Pedaling Better Streets

If you want to catch a glimpse of the future of New York City’s streets, head over to Ninth Avenue where trendy Chelsea meets the uber-trendy Meatpacking District.
Starting at 23rd Street and heading south, a network of stripes, buffers and parking spots that comprise the City’s latest effort to create an on-street, mostly separated bike line, will catch your eye. Appearing seemingly overnight, this nearly complete “hybrid” lane boldly defies preconceived notions of safety by actually bringing turning vehicles closer to bikes at intersections. This new approach to the vehicle/bicycle street relationship may very well be looked back upon as the tipping point for mass bike use in this increasingly bike- (and pedestrian-) friendly city.
For those tracking the evolution of Gotham’s growing embrace of pedal power, there has been a lot to keep up with since new leadership at the NYC Department of Transportation (NYC DOT) took hold. One early indication was new “Enhanced Class III” stenciling – consisting of a very large bike logo with arrows painted onto the street – that showed up on Fifth Avenue in Park Slope, Brooklyn last fall. This change from typical Class III routes, or street signs, is a more visible reminder to motorists that they are sharing the road.
The new leader at NYC DOT is Janette Sadik-Kahn. This past spring not only ushered in Mayor Bloomberg's PlaNYC – which included the promotion of cycling as one of sixteen transportation initiatives – but also brought in Ms. Sadik-Kahn as NYC DOT Commissioner. Under her direction, NYC DOT has quickly implemented bold ideas developed in the past while looking beyond the City for new visions of city street life.
Following her appointment, Sadik-Khan visited Copenhagen to investigate the city's extraordinary city-wide bikeway network. Organized by RPA and sponsored by the J.M. Kaplan Fund, the trip seems to have played a role in influencing recent NYC DOT decisions. This summer alone yielded the creation of a number of new bike lanes across the City, the removal of a parking space for increased bike parking in Williamsburg, Brooklyn, and – most vividly – the painting of a few Class II (striped, on-street) bike lanes in an eye-catching green. Combined with NYC DOT’s recently announced “2007 LOOK bicycle safety campaign,” these innovations are welcoming cyclists to take to the streets.
The latest NYC DOT move to create a separated bike path for Ninth Avenue is perhaps the most innovative and complex and, like many recent DOT projects, was installed with lightning speed.
To get a sense of the bike lane’s features, imagine yourself pedaling down this new “cycle-track,” as the Europeans refer to it. Immediately to your left you’ll see a wide sidewalk with bustling pedestrian activity. In front of you at the next intersection, pedestrians looking to cross Ninth Avenue walk swiftly across the bike lane to their very own designated “pedestrian island” situated at the edge of the newly-configured street. Not only will this island destination eventually be inhabited by green vegetation, but it will also reduce pedestrians’ crossing distance by 25 feet. Together with the wide sidewalks, this latest incarnation of the separated bike path cunningly avoids the pitfalls of the 1980 separated bike lane between Greenwich Village and Central Park which became clogged with pedestrians and street vendors.
Looking to your right, an assurance of safety is reinforced by an 8 foot buffer zone that will eventually feature low vegetation, and a 10 foot Muni-metered parking lane, cleverly moved to the outside of the bike lane. As you begin to reach one of the three designated left turn lanes for autos, you’ll notice the buffer begins to disappear and, before you know it, you’re side-by-side with a vehicle waiting to turn left. It turns out that bringing drivers and cyclists back together at intersections – while seemingly counterintuitive – can actually enhance awareness and safety at these critical junctions. As a reminder, visible street markings indicate to motorists where the bike path crosses the intersection.
So, you may be thinking “sure this sounds like a really great bike path, but why does it matter to me?” Well, for seven blocks, this bike path offers a glimpse of what New York City street life can offer if bold ideas are implemented. It finds a way to seamlessly weave together issues of livability, sustainability and safety while synchronizing motorists activity, cyclists and pedestrians into one accord – a rare feat on New York City streets.
While the configuration of this path will not work for all of New York’s diverse streets, NYC DOT will be sure to track the success of this route and identify other appropriate locations for it.

