the IPC violates the
liberties enshrined in the constitution under article 14.15,19 and 21 in
so far as it penalizes predominantly homosexual acts in private between
consenting adults. This can be seen that this is an instance of
overgeneralization for the provisions of the cited articles. There is a
concern for the rights of the children for reverent role models. Making
homosexual act lawful will mean endangering the lives of many children who
are being already provided with an overdose of atheistic libertarian
values where pre-marital and extramarital affairs do not get denounced,
punished and condemned.
5.      The article 377 of the IPC deals with the subject of unnatural offences
and states that "whoever voluntarily has carnal intercourse against the
order of the nature with any man, woman or animal shall be punished with
imprisonment for life, or with imprisonment of either description for a
term which may extend upto ten years and shall also be liable to fine".
There is a need to preserve this provision as its deletion even with
regard to the homosexuals and lesbians will create problems for the
collective social health and individual health.
6.      It has been argued, "section 377 creates an arbitrary and unreasonable
classification between natural (penile-vaginal) and unnatural (penile-non
vaginal) sexual acts that violates article 14's equal protection before
and under law". Here Naz Foundation already assumes the existence of a
"sexual minority" whose rights are considered to be violated. There is no
recognition of such minority in the constitution. There should not be any
recognition to such a minority in the law. Also classifications of the
sexual acts are very reasonable. Naz foundation is absolutely misguided in
mimicking the deviant atheistic intellectual and political currents
originating in Europe and US in this regard. Also Naz Foundation is
misguiding the court on its understanding of constitutionally recognized
minorities. There is no violation of the article 14 of the constitution
with reference to the provisions of article 377 as there is no recognition
for "sexual orientation" as a category. If there is recognition for sexual
minority there can be also a call to recognize the human rights of the
thieves and pickpockets to indulge in their smart acts of fooling,
cheating and looting.
7.      It has been argued that Section 377 imposes traditional gender
stereotypes concerning the "natural" sexual roles for men and women upon
the sexual minorities". Here again there is an explicit reference to the
"sexual minority" which refers to men and women who have been misguided
for appropriating homosexual acts. Instead of calling for help in
correcting the deviant behavior an appeal is being made to recognize it as
a normal and natural act. All traditional gender roles cannot be
denounced. Atheistic feminist discourse needs to have recognition of the
limits that are imposed biologically, ecologically, and morally. "Hijras"
need a special rehabilitative attention and for them there is no
imposition of gender roles. Hijra's are sexually challenged with reference
to reproductive capacities and there is no imposition of gender roles on
them. For homosexuals and lesbians, specific gender roles will continue to
be socially desirable as for many they will be known as men and women..
8.       According to the petition, the social effects (of article 377) drive
gay men underground with a devastating impact upon HIV prevention efforts
as " it becomes difficult to identify and target this population for HIV
/AIDS prevention efforts through education and provision of medical
services". I would like to denounce this contention, as most of men who
have unnatural sex with men cannot be considered to be so ignorant and
illiterate. As per journalistic accounts most of the men and women
identifying themselves, as gays and lesbians respectively are quite well
educated. There is no need for making homosexuality lawful in our country.
There is need to campaign for the reverting to the pre-1973 position in so
far as the related categorization in Diagnostic and Statistical Manual of
US is concerned.  Sheldon B. Korchin has noted the fact interestingly in
his book on Clinical Psychology that it was the gay movement in US that
compelled APA to change the understanding of homosexuality in 1973.
"Homosexuality was no longer considered a sexual deviance rather it was
just an 'alternative orientation'" (Sheldon J. Korchin (1998),"Modern
Clinical Psychology, Principles of Intervention in the Clinic and
Community", CSB Publishers). It may be noted that there is hardly anything
"oriental" about this "orientation". Homosexuality is a product of lack of
moral control and absolutely wrong socialization .It is curable. The best
cure can be tried by seeking forgiveness for the past sinful deeds.

