George Martorano is one of the longest serving non-violent 1st time offenders,
if not THE longest. 26 Years and counting-he was given a "Death Sentence" of
LWOP-while his crimes were serious and warranted prison time, they were not
serious enough to take ALL HOPE away-George Martorano's "Commutation of
Sentence" petition was DENIED by Bush on the way out and now he has to wait a
year to file with the new administration- BUT, with your help and some luck,
George could be released soon- I need everyone to write, call or email the White
House or the Attorney General's office and ask that George be released with
"TIME SERVED" you can send emails to comments@... and
askdoj@...

George was busted with alot of pot-pot the agents sold and bought from
him-naturally they "TRUMPED UP" the counts of conspirisy charges to include
qualudes and other drugs, BUT the bottomline was NOTHING but POT, and they knew

Brian Thompson has been incarcerated in Illinois for over 30 years. He is doing an indeterminate sentence of 40 to 80 for 1 count of murder. He has been denied parole repeatedly since 1988 by the PRB despite being an exceptionally good inmate.

The 9th Circuit Court of Appeals has ordered the release of 50,000
inmates + or -, instead they are taking it to the Supreme court to
get the order overturned.  Lets email the Governor and Attorney General telling
them to follow orders.  If they really have such a budget problem, not spending
$40,000 a year per inmate would save the state $20,000,000 not to mention it
would give the way too many cops something to do.  They need to spend that money
on our schools, not keeping parents in prison.  We need to tell them to also end
parole for non-violent offenders.  Those who re-offend, go back but not for a
violation of parole.  Just go to the California home page and you can e-mail
from there.  It can't hurt, I am just saying.  God bless us for we are also in
prison until we are reunited with loved ones.

Finding 4: Overwhelmingly disproportionate numbers of African Americans are under criminal supervision, overloading the criminal justice system in Virginia to a crisis level. Antecedents to this crisis are in the devastating consequences of educational, economic, and social disadvantages. The Committee finds that State and local governments pay little attention to the societal treatment of African Americans in general and consequences of drug law enforcement tactics in particular.

Recommendation 4.1: The Virginia General Assembly should place high priority on the work of its Joint Subcommittee Studying the Status and Needs of African American Males in Virginia, providing it with resources and staff support sufficient to fulfill its mandate to study the issues. Upon completion of the mandated study, it should take immediate action to pass corrective and ameliorative legislation.

Re: The Governor's Commission on Sentence and Parole Reform

We are a group of family members, friends and volunteers who are concerned about incarcerated men and women. Our concerns involves more than our close relationships with these men. We also are taxpayers who are concerned about the ineffective use of public funds for building additional prisons. We believe this approach is unsound and proven by history to be an investment in failure. We believe the Virginia Parole Board, through its arbitrary and capricious administration of the parole process, is contributing to the over-crowding problem by retaining in prison thousands of inmates who have demonstrated suitability for parole.

Incarcerated individuals are given sentences by the trial judge based on laws enacted by the General Assembly and a full understanding of the good-time system. The system of earning good-time toward discretionary and mandatory parole was established by the same legislative body and administered by the Department of Corrections. In a significant number of cases, the inmates abide by the conditions imposed on their behavior, meet all the requirements dictated by their treatment plan, and prepare adequate plan for their return to society (a place to live, a job, additional treatment, etc.). Then, time after time, they are denied parole for the "serious nature and circumstances of your crime." The parole board is permitted to disregard the laws concerning length of sentence and good-time and the discretion of the sentencing judge in favor of the value judgments of the individual parole board members as to the adequacy of time served.

By their arbitrary use of "the nature and circumstances of your crime" as the basis for denying parole, they send a clear message to inmates that nothing they do while in prison counts. Efforts to rehabilitate themselves are unimportant. Conduct is irrelevant. Planning for parole is futile. Release from prison will come only when the parole decides enough time has been served. The time has come to make the parole board accountable not only for those inmates it paroles, but for those it chooses not to parole.


The Commonwealth has in its prisons a literal "captive audience" to which to address specific treatment programs. Each inmates root problem and treatment needs are known. Yet, politicians opt for short-term "fixes" such as building more prisons, increasing sentences, and reducing opportunity for parole. These solutions are temporary in that almost every inmate will return to society at some point, perhaps later if the politicians have their way, and they are more embittered and less prepared to function in society upon release. Effectively, they have been "warehoused", untreated, and driven to such a degree of poverty that they are unable to support themselves and their families when released. If the statistics quoted by many are true that 75% of crimes are committed by repeat offenders, there appear to be only two solutions to the crime and recidivism problems - lock up everyone who commits a crime for the remainder of his/her life or address the issues which brought him to prison. The first option, which seems to be the one in vogue today, has a tremendous cost, not only in dollars but in costs to human lives and families. Revenge cannot be the only goal of the justice system.