If you were an enlightened developer – and yes, there are quite a few – seeking to build a neighborhood that put homes next to shops, small houses next to big ones, and the whole thing next to a transit stop and a public plaza, guess what? You probably couldn’t without going through an excruciating permitting process.
Why not? Because New Jersey’s zoning codes as a general rule don’t recognize the many dimensions of “smart growth” as something to be desired. Since the bulk of the state’s zoning is the old “dumb growth” model, achieving smart growth standards is done either through redevelopment statutes or by variance under conventional zoning, which encourages uses to be separated and rests on the cement blocks of old Euclidean zoning. Both smart growth and good community design end up as losers.
In addition, the more flexible provisions authorized by the Municipal Land Use Law – the state’s planning enabling legislation – were clearly designed for large projects on greenfields and are not that relevant at a time when most of the state’s growth is occurring through redevelopment of brownfields or greyfield sites.
Because of this, many are asking whether the state’s planning enabling legislation needs an update to bring it in line with what’s currently desired by the state’s own smart growth policies. It’s a dilemma faced not only by New Jersey, but to some degree in Connecticut and New York as well. Although the talk is now of smart growth, most states’ codes do not reflect those policies.
The model discussed as the new right way to regulate growth is called "form-based zoning" (FBZ). FBZ is more interested in the final, physical outcome and less focused on the inter-relationships between specific uses. As such, it focuses on building size, height and scale, and their position relative to the street, parking and public spaces. It does not seek to obsessively separate uses. In many ways it follows the maxim that urbanist Jane Jacobs came up with many decades ago, which was “regulate size, not function.”
Although the case for zoning reform seems strong, there has been little public discussion of the issue. With funding from the New Jersey Office of Smart Growth, RPA is attempting to change this. In coming months, RPA will convene an advisory committee of experienced planning practitioners, leading experts in NJ land use law and other important stakeholders to discuss the legality and limitations of widespread use of FBZ in NJ, and advise on potential legislative amendments to facilitate it and other zoning reforms. RPA will partner with a number of other organizations to host roundtable discussions. In order to focus those discussions, RPA will frame the issues in writing beforehand and ask each of the participants, in advance, to carefully consider the options. The outcomes of these roundtable discussions will become a chapter in the major outcome for this project - a Community Design Technical Guidance Report.
Whatever the product of these meetings, there is likely to be considerable opposition to implementing true FBZ. In spite of flaws, old zoning laws have been around a long time, and making fundamental changes will likely make people nervous. Most municipalities are generally satisfied with their zoning codes even though local planning boards, and in particular zoning boards of adjustment, are often not. Local zoning regulations have become a reassuring element in a fast-changing world, and people often have considerable misgivings about true zoning reform. While piece-meal amendments to conventional zoning codes are not cost-effective, this is standard practice for the majority of smart growth projects in NJ today. As such, an educational initiative to familiarize local officials with FBZ principles and their advantages is critical if this idea is to gain ground and be adopted on a widespread basis.
This means there is an ideal opportunity to educate local officials on the principles of community design and explain the inter-relationships between community form, mobility and transportation options. For Form Based Zoning is actually a far better tool to actually implement a community vision, because the zoning code in effect allows for a vision in the first place.

Restoring Manahatta, One Wetland at a Time

For those of us in love with old maps, nothing could be more fun that the “Manahatta Project.” Steve Sanderson of the Wildlife Conservation Society (a.k.a. the Bronx Zoo people) has set out to virtually recreate Manhattan before the European’s arrived and all the fuss started. Using the British military’s 1782 survey maps, natural histories, ecology, and a little creativity, Steve and his colleagues have reconstructed the Island as Henry Hudson saw it in 1609. You can check it out at the New Yorker's online website.
One of first things you might notice is the irregular shoreline and marshes that once ringed the Island. These tidal wetlands hosted herons, ducks, and songbirds that nested or foraged on their seasonal travels up and down the North Atlantic. They were a nursery for young striped bass and sturgeon that once (and still) plied the Harbor. The Island’s soft edge had a sponge-like capacity to absorb storm surges from hurricanes and nor’easters.
New York Harbor once boasted about 100 square miles of these marshes. Now, only 14 remain. The opportunity to set one aside for the future is rare, and the political will to do so perhaps even more so.
That’s why conservationists cheered last week when Mayor Bloomberg announced the preservation of Arlington Marsh. The 70-acre salt marsh is a cornerstone of a major wetlands complex on the northwest corner of Staten Island. Its protection has been a priority for a generation of advocates and scientists at The Trust for Public Land, US Fish and Wildlife Service, and other agencies. Thanks to the Mayor, and the support of Councilmen James Gennaro and Mike McMahon, the marsh will be transferred to the New York City Department of Parks & Recreation and dedicated as public parkland.
The announcement cames as the New York City Wetlands Transfer Task Force, created in 2005 to formulate strategies to ensure the survival of the City’s urban wetlands, submitted its recommendations to Mayor Bloomberg and City Council Speaker Christine Quinn. The Task Force recommended the transfer of 80 parcels totaling just over 220 acres to Parks, and identified hundreds more worthy of additional investigation.
Perhaps as important, the Task Force outlined what might be included in an overall wetlands policy for the City, including guidance to public agencies on disposition of underwater lands, mitigation of in-water piers and bulkheads, and oversight of smaller private wetlands. Creation of such a policy is also a recommendation of PlaNYC, the Mayor’s 2030 sustainability plan, which includes a strategy to improve water quality across the Harbor by employing pilot projects to test practices like installing roof gardens, capturing rain water on site in cisterns, and greening streets.
Manahatta exists only in relic patches. New York’s maritime history has drastically reshaped tidal connections between land and sea in the Hudson estuary. Bulkheads, relieving platforms, fill, and rip-rap built to protect property and accommodate ships have taken the place of marshes and tidal flats. The Harbor as Hudson saw it is not coming back. But restoration science, conservation action and political will can together recreate much of the structure and function of the Harbor Estuary.