9.      It is important to campaign for the restoration of the old definition
of degenerate practice of homosexuality that is being celebrated and
paraded in the dancing halls and bars of the irreverent and atheistic West
whereas practice of religion is propagated to be restricted to the privacy
of the homes. Also, I would like to appeal the people in the "orient" to
campaign for deleting the word orientation as this word has been abused by
referring this to a sexual deviance in DSM manual of American Psychiatric
Association.

10.      According to a study conducted by Himachal Pradesh Voluntary Health
Association, Shimla 20% of the children have experienced homosexual
atrocities. "Another after effect of this is sharp increase in
Transportation work which mainly comprise of rural people of HP with large
involvement of children working as cleaner. For one Big Cement plant viz.
ACC Cement Barmana approximately 8000 trucks are operating. As per one
small study 20% of such children have experienced homosexual atrocities".
There are other studies that have shown the involvement of homosexuals in
sexual abuse of the children through internet as well. Thus, I would like
to argue that granting revision and elimination of the prohibitory
provisions of article 377 will further increase the incidence of child sex
abuse by male homosexuals. In UK, there had been a demand by the gays for
reducing the age of consent from 18 to 14. Considering the dominance of
the atheistic liberal ethos, many children and adults will be become prone
to the abuse of homosexuals. Also there had been a study where 70% of the
abused children had been the victims of sodomy by homosexuals.

11.     Considering the above I would like to appeal for the dismissal of the
petition of Naz Foundation while also seeking the deletion of references
to adoption of homosexuality as matter of human right in the documents of
Amnesty International.

12.     Considering the developments in Europe and US in this regard there
might be a call for redefining institution of family so as to incorporate
homosexual couples as family. There may be also be call then for them to
be considered as legitimate recipient of abandoned children for adoption.
Thus it can be seen that for many youth, children and future generations
permission of deletion in provision of article 377 of IPC, there will be a
great intellectual and moral confusion. This will also have significant
adverse impact in the families where some boys and girls under the
persuasion of such neo-liberal atheistic "social workers" and homosexuals
will be called on to "come out of closet" and announce to the families and
relatives that they are gay.

13.     According to a study reported in Hindustan Times of 10 May 2001, two
psychologists led by Dr.Robert Spitzer proved that highly motivated
homosexuals could be converted. They also repudiated the attitude of the
mental health professionals "who have bought the idea that once you are
gay you cannot be changed". He and his colleagues have found that 66% of
men and 44% of women had achieved good heterosexual functioning. With
reference to the petition of Naz Foundation it can be seen that there is
no reference for the existence of controversy on the etiology of
homosexuality. Instead, they have been calling for making homosexuality
lawful.

14.     In case, there is a favorable judgement, there cannot be an end to the
social denunciation of lesbians and homosexuals in India considering the
strong conservative values that are shared across the religious groups in
this regard. If the petitioners and their tutors think that they are
"progressives" then they must recognize that RSS, practicing Muslims,
Christians, Jains and Buddhists will continue denouncing them for their
misguided understanding and seek correction in attitudes. Considering the
history of dissidence this may be noted that appropriation of
homosexuality is an instance of the most extreme and worst development in
the anti-Christian discourse in Europe that was championed by Michel
Foucault who could have excluded gays and lesbians while advocating for
better treatment of women, blacks and prisoners. But then in his zeal for
unearthing the archeology of knowledge he tried to have "limit experience"
in the bars with provisions for sadomasochist experiences and liberated
the gays and lesbians from the psychiatric label. Formation of groups of
lesbians and homosexuals across the world are seeking a change in the
legislation in all societies. Unfortunately, Richard Falk has also
included such a change in the existing legislations as part of "humane
governance" (Falk, Richard (1995), "Towards a new global politics ,world
order model project report of the global civilization initiative", Polity
Press  Cambridge, UK )

15.     Considering the exclusive studies by the undersigned, I may be called
in person for presenting my case.

Considering the above I would like to appeal for the dismissal of the
petition with a severe reprimand for Naz Foundation while suggesting them
to use faith based instruments for gays and lesbians. They can do better
prevention of AIDS by faith based counseling than seeking legitimacy for
deviant sexual acts. I would like to earnestly request you to reject the
petition and affirm the judgment of the Delhi High Court in this regard.