The parole process which affects a year (or 2-3 years in the case of deferrals) in the life of an individual and his family has been reduced to an average 5-7 minute deliberation by parole board members, acting individually rather than as a board. This deliberation follows a 15-20 minute interview by a parole examiner who makes a recommendation concerning parole based on the results of the interview and the input by the inmates counselor. The inmate sees his counselor at best only about four hours per year. There is no input from the correctional officers, work supervisors, or other staff members who observe the inmate on a daily basis.

The decision is therefore made at the pinnacle of ignorance by bureaucratic body which answers to no one for its lack of logic. The board does not participate in the problems caused by its decision. It does not have to deal with the disciplinary problems for the families of those denied parole who must struggle to survive yet another year of separation and loss of family income. It's time to restore a degree of credibility in the system for both inmates and their families.

The parole board is unrestrained from considering, as part of the decision parameters, convictions which have been overturned on appeal, and routinely require in parole interviews a defense of those charges. In effect, this procedure negates the decision of the appeals court and supreme court and substitutes and additional review of a crime or crimes already deemed absolved by the judicial system.

We, as citizens, have the same concern as others about the rising crime rate. But by our observation on a personal basis we see the "system" as a large part of the problem rather than being a viable element or its solution. Until some reason is restored concerning the length of time individuals are incarcerated without credible treatment programs and some sanity is restored in the system for considering parole suitability, the problems will remain unsolved.

In your study of the issues relating to sentencing and parole we request that you consider creative alternatives to the current bankrupt system and intelligently filter out the rhetoric of the current political campaigns designed to play to and prey on the fears of the public rather than seek long-term solutions. The belief that increasing sentences, delaying parole, and building more prisons solves the problem is unfounded, unreasonable, and unending.

Hi,
      The CDC just took my man from me. That is why I am here. I think
it is sad how few members you have, given the number of incarcerated.
If we could manage to all come together, sheer numbers would give
infulence to help our loved ones.
      I thought, if people could here my mans story, see what a really
good person he is and know how little he did to deserve 8 years and
counting behind bars, they would feel as I do that it is just not
justice. Once you have a record, you are subject to the prior
conviction, prior offences bla bla bla, you are scared into admitting
guilt, scared to not take 2 years because you are threatened with 4
years. You never get the basic right of being judged by you peers. They
frighten you into signing that right away.
      How many people would have to sign a petition to make a difference?
Why shouldn't the people be able to decide whether they want their tax
dollars to pay for someone to be in prison for no good reason.
      With Obama comming in I bet we could get an answer to these
questions. I propose the most real or all reality shows. Any non-
violent, non-sexoffender inmate who has been denied judgement by jury
due to his past record, could present his story, the public could
decide to sign his petition for release or not. Sound crazy?  Let me
know what you think. We need to start making noise, I am so angry that
I will not stop unitl someone listens. You guys have more experience
than I, lets put our heads together.

Petition to save Kevin Watts from State execution


Kevin Watts is due to be executed in the state of Texas. Execution is a cruel and inhumane practice. It has been outlawed in most civilised countries.

“The vast majority – 88 per cent – of executions were carried out by just five countries; China, Iran, Saudi Arabia, Pakistan and the USA.” quote from Amnesty International.

Prisoners receive little (or no) representation in their trials.

Kevin Watts is 27years old and is one of the prisoners due to face execution in Texas. His death will be utterly pointless and will not serve justice. The death of this young man will only serve to continue this already deeply flawed and immoral system. Please stop this cruel and unnecessary act.

I just sent an email to Alabama Gov. Bob Riley calling on him to grant DNA
testing in case of death row inmate Tommy Arthur.

Arthur has been requesting DNA testing for years, but courts have refused. Now
he is scheduled to be executed on July 31. The execution could happen, even
without a DNA test, if we don't act today.

Hello Everyone,
My name is Leslie I just wanted to talk to others in the same situation I am in with a love one being in prison.  I would like to know how people have dealt with the prison system.  I am finding it so hard to deal with.  I wish there was a rule book for me to follow so I would know what he was able to have and not have I am finding that each guard follows the rules differently.  It is so frustfrating.  I have only been dealing with the prison system for 5 years today is our anniversary and I am finding I hate it more and more with each passing day.  I find it so hard to deal with having someone tell me what I can and not do for my husband and I am so limited with what I am able to bring him.  I wanted to surprise him with a new wedding band for our anniversary and I was the one that got the surprise that there were rules to go by in order to just bring it into the visiting room.  I was not aware of this.  I am finding that if you say something you lose anyway and it is just a waste of time. 
Unless you are involved in one way or another with the situation you are not aware of all that happens and can not understand what one goes through. 
Thanks for listening.  It is hard enough trying to deal with the hardships of dealing with the outside world and its problems with out having to deal with the problems the prison system wants to add to it.