Dear Friends,
    As the leaves are changing to red, yellow, and orange, I would like to wish you and your family a safe Thanksgiving. This is a time to be grateful for our family, friends, and all the blessings in our lives. Whether you are traveling hundreds of miles or just down the road for your turkey dinner, I’ve listed a few holiday travel tips to help you get to your destination safely.

If you are traveling by car:

• Make sure your car is tuned, ready, and in good working order. Check tire pressure, the spare tire, brakes, and change your oil. Have an emergency kit on hand including items such as a flashlight, blanket, flare, first aid kit and your cell phone.
• Check the road conditions and weather report before you leave.
• Gas up the night before to avoid delays and long lines at the gas pumps.
• Always wear your seatbelt. Seatbelts are the single most effective way to protect yourself and your passengers. State and local law enforcement agencies are planning an aggressive “Click it, or Ticket” campaign over the Thanksgiving holiday.
• Don’t drink and drive. Drivers under the influence of alcohol or drugs are a leading cause of accidents.
• Don’t rush, drive the speed limit, and leave plenty of time to reach your destination. Leave time for unplanned stops.
• Pack snacks and water if your trip is longer than an hour.

If you are traveling by air:

• Get to the airport early. Over the Thanksgiving holiday weekend two hours before your departure is recommended.
• Pack light to save time and energy. Having only one carry on bag saves time over checking luggage.
• Check the TSA guidelines as to what you can and cannot pack.
• Bring a good book to read and games to keep children occupied.
• Check in online and print out boarding passes if available.

General travel tips:

• Don’t forget to lock doors and windows of your home if you are leaving for an extended period of time.
• Be flexible, patient, and keep a positive attitude!


    I hope that you arrive at your destination safely and enjoy your turkey, stuffing, football, family and friends. Have a safe Thanksgiving.

As we get set to enter the last month of 2007, I believe 2007 has been a relatively strong year for Senate Republicans. While we've faced some unexpected retirements and bumps along the way, we've also had our share of successes.
Our most recent success, however, is a news story that is breaking as I write this. In the race for the Louisiana Senate seat, GOP State Treasurer John Kennedy has just filed to run against the very vulnerable Democrat Mary Landrieu.
John Kennedy will be the strongest challenger Mary Landrieu has ever faced in her public life and combined with other compelling factors, this match-up is almost guaranteed to be one of the hottest races this cycle. It is also a prime pick-up opportunity for us.
Republicans in Louisiana are coming off the recent state elections; elections which provided a significant amount of momentum going into 2008. Newly elected Republican Governor-elect Bobby Jindal was overwhelmingly voted into office on a message of cleaning up the way Louisiana politicians operate. Louisiana voters proved that when given the opportunity for a choice between politics as usual -- symbolized by Mary Landrieu and Louisiana Democrats -- and real change, change wins in a landslide.
I am confident that Mary Landrieu will be the next electoral victim of that message in November.
One thing to remember when looking at the electoral map for 2008, however, is that Mary Landrieu will have to answer for her liberal votes and partisan politics -- something she didn't have to do last election. That said, we can't do it alone.

