Hi there,
 
For maintenance fund for applying dependent Tie1 visa, can I show my account and my wife's account details ( note that my wife's account is having her previous surname before marriage) or Do i need to show only my ( main applicant's ) account details note that I have my tier 1 visa and I am showing 2800+1600 as maintenance fund as I am applying from India...hope that correct..plz advice asap...

Appricate your reply, but in my case I have already holding Tier1 visa and applying for dependent visa ( as got recently married) from India so I have to show 1600+800(myself) as the maintenance fund,

The below incerpts is applicabel for those who are applying a NEW Tier 1 visa and dependaent visa at the SAME TIME. Please check the pbsdependantspolicy .pdf guidelines para 39 to 43 and reply from Pauline smith as well..

I went for a personal appointment and there they only look at originals so if you are sending all originals I dont think you need to submit any copies along with it.

If your dependents are applying with you then obviously the answer would be No

Thanks for confirming that Tier-1 visa holders indeed can do their Mastes in UK.

Today when I had a consultation with an Education UK consultant out here in Chennai, he wasn’t pretty sure on what would happen to the Tier-1 visa when one pursue a master’s degree with it.

Can you let us know whether the Tier-1 visa would be downgraded to Tier-4 visa if one opts to do his masters?

Please confirm and also it would be great if you could share the contact information of the people who you know have done their masters in Tier-1 visa!

I have proofs of people studying under Tier 1 Visa. We are allowed to study as long as you are able to meet your requirements for extension.

@Sandip,

Your case is exceptional because you need to proveto the home office that the salary on which you are claiming extension has been earned within UK and your Taxes and NI's on the amount were fully paid. The basic thing is that you can not extend your VISA in india, it has to be in the UK. Any house member that feels contradictory to this can prove me wrong. Here in UK I have seen people's extension rejected based on salary issues.

These are my opinions and can be contracdicted.

I agree with Mohan, we should try to pursue master's degree in UK with our Tier1 visa. But we should also consider that there are many among us who can't afford to stop earning (for say 1 year) and invest money on education as they have dependents to look after.

This is feasible for un married bachelors like me or someone with less family responsibility. ..what say guys?

Considering the facts on the ground,underground, air, water... and wat not of THE United Kingdom at this moment.

I would like to debate on Why wouldnt the recently Tier-1 visa enabled juntas in India consider of doing a Masters (Science or Business) in UK Univs? Instead of time and again worrying about the ground level happenings in UK?

I undersrand that all the recently Tier-1 visa enabled juntas in india are earning Big money over here already. But that doesnt rule out the option of pursuing a masters in UK rite? orrr... maybe juntas think that they should only earn BIGGER money rightaway as they are already earning Big money now in india? orrr... is it a fact that juntas think why would i take the risk of opening the Books agian ??

I saw a lot of emails flowing into the group in the recent past curiously posted to know about the job market in UK esp. for IT sector. infact i had posted an email on the same lines as well.. "forget the fact that i never got a reply to my post" :-)

I jus think there is some way to break this ice if not later, then now!!. why wouldnt the desperate Tier-1 visa juntas go over UK to pursue a Masters for the next one year and pick-up the advantage of 20 hour permit to work per week? and use this one year to know and search a Job in UK, indeed wouldnt that give sometime for the UK to come out of recession .. if not completely atleast partially so as to fecth the junta a job which would give BIGGER money?

hmm.. can some1 provide a good reply on these too many questions i have posted for the juntas to respond :)

They say the situation is very worse there as IT is affected very badly. :(
Most of the jobs posted in the jobsites are fake. U may get calls asking whether u have attended any interviews and if attended
details of the company,interview etc, but no job offers.

  I am into IBM Mainframe. The situation for overall IT is bad here. As long as I have observed from my friends, IT and HR are badly affected. Request not to send me any technology details asking how that particular technology is doing, as I am not a market expert. Redundancy is still in progress, I am seeing people losing jobs due to recession even now. No idea at all about the future, again i m not a market expert so this is all my observation, readings and experiences about job scenario and market.

Some one was telling me that one person got refusal on his HSMP extension due to unavailability of Police registeration certificates. As for my understanding that HSMP or Tier-1 visa donot need that. Is this necessary for HSMP extension visas for south asian countries.
Please express ur views.

Hi All,

I had applied for Tier1 on Oct14, aond on Nov 2 i got message, that i may collect my passport.
I went and found that it has been refused for non maintanence of funds .

They stated two reason
1. They don't consider Fixed deposit.
2. Amount in my account is very low.