Dear Sir/Madam:

This letter is written on my brother's behalf, Tony Cobos, CDC number
D-45686, and he is imprisoned at Avenal, the state's most overcrowded
prison.

My family has a history of auto-immune disorders and a history of
cancer on both sides of my family.  My brother has been complaining
for years about the pain in his throat and he is still in awful
pain.  How come these doctors aren't doing anything for him?  The
doctors at the prison tell him that there isn't anything wrong with
him.  How can a doctor make this determination without doing any
bloodwork?  WHAT CAN I DO TO BE CERTAIN HE GETS ADEQUATE MEDICAL
CARE?  This treatment is downright inhumane.

Please do something before my brother loses his life prematurely.

Troy Davis is an innocent man on Georgia's death row. In 1989, Troy was falsely accused of the murder of Savannah Police Officer Mark MacPhail. Since then, with the support of his loving family, he has been struggling to vindicate himself. There was no murder weapon or DNA to test. There was no physical evidence connecting Troy to the crime.

He was wrongfully convicted and sentenced to death in 1991 on the word of nine eyewitnesses and snitches, seven of whom have since admitted that their trial testimony was false or inaccurate. The two remaining witnesses include a man who has subsequently been identified as the actual killer and another man who candidly admitted his inability to identify the shooter when questioned by police on the night of the murder and, then again, a month later.

At trial, all the jurors had to go on was the virtually unchallenged false testimony of six eyewitnesses and three snitches. His court-appointed lawyers did not try to suppress the eyewitness evidence, nor did they present any expert testimony to explain the factors that contributed to the unreliability of this eyewitness and snitch testimony. They did not offer any affirmative evidence to show the inherent implausibility of the witnesses’ claimed observations. One woman, for instance, stood at a distance of at least 160’ away looking at four strangers for a few seconds in a poorly lit parking lot at one o’clock in the morning. Troy’s trial lawyers did not even bother to get the actual distance into record; though, based on her testimony, she was anywhere from 160’ to 260’. According to the affidavits, the defense also never got around to conducting pre-trial interviews of key trial witnesses in this capital case. Perhaps that explains why the cross-examination of each of these vital witnesses was flawed in so many respects.

The government had no qualms about taking advantage of a poorly orchestrated defense as it brushed aside concerns over implausible eyewitness and snitch testimony. In his closing argument, the District Attorney assured the jurors that they could rely on the word of all these witnesses. With respect to the woman standing at least 160’ away, the District attorney said: "Of course, the Defense has raised issue [ ] about whether she could have seen what she said she saw. The point is that she said she saw it, and there’s no reason to doubt that she saw what she said she saw. There just simply isn’t any reason to doubt it. She’s got no reason to make it up." T. 1499.

The prosecutor knew at the time that some of the witnesses were alleging police intimidation and tried to recant at trial. Indeed, this very witness reportedly called the defense attorney’s home the night after she testified to let them know she committed perjury. Yet, the record strongly suggests that neither the prosecutors nor the defense attorneys ever “investigated” the police department’s investigation. The jurors decided the case based on a version of “facts” that the overzealous prosecutors and subpar defense attorneys presented to them.

But as each of the seven recanting trial witnesses came forward - all in their own time - a very consistent and logical explanation began to emerge. One recantation after another reported that heavy-handed police tactics and pressure caused the witnesses to falsely implicate Troy in the murder that another man committed. These recantations lend credence to other witnesses' earlier attempts to recant made at trial.

The result is that the evidence that was used to convict this innocent man has been largely repudiated. There simply is no credible evidence that points to Troy. On the contrary, since the trial, nine additional witnesses have implicated Redd Coles in the shooting. In fact, Redd is reported to have confessed on three separate occasions.

Troy lawyer’s filed an extraordinary motion for a new trial based on his compelling evidence of actual innocence. But, by a 4/3 vote, the Georgia Supreme Court recently denied that request. To their credit, the dissent recognized that the question of “whether or not an innocent person might have been convicted or even, as in this case, might be put to death” is a “fundamental” one which should compel an evidentiary hearing, at the very least.

"If recantation testimony, either alone or supported by other evidence, shows convincingly that prior trial testimony was false, it simply defies all logic and morality to hold that it must be disregarded categorically." Davis v. State, 2008 Ga. LEXIS 262 (Chief Justice Sears dissenting opinion).