Dear Friends,
Tomorrow, as we commemorate World AIDS Day, we must reflect both on the lives lost so far and on our continued moral obligation to ensure we provide necessary treatment and research to assist those living with HIV/AIDS.

As a senior member of the Health Subcommittee of the House Energy and Commerce Committee, I have fought hard for increased federal dollars for New York to treat more than 111,000 New Yorkers living with HIV/AIDS today. New York remains the epicenter of the AIDS epidemic in our nation with nearly 18 percent of all HIV/AIDS cases in the United States.

Last year, during the reauthorization of the Ryan White CARE Act, which addresses the unmet primary care and health support needs of low income people living with HIV/AIDS, I led the charge to stave off the Administration’s proposal to dramatically shift needed funding away from New York. This year, we were able to achieve record increases in funding nationwide for the Ryan White CARE Act in the Labor-Health and Human Service appropriations bill. Sadly, President Bush vetoed this critical legislation on November 13, 2007.

I have also introduced the bi-partisan Early Treatment for HIV Act, which reforms rules in the Medicaid program which mandates that people be disabled by AIDS before receiving treatment. This rule is inconsistent with national health guidelines for those with HIV, which recommends early and aggressive treatment for those with HIV to keep their illnesses from progressing to AIDS. My bill will allow states to treat low-income individuals with HIV under the Medicaid program. HIV no longer has to be a death sentence with the new medical treatments available today.

Globally, we must also continue to be mindful of the 33 million individuals currently living with HIV/AIDS. Over 5700 people die each day from AIDS related illnesses and the United States must provide adequate resources to help stop the global scourge of AIDS. As you may know, tuberculosis is the leading infectious killer among adults with HIV/AIDS as it preys upon these individuals with weakened immune systems. I am pleased to report that my bill, H.R. 1567, the Stop Tuberculosis Now Act recently passed the House of Representatives overwhelmingly and is currently awaiting action by the U.S. Senate. Worldwide, tuberculosis kills 1.6 million adults and 1.4 million children each year. My bill will go a long way towards providing resources to those with both HIV/AIDS and tuberculosis.

I am proud that the AIDS Institute has decided to honor me with their "HIV/AIDS Care & Treatment Award for 2007" for my work in Congress. I am grateful for the award but am equally aware that World AIDS Day must prompt us to examine what progress we have made and to reevaluate what additional steps should be taken to combat this deadly epidemic. Working together, we can address both prevention and early treatment options and hopefully one day find a cure for AIDS. Be assured that I will continue to work hard in Congress on both the House Energy and Commerce Committee and House Foreign Affairs Committee to make a difference every day for those living with HIV/AIDS.

The race for Ohio's Fifth Congressional District this Tuesday, December 11 is closer than we thought.

In fact, today's Roll Call has this quote from a Democratic consultant in Ohio which highlights how close this race is and why it's absolutely critical that Republicans hold the seat:
"I've heard that there are internal polls that show a 3-point race," said Ohio Democratic consultant Dale Butland. "It would be shocking. If that district goes Democratic, then there would literally be no district in this state that would be safe for Republicans." 
Bob Latta is our Republican candidate. He needs our support right now.
 
Bob Latta's candidacy has been endorsed by conservative groups that we know and trust like Ohio Right To Life, National Right To Life, Susan B. Anthony List, National Rifle Association, and the National Federation of Independent Business (NFIB).
 
Erick Erickson over at the influential conservative blog Redstate has this to say:
 
Bob Latta needs our help in OH-05. There is a special election there on December 11th. The race is within three points. Latta is running against a huge lefty.
Latta and the Lefty are within 3 points of each other in the polls.
Bush won the district with 61%, but given the GOP brand right now in Ohio, the lefty is coming on strong.
Latta could use some cash and if you are in Ohio, he could use some people power on the ground.
The DCCC is so eager to win this race, they started throwing outright phony ads on television that the networks pulled because the lies were so extensive. But they are keeping at the smears.

You'd be right to think that history is repeating itself the way Hillary Clinton is running her campaign for president.

This week, Congressman Joe Crowley voted to enact historic and sweeping legislation to make the U.S. energy independent. The Energy Independence and Security Act of 2007 will bring down fuel costs by making cars more fuel efficient, reduce greenhouse gases that contribute to global warming, and encourage the development of green-building. It will also direct $2 billion in leftover 9/11 New York Liberty Zone tax credits toward the construction of transportation infrastructure projects for the City, such as the John F. Kennedy Airport rail link and other City mass transit projects.
 