Saving the lives of sickly children doesn't take much: a little money,
some medicine, the right food. In Nepal, they've discovered one more
factor: the power of the grandmother. It was Ram Shrestha, chemist and
health expert, who figured out how to unleash it.

The poverty in Nepal and the toll it exacts on its smallest citizens
are staggering. Twenty years ago, the infant-mortality rate was 133
for every 1,000 births, most of the babies claimed by pneumonia and
diarrhea. By the 1980s, it was clear that a lack of vitamin A in the
Nepalese diet was a factor in the high rates of infant mortality and
in a form of blindness. All it would take to reduce both would be a
low-cost vitamin-A capsule taken as infrequently as twice a year.

Great news, but how to get the word--and the vitamins--out? The
government set up a program to do the job, but in a rugged country
like Nepal, with a scattered population innately suspicious of
strangers, it wasn't going to be easy.

Shrestha had some ideas. A onetime Peace Corps employee who earned his
master's degree in international health at Tufts University in
Massachusetts, he returned to Nepal in 1991, at about the time the
vitamin program was getting under way, and offered his assistance.

The first thing he realized was that no matter who sponsored the
program, the villagers were not going to be receptive unless they felt
some ownership of it. So he began traveling through remote areas,
explaining the benefits of vitamin A and looking for volunteers to
help distribute the pills. When he signed someone up, he would return
for a follow-up visit, accompanied by the district chief. Shrestha
would make a show of asking passersby for directions to the
volunteer's home; with the chief in the car, it was clear they must be
on some vital business. "Whole families had to feel it was important,"
Shrestha says.

To make the volunteers more distinctive still, he issued them all
green canvas bags stamped with a vitamin-A logo and suggested that
they carry the bags all the time, not just on their rounds. He
instructed supervisors in the program who had cars to stop whenever
they saw anyone carrying a green bag and offer a lift.

Shrestha clearly had a knack for this kind of thing, but his next idea
was pure genius. As the need for volunteers grew more acute, he
started thinking about which individuals in Nepalese society--or most
societies, for that matter--have the most influence in the family but
are the least utilized. That's when he came up with the grandmothers.
They have the time to distribute the pills and the moral authority to
see that the children jolly well take them. And it didn't matter if
some of the women were too frail to make the rounds; the program
actually worked better when villagers came to them to get the pills.
"Even within a limited physical environment," says Shrestha, "the
grandmothers can do a lot."

And so they have. Today there are 49,000 grandmothers distributing
vitamin A to 3.5 million Nepalese children every year. Since the
1980s, infant mortality in the country has been cut in half; the
program is now getting the vitamin to pregnant women too, among whom
eye disease has plummeted, from 23% to 3%. Shrestha does not minimize
what he has accomplished for his country, but he is too modest to make
a fuss about it. "As a Nepali," he says, "I figured it was my duty."

I am not sure if we can reslove the issues without undertanding all the
issues..For me, I am serving the interest of all men and women and
children who wish to seek both temporal and eternal wellbeing. My analysis
and recommendations are in the best interests of men and women who
appropriate homosexuality.

I do not fear anyone. I do fear the Day of Judgement as a Muslim and seek
a better deal for myself and all.

The arguments in the letter for the Chief Justice is based on the shared
values acorss the religio-cultural moral universes.

I am biased for the right approach towards the rights and duties of men
and women to each other and to Almigthy.

I would like to seek deletion of the appropriation of homosexulity in the
mind of men and women with the application of faith based instruments.