Actually the FD i had submitted were sweep in FD(worth 1.25 lCs), ie they can breaked any time. I had also attached a documents which stated
that these FD are not in lein with bank (that it can be breaked)
They disregarded it & said FD is not a specified documents.

The second objection is for my PNB bank passbook(total 4 lac, out of which 1.75 lac were consistently maintained for over 5 months).
My PNB account is sweepin enabled.
Under this whenever balance reaches above 25000, it is sweeped in to flexible FD in multiples of 5000.
The passbook in that case will always show balance b/w 25000 - 30000, and in last line it states total available balance including FFD, 3.5 lacs in my case.

But all entries were b/w 25000-30000, if some amount was deposited it showed addition of that amount and in next line moving of that amount to sweepin FD.

Probably assessing officer failed to understand that, and rejected my application stating only 26000 are available.
Though there was an entry of 3 months back stating total available balance of 2.5 lac and for three months no withdrawl was there, but balance always showed was b/w 25k-30k.
in last line it showed total available balance including FFD, 3.5 lacs.

I'm surprised how didn't accessing officer didnt' understand this.

Now i need to apply for an administrative review, but don't know what should i state in my explanation.
Would they consider the FDs of HDFC?
Also would they understand concept of sweepin account in PNB.

Both bank have refused to provide any declaration / document stating this feature.

Please help.......
What should i do?
How should i file my reivew?
What additional documents should i provide.

SHould i just only provide the explanation of sweepin concept and why FD are flexible and not regular & can be broker.

Has any one faced similar problem.

I have seen with many other people, by default you get the visa extended for 3 years from the date your initial visa expires.  Looks like the case worker did some mistake in my case. But am not too much bothered about it and I did not follow it up.

Best to put this question to the case workers...as I think it does depend on the case worker but in any case the permission to stay will be valid till end of 5 yrs...Dont think that makes a differentce to me or to Piysuh but I had specifically asked tht after checking with UKBI and got a chance to talk to the case worker too as I went in person.

Why such kind of difference in validity?

I know this is useful information for people who are thinking of getting their HSMP visa extended under Tier 1 rules.

About my application: HSMP under old rules valid from 4th April 08 to 4th April 2010.

·         I was asked to wait and in 10 mins I was called by a case worker who has read the filled form and asked for the supporting documentation.

·         I submitted the following to him:

o   Cover Letter (Draft attached)

o   Point Based Assessment

o   12 Months Salary Slips

o   P60 for 2008

o   14 months Bank Statement

o   One letter from HSBC confirming that the minimum balance maintained in the account was £xxxx.xx.

o   Copy of my marriage certificate (as I was single at the time of my HSMP approval)

o   Email correspondence with UKBI confirming that the visa if granted is valid for 3 years (i.e., 2 +3)

·         He asked if these were all and I said yes and also asked him if the visa is granted when will be applicable from. He said it will be valid for 3 years after the initial leave expires. He asked why I was applying 5 months early and I replied stating that I need to move to India for a couple of months and wanted this out of the way and he said it was fine.

·         He told me that it will take him approx one and half hours hence I could wait inside or go out and come back and check with him.

·         Hence, I went out for breakfast and returned after 90 mins and waved at the case worker. He called me to his desk and gave me my passport to check the visa.

·         He then gave me all my documents and also commended me for the putting together of the supporting documents.

Summary:

·         Make the arrangement of the documents so that it is easier for them to check and verify facts.

·         I didn’t need any Xerox.

·         Just needed one photograph.

Myth:

One can apply as soon as he qualifies for extension and it is not necessary to wait till just before the end of the visa.

Learning:

·         In person application is costly (£200 more) but I guess is a much better way of doing it as you can get over and done with it on the same day.

·         However, it is a task to get the appointment as everything is always booked up.

My HSMP is about to expire on Feb 8 2010, and I am about to apply for extension during Dec-Jan and have some following doubts.

1) My Passport is expiring on 13-06-2010 , will there by any problem (Is there any specific validity 3 or 6 months mandatory before it expires)
Not for applying for the visa the criteria is for travelling you can apply as long as you have sufficient visa for them to have  reasonable time to decide on your application (apprx 5 weeks for postal application) My Passport expires in May 2011 but still the visa is stamped till April 2013. Best to check with the UKBI directly.

2)For degree verification in the form there is an option that says
     - Evidence previously provided with the applicant’s initial HSMP application.
   Does this mean I dont have to send my original degree certificate if so How will they verifiy the points that I have claimed during the initial HSMP application becuase there is no where that asks for initial HSMP approval letter etc

No you do not have to send any document for your degree verification. You will attach your initial HSMP approval letter and if you had a Masters degree then so they will know you claimed 35 points then and you will be awareded the same points. If you had a Bachelors degree then but now if you have Masters then send your orginal degree or else you dont need to.