“The JFK rail link will reduce traffic congestion and pollution, spur economic development, create jobs in the City, and save commuters time – allowing them to get home earlier for dinner with their families,” said Congressman Crowley. “This landmark bill also redoubles our nation’s efforts to achieve energy independence by requiring cars and trucks to be more fuel efficient, by promoting green-building, and by improving mass transit.”

2.)  Crowley Urges Constituents to Check If IRS Owes Them Money
 
Congressman Joe Crowley urges his Queens and Bronx constituents to check if they are among the nearly 9,000 New Yorkers with unclaimed tax returns. Congressman Crowley’s Web site features a list of more than 1,000 constituents in New York’s 7th Congressional district owed tax refunds from the Internal Revenue Service (IRS).
 
Because of invalid mailing addresses, these tax refund checks were undeliverable and have yet to be claimed. 4.)  Congressman Crowley Pushes for Creation of International Fund for Middle East
 
Congressman Joe Crowley called on the Secretary of State to spearhead the creation of an International Fund for the Middle East. The proposed International Fund for the Middle East would be modeled after the International Fund for Ireland (IFI), which has successfully promoted coexistence and reconciliation efforts in Northern Ireland. The International Fund for the Middle East would act as a central clearinghouse for the international effort to provide resources to achieve the goal of peace in the Middle East.
 
“History has taught that no political solution may arrive, and certainly none will last, without seriously engaging the publics on both sides of this conflict,” wrote Congressman Crowley in a letter to Secretary Rice. “An International Fund for the Middle East would certainly help to engage the people who are impacted daily by the conflicts in the Middle East. It is time to bring about this kind of effort, but doing so will require the leadership of the United States.”

5.)  Crowley Encouraged by Flood Control Proposals for Woodside
 
On November 27, at St. Mary’s Church, Congressman Joe Crowley and other Queens elected officials hosted a town hall meeting with city and state officials to discuss with Woodside residents – among the worst hit by the Aug. 8 storm that pounded New York – ways to address flooding problems in the area.
 
Department of Environmental Protection (DEP) Commissioner, Emily Lloyd, and other representatives from the City and State Departments of Transportation and New York City’s Comptroller’s Office, discussed specific proposals to prevent future flooding in the Woodside and Queens area. At the request of Congressman Crowley, city and state officials will have a follow up meeting with residents of Woodside and Queens to discuss the status of how the City is addressing the issue.
 
“This meeting with Woodside residents and city and state officials was an important first step in establishing specific ways the City can prevent longstanding flooding problems in this area,” Congressman Crowley said. “I was encouraged to hear that the Department of Environmental Protection is considering improvements of key City infrastructure in the efforts to protect homes and businesses from damage.”

You may be surprised to learn that agriculture is one of the most regulated and controlled parts of the U.S. economy. Remember the Soviet Union’s Five Year Plans? Congress authors a new farm bill every 5 years to set prices and manage supplies of America’s major commodity crops.

The 2007 Farm Bill, which has already passed the House and Senate, will spend $288 billion. It’s easily the most anti-consumer, anti-freedom Farm Bill in a generation. The failure of Congress to reform these programs comes despite record farm prices this year. The nation is missing a tremendous opportunity to reform a set of programs that are antithetical to free market competition and limited government principles.

Even if America wanted some kind of rational socialism in agriculture, such a program would look nothing like the byzantine Farm Bill currently before Congress. Our current agriculture program is a prime example of the folly that occurs when decisions are made by political criteria instead of market criteria.

Enter the Budget-Busting Omnibus

Last night, the House, as expected, passed the earmark-laden omnibus. The bill now heads off to the Senate, where, after the addition of about $70 billion in troop funding, it’s expected to pass. This huge spending measure is packed with policy riders, earmarks and budget gimmicks that add billions of dollars in spending to an already gigantic U.S. budget.

This bill includes more than 8,000 earmarks, so that politicians can spend taxpayer money on their own pet projects. It has budget gimmicks that hide $14 billion of additional spending, to avoid responsibility for over-spending in Congress. A better idea for funding the government through next year is a continuing resolution. A clean continuing resolution would leave government programs funded at their current levels, but no more, and would save taxpayers billions of dollars.