Dr. Alam:

It's dishonest to talk about people's rights and duties without allowing space for the voices of those whose rights are actually being affected and indeed violated. What kind of human rights violation have you faced because of people who engage in alternative sexual practices? What kind of violations have heterosexual people, for whom you are advocating criminalizing homosexuality faced? To the contrary, it's people who have alternative sexual preferences and are erotic minorities, who are at the receiving end of violations due to the biases of the 'pervert' majority that discriminates against them.

Whatever happened to diversity? If we can think of respecting caste, class and indeed religion based differences... how does it become so difficult for you to accept difference on the basis of sexuality?

What is also quite absurd in your petition... is the fact that you submit that 'homosexuality' is western import... surprisingly by citing wetern studies and authors... that's flawed research...

You've got to keep your mind open... you've got to be more toleranant and accomodating to talk about human rights yourself... otherwise, the way you seem to be up-in-arms agaisnt sexual minorities in India... you have set yourself up as an intolerant, discriminatory rogue...

You don't consider people, irrespective of whatever their color, creed, gender, class, caste, religion or sexuality to be human beings... your thoughts are partisan and discriminatory from their very foundation... you've got to meet sexually marginalised people to believe that they are humans too... not aliens who need to be wiped out of the world's face... and if that's what you are professing... your thoughts are no less dangerous than Hitler's...

Pardon my being critical... but you have no idea about minority rights and issues of discrimination... cause you are part of that school that still perpetuates it... if not in the name of religion... in the name of sexuality...

Greetings,

I am not sure if we can reslove the issues without undertanding all the
issues..For me, I am serving the interest of all men and women and
children who wish to seek both temporal and eternal wellbeing. My analysis
and recommendations are in the best interests of men and women who
appropriate homosexuality.

I do not fear anyone. I do fear the Day of Judgement as a Muslim and seek
a better deal for myself and all.

The arguments in the letter for the Chief Justice is based on the shared
values acorss the religio-cultural moral universes.

I am biased for the right approach towards the rights and duties of men
and women to each other and to Almigthy.

I would like to seek deletion of the appropriation of homosexulity in the
mind of men and women with the application of faith based instruments.

Whatever be your views on the subject, I think it is not proper to
presume that they coincide with that of Islam or speak exclusively on
behalf of 'our' culture. Those are your views and you will find many
supporters of your views who speak from a 'religo-cultural' space, but
then there are others too, who hold other views and who also believe

WORKERS OF MICHAEL ARAM EXPORTS PRIVATE LIMITED

PROTEST NON-PAYMENT OF WAGES AND DENIAL OF WORK

 

Seventeen workers of Michael Aram Exports Private Limited (B-156 DDA Sheds, Okhla Industrial Area Phase I, New Delhi-20) stood with placards in Connaught Place and Janpath Lane Market on Divali, November 1, 2005 to protest against the denial of work in the factory since March 2005, non-payment of wages, and non-payment of their Divali bonus. 

Michael Aram is an America-based artist and designer whose metal artware products (tableware, cutlery, vases, hardwares, etc.) are marketed in high end retail department stores in America such as Macy’s and Bloomingdales (please see www.michaelaram.com for details). He has been conducting business in India for over fifteen years. Michael Aram Exports Private Limited (India) supplies finished products to Michael Aram Inc. (USA), and operates production units in Okhla Phase I, Lado Sarai, Kishangarh, and Sahibabad (U.P.), and is headquartered at F-61, Ground Floor, Sujan Singh Park, New Delhi (Ph.29523920, 29523095, 29522297-8). The annual turnover of Michael Aram Exports is estimated at Rs.9 crores, while that of Michael Aram Inc. is $4.4 - 6.7 million. 

Steel polishing is done at B-156 DDA Sheds, Okhla Phase I. The work is extremely difficult, dirty, and dangerous. Workers are blackened in the production process, wear tattered and torn clothes, cough and spit up dark phlegm, and suffer from chronic colds, fever, stomach disorders, chest pains, and tuberculosis. The workers (24 presently) are on the company muster rolls and have been paid minimum wages (Rs.2950-3386), though they have been denied legal overtime rates, timely dearness allowances, clean drinking water, and proper pollution masks. These workers are migrants from Uttar Pradesh, Bihar, and Jharkhand, and are highly skilled, inventive, and hardworking, and have increased production quantity (by double for many items) and quality since the unit was started in 2001. 