3)  In one of the section it says
     - Please enter the reference number on the entry clearance or visa which can be found in
the applicant’s passport or travel document.
Enter the reference number from your HSMP approval letter it should be against HO Reference. Same number is also there on the visa in the passport.

      I traveled initially Business visa and later on WP during which I converted to HSMP.
Should I be entering the Business visa details or WP details in this section
No you are switching from HSMP hence you should just write about the HSMP visa. Do not confuse the case worker.

Congratulations, just I had quick question on the Visa stamped in your passport.
 
Did you get Entry clearance or Residence permit for the extension when you applied within UK.. I mean the blue colour visa with Residence permit written or Entry Clerance.. just clearing some confusion .. as I feel if you apply from outside you get EC and if from within the country.. you get Residence permit written on your visa.. with the conditions tier1 tier 2.. etcc

What all the measures I need to take?

I know this is useful information for people who are thinking of getting their HSMP visa extended under Tier 1 rules.

About my application: HSMP under old rules valid from 4th April 08 to 4th April 2010.

Data of Tier1 extension: 9th November (5 months before the visa was expiring)

Mode: In person Application

Appointment Location: Sheffield

Appointment Time: 10:00 AM

Result: Visa granted valid till 4th April 2013

Also got a cover letter from HO stating that the new visa supersedes, any visa given before this.

What happened on the day:

·         Reached there at 9:15 AM and reached inside after clearing (airport kind of) security.

·         At the reception showed my appointment confirmation was allotted a ticket number and asked to be seated.

·         In 2 mins I was called by a case worker who asked for my passport and the filled form and a photograph and checked if the photograph was fine.

·         Asked me a few basic questions to confirm that I was applying for extension and put my form in a plastic envelope and told me that I will need to pay the fees and handover this folder to the payment counter.

·         I paid the fees (by Debit Card) at the payment counter and handed in the envelope.

·         I was asked to wait and in 10 mins I was called by a case worker who has read the filled form and asked for the supporting documentation.

·         I submitted the following to him:

o   Cover Letter (Draft attached)

o   Point Based Assessment

o   12 Months Salary Slips

o   P60 for 2008

o   14 months Bank Statement

o   One letter from HSBC confirming that the minimum balance maintained in the account was £xxxx.xx.

o   Copy of my marriage certificate (as I was single at the time of my HSMP approval)

o   Email correspondence with UKBI confirming that the visa if granted is valid for 3 years (i.e., 2 +3)

·         He asked if these were all and I said yes and also asked him if the visa is granted when will be applicable from. He said it will be valid for 3 years after the initial leave expires. He asked why I was applying 5 months early and I replied stating that I need to move to India for a couple of months and wanted this out of the way and he said it was fine.

·         He told me that it will take him approx one and half hours hence I could wait inside or go out and come back and check with him.

·         Hence, I went out for breakfast and returned after 90 mins and waved at the case worker. He called me to his desk and gave me my passport to check the visa.

·         He then gave me all my documents and also commended me for the putting together of the supporting documents.

Summary:

·         Make the arrangement of the documents so that it is easier for them to check and verify facts.

·         I didn’t need any Xerox.

·         Just needed one photograph.

Myth:

One can apply as soon as he qualifies for extension and it is not necessary to wait till just before the end of the visa.

Learning:

·         In person application is costly (£200 more) but I guess is a much better way of doing it as you can get over and done with it on the same day.

·         However, it is a task to get the appointment as everything is always booked up.

My HSMP is about to expire on Feb 8 2010, and I am about to apply for extension during Dec-Jan and have some following doubts.


1) My Passport is expiring on 13-06-2010 , will there by any problem (Is there any specific validity 3 or 6 months mandatory before it expires)
Not for applying for the visa the criteria is for travelling you can apply as long as you have sufficient visa for them to have  reasonable time to decide on your application (apprx 5 weeks for postal application) My Passport expires in May 2011 but still the visa is stamped till April 2013. Best to check with the UKBI directly.

2)For degree verification in the form there is an option that says
     - Evidence previously provided with the applicant’s initial HSMP application.
   Does this mean I dont have to send my original degree certificate if so How will they verifiy the points that I have claimed during the initial HSMP application becuase there is no where that asks for initial HSMP approval letter etc

No you do not have to send any document for your degree verification. You will attach your initial HSMP approval letter and if you had a Masters degree then so they will know you claimed 35 points then and you will be awareded the same points. If you had a Bachelors degree then but now if you have Masters then send your orginal degree or else you dont need to.