FreedomWorks made the news last week when it released an open letter from economists opposing government intervention into the mortgage market.   This letter should give policymakers pause in their rush to pass bailout schemes for the real estate market. Most of the policy proposals before Congress would arbitrarily rewrite private contracts, reward speculative lending and borrowing, and expose taxpayers to additional risks.

Knowing of your concern about the situation in Darfur, I wanted to update you on what Congress is doing to end this ongoing tragedy.  On December 18, 2007, the U.S. House of Representatives unanimously passed one of the most important human rights measures it has dealt with all year – The Sudan Accountability and Divestment Act.
 
The Sudan Accountability and Divestment Act authorizes state and local governments and universities to divest from companies doing business with the military, power production, oil-related, or mineral extraction industries that are working in partnership with the government of Sudan.  Further, it provides safe harbor to mutual funds and pension plans choosing to divest their assets in such companies.  In addition, it prohibits the U.S. government from entering into new federal contracts with these offending companies.  No longer will Americans have to worry that their tax dollars are going to companies that support the inhumane regime in Khartoum.
 
This legislation will be sent to the President of the United States as one piece of a multi-faceted effort to address the crisis in Darfur.  You and I agree that to resolve the situation in Darfur, the United Nations/African Union hybrid peacekeeping force must be quickly and fully implemented.  Additionally, the international community must maintain its support for a single, unified peacekeeping process that includes a sustained and secure role for the courageous humanitarian workers.

One-Man Gridlock: Meet Tom Coburn, Senate's 'Dr. No' Oklahoma Conservative Specializes in the 'Hold'; Stopping 90 Bills in 2007