In March 2005, a dispute broke out between Michael Aram and the company’s Indian Director (and thirty-percent shareholder), Francis Joseph, over alleged siphoning and bungling of funds, amongst other charges, and the case is being carried out in the Company Law Board. Citing this dispute, management stopped giving work to workers in all of the factories of Michael Aram Exports, and they were made to sit idle. Michael Aram assured workers at the time that the dispute would be resolved in two weeks and a new transparency and accessibility would be brought into the company. Instead, water, electricity, tea, and other facilities were cut, and wages were given late and reluctantly every month, only after workers filed complaints in the Labor Department (via the Delhi State Kamgar Union (IFTU)). The exigency of going back and forth to the Labor Department led to the death of one worker, Ramdev, whose cycle was hit by a car on the way back from the South Delhi Labor Office in July 2005. Although Michael Aram promised Ramdev’s wife at the time that she would be given a job on compassionate grounds, the management has yet to act on this promise. 

Meanwhile, in May 2005, Michael Aram started a new company and production unit at C-109, Okhla Phase I under the name of Michael Aram Design India Private Limited, and has been carrying out the exact same work there through a combination of newly recruited employees, former employees of Michael Aram Exports who have tendered their resignations, and contractors’ workers working on an illegal night shift, now relocated elsewhere. 

In October 2005, alleging that there was no more money left in their accounts, Michael Aram Exports management stopped paying wages to its workers. On Divali, no bonus was given. B-156 workers have filed a case under the Minimum Wages Act in the Labor Department for non-payment of September wages. Although there have been no official closure or retrenchment notices of any kind, management has offered workers their full and final settlements. But the metal workers of B-156 DDA Sheds desire work, in any of Michael Aram’s units, including C109, and have communicated the same in a letter to Michael Aram, who has not given a response, and is said to be in America at present.

Beginning October 27th, B-156 workers have taken their struggle to the streets, standing with placards in and around Okhla Industrial Area, in an effort to generate awareness of the above events and developments as well as engage in conversations and discussions with workers at large about their common experiences and difficulties. On Divali, workers brought their placards to Connaught Place and Janpath Lane Market, in the attempt to reach out to inhabitants of the capital city more generally. They quietly stood, like statues, within the busy, festive market as shoppers walked by and occasionally stopped to read the messages and inquire into their present plight. 

Should not every worker be allowed to celebrate Divali, even in a modest way? Is this how we wish foreign employers to treat the workers of this country? That too, within the heart of the capital city? Should we be welcoming into this country a set of arrangements which increasingly look upon workers as things to be exploited and discarded at will? Eid and Chhat are now rapidly approaching. Without wages, yet also without the desire to submit to the illegal and inhumane practices of Michael Aram Exports management, B-156 workers will continue to be seen on the streets of Delhi with their placards, with the hope that some festivity might be found in these new conversations and discussions with fellow workers, residents, and co-strugglers of the capital city.

A FINE WAY TO BREAK WORKERS’ SPIRIT

In March 2005, the Director, Michael Aram, promised to give us work within two weeks’ time and to bring transparency to the company. But today, six months later, he has yet to give us work. On the way back from filing a complaint on non-payment of wages at the Labor Department, our co-worker Ramdev had a road accident and died. He gave his word that he would give Ramdev’s wife a job but today, three months later, she has yet to be given this job. What will happen to Ramdev’s family now? Now management says that they will not give us our wages or bonus. Can we possibly hope that they will go back on their word this time? 