3)  In one of the section it says
     - Please enter the reference number on the entry clearance or visa which can be found in
the applicant’s passport or travel document.
Enter the reference number from your HSMP approval letter it should be against HO Reference. Same number is also there on the visa in the passport.

      I traveled initially Business visa and later on WP during which I converted to HSMP.
Should I be entering the Business visa details or WP details in this section
No you are switching from HSMP hence you should just write about the HSMP visa. Do not confuse the case worker.
4) For English verification - there is option that says

Applicant is currently in the United Kingdom as a Tier 1 (General)

migrant, a Tier 1 (Entrepreneur) migrant or as a Highly Skilled Migrant

Programme participant and has previously satisfied the English

Language requirement.

 If this was proved during HSMP then you do not need to provide any further proof.

However, you will need to fill the online assessment and put the same things in there.

Thanks for your mail.  But I dint get your answer.  "Only maintanance requirement would change ??"   -- Does it mean Maintenance funds would be 2400£  instead of 800£.. Is that the only difference ??
 
Still my
1. Pay slips   will remain unchanged
2. Maintainance funds - Savings bank accound will still remain unchanged  since I have more than 2400£  for last 4 months.
3. And application will be change due to outside UK.
 
Any other requirement i need to concentrate??
 
So can i directly go to VFS offcie in Hyderabad (My home town) and submit directly ??

Hi All,

I had applied for Tier1 on Oct14, aond on Nov 2 i got message, that i may collect my passport.
I went and found that it has been refused for non maintanence of funds .

They stated two reason
1. They don't consider Fixed deposit.
2. Amount in my account is very low.

Actually the FD i had submitted were sweep in FD(worth 1.25 lCs), ie they can breaked any time. I had also attached a documents which stated
that these FD are not in lein with bank (that it can be breaked)
They disregarded it & said FD is not a specified documents.

The second objection is for my PNB bank passbook(total 4 lac, out of which 1.75 lac were consistently maintained for over 5 months).
My PNB account is sweepin enabled.
Under this whenever balance reaches above 25000, it is sweeped in to flexible FD in multiples of 5000.
The passbook in that case will always show balance b/w 25000 - 30000, and in last line it states total available balance including FFD, 3.5 lacs in my case.

But all entries were b/w 25000-30000, if some amount was deposited it showed addition of that amount and in next line moving of that amount to sweepin FD.

Probably assessing officer failed to understand that, and rejected my application stating only 26000 are available.
Though there was an entry of 3 months back stating total available balance of 2.5 lac and for three months no withdrawl was there, but balance always showed was b/w 25k-30k.
in last line it showed total available balance including FFD, 3.5 lacs.

I'm surprised how didn't accessing officer didnt' understand this.

Now i need to apply for an administrative review, but don't know what should i state in my explanation.
Would they consider the FDs of HDFC?
Also would they understand concept of sweepin account in PNB.

Both bank have refused to provide any declaration / document stating this feature.

Please help.......
What should i do?
How should i file my reivew?
What additional documents should i provide.

SHould i just only provide the explanation of sweepin concept and why FD are flexible and not regular & can be broker.

Has any one faced similar problem.

    Is this required if I am applying extension just for me since I am not applying for my dependents since they are in India now

 

HSMP approval letter is this mandatory since it has no where asked in the form

I am fine with that.  We have some function planned so anyway my family needs to return to india.
I was thinking of visitor visa because maintaining funds for 3 months and then getting tier1 dependent visa will take 5-6 months. So in the mean time they can come to UK stay for some time and return to India.
 
As far as my understanding is concerned i need to maintain 2400 (self) + 1600(spouse) + 800(kid). Total of 4800 GBP for 3 months.
I got my tier 1 visa last year. I was in india till last month so Do i need to maintain total 4800 GBP in account or only 2400 GBP for 3 months?

Hi Swanad,

You need to be very careful while thinking about this option.

As far as my understanding goes a visitor cannot switch into a PBS category from a visitor category directly in the uk and they will have to go back and get the visa stamp b4 coming back as Tier 1 dependents.

It is going to be a task to call your family on visitor visa because as a visitor their rights would be limited and the schooling and stuff cannot be done in the UK for your kids whilt they are a visitor.

It would be best if you arrange for the the maintaince funds and the call them directly on Tier 1 visa. Also, it is worth considering if you would be eligible for PR (if uk is your settlement destination) as calling family is a long term move.