WASHINGTON -- On Tuesday afternoon, when most senators were preparing to leave Washington for the holiday recess, Tom Coburn was declaring his intention to stick around.
"The floor's going to be open," said the 59-year-old Oklahoma Republican. "I'm going to have to be here...to try to stop stuff."
Stopping stuff is Sen. Coburn's specialty. In a Congress that has had trouble passing even the simplest legislation, Sen. Coburn, who proudly wears the nickname "Dr. No,'' is a one-man gridlock machine. This year, the senator, who indeed is a medical doctor, single-handedly blocked or slowed more than 90 bills, driving lawmakers on both sides of the aisle to distraction.
He blocked a ban on genetic discrimination by health insurers. He thwarted a bill to set up a program to track patients with Lou Gehrig's disease. Also nixed: an effort to promote safe Internet use by children and a resolution to honor the late environmentalist Rachel Carson on the 100th anniversary of her birth.
A bill that would authorize government mapping of the ocean floor and coastal areas? No way. One that would require more data collection on the availability and quality of broadband service? Uh-uh. If Dr. Coburn had his way, there would be no new funding for a Justice Department office to investigate unsolved Civil Rights-era killings, no promotion of wild-land firefighter safety.
Sometimes, Dr. Coburn, an obstetrician who sees patients one morning a week, disagrees with the proposals. As a fiscal conservative, he usually objects to what he sees as excess spending. Sometimes, he just wants to force a debate or improve on items that would otherwise fly through the Senate. In a crowded legislative calendar, not everything gets the scrutiny voters might imagine.
Dr. Coburn's weapon of choice is the "hold," a procedural maneuver that allows a single senator to prevent a bill from being passed quickly without a roll-call vote or floor debate. Until a rule change this year, senators could keep their holds secret, and they usually did. Dr. Coburn notifies colleagues about his intentions.
To keep track, Dr. Coburn has four manila cards in the pocket of his suit coat. He pulls out the list, printed in tiny type on both sides, whenever colleagues approach to discuss their bills. In his office's intranet, which staffers jokingly call the "Write-Wing Portal," there's a section for aides to look at bills that have incurred their boss's displeasure.
John Kerry, the Massachusetts Democrat and 2004 presidential nominee, had several bills blocked by Sen. Coburn this year. One would help military veterans and reservists with small businesses. Dr. Coburn said it duplicated another program. Another would expand government-backed venture-capital investment in small business. "I can't imagine the government can be good at it," Dr. Coburn said.
Negotiations between the two men stretched into Tuesday night as the Senate tried to finish tax legislation and a mammoth spending bill. Dr. Coburn's remaining issues were "this point, that point, the other point," complained Sen. Kerry. "You can't have a one-person committee for every single bill that goes through the U. S. Congress. You'd never get anything done."
Dr. Coburn first ran for a seat in the House in 1994, prompted by his opposition to the Clinton health-care plan. He was part of a wave of Republican freshmen who promised to shake up the system and cut government waste. He became an irritant to Democrats and Republicans alike. In 1999, he delayed passage of a Republican-backed appropriations bill by proposing 115 amendments.
In 2000, Dr. Coburn kept a campaign promise to leave after three terms. He returned to Muskogee to be with his wife, Carolyn -- who was Miss Oklahoma of 1967 -- and to treat patients. But Dr. Coburn made another run in 2004, entering a Senate race relatively late.
Sent back to Washington, he started pushing pet topics, one of which is to warn of the dangers of sex. In the past, he has held a slide show for young staffers, depicting the effects of sexually transmitted diseases and the consequences of sex outside marriage.
In February, after the Democrats took over, Dr. Coburn wrote to his colleagues, warning of his intention to block fast-track passage unless his "common-sense principles" were met, which included: New programs can't duplicate existing ones, and new spending should be offset with other cuts.
"I think it's good for our leadership to know there's a very vocal and effective right flank in our party, and that can be used in negotiations with Democrats," says Republican Sen. Jim DeMint of South Carolina, a conservative who often works closely with Dr. Coburn.
The alliance with Mr. DeMint didn't keep Dr. Coburn from slapping a hold on a bill Mr. DeMint supports -- the one that would set up a government registry to track people with Lou Gehrig's disease, also known as amyotrophic lateral sclerosis. Mr. DeMint is one of 69 senators sponsoring the bill. "He's a physician and he's going to have his opinion on that," says Sen. DeMint, who says he thinks he can win over his colleague.
This month, Dr. Coburn sent out a letter encouraging senators to talk to him about legislation they wanted to complete. That had some Democrats muttering about a "tyranny of one." Last week, Senate Democrats took to the floor complaining about Republican tactics, which Senate Majority Leader Harry Reid called "obstruction on steroids." They pointed to the lack of action in several areas stymied by Dr. Coburn, including the Lou Gehrig bill.
"Just give us a chance to bring that up on the Senate floor," pleaded Sen. Dick Durbin of Illinois, who is the majority whip. "How much time would it take? Thirty minutes?"
Mr. Reid, calling Dr. Coburn's tactics "unreasonable," said when the Senate returns next year, he plans to combine a number of blocked bills and bring the package to a vote.
Dr. Coburn says he isn't to blame for slow progress. Democrats used too much floor time debating the Iraq war, he says, and tried to move too many bills on the fast track. He notes he didn't try to stop the spending bill, the only legislation Congress technically must pass in order to keep the government running.
As Congress wound down, Dr. No started to act a bit like Dr. Maybe. After winning some changes, he agreed to let one of the Kerry bills pass. Dr. Coburn dropped objections to giving the Federal Housing Administration leeway to insure more troubled mortgages, a key part of the administration's response to the housing crisis.
"I lost," Dr. Coburn says. "I decided because of the severity of the problem we face, I can't win that point...but I can at least debate it."

My Christmas Story
As a POW, my captors would tie my arms behind my back and then loop the rope around my neck and ankles so that my head was pulled down between my knees. I was often left like that throughout the night.
One night a guard came into my cell. He put his finger to his lips signaling for me to be quiet, and then loosened my ropes to relieve my pain. The next morning, when his shift ended, the guard returned and retightened the ropes, never saying a word to me.
A month or so later, on Christmas Day, I was standing in the dirt courtyard when I saw that same guard approach me. He walked up and stood silently next to me, not looking or smiling at me.
After a few moments had passed, he rather nonchalantly used his sandaled foot to draw a cross in the dirt. We stood wordlessly looking at the cross, remembering the true light of Christmas, even in the darkness of a Vietnamese prison camp. After a minute or two, he rubbed it out and walked away.
That guard was my Good Samaritan. I will never forget that man and I will never forget that moment. And I will never forget that, no matter where you are, no matter how difficult the circumstances, there will always be someone who will pick you up and carry you.