3. DASHAHRA PHIKA, DIPAVALI ANDHKAAR

Dashahra to jaise taise bit gaya. Karva Chauth karvi rahi. Dipavali andheri dikh rahi hai. Tankhvah to di nahim, bonus ki aas karem kaise? Baccom ko kaise bahlayemge, patni ko kaise bahkayemge? Khud to bam bane baithe haim, patakha kaham se bajayemge?

We somehow got through Dashahra. Karva Chauth was bitter. Dipavali is looking absolutely black. Our wages have yet to be paid. How can we hope for our bonus? How will we give our children a good time? How will we explain things to our wives? We ourselves have become bombs. Where is the question of exploding firecrackers?

Make your permanent workers sit idle, start a new company and have the very same work done there and through outside contractors. Close the factory on the pretense of the bungling of funds, open a new factory and start bungling anew.

WORKERS CRUSHED BETWEEN TWO PROPRIETORS

A dispute between the two proprietors over alleged bungling of funds began in March 2005 and we workers were made to sit idle. A new company was started under the name Michael Aram Design India Private Limited, and the same work is being carried out there. Resignations were tendered from former workers in exchange for fresh employment and along with this, bungling of funds has started afresh. Permanent workers are made to sit idle while work is done outside by contractors. Wage payments have been stopped. May we hope for our bonus to be paid? The dispute, quarrel, and bungling are between the proprietors, but workers have been made the sacrificial goats.

Due to a dispute between the Directors, we have been made to sit idle since March 2005. The company stopped tea, water, electricity, and now they have stopped paying our wages. They sliced the throat, and wages were stopped. Then they chopped the head, and 60 workers were given their final settlements. Our throats are still being sliced. The blade is being sharpened for the chop.

7. TANKHVAH BAND, MALIK FARAAR

Company ke donom malikom ke vivad ke calte March 2005 se ham mazdurom ki khali bithaya aur Sitambar se tankhvah bhi band kar di. Jaham ek taraf ham apni rozi-roti ke lie pareshan haim to dusri taraf ek malik Dilli mem chupa hua haim to dusra malik America cala gaya. Ab tak payment nahim mila. Management ka kahna hai ki company ke khate mem paisa nahim hai.  ‘Malik se bat karo, shram-vibhag mem shikayat karo, malikom ka putla phumko, jo caho so karo.’ Jab donom malikom faraar haim, to ham mazdur kisse bat karem? Jiske pas paisa hai, vah to kahim bhi bhag sakta hai. Parantu ham mazdurom ko payment nahim milegi to makan-malikom aur dukandarom se ham kahim aur kaise bhag sakte haim? 

WAGES STOPPED, PROPRIETORS GONE

Due to a dispute between the two company proprietors, we workers have been made to sit idle since March 2005. Since September, wages also have been stopped. While we are facing great difficulty for our daily bread, one proprietor is hiding out in Delhi and the other has left for America. We have not been paid our wages, and management says there’s no more money in the company account. ‘Go and talk to the proprietors, file a complaint in the Labor Department, burn effigies of the proprietors, do whatever you feel like.’ When both proprietors are nowhere to be found, whom are we to speak to? Those who have money can run anywhere. But if we don’t get our wages, can we possibly flee from our landlords and shopkeepers? 

8. NAUKRI SARKAR KI, SEVA PUNJIPATIYOM KI

Malikom ke vivad ke calte har mahine payment mem deri aur phir payment hi band kar di. Har mahine shram-vibhag mem shikayat dalne par shram-adhikari pratyaksh mem hamare paksh mem bol kar hamem ashvasan dete haim, hamara hausla badhate haim. Shram adhikari company mem 6 baje chutti ke bad hi pahumcte haim, derh ghante tak company mem rukte haim. Jab bahar ate haim to cehra khushhaal, magar khabar hamesha badhaal hi dete haim. Shram-adhikari sarkari naukri nahim karte haim, punjipatiyom ki naukri karte haim. Kaham milega nyay?