Please let the group know your thoughts.

Hi Satish and all other ppl who are planning to apply for their extensions,

I know this is useful information for people who are thinking of getting their HSMP visa extended under Tier 1 rules.

About my application: HSMP under old rules valid from 4th April 08 to 4th April 2010.

Data of Tier1 extension: 9th November (5 months before the visa was expiring)

Mode: In person Application

Appointment Location: Sheffield

Appointment Time: 10:00 AM

Result: Visa granted valid till 4th April 2013

Also got a cover letter from HO stating that the new visa supersedes, any visa given before this.

What happened on the day:

·         Reached there at 9:15 AM and reached inside after clearing (airport kind of) security.

·         At the reception showed my appointment confirmation was allotted a ticket number and asked to be seated.

·         In 2 mins I was called by a case worker who asked for my passport and the filled form and a photograph and checked if the photograph was fine.

·         Asked me a few basic questions to confirm that I was applying for extension and put my form in a plastic envelope and told me that I will need to pay the fees and handover this folder to the payment counter.

·         I paid the fees (by Debit Card) at the payment counter and handed in the envelope.

·         I was asked to wait and in 10 mins I was called by a case worker who has read the filled form and asked for the supporting documentation.

·         I submitted the following to him:

o   Cover Letter (Draft attached)

o   Point Based Assessment

o   12 Months Salary Slips

o   P60 for 2008

o   14 months Bank Statement

o   One letter from HSBC confirming that the minimum balance maintained in the account was £xxxx.xx.

o   Copy of my marriage certificate (as I was single at the time of my HSMP approval)

o   Email correspondence with UKBI confirming that the visa if granted is valid for 3 years (i.e., 2 +3)

·         He asked if these were all and I said yes and also asked him if the visa is granted when will be applicable from. He said it will be valid for 3 years after the initial leave expires. He asked why I was applying 5 months early and I replied stating that I need to move to India for a couple of months and wanted this out of the way and he said it was fine.

·         He told me that it will take him approx one and half hours hence I could wait inside or go out and come back and check with him.

·         Hence, I went out for breakfast and returned after 90 mins and waved at the case worker. He called me to his desk and gave me my passport to check the visa.

·         He then gave me all my documents and also commended me for the putting together of the supporting documents.

Summary:

·         Make the arrangement of the documents so that it is easier for them to check and verify facts.

·         I didn’t need any Xerox.

·         Just needed one photograph.

Myth:

One can apply as soon as he qualifies for extension and it is not necessary to wait till just before the end of the visa.

Learning:

·         In person application is costly (£200 more) but I guess is a much better way of doing it as you can get over and done with it on the same day.

·         However, it is a task to get the appointment as everything is always booked up.

My HSMP is about to expire on Feb 8 2010, and I am about to apply for extension during Dec-Jan and have some following doubts.

1) My Passport is expiring on 13-06-2010 , will there by any problem (Is there any specific validity 3 or 6 months mandatory before it expires)
Not for applying for the visa the criteria is for travelling you can apply as long as you have sufficient visa for them to have  reasonable time to decide on your application (apprx 5 weeks for postal application) My Passport expires in May 2011 but still the visa is stamped till April 2013. Best to check with the UKBI directly.

2)For degree verification in the form there is an option that says
     - Evidence previously provided with the applicant’s initial HSMP application.
   Does this mean I dont have to send my original degree certificate if so How will they verifiy the points that I have claimed during the initial HSMP application becuase there is no where that asks for initial HSMP approval letter etc

No you do not have to send any document for your degree verification. You will attach your initial HSMP approval letter and if you had a Masters degree then so they will know you claimed 35 points then and you will be awareded the same points. If you had a Bachelors degree then but now if you have Masters then send your orginal degree or else you dont need to.

3)  In one of the section it says
     - Please enter the reference number on the entry clearance or visa which can be found in
the applicant’s passport or travel document.
Enter the reference number from your HSMP approval letter it should be against HO Reference. Same number is also there on the visa in the passport.

      I traveled initially Business visa and later on WP during which I converted to HSMP.
Should I be entering the Business visa details or WP details in this section
No you are switching from HSMP hence you should just write about the HSMP visa. Do not confuse the case worker.
4) For English verification - there is option that says

Applicant is currently in the United Kingdom as a Tier 1 (General)

migrant, a Tier 1 (Entrepreneur) migrant or as a Highly Skilled Migrant

Programme participant and has previously satisfied the English

Language requirement.

 If this was proved during HSMP then you do not need to provide any further proof.

However, you will need to fill the online assessment and put the same things in there.