Troy’s lawyers are preparing a petition for certiorari to the United States Supreme Court asking the Court to compel Georgia to hear Troy’s evidence of innocence. The Court selects an extraordinarily small number of cases to hear. Therefore, we need to work hard to persuade them that this is an important issue to the citizens throughout America.

The more signatures I collect, the better the chance of this Bill becoming a reality. I recently sent the below e-mail to every member of the Virginia Senate and Congress. I have had three return e-mails. I need your support. My bill is called the “Second Chance Bill”.

In October of 1985 I went to New York on vacation. I worked as a waitress mostly at night and carried a small handgun for protection. Without thinking I packed the gun in my suitcase. On my return flight I tried to catch an earlier flight and brought my suitcase to the ticket counter. The suitcase was searched and I was arrested for “Attempted Criminal Possession of a Weapon”. This is a class E felony. I didn’t understand why this was happening; to me I just made an innocent mistake. I was scared to death and was a single parent of a 5 year old. The lawyer that I hired said the crime carried a sentence of 1-5 years. I plead guilty because I feared that I would loose my child. The lawyer told me that when I left the state of New York I would not have to worry about this again. That turned out to not be true.

In the last 23 years I have not been in any more trouble. I raised my child, returned to college and recently graduated with honors. The purpose of returning to school was to find a successful job and increase my wages. I am also a Notary for the State of Virginia and a member of Phi Theta Kappa. In 1994 I had my civil rights restored by Governor Allen.

Recently I went on a job interview. The application asked if I had ever been convicted of a felony. Of course I said yes. I attached a letter of explanation, the order from the Governor restoring my civil rights and my notary certificate. I also added to the education portion that I graduated from college with honors. When the interviewer read my letter of explanation she excused herself and said that she needed to speak to her supervisor about my conviction before she could start the interview. After about 15 minutes, she returned. I couldn’t believe that I was being treated like this. They did interview me. After the interview I asked her how she thought I did. She said that I did very well and she thought of many jobs within the company that I could be considered for. She said that she thought my conviction could stop me from being hired and as it turned out it did. I sent my resume to this company through an internet add. Nothing in the job announcement asked about a felony conviction. This treatment made me feel very uncomfortable and prompted my decision to write this e-mail.

Recently many corporations have implemented a criminal and credit check on all prospective employees. Other than getting my civil rights restored I have asked the Governor of Virginia for a pardon. It was denied because the Governor cannot pardon a crime from another state. I applied for a pardon in New York and I was denied because the Governor only pardons extra exemplary convictions. The Governor’s office suggested that I have my civil disabilities restored in New York. I went to New York January 29, 2008 to make this request. I asked for a Presidential pardon and I was not eligible because my offense was not federal.

I think that everyone deserves a second chance. How would you like to be judged your entire life for a mistake that you made when you were young? No matter what accomplishments you make, you are held back because of your past.

Here are a few of the requirements that I feel should be fulfilled before you’re granted a “Second Chance”:

1) Applicant has been conviction free for 10 years.
2) A resident of the state of Virginia. The conviction could have happened in another state.
3) Your civil rights have been restored.
4) At least four references that can prove that you have turned your life around since the conviction. One of which must include that the applicant graduated from a community college or university, since the time of conviction.

If the applicant is granted a “Second Chance”, the record will be sealed. This will allow the person to carry on with his or her life without the constant discrimination that they will have to endure without a “Second Chance”

Ms Green, now aged 76, was found to be suitable for parole on
December 28, 2005 with a parole date June 8, 2010.  She has now
served 18 years in a case of Conspiracy, where no harm came to anyone
nor was there any attempt made on anyone's life.  Both the Parole
Commissioners and the District Attorney agreed she would be no threat
to the public safety.  This begs the question, "why should she serve
27 years for murder when there was neither murder nor any attempt?"

Ms Green suffers from multiple disabilities, including cardiovascular
disease, diabetes and hypertension, causing the 2nd stroke on 1/5/07
leaving her blind in one eye.  She also suffers from deafness.

In these days of severe prison overcrowding, would it not make better
sense to free the California Taxpayers from the cost of her
incarceration and medical care?  The odds are against her living
until 2010.

Would you please consider an earlier release for her?

Life of a 75 Year Old
'There is not much to say about my life except I had it all. Now,
suffice to say, it's better to have had and lost, than never had at
all. In my free state I was a law school graduate, owned for 35 years
my own tax, accounting investment and real estate brokerage firms.
All the while my partner raised and I raised 2 children. She stays in
touch and supports me financially even though I have not spoken to
her in 17 years. My daughter lives in Mississippi with my
granddaughter who will turn 18 this month. She graduates this year,
plans to attend university.

I have written my autobiography and am looking for a publisher.  The
title I have in mind is "From Cottonseed to Coca Leaf and All the
Points Between".