GOVERNMENT EMPLOYMENT, BUT SERVICE TO CAPITAL

Due to a dispute between the two proprietors, every month our wage payments have been late and now they have been stopped altogether. Every month, upon filing complaints with the Labor Department, the labor officers give assurances to us and bolster our spirits. The labor officers show up at the company only after 6 pm, and stay there up to 1½ hours. When they emerge from the factory gate, their faces are always beaming, but the news they bring is always bad. Labor officials don’t do government service, they work for the capitalists. Where will one get justice? 

9. HISAB NAHIM, KAAM VETAN CAHIE

Ham kushal karigar haim. Hamne jugadom ke zariya bhi utpadan badhaya haim, quality sudhara hai. Iski saza yah hai ki donom malikom ke vivad mem ham 6 mah se khali bithaya gaya. Nai company mem utpadan karvana, thekedarom dwara bahar se kaam karvana aur hamara vetan bhi nahim diya. Hamne kaam manga to management dwara hamem koi javab nahim. Hamem hisab nahim, kaam aur tankhvah cahie, sath hi Dipavali ka bonus. 

WE DON’T WANT FINAL SETTLEMENTS, WE WANT WORK AND WAGES

We are skilled workers. Through our own efforts and ideas we have brought about increases in production and quality. The punishment for this is that thanks to a dispute between the proprietors we have been made to sit idle for six months. The company now gets production done in a new factory, and also via outside contractors. We have asked for work but we have yet to get an answer from management. We don’t want our final settlements. We want work, wages, and our Divali bonus.

swapathgami kabaad se jugaad meet

 

Every day, people in the cities of India are churning out mountains of plastic and non-biodegradable waste, which are threatening to eclipse our living spaces. 

 

And yet, traditional cultures around India have not had a conception of waste.  Each and every thing is to be used and re-used, until its own unique place and purpose has been found – sometimes as a building material; other times for creative art; still other times for new useful functions.

 

Luckily, in small towns and villages around India, as well as with experimenters around the country, people are finding ways to continue this tradition of ‘upcycling’, of transforming kabaad (garbage) into jugaad (useful things).

 

From December 16-19, 2005, the Swapathgami Network would like to invite kabaadi-walas (those who make useful things from waste) for a gathering to share and explore:

-           What kinds of creative and useful things are we making already out of waste?  What kinds of new things can we make?

-           How are we connecting ‘upcycling’ with art, architecture, music, performance, farming, festivals, and many other aspects of daily life?

-           How can we expand our understandings around Refuse, Reduce, Reuse, Recycle, Regenerate, Upcycle, Unlearn, etc.?

-           How can we earn a healthy livelihood from our waste creations? 

-           What can we do to nurture ‘zero waste zones’ in our families and communities?

 

and many other questions related to creativity, waste, nature, and our selves.

 

The gathering will be hosted at Karm Marg, in Faridabad, Haryana.  Karm Marg has been working with street children for years, to transform industrial waste into useful items for sale.  Their inspiring initiatives, as well as their large working spaces, make them great hosts for this meet. The event will be facilitated by Ranjan De (Bridging Gaps), Vishal Singh Dhaybai (Shikshantar) and Anish Singh (Manzil).

 

Please share this invitation with friends and neighbors who are doing wonderful things with waste.  They make be working with industrial waste, household waste, or the ‘waste’ of nature (i.e., coconut shells, wood shavings, corn cobs, etc.). We hope to have about 35-40 people come and share their creations, experiences, and fresh ideas.

petition for information. The issue is for judgement. This is not the
issue of majority or a minority..I have denounced Michel Foucault who was
called an AIDS Guerilla..He wrote on the geneology of knowledge with an
atheistic deconstructionist view..I argue for global application of
monotheistic decosntruction..

Loot..The issue is that of making homosexuality lawful..Is this in

As a matter of fact, I have, sir. And that is precisely why I was
trying to draw your attention to the writings of Scott Siraj-al haqq
Kugle. He discusses the story of loot in great detail.(See Sexuality,
diversity and ethics in the agenda of progressive Muslims, Scott Siraj
al-Haqq Kugle in Progressive Muslims ed. Omid Safi). There are many
Christian Liberation Theologians who also write about the Biblical
reference to the same story and see it somewhat differently than you.