I want to continue promoting these conservative principles, this time as a U.S. Senator.  But to do that I need your help.
Your help is absolutely critical as I plan to launch ads in the media in January - which is next week!
I intend to remind Virginians about Mark Warner, my opponent. 
Like me, Warner also served as Virginia's governor.  But that's about where the similarities between us end.
The head of the United Mine Workers called Mark Warner a "Democratic Moses" and said he would "lead [the Union] to the promised land".
If it's the Mark Warner that conservatives know, he should have said "the land of broken promises".
The fact is, as Governor, Warner raised taxes and will do so again if elected to the U.S. Senate.  A Connecticut millionaire, he is a former aide to liberal presidential candidate Chris Dodd
If he is elected to the Senate, Mark Warner will become another solid liberal vote joining Chris Dodd, Teddy Kennedy, Barbara Boxer and Harry Reid.
Help me stop him by helping me get my message out next month.
Mark Warner has made millions in the cellular phone industry, and I will need to match him as much as possible to have a chance.  And that's why I need your help.
The money battle will be like David and Goliath.  But we both know who won that one.
Earlier I told you there were two reasons I needed to win this race.  One was so that Virginians would have conservative representation in the U.S. Senate.  I think you know and understand that - we haven't had two Democrat senators from this state in since 1976 and I don't think now is the time to start.
But the other reason is as important.
You see, Senate Republicans have held the line when it comes to bad legislation coming from left-wing Democrat Harry Reid.  It's their resolve and commitment to those conservative principles I talked about which have helped fund our troops, fix the Alternative Minimum Tax, and prevent new taxes on Internet access.
We can't afford to lose even one seat right now.
Can you imagine what our country would look like if Hillary were president and Mark Warner were in the Senate?
Neither can I.  And I don't want to see that happen.

Dear Friends,
While you have been busily purchasing presents, attending seasonal parties, spending time with family and spreading cheer, the 110th Congress has also been very busy.  Last week the House of Representatives passed an Alternative Minimum Tax patch, the State Children’s Health Insurance Program extension, a comprehensive energy bill, the Sudan Accountability and Divestment Act, and finalized the budget for Fiscal Year 2008.

One thing I’m sure is in the back of your mind while purchasing toys this month, is the increasing number of toys and children’s products being recalled because they had unsafe designs, unhealthy levels of lead, or were otherwise unsafe for use.  As a father of three, I find it unconscionable that products using lead-based paint were allowed into the country and given out to children even though lead-based paint has been banned in the U.S. for 30 years.  H.R. 4040, The Consumer Product Safety Modernization Act, is an excellent step towards protecting our families from dangerous products and I was proud to be a cosponsor.  H.R. 4040 passed by a vote of 407-0 in the House.  The legislation has now been sent to the Senate, and it is my hope that they will pass it very soon.  

The House also passed legislation, by a vote of 411 to 3, which will extend the State Children’s Health Insurance Program (known as Child Health Plus in New York) through March 31, 2009 and provides additional funding to ensure that no children currently enrolled will be dropped from their coverage. The bill also blocks the scheduled 10.1% percent cut in Medicare physician payments scheduled for January 1, 2008 and replaces it with a 0.5% increase through June 30, 2008.

Included in last weeks activities, the House passed The Sudan Accountability and Divestment Act (S. 2271), which will provide several tools to pressure the Sudanese government to finally put an end to the ongoing genocide in Darfur.  I am proud to have voted for this crucial bill because I believe we have a moral responsibility to do everything we can to pressure the Sudanese government to once and for all end the genocide in Darfur.

We were also able to pass The Energy Independence and Security Act with overwhelming bipartisan support, with myself as a cosponsor, which will help move the United States toward energy independence.  A significant part of the bill was adapted from my legislation, H.R. 670, the DRIVE Act’s, proposals including Plug-in Hybrid Electric Vehicle (PHEV) and other Advanced Drive Transportation Technologies, a Renewable Fuels Standard, the Tire Efficiency Program, and the United State-Israel Energy Cooperation grant program.  The effect of the legislation is to strengthen national security, lower energy costs for consumers, help our economy grow, create new jobs, and begin to reduce global warming.

With my strong support the House also passed Alternative Minimum Tax relief legislation last week.  This legislation would provide essential tax relief to working families and provide Alternative Minimum Tax relief to over 23 million American families, including more than 38,000 in our district.  Although not a permanent solution, it is a necessary step in the right direction to help middle class families.

The final task completed last week was finalizing the budget for Fiscal Year 2008.  The Omnibus Appropriations bill passed the House 272-142.  While providing funding for government agencies, the budget also included money for veteran’s health care, K-12 education, the National Institutes of Health, transportation improvements, homeland security grants, and international assistance programs.