Their readings might convince you or they might not. But the fact is
that different interpretations to the story do exist. And they come
from within Islam/Christianity. Religion/culture does not comprise a
monolithic body of knowledge. And at least I wouldn't want to assert
that my particular understanding of the text is more correct than all
others...

Gender Training Institute is the training wing of Centre for Social Research. Since its inception in 1997 GTI has been working relentlessly towards dispelling the various misconceptions associated with gender, so that the notions associated with gender do not become a disabling factor for both men and women. The Institute endeavors to facilitate this mission through capacity building and training related activities. GTI focuses on the concept of restructuring gender relationships in society; such as status of women in society, gender stereotypes, patriarchy, violence against women, leadership, power relations, women’s rights as human rights issues, sexual harassment, participation, conflict resolution, gender and governance, sensitization to gender concerns at the workplace socialization, gender in community development, health, etc.

 

GTI believes that all people are decision makers in their own context and consequently are all potential participants in the GTI’s programmes.

Its amazing that a 5 hour  evening programme where  2000 young minds would only listen to 5 elders ( according to the programme below) can be called a National Youth Meet. It is high time that we stop preching the young generation and organsing prathana sabha's for them.
 
It would do a lot of good to all elders and intellectuals/ activists of the 50+ generation to  listen to young voices.

DHARNA IN LUCKNOW TO PROTEST AGAINST POLICE ACTION IN VARANASI

 

A one day dharna is being organized by Asha Parivar and National Alliance of People’s Movements against the action of Varanasi Police in the recent case when students of BHU and volunteers of Guria rescued 31 girls from the Shivdaspur area, known for business of prostitution. Ajit Singh of Guria is a reputed social activist and has a long history of working with sex-workers not only in Varanasi but also other parts of country. He has on one hand tried to bring respectability for women in the business by giving them opportunity to display their artistic talents in cultural events and on the other tried to rescue minor girls who are forced into this business by the vested interests. He has also been running education programme for the children of sex workers which was supported by Asha.

It is quite unfortunate that the Varanasi SSP, Navneet Sikera, even though he was given prior information and his cooperation was sought in rescuing the girls, instead of supporting the initiative of Ajit, his wife Manju and students of BHU, who came there with the consent of their Professor M.P. Singh, Head of Law Department, to rescue girls of tender ages who were forced into this business after having been brought from far away places, decided to frame Ajit, Manju and others in false cases by imposing 8 charges against them.

The dharna is being organized to demand lifting of charges on social activists and students in Varanasi. Details of the dharna are as follows.

 

Date: 12th November, 2005, Saturday

 

Time: 11 am to 4 pm

 

Venue: Sardar Patel statue, GPO, Hazratganj, Lucknow

 

Ajit Singh will also address a press conference at 2 pm on the dharna site.

Well shabnam,
i do agree with you.

its outright crass and outmoded program where people who have got meters of buffer layer between what YOUTH IS and what they think youth is.

if its youth meet, there must be agenda on which youth speaks its mind and for a change let all the old people sit and listen and go back to their respective public post and implement it.

moreover we should have continuous forum and session to follow up what youth said and what it is doing to pursue and to DO IT.

Pity that our youth leaders are also in the middle age. do we have a someone as young as 20-25 to voice their mind?

In plain speech, it is ridiculous. It also plays into the hands of the Orientalists of today by gifting them with the opportunity for a rant on the "changeless Orient". 
 
Do you remember another recent instance of the same kind of rubbish within Arkitectindia,  contained in a response to an email from Sneha Singh (if I remember right), or someone similar, about the pitifully poor opportunities available to young, poor muslims living in New Delhi. That great elder of today, Md. Shabuddin did what India's elders have done for ages i.e., "opined" that only educated young Muslims should lead the poor Muslim masses. When will we learn?
